We are pleased you have selected Cutler Real Estate to help you with your real estate needs. Whether you are selling, buying or leasing real estate, Cutler Real Estate can provide you with expertise and assistance. Because this may be the largest financial transaction you will enter into, it is important to understand the role of the agents and brokers with whom you are working. Below is some information that explains the various services agents can offer and their options for working with you.

REPRESENTING SELLERSMost sellers of real estate choose to list their home for sale with a real estate brokerage. When they do so, they sign a listing agreement that authorizes the brokerage and the listing agent to represent their interests. As the seller’s agent, the brokerage and listing agent must: follow the seller’s lawful instructions, be loyal to the seller, promote the seller’s best interests, disclose material facts to the seller, maintain confidential information, act with reasonable skill and care, and account for any money they handle in the transaction. In rare circumstances, a listing broker may offer “subagency” to other brokerages which would also represent the seller’s interest and owe the seller these same duties.

REPRESENTING BUYERSWhen purchasing real estate, buyers usually choose to work with a real estate agent as well. Often the buyers want to be represented in the transaction. This is referred to as buyer’s agency. A brokerage and agent that agree to represent a buyer’s interest in a transaction must: follow the buyer’s lawful instructions, be loyal to the buyer, promote the buyer’s best interests, disclose material facts to the buyer, maintain confidential information, and account for any money they handle in the transaction.

DUAL AGENCYOccasionally the same agent and brokerage who represents the seller also represents the buyer. This is referred to as a dual agency. When a brokerage and its agents become “dual agents,” they must maintain a neutral position in the transaction. They may not advocate the position of one client over the best interests of the other client, or disclose any confidential information to the other party without written consent.

WORKING WITH CUTLER REAL ESTATECutler Real Estate does offer representation to both buyers and sellers. Therefore the potential exists for one agent to represent a buyer who wishes to purchase property listed with another agent in our company. If this occurs each agent will represent their own client, but Cutler Real Estate and its managers will act as a dual agent.

This means the brokerage and its managers will maintain a neutral position and not take any actions that will favor one side over the other. Cutler Real Estate will still supervise both agents to assure that their respective clients are being fully represented and will protect the parties’ confidential information.

In the event that both the buyer and seller are represented by the same agent, that agent and Cutler Real Estate will act as dual agents but only if both parties agree. As dual agents they will treat both parties honestly, prepare and present offers at the direction of the parties, and help the parties fulfill the terms of any contract. They will not, however, disclose any confidential information that would place one party at an advantage over the other or advocate or negotiate to the detriment of either party.

If dual agency occurs you will be asked to consent to it in writing. If you do not agree to your agent acting as a dual agent, you can ask that another agent in our company be assigned to represent you or you can seek representation from another brokerage.

As a buyer, you may choose to work with a listing agent on a property listed with Cutler Real Estate. Provided that you have not already been working with this agent or working with any other agent under an Exclusive Agency Agreement, then you may choose to represent yourself. In that instance Cutler Real Estate will represent the seller and you would represent your own best interests. Because the listing agent has a duty of full disclosure to the seller, you should not share any information with the listing agent that you would not want the seller to know.

WORKING WITH OTHER BROKERAGESWhen Cutler Real Estate lists property for sale it also cooperates with, and offers compensation to, other brokerages that represent buyers. Cutler Real Estate does reserve the right, in some instances, to vary the compensation it offers to other brokerages. As a seller, you should understand that just because Cutler Real Estate shares a fee with a brokerage representing the buyer, it does not mean that you will be represented by that brokerage. Instead that company will be looking out for the buyer and Cutler Real Estate will be representing your interests. When acting as a buyer’s agent, Cutler Real Estate also accepts compensation offered by the listing broker. If the property is not listed with any broker, or the listing broker does not offer compensation, we will attempt to negotiate for a seller-paid fee.

FAIR HOUSING STATEMENTIt is illegal, pursuant to the Ohio Fair Housing Law, Division (H) of Section 4112.02 of the Revised Code and the Fed-eral Fair Housing Law, 42 U.S.C.A. 3601, as amended, to refuse to sell, transfer, assign, rent, lease, sublease or finance housing accommodations, refuse to negotiate for the sale or rental of housing accommodations, or otherwise deny or make unavailable housing accommodations because of race, color, religion, sex, familial status as defined in Section 4112.01 of the Revised Code, ancestry, military status as defined in that section, disability as defined in that section, or national origin or to so discriminate in advertising the sale or rental of housing, in the financing of housing, or in the provision of real estate brokerage services. It is also illegal, for profit, to induce or attempt to induce a person to sell or rent a dwelling by representations regarding the entry into the neighborhood of a person or persons belonging to one of the protected classes.

Please note: We hope you find this information to be helpful to you as you begin your real estate transaction. When you are ready to enter into a transaction, you will be given an Agency Disclosure Statement that specifically identifies the role of the agents and brokerages. Please ask questions if there is anything you do not understand.

Agency Consultation

Seller’s AgencyI represent you, the seller, and owe you loyalty, obedience, confi dentiality, accounting and reasonable skill and care in performing my duties. I am required to act solely on behalf of your best interests and to seek the best price and terms for you. Finally, I have an obligation to disclose all material information obtained about the buyer.

Buyer’s AgencyThe buyer’s agent owes all of the fi duciary obligations listed under Seller Agency to the buyer. They will work on the buyer’s best interest and seek the best price and terms for their buyer. Finally, they have an obligation to reveal any information obtained about the seller to their buyer.

Dual AgencyOne agent may represent both parties in a real estate transaction with their consent. This normally occurs when a buyer works with a listing agent directly. A dual agent may not disclose any confi dential information that would place one party at an advantage over the other party and may not advocate or negotiate on behalf of either of the two parties.

Home Market AnalysisThe most important part in the role of advising you is providing you with detailed information to guide you in the pricing of your home. My home market analysis will consist of data on homes similar to yours in close geographic proximity. This data will show what your home will be competing against as well as what able buyers have been willing to pay for homes similar to yours in the area.

ListingI will be completing all of the forms necessary to market your home through the Multiple Listing Service (MLS). While many agents take this step for granted, we need to carefully plan the marketing remarks we will be using to attract other Realtors and their buyers to your home, as over 60% of the homes in our MLS are sold by buyer agents.

PricingWhile our Home Market Analysis will guide you in your pricing consideration, there are other factors involved in the process. We should consider positioning your home in relation to the others you will be competing against. A minor adjustment in price may place your home in a better position in relation to the others you will be competing against.

Estimate of the ProceedsYou obviously have goals involved in the sale of your most important asset, your home! I will provide you with a detailed estimate of the proceeds you will receive on the sale of your home so you can plan your next move.

Financing OptionsI can provide you with information on the majority of loan products that a buyer may be utilizing to purchase your home, as some may be more advantageous to you in the amount of time and expenses involved in closing - all items that play an important role in negotiating the purchase agreement for the sale of your home.

MerchandisingI will provide you with tips on how to show your home in the best possible light to potential buyers. You want to be sure that you provide the buyer with a pleasant experience when viewing your home. After all, you never get a second chance at a fi rst impression!

Seller UpdatesI will provide you with an update of the marketing of your home on a regular basis, detailing the steps that I have taken to market your home to the largest pool of buyers qualifi ed to purchase your home. In addition, each month we will review the market to investigate if a change in pricing considerations is warranted.

Showing FeedbackBuyer perception is a key factor in the sale of your home. Therefore, as soon as possible after a showing on your home, I will provide you with feedback from the buyer who viewed your home. This information may provide us with details on items that we should concentrate on when marketing your home.

Presenting the OfferOne of the most exciting and complex parts of the sale process, I will be involved in providing you with all of the information you need to make an informed decision when provided with an offer from a potential buyer. From buyer fi nancial information, inspection considerations, closing costs, possession and more, I can give you the information to accept the offer or formulate an attractive counteroffer to the buyer.

Negotiation

As your negotiator, I will be working hard to help you achieve the goals you have set in the sale of your home in the following ways:

Answering ObjectionsAs part of the negotiating process, many buyers have initial objections regarding a home. It is my job to provide them with the information they need to overcome that objection and decide to purchase your home. All Cutler Realtors are trained in the “Consultative Sales Process” which helps them provide information to overcome buyer’s objections quickly.

Asking the Customer to BuyAs part of the Consultative Sales Process, we’re trained to recognize the signals that buyers exhibit enabling us to help the buyer decide to purchase your home quicker, resulting in a faster sale.

Negotiating the SaleAs your negotiator, I will provide you with all of the information on the buyer, their fi nancing and all other contingencies involved with the offer necessary to make an informed decision. This will enable you to accept the offer or formulate an acceptable counteroffer to the buyer.

Purchase AgreementThe purchase agreement is an integral part of the sales process governing the closing process. While there are many different purchase agreement documents in use by different brokerages, as your negotiator, I will explain each part of the agreement in detail, so you will understand the entire closing process.

Facilitation

As your facilitator, it is my job to promote your home to ensure that you receive the most money quickly, with the least amount of inconvenience. I will utilize the following tools in the process:

Promotion to Local Realtors and Cutler RealtorsPromotion to other local Realtors and over 300 Cutler Realtors is one of the most important facets of the marketing of your home. Over 60% of homes in our area are sold by Realtors other than the listing Realtor, so it is important to “get the word out” on your home to other Realtors so they can get their clients excited about your property. This is accomplished through the use of mass mail, e-mail and personal networking and may include a “Broker’s Open,” where Cutler and other Realtors are invited to view your home personally on a specifi c day and time.

The Power of a Yard SignYard Signs are one of the best ways to promote the sale of your home. Recent National Association of Realtor studies show that over 59% of home buyers found their home as a result of a yard sign.

Multiple Listing Service (MLS)The Multiple Listing Service is a computerized database of real estate information. This database allows members to access information on your home for their clients. As a member of fi ve regional MLS services in Ohio and Kentucky, we can expose your property to the clients of thousands of Realtors throughout the region. In my role as facilitator, I will compile an exhaustive list of all of the features of your home to attract the largest possible number of potential home buyers in the area.

Open HousesOpen Houses allow us to expose your home to buyers without a private appointment. Open Houses are usually held on Sundays since most buyers view homes on their days off. Showing the HomeHouse showings are the most important aspect of the sale process. Therefore, it is important that your home be in showing-ready condition while it is on the market. As your facilitator, I have provided a short list of items that can help maximize the fi rst impression that your home will make on the prospective buyer.

First Impressions are ImportantThe following tips will make it easier to prepare your property to sell.

The Approach. The fi rst few seconds, when your Realtor arrives with a potential buyer, can literally make or break a sale. Make certain that the fi rst things to come into view are neat and attractive.

The Entry. The front entry area and front door should be warm and inviting. The area should be swept clean, and the door itself should be in good repair (painted, if necessary). A seasonally decorative touch can set the proper inviting tone.

The View. Windows should be clean and sparkling in order to maximize the light entering the home and to provide an inviting scene from the exterior. Keep curtains and window coverings open whenever possible to achieve a bright, open effect.

The Surroundings. Faded or worn paint or papers on the walls and ceilings can create a drab effect throughout the interior and will leave an impression in the buyer’s mind that is hard to erase. Spruce up, paint up, touch up.

The Furnishings. A cluttered look makes every room seem smaller than it really is. Remove extra furnishings wherever possible to give your home a clean, simple appearance. Remember, the buyer is trying to visualize how their furniture will fi t in the home. Make it as easy as possible.

Storage. One of the fi rst things a typical buyer looks for is adequate closet and storage space. Maximize the size of your closets by removing excess items and neatly arranging those items that remain.

Bathrooms and Kitchen. These areas should be clean and spotless. No matter how relaxed a housekeeper the buyers may be in their present home, they will invariably downgrade the desirability of a home if the kitchen and baths are less than spotless. Make sure everything shines!

Fix the Little Things. Loose door knobs, doors that don’t close all the way, screens off the track and cracked window panes are all a part of everyday life, except when you’re selling your house. Little things undone can suggest neglect to a fussy buyer. For top dollar, it’s smart to fi x these items.

Shed Light on Dark Areas. Whenever possible, make sure the lights are turned on in areas of the house that appear dark.

Preparing Your Home Checklist

OutdoorsKeep lawn neat and mowed. Replace dead plants and keep shrubs pruned.Keep driveway and steps clean of debris.Apply fresh paint as needed and replace damaged bricks or wood siding.Repair any cracked or broken windows and replace old or torn screen doors. Be sure the faucets and sprinklers are in good working order.If you have a pool or spa, be sure it sparkles. Keep the patio area neat and the yard furniture in good repair.

GarageRemove all unnecessary items. Clean the fl oor and tidy the shelves.

Communication/FeedbackCommunication is a vital part of the home selling process. From setting up show-ings to providing important feedback from potential buyers and their Realtors, Cutler Realtors strive to make this part of the process worry-free.

Realtors have the option of employing our Showing Time/Call Coordinator system to aid them in this function. Call Coordinators in each offi ce can schedule appoint-ments through this computerized system, logging each showing. In addition, the system has the ability to send out feedback reports to the Realtors that show the properties via e-mail or fax, enabling them to obtain vital feedback quickly!

Another great function of the Showing Time system is its reports. Call Coordina-tors log each call on your property and where it was generated from, so we can gauge how successful our marketing is. All showings are logged as well, allowing your Realtor to provide you with a detailed activity report on your listing, breaking down marketing results and showings.

Pre-Approving BuyersIt is important that we make sure the buyer that becomes interested in your home is qualifi ed to purchase it. As your facilitator, I know the questions that need to be asked to ascertain the buyer’s qualifi cation. In addition, through our in-house lender, Westfi eld Bank, I have the ability to have the buyer pre-approved to ensure that your closing will occur smoothly, without any unwanted surprises.

Personal ReferralsOne of the most underrated sources of buyers is an agent’s sphere of infl uence. As your facilitator, my personal marketing to my sphere of infl uence provides a steady stream of buyers to me, one of which may be just the right buyer for your home!

The Closing ProcessIt is my job to handle the details on the closing of your property. I will facilitate the following items in your closing:

InspectionsWith the help of my closing coordinator, we will arrange for the buyer’s inspectors to inspect your home within the timeframe allotted in your purchase agreement. In addition, I will ensure timely follow-up for the results of the inspections.

FinancingOur closing coordinator will be in constant communication with the buyer’s mortgage company, providing me with detailed updates on the buyer’s fi nancing, which I will communicate to you in a timely manner.

Title WorkWe will ensure professional title work and services through our title partner, Title One, located in our offi ce.

ClosingIf possible, we will coordinate your escrow closing to occur in our offi ce with our partner, Title One.

The pricing triangle represents all of the potential buyers in the market for a given home. As the asking price increases toward the peak of the triangle, the number of potential buyers who are willing to pay a premium price for the home declines, until the buying public perceives that the price is so high that no prospects are attracted at all.

Many sellers think that an overpriced property simply can be reduced if it doesn’t sell.
