45L Tax Credit – Congress Reinstates Tax Creditfor Energy Efficient Homes

When contractors must be on-the-job you can count on the Capitol Connection to keep you up on the latest meeting of the California Contrac-tor’s State License Board. We learned a great deal of interest to contractors directly related to get-ting paid…

Over the years we’ve received many questions regarding the state’s Mechanics Lien laws. As dis-cussed at the Contractor Board’s recent meeting in Sacramento, a number of legal revisions took place on July 1, 2012, which mainly changed the wording and format of the Mechanics Lien notices. Because of these changes, the CSLB has updated release forms to reflect the new lan-guage and made them available on their web-site (www.cslb.ca.gov).

Contractors can use these documents to pro-tect their lien rights on construction projects. Among the forms included by the CSLB are: the Notice to Property Owner statement, required as part of the Preliminary Notice (formally known as the 20-day Preliminary Notice); Notice of Me-chanics Lien; and the Conditional and Uncondi-tional Release of Progress and Final Payments.

As most subcontractors and suppliers know, it is important to use the proper forms in order to protect your lien rights. As a refresher, the CSLB has summarized some of the requirements in-cluding that The Preliminary Notice should be

delivered to the homeowner in person or by cer-tified, registered, or express mail, or overnight delivery, with a receipt of the mailing as proof. “Notice can be given at any time before work starts or products are delivered, and up to 20 days after. If notice is given more than 20 days after work or delivery, your lien rights only apply to the work or products provided 20 days before the notice was given, and anytime thereafter.”

The Notice of Mechanics Lien must accompany the lien claim and be sent via certified, regis-tered, or First Class mail (proof of mailing is re-quired). As indicated in a CSLB Industry Bulletin, “Failure to send the properly worded Notice with the lien claim could result in the lien being un-enforceable.”

If you have any specific questions regarding lien laws, it would be advisable to discuss this with your legal counsel.

Also highlighted at the recent CSLB meeting was the Senior Scam Stoppers program aimed at providing information about construction-re-lated scams and how seniors can protect them-selves when hiring a contractor. The CSLB offers these seminars several times a month featuring expert speakers from many local, state, and fed-eral agencies.

In line with the Senior Scam Stopper program,

the CSLB has also launched the “Consumer Scam Stopper” program. This new program provides valuable information to consumers of all ages and audiences to help them make informed choices related to construction and home im-provement, and also provides information about current scams in the local region.

a credit, it has the potential to lower taxes dollar for dollar. Under the Small Business Jobs Act of 2010, the 45L credit is poten-tially more beneficial in tax year 2010 for an ESB. The majority of business credits re-ported on Form 3800 are not allowable as a credit to offset the Alternative Minimum Tax (AMT). Although the American Taxpayer Relief Act of 2012 did apply a permanent “patch” to the AMT, the allowance of a tax credit for AMT purposes primarily involved nonrefundable personal credits as opposed to a general business credit. To illustrate the effect of the AMT on a credit generated in a year other than 2010 assume the follow-ing facts: If an individual had a 45L credit in 2012 in the amount of $20,000, his regu-lar tax was $80,000 and the tentative mini-mum tax was $78,000, only $2,000 of the 45L credit would have been allowed in 2012 (the difference between the regular tax and tentative minimum tax). The $18,000 un-used 45L credit could be carried back one year and carried forward for 20 years to off-set other year’s taxes, but it would still be subject to the AMT limitation.

With the Small Business Job Act of 2010, ESB credits incurred in 2010 are not subject to the AMT limitation as stipulated above. For purposes of Code Sec. 38(c) including the rules permitting ESB credits determined for tax year 2010 to be used to offset the AMT, an ESB is, with respect to any tax year: a cor-poration the stock of which is not publicly traded, a partnership, or a sole proprietor-ship, if the average annual gross receipts of the corporation, partnership, or sole pro-prietorship for the three-tax-year period preceding the tax year does not exceed $50,000,000. If such 45L credit generated in 2010 qualifies as an ESB credit, the tenta-tive minimum tax is treated as being zero. Therefore, the ESB credit can offset both the regular and AMT liability. In the example above, if the credit was generated in 2010 as opposed to 2012, the entire $20,000 could have been used to offset both the regular tax and tentative minimum tax.

As part of the New Energy Efficient Home Tax Credit under Code Section 45L, a $1,000 credit is also available for an eligible con-tractor with respect to a manufactured home. The manufactured home must have a projected level of annual heating and cooling energy consumption that is at least

30% below the annual level of heating and cooling energy consumption of a reference dwelling unit in the same climate zone. It must also conform to the Federal Manufac-tured Home Construction and Safety Stan-dards.

45L Tax Credit – Congress Reinstates Tax Creditfor Energy Efficient Homes

Based on this definition, the units within an apartment building, condominium, house-boat or house trailer might qualify for the 45L credit as well as a traditional home. There is no requirement in Code Section 45L that the property used as a residence be the person’s principal residence. Thus, assuming the other requirements of Code Section 45L are satisfied, vacation homes might qualify for the credit.

The Internal Revenue Code generally pro-vides for a one-year carry back and 20-year carry forward for the current year unused business credits. However, for an Eligible Small Business (ESB) credit generated in 2010, the carry back period is five years rather than one year. However, no credits attributable to energy efficient homes can be carried back to any tax year ending on or before the effective date of the new energy credit. Since the credit was not allowable until the 2006 tax year, this effectively lim-its the carry back period generated in 2010 to 4 years.

To illustrate the potential impact of the 45L credit for the owner of an apartment building, assume the following facts: ABC Company, LLC had an apartment complex constructed that was completed in October of 2012. The complex is three stories tall and has 950 units within the building. ABC Company, LLC owned the property during the construction of the apartment build-ing and is therefore considered the “eligible contractor.” Assuming the 50% energy re-duction requirements are satisfied and 800 units are occupied as of December 31, 2012, the potential tax credit for ABC Company, LLC would be $1,600,000 (800 units * $2,000 per unit). Even though the apartment was completed in 2012 with 950 units available, it is limited to the 800 occupied units as the dwelling needs to be used as a residence in order to qualify. The depreciable basis of the apartment building would be reduced by $1,600,000.

Eligible contractors use Form 8908 to claim a credit for each qualified energy efficient home sold during the year. The eligible con-tractor reports the amount of the current year credit shown on Line 4 of Form 8908 and on line 1p, Part III of Form 3800 to de-termine the amount of his allowable gen-eral business credit for the tax year. Being
