FROM THE PRESIDENT

THE PAUSE THAT REFRESHESAs I sit to write this column, we are exactly mid-way

through 2013. I have been reflecting upon the first six

months of the year and thinking about what the next

half of this year holds. I thought about titling this column

“Halfway There,” but decided to drop Bon Jovi and go

with Coke’s 1929 slogan instead. Because while summer

can be a time of pool parties, backyard barbecues, and

shuttling kids from one summer camp to the next, this

season also provides us with a chance to “vacate” our

hectic lives and make time for quiet walks along the

beach and naps in the hammock. We welcome the busy

pace of a real estate rebound that continues to gain

strength, despite mixed signals in other sectors of the

economy. At the same time, I hope all of you found a

little time to take a break, breathe, refresh, and recharge.

As we all know, in many neighborhoods within the

Richmond region, the housing market has heated up

rapidly, shifting from a buyer’s market to a seller’s market

seemingly overnight. Although none of us wants to return

to the doldrums of the recession, the market in which

we now find ourselves is not without its challenges; chief

among them, a lack of inventory. Please remember that

REALTOR® cooperation serves as the foundation of our

business and remains in the best interests of our clients.

As nerve-racking as multiple offers are, ensuring that

new listings hit the MLS quickly gives all buyers equal

opportunity at available inventory and offers sellers their

best exposure to ALL interested buyers.

While we have been busy serving our clients, the

Association has also been hard at work meeting

our needs. In the first six months of 2013, we hosted a

fascinating seminar on the multiple generations of buyers

and sellers in today’s market, held a YPN happy hour that

featured an update on the city’s economic development

initiatives, and conducted a joint appearance of the two

gubernatorial candidates. In an effort to remind consumers

that REALTORS® are the expert interpreters of market

data and housing trends, we published The Interpreter, a

quarterly eNewsletter featuring real estate related stories

of interest to area residents.

After a smooth lockbox exchange in early June, we

launched the RVA Homes app. RVA Homes provides the

most accurate, real-time listing data of any real estate

search application focused on central Virginia. Agents

are welcome to brand the app and provide it to their

clients; this is another way to remind consumers that while

data is everywhere, the most accurate and current data—

and the essential analysis of that data—resides only with

their local REALTOR®.

As I look to the second half of 2013, I’m excited about the

lineup we have for TRENDS on October 22, when we will

hear from economist Chris Chmura and political scientist

Bob Holsworth—two highly regarded commentators. Later

this year, we will also invite members to preview the Matrix

MLS system, to which we are transitioning in early 2014.

Matrix is a state-of-the-art MLS designed to facilitate your

business in the ever-changing, fast-paced world in which

we all work.

That’s the past and the future; but for now, here’s to the

present and the pause that refreshes.

A MECHANIC’S GUIDE TO THE MLSCVR MLS…it’s fast, has lots of shiny options, fields and tools on the dashboard…and can sometimes feel as challenging as working on a race car. And did l mention the 45-page User Manual (a.k.a. the MLS Rules and Regulations) covering everything from unconditional offers of cooperation and

compensation to compliance with the REALTOR® Code of Ethics? Compliance with the rules and regulations does not require a hydraulic lift and full pit crew.

You can attain optimal performance and fine-free cruising if you become familiar with the top ten MLS rule violations.

Listings containing incorrect tax IDs, property types and area designations are among the most common errors identified by the i-check system.

Repair Instructions: Update the listing with the correct information within five calendar days of receipt of the i-check warning notice. No other steps are required, as the i-check system will automatically close out your warning ticket once the correction is made. Note: If the information identified by i-check is inaccurate, you should respond to the i-check notice indicating the information is correct within five calendar days.

Cost of Repair: $250 fine if the identified error(s) is not corrected within five calendar days of the warning notice date.

Branded virtual tours or URL’s, agent and lender contact information are not permitted in public remarks. Note: Unbranded virtual tours and URL’s related to the property or neighborhood in which it is located are allowed, but may generate a warning ticket in the i-check system.

Repair Instructions: Remove the branded information within five days of receipt of the warning notice. You may add such information to Agent Only Comments, if you wish.

Cost of Repair: $250 if not corrected within five calendar days of warning notice date.

Listings must be entered into the MLS database within three calendar days of seller ratification of the listing agreement. There are no exceptions for delivery delays, so agents and brokers should consider this time constraint when preparing both the listing agreement and the instructions for its prompt return following ratification by the seller.

Repair Instructions: None. Failure to submit a copy of the listing agreement to the MLS service within three calendar days is not correctable.

Cost of Repair: $250 fine. Violations of this rule are considered uncorrectable.

All MLS listings are required to have a minimum of one photo uploaded within three calendar days of listing submission. Photos must be of the listed property and/or the surrounding neighborhood. For lots and land, if no photo is available, you may use a copy of the plat or the land template.

Repair Instructions: Upload one or more photos or insert the Land/New Construction template, if appropriate to the property type.

Cost of Repair: $250 fine if one or more photos are not uploaded within five calendar days of the warning notice date.

MLS rules and the REALTOR® Code of Ethics require that dual or variable compensation be disclosed to other MLS users. A dual or variable rate commission arrangement is one in which the seller agrees to pay a specified commission if the property is sold/leased by the listing participant without assistance and a different commission if the sale/lease results through the efforts of a cooperating participant. It can also be one in which the seller agrees to pay a specified commission if the property is sold/leased by the listing participant— either with or without the assistance of a cooperating participant—and a different commission if the sale/lease results through the efforts of a seller.

Repair Instructions: Enter a “Y” in the dual/variable field in the compensation section of the listing.

Cost of Repair: $250 fine if the dual or designated disclosure is not added to the listing within five calendar days of the warning notice date.

Listing status must be updated to pending within three calendar days of contract ratification. Note: If the listing instructions direct the buyers agent to negotiate offers directly with the seller (limited service/MLS only listings), it is the responsibility of the buyer agent to notify the listing agent within three days of contract ratification. The listing agent then has three days from receipt of that notification to update the pending status.

Repair Instructions: None.

Cost of Repair: $250 fine. Violations of this rule are considered uncorrectable.

If a seller does not wish to have their listing in the MLS, they must indicate those instructions in the listing agreement and a copy of the agreement must be filed with the MLS within three days of the sellers signature.

If an active listing indicates lockbox call agent, lockbox call owner, lockbox go direct or Lockbox Call Tenant, the Supra™ lockbox serial number must be entered into the SUPRA LB Serial # field in Tempo™ within three days of the MLS listing entry date.

Repair Instructions: Enter the lockbox serial number. Time saving tip: When you place your lockbox on a property, use your phone to take a photo of the serial number on the box so you will have ready access to that information.

Cost of Repair: $250 fine if lockbox serial number is not added to the listing within five calendar days of the warning notice date.

Lockbox key holders must comply with the listing showing instructions. Use of the lockbox key to gain entry to a property for any purpose other than the exercise of authority or responsibility derived from a legally recognized brokerage agreement or the offer of cooperation by an agent or broker is prohibited. In other words, unless a listing states lockbox go direct, you must arrange your showings through the listing agent.

Repair Instructions: None.

Cost of Repair: $500 fine. Violations of this rule are considered uncorrectable.

My husband did not want me to work full time, so real estate seemed like a good compromise. He followed me into the business a year after I attained my license and the rest is history.

FAVORITE VACATION SPOT: Spent many summer vacations on the beach in North Carolina and still love the beach, but also love to cruise.

HOBBIES & ACTIVITIES OUTSIDE THE OFFICE: Travel; the Richmond Symphony; reading; spending time with my 3 incredible grandchildren; and family events with my sons, daughter-in-law, seven siblings, and almost 95-year-old mother.

THE NEW RVA HOMES APP

This summer, CVR MLS proudly debuted the mobile application RVA Homes, giving members a useful tool and another way to connect with and engage clients during the home buying process.

In addition to providing the most accurate on-the-go access to listing information for REALTORS® and consumers, RVA Homes offers a variety of new features and capabilities:

• A touch sensitive “draw search” feature, used to retrieve listings within a drawn area on a map

• A “search nearby” feature that works with a GPS enabled device to locate listings near the user’s current location

• A one-touch maps function that provides agents and consumers with guided directions to each listing

• A “share app” feature that allows agents to send clients an invitation to download the app, which will then be sub-branded with that agent’s information

• The ability to save and share searches and favorite listings between agents and clients

GETTING STARTEDAgent User Name and Password Use the login/password you use for Tempo/Fusion™

to access your sub-branded app. If you have a photo uploaded into Fusion, it will load on the home screen, along with your name and contact information.

Invalid PasswordPasswords are case sensitive unlike Tempo/Fusion. If you are experiencing issues, try using all lowercase letters, then all capitalized letters, then lower case first letter, and capitalized first letter. Be sure to write down the letters you entered in the correct case for future use.

Agent LoginAfter downloading, be sure to click “Agent Login” to access the agent side of the app. At the top of the login page it will say: “Agents see more. Log in to view agent specific data and advanced search filters.”

Sharing the App with ClientsTap the “Share App” button. A screen will appear allowing you to select the method you would like to use (email, text, or social media). If a client already has the app, they can tap the “Add My Agent” button and add your MLS ID provided in the message you send.

information delivered to buyers and sellers. Using the portal’s

split screen technology, clients can more effectively manage

listings by visually identifying where they are located on the

map. The portal also serves as a powerful communication tool

of interest, as well as log their conversation notes to and from

So, what does this mean for new salesperson

licensees who have not completed their 30 hours of

PLE? If you are reading this article and began your

post licensure education after January 31, 2013, your

PLE credit hours may be at risk. If you have taken

classes carrying PLE credit, you may only use those

credits to satisfy your post license education if you

complete all of the remaining hours in the PLE track

before December 31, 2013 (regardless of when your

license was issued). If you do not complete all 30 of

your PLE hours by December 31st, as of January 1,

2014 any PLE credit hours you have acquired will not

count toward your 30 hour requirement, and you will

need to take 30 hours of the new SPLE curriculum

before your one year anniversary date.

The RAR education passport program can help

you secure those remaining PLE hours. The PLE

Passport allows you to select a customized set

of PLE classes covering the hours you need and

PROPOSED MEALS TAX :AN INVESTMENT IN HENRICO AND CHESTERFIELD

On November 5, when Henrico County voters cast their ballots for

statewide candidates, they will also vote on a 4% meals tax referendum.

The Henrico Board of Supervisors unanimously endorsed the ballot

measure in order to generate the revenue needed to close a $33 million

dollar budget gap for fiscal year (FY) 2015. The revenue generated by

the meals tax will be used exclusively to fund the operational needs and

capital projects of Henrico public schools.

How We Got Here

Due to the recession, Henrico and its citizens suffered a $4 billion loss in real estate value. Because Henrico

(like all other localities in Virginia) relies heavily on real estate taxes, county revenues have decreased

dramatically each year since FY 2009. Additionally, the General Assembly’s decision to obligate local

governments to pay into the Virginia Retirement System (VRS) for teachers dealt another staggering blow

to the county’s budget. This unfunded mandate will require the county to pay $500 million into VRS in the

next two decades.

Steps Henrico has Taken to Address the Shortfall

Henrico has a well-deserved reputation for fiscal conservatism and efficient, effective management. During

the economic downturn, Henrico did not raise real estate taxes, eliminated $115 million from its budget

over the last four years, reduced its workforce by 650 positions, utilized $100 million in cash reserves and

reduced the school system’s budget by $70 million. These measures have allowed the county to make the

least visible, least painful cuts without decreasing the quality of services delivered to Henrico citizens.

Where Things Stand Now

The County needs $33 million to meet its FY 2015

obligations. Of this $33 million, $18 million is needed

for the school system’s budget. A 4% meals tax

generates $18 million annually, as would a 6¢ increase

in the real estate tax. If the meals tax referendum is

defeated, the County will most likely need to raise the

real estate tax by 6¢ (per $100 of value) or reduce the

budget for schools and public safety. Seventy-six percent

of the County’s budget is devoted to education and

public safety.

Reductions in these services would adversely affect

all residents of and businesses in Henrico. Because

the school system has already made cuts in programs,

90% of the schools budget is now personnel costs; so

additional cuts to the schools will invariably drive up

the pupil/teacher ratio. Any cuts will affect the quality of

services delivered to Henrico citizens, particularly our

children’s educational experience.

Why The Meals Tax?

• A 4% meals tax raises $18 million annually as would a

6¢ increase in the real estate tax rate.

• Unlike the real estate tax, the meals tax is an optional tax (if

a person chooses to eat out, the person pays the tax.)

• Over 40% of the meals tax revenues will be paid by

non-county residents.

• For a house valued at $250,000, a 6 cent increase in

the real estate tax results in an annual increase of $150;

that same household would have to eat out to the tune

of $3,750 each year to pay the same in meals taxes.

• An increase in the real estate tax is far more threatening

to the County’s economic development prospects than

a meals tax; at 87¢ per $100, Henrico’s tax rate is the

lowest of the fifteen largest localities in Virginia.

The referendum questions focus on:

• Issuing debt of $304 million in school projects — renovations

to ten schools and one new school to ease overcrowding at

Watkins and Bettie Weaver elementary schools.

• Issuing debt of $49 million to replace a near-obsolete

communications system used by police, fire and

emergency personnel.

• Seeking a meals tax of 2% to address the public

education and public safety capital projects noted above.

While the 2004 school bond referendum focused on

addressing growth and overcrowding issues, this fall’s

bond package focuses on revitalizing older schools. The

average age of the elementary schools included in the

bond referendum is sixty-two years, for middle schools it

is forty-seven years.

The schools selected for revitalization serve the County’s

aging neighborhoods most in need of revitalization.

The meals tax will ensure the County has the revenue

needed to carry out the revitalization outlined within the

comprehensive plan. A direct correlation exists between

school performance and property values, thus the County

must place a premium on efforts that will maintain, and

where necessary, revitalize these areas. Improving the

County’s aging schools will improve the surrounding

neighborhoods and ensure these neighborhoods remain

vibrant and attractive for current and future homeowners.

Why Is The Meals Tax Important To REALTORS®?

This meals tax referendum will help maintain a strong,

competitive school system that is the cornerstone of

a flourishing Henrico County. Individuals and families

will not buy a house until they have first bought into a

community’s quality; schools are an essential element

in that quality of life.

Henrico has a reputation for being a well-managed

county, with excellent jobs and amenities, a high-quality

transportation system and a nationally regarded public

education system. If REALTORS® want Henrico to retain

its competitive advantages—a low tax environment

that attracts businesses and a world class educational

system that not only produces work-force ready talent

but also attracts jobs and residents to the County—then

they should support the meals tax in November.

Chesterfield County Referendums and School Revitalization

Chesterfield voters will also have the opportunity

to vote on a meals tax referendum in November.

Chesterfield voters will decide three referendum

questions: two bond issues and a meals tax.
