New Laws for 2012 - By CategoryGovernor Brown completed actions on 2011 leg-islation on October 9, 2011. The Governor had a veto rate of 14.3%. There were 889 bills on his desk in 2011. 760 were signed, 128 vetoed, one became law without his signature. Unless other-wise noted, all new laws become effective Janu-ary 1, 2012.

APPRETICESHIP/CERTIFICATION

AB 554 (Atkins) - Directs the state and local Workforce Investment Boards to ensure that pro-grams and services funded by the Work Invest-ment Act (WIA) are conducted in coordination with apprenticeship programs and would en-courage collaboration between community col-leges and apprenticeship programs. AB 1346 (Atkins) - Requires applicants for elec-trician certification to submit an application for certification and examination that includes an employment history report from the Social Se-curity Administration (SSA). Under the existing certification process, an applicant must have at least four years of experience in the class he/she is applying for to qualify to take the electrical cer-tification examination. In a recent appellate decision (published October 10th), an appellate court upheld the right of pub-lic agencies to enforce specific pre-claim notice procedures against general contractors when it comes to delay type claims.

Opinski, a general contractor, executed a contract with the City of Oakdale. The construction work was to be completed within 300 days, and the contract allowed the City to recover liquidated damages in the amount of $250 per day in case of delays. The project was completed seven months late, so the City sued Opinski to recover approxi-mately $54,000 in liquidated damages. Opinski cross-complained claiming, among other things, that the City: (1) was responsible for the delays; (2) wrongfully refused to release approximately $165,000 in retentions; and (3) wrongfully refused to approve $24,000 in change orders. ELECTRIC TOOLS - GROUNDS FOR CONCERN

Each year workers suffer shock when handling electrical tools and equipment. To protect workers against the hazards of electricity, teach them the basic facts about the causes of shock and death. One of the big problems in understanding the dangers of electrical shock is the mistaken belief that only high voltages kill. It’s not the voltage that kills, but the amount of current that passes through the body. The condition and placement of the body has a lot to do with the chance of getting a shock.

Water and electricity can be a fatal combination. Damp areas and metal objects can offer good shortcuts for electricity to reach the ground. If a worker’s hands are sweaty, if socks and shoes are moist or damp, if the floor is wet, or if the worker is standing in a puddle of water, the moisture will allow more current to pass through the body. If work is to be done with metal objects or in damp areas, workers should recognize the hazards and take necessary precautions. These precautions include rubber gloves and boots, rubber mats, insulated tools, and rubber sheets which can be used to cover exposed metal.

Remembering a few tips can help avoid electrical accidents:

Treat every electric wire as if it were a live one. Inspect equipment and extension cords before each use. Take faulty equipment or plugs with bent or missing prongs out of service for repair. Only qualified electricians should repair electrical equipment or work on energized lines. If a plug doesn’t have three prongs or if the receptacle doesn’t have three openings, make sure the tool is grounded in some

other way before use. Never try to bypass an electrical system by cutting off the third prong of a plug. Turn off the power and report the smell of hot or burning plastic, smoke, sparks or flickering lights. Stop using a tool or appliance if a slight shock or tingling is felt. Never disconnect an electrical plug by pulling on the cord. Whenever working on an electric circuit, the circuit should be turned off and locked out at the circuit breaker or fuse box to

ensure that the circuit cannot be accidentally turned on. Those who regularly work on or around energized electrical equipment should be trained in emergency response and CPR.

In wet, winter months, extra caution should be observed when working with electrical equipment or when working near grounded objects.

Cada año trabajadores sufren choques eléctricos al manejar herramientas y equipos eléctricos. Para proteger a los trabajadores contra los peligros de la electricidad, es necesario enseñarles los conocimientos básicos sobre las causas de los choques eléctricos y la posibilidad de muerte. Uno de los grandes problemas al comprender los peligros de los choques eléctricos es la creencia errónea de que sólo los altos voltajes pueden producir la muerte. Lo que mata no es el voltaje sino la cantidad de corriente que pasa a través del cuerpo. Las condiciones y la posición del cuerpo tienen mucho que ver con la probabilidad de recibir una descarga eléctrica.

El agua y la electricidad pueden ser una combinación fatal. Las áreas húmedas y los objetos metálicos le ofrecen un paso fáci l a la electricidad para llegar hasta la tierra. Si un trabajador tiene las manos sudadas, si los calcetines o los zapatos están húmedos o mojados, si el piso está mojado, o si el trabajador está parado en un charco de agua, la humedad permitirá que pase más corriente a través del cuerpo. Si el trabajo se hace con objetos metálicos o en áreas húmedas, el trabajador debe reconocer los peligros presentes y tomar las precauciones necesarias. Estas precauciones incluyen guantes y botas de hule, alfombrillas de hule, herramientas aisladas y láminas de hule que pueden usarse para cubrir el metal expuesto.

Recordar algunas recomendaciones puede ayudar a evitar accidentes eléctricos:

AB 240 (Bonilla) - Authorizes the Labor Com-missioner (LC) to recover liquidated damages for an employee who brings a complaint alleging payment of less than the minimum wage. Click Here

LOCAL GOVERNMENT REQUIREMENTS

AB 147 (Dickinson) - Authorizes a local ordi-nance to require the payment of a fee subject to the Mitigation Fee Act, as a condition of ap-proval of a final map or as a condition of issuing a building permit for purposes of defraying the actual or estimated cost of constructing other transportation facilities. AB 204 (Fuentes) - Extends by 24 months the ex-piration date of any tentative map, vesting tenta-tive map or parcel map for which a tentative map or tentative vesting map has been approved that has not expired when this bill becomes effective and that will expire before January 1, 2014. Also extends the expiration date by 24 months for any legislative, administrative or other approval by a state agency relating to a development project included in a map that is extended. Click Here AB 720 (Hall) – Amends the Public Contract Code within the California Uniform Public Con-struction Cost Accounting Act, which currently allows any county that has appointed a regis-tered civil engineer as “Road Commissioner,” or has abolished that position and instead has ap-pointed a Director of Transportation to perform all work on county highways by force account or day labor, regardless of cost. In doing so, this measure will ensure that large counties that have voluntarily chosen to utilize the Act, do not abuse the use of the “Road Commissioner” au-thority while still allowing counties the flexibility to address maintenance and emergency issues. The bill allows counties to continue to make their own decisions in regards to how they want to perform highway and road construction proj-ects while protecting the integrity and intent of the California Uniform Public Construction Cost Accounting Act. AB 943 (Williams) - Increases the formal bid-ding threshold under the Uniform Public Con-struction Cost Accounting Act (UPCCAA) from $125,000 to $175,000. Click Here

MECHANICS LIENS

AB 456 (Wagner) - Clarifies that mechanics’ lien claimants in construction disputes shall specify in the required affidavit indicating service of the notice of mechanics lien that the notice was

served on the owner or reputed owner of the property, consistently with existing obligations regarding service of these claims. Click Here

SB 424 (Rubio) - Gives design professionals pro-viding services for private works of improvement the ability to convert a design professionals lien into a mechanics lien. Click Here

PREVAILING WAGE/PLA/PUBLIC WORKS

AB 436 (Solorio) – Makes changes to existing law related to a prevailing wage enforcement mechanism in order to address potential legal questions about the funding method of that process. The bill also exempts a school district or covered public entity from having to reimburse DIR for labor compliance activities where the school district or public entity has entered into any collective bargaining agreement that binds all the contractors performing work on the proj-ect; i.e.: “PLA’s.” Click Here

AB 551 (Campos) - Increases the maximum pen-alty on contractors and subcontractors who fail to pay the prevailing wage from $50 to $200 a day and would increase the minimum penalty (except in certain cases of a good faith mistake) from not less than $10 to not less than $40 a day for prevailing wage violations on a public work. AB 514 (R. Hernandez) – Existing law provides that prevailing wages are due to construction works for the hauling of materials into a con-struction site as well as the hauling of refuse off of the site. If refuse is hauled from site and sold as a commodity, prevailing wage does not ap-ply. The bill clarifies “refuse” to include soil, sand, gravel, rocks, concrete, asphalt, excavation, ma-terials and construction debris. Click Here

AB 587 (Gordon) - Extends the sunset on the ex-emption for volunteers on public works project out five years, from January 1, 2012 to January 1, 2017, and also makes findings and declarations on the intent of the Legislature to not undermine the wage base of a community, as well as several non-substantive amendments. AB 766 (Monning) - Requires nonredacted cop-ies of certified payroll records to be provided upon request to any agency included in the Joint Enforcement Strike Force on the Underground Economy (JESF), and other specified agencies. Click Here

SB 117 (Kehoe) - Prohibits a state agency from entering into a goods or services contract worth $100,000 or more, if in the provision of benefits, the contractor discriminates between employ-ees with same or different sex spouses or part-ners, or discriminates between same or different sex spouses or partners of employees. SB 136 (Yee) - Expands the definition of “public works” and applies prevailing wage require-ments to include construction, alteration, de-molition, installation or repair work done under private contract when the following conditions exist: The work is performed in connection with the construction or maintenance of renewable energy generation capacity or energy efficiency improvements; the work is performed on the property of the state or a political subdivision of the state; either of the following conditions exist: More than 50 percent of the energy generated is purchased or will be purchased by the state or a political subdivision of the state. The energy efficiency improvements are primarily intended to reduce energy costs that would otherwise be incurred by the state or a political subdivision of the state. Click Here

SB 293 (Padilla) – Requires progress payments be made within seven days instead of the cur-rent 10 day requirement of law. In addition, the bill also lowers retention withholdings on public works to no more than five percent as opposed to current 10% limit. Click Here

SB 835 (Wolk) – Expands the Best Value Con-struction Contract Pilot Program (Best Value Pilot Program) to all University of California campus construction projects statewide valued over $1 million, and extends the sunset date of the Best Value Pilot Program to January 1, 2017. Click Here

SB 922 (Steinberg) – Establishes parameters for the use of project labor agreements (PLAs) for publicly-funded construction projects. Denies state funding to any charter city that prohibits project labor agreements (PLA’s) on public works projects. The law also provides that a process for all other local government jurisdictions provide PLA’s on all public works projects. This provision is not applicable until January 1, 2015, for char-ter cities in which a charter provision, initiative, or ordinance in effect prior to November 1, 2011, would disqualify a project from receiving state funding or financial assistance. AB 930 (Gordon) - Requires at least one member of the California Building Standards Commission (CBSC) to be experienced and knowledgeable in sustainable building, design, construction, and operation. Click Here

AB 1330 (Beall) – Adds career technical edu-cation (CTE) as an option for pupils to fulfill the existing high school graduation requirement to complete a course in visual or performing arts (VPA) or foreign language, and requires school districts that elect this option to notify parents, teachers, pupils and the public. Kalb’s Q & A for ContractorsBy David Kalb, Capitol Services, Inc.

With tax revenues down and budget cuts across the board State government is targeting the ‘underground’ economy as a top law enforcement priority. Contractors just want a level playing field whether the market is rising or falling…

According to CSLB Registrar Steve Sands, “unli-censed illegal activities that put homeowners at risk and puts those who follow state laws at a competitive disadvantage will not be tolerated”. Contractors can also do a lot to help.

CSLB’s Statewide Investigative Fraud Team (SWIFT), in conjunction with District Attorney’s offices, is effectively stopping a number of “bad actors”; however, it’s incumbent upon legiti-mate contractors to also help their own cause. Licensed contractors have several ‘weapons’ to combat their unlicensed counterparts.

First, when bidding on any project, leave the ho-meowner with some important information on what they should look for when hiring a contrac-tor. For instance, the Board has several “consum-er” pamphlets, including: “What Seniors Should Know Before Hiring a Contractor” and “Terms of Agreement: A Consumers Guide to Home Improve-ment Contracts”. These list a number of common sense ways that, if followed, will increase your chance of getting the job. Among the items on the Board’s check-lists are: ‘What is a Con-tract’; checking the license on the CSLB web site; asking to see the contractor’s pocket card; and requiring a copy of the contractor Worker’s

Comp insurance certificate. You can be assured that unlicensed contractors will not have any of these.

Second, if you see or suspect there is an unli-censed contractor working in your area, report this to the CSLB SWIFT Unit. The best way of do-ing this is to complete and submit a SWIFT Lead Referral Form. This is used for filing a complaint against an unlicensed contractor who is ACTIVE-LY working on a construction project. The form is available on line or by phone from the CSLB. This form is also available on Capitol Services web site (www.cutredtape.com). It is important that you provide SWIFT with complete and de-tailed information about the current unlicensed activity and note if there are employees on the project -- the more information and evidence, the better.

Third, remind your potential customer that if they hire an unlicensed contractor, and he or his employees are hurt, the property owner will likely be held financially responsible.

Just as they have done over and over again dur-ing the past several years, the CSLB has blitzed the State and stopped scores of unlicensed “con-tractors” in their tracks. The CSLB SWIFT team conducted two days of simultaneous sting oper-ations in eight cities on October. Included were Burbank, Cameron Park, Madera, and Union City among others.

Swift investigators posed as homeowners seek-

ing bids for home improvement projects in-cluding, painting, landscaping, tile work, tree trimming and cabinetry. In over 30 cases, inves-tigators issued “ STOP” orders until they secured Worker’s Compensation to cover their employ-ees. One was booked on an outstanding warrant and several parolees were apprehended. In all, 113 people were caught.

It has come to my attention that the CSLB has now lost approximately 21% of its staff in the past few years due to retirements and other factors and they are unable to replace most of them do to the Governor’s hiring freeze. Ap-parently official requests by the Board for a hir-ing exemption to backfill these positions have met with silence or an outright NO! As I have reported in prior columns, these 70+ vacancies (about ½ of which are in the Enforcement Unit) are preventing the Board from doing its job most effectively. This adversely impacts the legitimate licensed contractor and can cost you important contracts.

This is NOT saving the State any money since the CSLB is fully funded by contractor’s application and renewal fees. Write, email, fax or call the Governor’s Office and ask why the CSLB is not being allowed to fill these important positions.

AIf the contractor wished to claim it needed an extension of time because of delays caused by the city, the contractor was required to obtain a writ-ten change order by mutual consent or submit a claim in writing requesting a formal decision by the engineer. It did neither. The court was correct to rely on its failure and enforce the terms of the contract. It makes no difference whether Opin-ski’s timely performance was possible or impos-

sible under these circumstances. The purpose of the contract provisions of the type authorized by the 1965 amendment to Civil Code section 1511, subdivision 1, is to allocate to the contractor the risk of delay costs even for delays beyond the con-tractor’s control unless the contractor follows the required procedures for notifying the owner of its intent to claim a right to an extension. There was no error. (2011 DJDAR at 15069)

In a different part of the decision, the appellate court also upheld the City’s right to withhold the retention amounts pursuant to Public Contract Code ‘ 1707(c) (a Aprompt payment statute). That section allows public agencies to withhold up to 150% of a disputed amount from the contractor’s retention. The statute also provides for the recov-ery of interest penalties and attorneys’ fees by the prevailing party.

Contractors need to read what they sign, and un-derstand that even the esoteric administrative provisions buried within the sometimes lengthy public contracts are enforceableCand could viti-ate their claims if not adhered to.

SB 474 (Evans) – Eliminates type 1 indemnity provisions in construction subcontracts entered into after January 1, 2013. Under SB 474, which adds a new Section 2782.05 to the Civil Code, a general contractor cannot require a subcontrac-tor to defend against, or provide insurance cov-erage to defend against, the active negligence or willful misconduct of the general contractor, for defects in design furnished the general contrac-tor, or to the extent the claims to be defended against do not arise out of the scope of work of the subcontractor pursuant to its subcontract. The new law also provides that public agencies or private owners cannot shift to contractors’ li-ability for the agencies’ or owners’ active negli-gence (current law precluded only public agen-cies from shifting liability for their active or sole negligence.) The new law authorizes a general contractor to request that a subcontractor either provide a defense or pay for the general contrac-tor’s defense, but a subcontractor who does so can request reallocation and reimbursement of defense costs under certain circumstances, such

as where the statute prohibits a defense obliga-tion. Click Here
