April 11, 2018

Norm Stanek called the meeting to order at 6:00 p.m

A motion was made by Kevin Riley and seconded by Kevin Erueggeman to approve the minutes of theMarch 15, 2018 meeting, Director of Public Works reports for April; Wastewater Treatment Operationand Maintenance reports for March; Water Utility Operation and Maintenance reports for March andmonthly bills for the Sanitation Dept., Street Dept. and Water Utility. Motion carried 5-0.

With the reconstruction on Hwy 27, the police chief and fire chief are recommending that we add a stopsign at AverillStreet and Roberts Road. This stop sign will remain there permanently and the road willbe paved. A motion was made by Jim Church and seconded by Kevin Brueggeman to add a stop signat Averill street and Roberts Road permanently and that the road be paved. Motion carried 5-0.

Mark Van Wormer is in the process of applying for a CDBG for parts of Chester Street. This grant, if we

are selected, is to help with infrastructure costs for low to moderate income areas. Vierbecher will helpus out in this project and the cost for their services is 56,000.00. lftheyfeel wewill not qualify, we willnot go forward. Amotionwasmade byJim Church and seconded by Larry Tichenor to move forwardwith the grant process for Chester Street. Motion carried 5-0.

The Wellhead Protection Plan in Chapter 13 of our ordinances needs to be changed. Our language and

verbiage needs to be changed to match the State's. A motion was made by Jim Church and secondedby Kevin Riley to adopt the changes as presented in Chapter 13 regarding the Wellhead ProtectionPlan. Motion carried 5-0.

Our solid waste contract with Modern Disposal is up for renewal in May. The owner is requesting a 1%

per year increase for the next three year contract. Mark Van Wormer is recommending that we go withModern DisposaI for the next three years. Amotionwas made by LarryTichenorand seconded byKevin Brueggeman to accept the three year contact with Modern Disposal with a 1% increase eachyear until the contract expires. Motion carried 5-0.

Paper Mill Dam Proiect

MSA has submitted surveys and design plans for approval to the DNR. Thesemodifications have not been approved by the DNR to date, but there is still a possibility that theconstruction could occur in 2018. Along with these plans they submitted a request to pave thelake road. lf approved it would be one more step in getting the lake road paved.

Chester St, Reconstruction (2019)

I am currently working with Vierbicher for a potential grant to help fund a 2019 Chester 5t.reconstruction. We are conducting an income survey for residents of Chester St. to determine if wewould qualify for the grant. lt would be a 50/50 grant up to 5500,000 for street reconstruction and allutility upgrades.

Milwaukee St. Bridse Proiect (2019)

Replacement of the Milwaukee 5t. Bridge over Farmer's Valley Creek is scheduled for 2018bidding and 2019 construction. The DOT requested we move the project into 2018, but the engineer andmyself thought it would be in the City's best interest to keep the project in 2019. The short time framefor bidding in the summer of 2018 could significantly increase project costs.

South Pointe Business Park

Hoffman Construction is currently working on clearing and grubbing at the park and we arelooking at extending Bicycle Road for a potential business.

WASTEWATER TREATMENT FACILITY

OPERATION AND MAINTENANCE REPORT

APRIL 2018

The month of April was devoted to general plant maintenance and equipmentrepairs and installations. We installed our UV Disinfection equipment and placedon-line for the 20L8 disinfection season which runs from May i.'t thru September30th. We replaced a 240-v block heater on the portable emergency generator, alsoreplaced a fuel line. Pulled pumps at Riverwood and Jane Dr. liftstations andunplugged, also replaced the start and run capacitors and a potential relay forpump #2 at the Jane Dr. liftstation. Wright's Septic cleaned the siphon manholesat the Beaver Creek River Crossing in Evan's Bosshard Park and Service Plus

replaced 2 damper actuators in the blower room for the exhaust fans. Synagrohas had a slow start hauling out our sludge this Spring due to the weather. So far,they only been able to haul about 200,000 gallons of the 1.8 million gallons instorage. The plant is performing very well and we are in full compliance with ourcurrent (expired) WPDES permit requirements. Listed below are some of theother operation and maintenance tasks, which were completed during April 2018.

o Continued to remove snow and ice from roadways and walks as needed.o Hauled 8,750 gallons of leachate and completed the semi-annual leachate

report for the Sand Creek Landfill and sent to the WDNR.r Continued to clean weirs, launders and trickling filter arms weekly.r Submitted and certified our 2018 Sludge Characteristics Report 3400-49.o Continue to run the sludge Gravity Belt Thickener (GBT) 3x a week.r Replaced a cam lobe and bearing on the upper arm of sludge transfer

ln April we pumped 34,981,000 gallons of water compared to 33,692,000 gallons for the same periodlast year.

The following is a list of what the Water Utility has been working on during the month of April

Completed the monthly bacti samples

Completed the monthly fluoride sample

Completed the quarterly raw water samples

Completed the quarterly nitrate sample at site 200

Ran standby engines and Benerators for the monthly tests

We assisted our contractor in repairing a leaking water service at 301 S. "K" St. One block ofcustomers were shut off for a short time while repairs were made.

On April 1lth, we had our annual DNR inspection. The inspection went very well with no majorissues or concerns.

We completed the city wide spring hydrant flushing, during the week of April 9th. At this time, allfire hydrants are in good working condition.

We have been ra ising/lowering and repairing some curb boxes and valve boxes that were hit andbroken by snow plows, during the winter months.

The South Tower was due for a full drain and inspection this year. The exterior was also powerwashed and cleaned. The East Tower required a half drain and inspection. The exterior was alsopower washed and cleaned. A half drain and inspection was required at the North Standpipe aswell. Lane Tank Company found no major issues during all of these inspections.

The VFD on our Well 10 pump motor failed and was replaced. We were able to run the well onbypass while waiting for the new VFD to arrive. These units are expensive, as you will see a largeinvoice from Brad Olson Electric for this replacement.

The Public Service Commission (PSC) regulates the fees charged by the Water Utility. We areallowed to complete a "Slmpllfled Rate Study" every year for 5 years if we choose to. Ihe studydoes not cost anything and if an increase is determined, we can adjust our rates slightly without aformal public hearing. After completing our 20L7 audit, we are eligible for a 3% increase to ourrates. This would increase the average residential bill S1.79 per quarter. The City stafffeel it is

easier on the customer having a small increase more often than to wait several years and thenhave a substantial increase. After the rate adjustment, our average bill would still rank in thelower 1/3 statewide for Class AB Utilities (at least 4,000 customers). tf approved, this would takeeffect August 15th, the customer would not see this increase until the bill due jan 2oth, 201.9.

City staff, including myself, met with our engineers and contractor in regards to the South pointeBusiness Park project. The tentative schedule is to start in April.

We received a chemical delivery, from Hawkins Chemical Group, to some of our well houses.

We have been spending a lot of time with Diggers Hotline tickets, locating curb stops, for all thestumps that need to be ground on the boulevard.

We completed the fluoride and chlorine project upgrades for Wells 6 & 7. These chemicals arenow in separate rooms. The DNR was recommending we do this sometime. I had figured thisproject in with the 2018 budget.

CONTRACT FORGARBAGE, REFUSE, AND RECYCLABLE MATERIAL COLLECTION

THIS AGREEMENT, made this 18tr'day of March,z\ls, by and between the City of Sparta, a

municipal corporation of Monroe County, Wisconsin, hereinafter referred to as the "City," and

Modern Disposal Systems, L.L.C., a Wisconsin corporalion hereinafler refened to as the"Contractor,"

WIIEREAS the City desires to have garbage, refuse, and recyclable material collection within itsboundaries handled by private contractor, and

WHEREAS the Contractor has agreed to perform said functions for the City,

NOW TIIEREFORE it is agreed:

PURPOSE OF'CONTRACT

1. The Contractol shall collect all residential garbage, refuse, and all materials required to

be recycled under Section I 1 .09 ofthe Municipal Code within the corporate boundatiesofthe City under the terms, conditions and specifications set forth herein.

2. The City agrees not to contract with another garbage, refuse, and recycling hauler toperform residential collection services within the boundaries ofthe City while thisContract is in force.

TI]RM OF CONTRACT

This agreement shall be effective commencing the sixteen r (1611') day of May,2015, and

continue up to and including the fifteenth (15'r') day of May, 2018. This Contract may be

automatically renewed for additional one year periods commencing on the termination date oranniversary thereofunless either parly shall, by written notice, dispatch to the other by certifiedmail, return receipt, postrnarked no later than thirty (30) days prior to the initial tennination date

or any renewal period, nolice of its intention to terminate. Substantive changes may be made to

this Contract only by mutual agreemenl.

DUTIES OF CONTRACTOR

Collection and disposal by the Contractor shall take place at least once each week at each

dwelling in the City for garbage, refuse, and recyclable materials. Residents shall place

all containers and bundles at the alley or curb or near the street edge for collection by the

Contractor by 5:00 a.m. on the day designated by the Contractor for collection. The

Contractor shall empty the containers and pick up the bundles on the designated dateprovided, however, that in the event of inclement weather the Contractol may be excusedif 1l.re stleets are in.rpassable. In such event, the Contractor shall make the collection as

soon thereafter as is reasonably possible.

2. Collection service shall be provided by the Contractor as specified in paragraph 1 exceptthat there shall be no collection on the following holidays: New Years Day, ChristmasDay, Thanksgiving Day, Labor Day, Meinorial Day, and Independence Day. Collectionofthe residences missed duling these holidays will be made up during the calendar weekwithin which the holiday occuned, bu1 no home shall be serviced more than 24 hoursafter its normal collection time.

3. The Contraclor shall make a reasonable attempt to collect from ploperties affected bystreet construction projects. This may be accomplished by collecting from nearby sidestreets or alleys, or coordinating with the street contraclor 10 enter the construction site ona regular basis.

4. All wet garbage shall be drained and wrapped and deposited in a standard garbage orrecycling container and set at the curb or alley or near the street edge or else theContractor shall not be obliged to pick up such wet garbage.

5. The Contractor shall not be obligated to pick up or to empty containers, bundles or bagsweighing more than fifty (50) pounds each.

6. Ifthe Conlractor refuses to collect any material not properly prepared, he shallimmediately notify the occupant by leaving an informalion sticker. If this problemoccurs consistently at the same household, the Contractor shall notify the Director ofPublic Works.

7. The ernployees ofthe Contractor shall handle all bags and containers with reasonablecare and as quietly as possible. The employees ofthe Contractor shall also immedialelyclean up and dispose ofany garbage, refuse, or recyclable materials which may be spilledor which may be lying near the containers due to the employee's negligence.

DN,FINITION OF TEITMS

The following definitions shall be used for re purposes ofthis Contract

Garbaee shall mean animal and vegetable waste resulting from the handling, preparation,cooking and consumption offood.

2. Refuse shall mean wasle, except bodily waste, including, but not limited to rubbish,unrecyclable plastics, unrecyclable paper, unrecyclable pieces of glass, wood, all ofwhich normally result frorn the operations of a household. The term refuse shall notinclude leaves, grass clippings, earth, sod, rocks, concrete, brush, materials from the

remodeling or construction ofhomes or buildings, and trees or parts of trees. The terrnrefuse sl.rall also not ir.rclude waste desigr.rated hazardous by the United StatesEnvironmental Protection Agency or appropriate agencies of the State of Wisconsin.

3. Recyclable Materials shall mean and ir.rclude glass cor.rtainers, tin cans, newspapers,magazines, corrugated boxes (no larger than 36" by 36"), #1 and #2 plastic bottles,aluminum scrap and aluminum cans as described in Section 11.09 ofthe MunicipalOrdinance.

4. Collectine shall mean the picking up and collecting of all garbage, refuse, and recyclablematerial which is deposited in standard containers or which is securely tied in bundles ofappropriale size and weight and set at or near the culb or street or alley edge.

5. Disposal shall mean disposal ofany material collected, such disposal lo be done inaccordance with all city, town, village, county, state and fedelal regulations.

6. Residenlial dwelling or dwellins unit shall mean a separate place including single familydwellings (dwellings of two or fewer units), multi-family dwellings (dwellings of three orfour units), mobile homes, and individual apartment units. This definition does notinclude apartment buildings (more than four units) or commercial businesses located inresidential areas, but does include home occupations as defined in the MunicipalOrdinance. Apartments above businesses are no longer included in this contract.

7. Citv Aoproved Recvclins Container means a clear plastic bag, or a bin or can thatprotects the contents from the wind but allows the Conhactor to determine that it containsrecyclable material.

SPITCIF'ICATIONS AND RATES OF PAYMENT FOR COLLECTION

As consideration for this Contract, the City hereby agrees to pay the Conlractor for collection ofgarbage, refuse, and recyclable malerial within the City as follows:

1. The Contractor shall charge and the City shall pay $5.30 per monlh for weekly garbage,refuse and recyclable collection for each occupied single-family residence in the City.The Contraclor shall also provide service once per week 1o the public library and tochurohes within the Cily boundaries at this rate. For 2015, this Contract includes 3,476single-family housing units. The Contractor shall charge and the City shall pay $4.94 perunit per month for weekly garbage, refuse and recyclable collection for each occupiedmulti-family residence in the City. For 2015, this Contract includes 182 rnulti-farnilyhousing units. Within 90 days of Contlact commencement, the Contractor may verifythese quantilies after notifying the Director of Public Works, who shall be allowed toaccompany the Contractor during verification. A one-time adjustment may be made tothe number ofunits in this Contract to ensure that the Contractor is paid for an accuratenumber ofunits, although this study will not alter the per-unit charge.

2. The collection fee shall be canceled for any dwelling which becomes vacant for a periodof ninety (90) days. For new dwellings constructed during the term of this agreemellt,and for dwellings which were unoccupied at the beginning ofthe agreement bu1 whichlater become occupied, the Conlractor shall begin service immediately after notice ofoccupancy is given to the Contractor. The monthly charge for such units shall be paidunder this Contract at the existing rate for that type ofresidence beginning the quarterafter the sewice to that unit is commenced.

3. Should the owner of any multi-family dwelling choose 1o arrange for dumpster service rnlieu ofcurb-side collection, such service shall be at the owner's expense. The Contractorshall notift the City ofany such arrangement, and the units removed from this Contract.

4. If dumpster service to apartrnenl buildings over four units is not feasible as determined bythe City's Public Works Board, curb-side service to such dwellings shall be added to thisContract and payment will be based on the multi-family unit cost.

The Contractor shall collect and dispose ofunwanted large items ofpersonal propeftysuch as household furniture and mattresses not normally included in the weekly garbage

collection at a minimum during the first and third full week of each month at residentialdwellings and churches. Such items include but are not limited to the following: chairs,tables, couches, shelves, desks, lamps, toilets, and sinks. This service also includes largemetal items such as gutlers, exercise equipment, hide-a-beds, swing sets, fence posts, and

grills. These items shall be set out at the curb or street or alley edge. Objects too largefor removal may be rejected at the discretion ofthe Contractor. The Contractor shallcollect lurnber, gutters, carpets, or boards not exceeding four (4) feet long or 4'x4'square, bundled and not more than 75 pounds. Appliances are not included in thisservlce.

6. The contractor shall collect additional residential solid waste as needed within 24 hoursofbeing contacted by a resident (Monday through Friday). This service is intended forspecial situations where a resident has a legitimale reason to not wail for their nextregular collection day for service, such as moving to or from a new residence or safetyconcerns. This "call-in" service does not include bulky items.

Collection ofresidential appliances is not included in tltis contract. Should a residentarrange with the Contractor for collection and disposal ofthese items, the fee slrall notexceed $20 per item. Stickers to have these items collected should be available forpurchase at City Hall as well as directly frorn the contraclor.

8. The Contractor shall collect recyclables in clear plastic bags or other containers or binscontaining only recyclable materials.

9. At no additional fee to the City, the Contractor shall coordinate with the Monroe CountySolid Waste Department to publish and deliver an updated brochure describing residents'rights and responsibilities concerning recycling and large material collection. These shallbe delivered to each residence covered by this Conlract within 90 days of the Contract

comlnencemellt. The Contractor shall also provide a brochure to new homes added to theContract during the Contract period.

10. A1 no addilional charge to the City, the Contraclor shall provide and service up to 12

dumpsters each for up to three weekends a year-from Friday at 3:00 p.m. to Sunday atl0:00 p.m.-at Memorial Park or other public areas for Cily events. These dumpslersshall be sized adequately to meet the demand for the event.

11. The City shall pay the Contractor $1,800.00 per monlh for dumpster service at municipalbuildings and public downtown galbage cans, which includes all disposal cosls. TheContractor shall provide the dumpsters and single-stream recycling containers and willcollcctcd on an as nccded basis.

The size, number, and servicing schedule ofthese dumpsters may be adjusted annually atthe mutual agreement of the Contractor and the City, with the intent to save time andmoney without sacrificing convenience, appearance, or health conditions ofthe municipalbuilding. 'l'he Waste Water Tre atment Facility dumpsler includes washed wastc watergrit as well as regular refuse, which shall be collected together. The Contractor willobtain any required permits fol such collection. This Contract does not include service ofthe Post Office, County or school buildings.

12. The City shall pay the Contractor $13,416.21 per monlh for tipping fees at a licensedlandfill. At the discretion of the City, this amount may be adjusted to reflect tipping feechanges at the City's preferred landfill. The City reserves the right to remove lhis itemfrom this Contract, and to pay the landfill of its choosing directly for such fees. ThisContract does not include the payment of any tipping fees for businesses, industries orother organizations not included in this Contract. Unless directed otherwise by the City,the Contractor shall dispose ofall garbage and refuse at the Monroe County Landfill.

13. The monthly residential garbage, refuse and recyclable materials collection fee shall bepaid by the City to the Contractor by the thirtieth (30tr') day of the month for the previousnonth's service. 'fhe total monthly cost for this Contract is summarized as follows:

14. The Contractor shall comply with the existing lecycling agreement eslablished betweenthe City and the Monroe County Solid Waste Deparlmenl, as Monroe County is the"Responsible Unit" for the City's recycling program.

i5. This Contract will not include the collection of engine oil, automobile batleries, paintcans that have not been cleaned and dried, or any othel hazardous malerials.

16. The Contractor may be required to prepare an annual report reflecting the amount ofrefuse and recyclable rnaterials collected. The report will also provide a record of thenumbel of dumpsters provided for multi-family dwellings. The report shall reflect theamounl of waste generated under this Conlract, and the corresponding lipping fees. Thereporl shall summarize the revenue provided to the City through its involvement in theMonroe County recycling program.

i7. The Contractor shall establish a reasonable policy for receiving and responding tocomplaints. If the Contractor does not resolve a legitimate complaint by the end ofthefollowing business day, a $5 fee will be required per day for liquidated damages. Latecollections due to an act ofGod or circumstances beyond the Contractor's control shallnot be considered missed collections.

18. The Contractor shall provide a schedule approved by the Board ofPublio Works with a

route map showing the regular day of collection for each area in the City. The scheduleshall follow as closely as possible the previous contract's schedule.

19. The Contractor shall provide, maintain and man a local collection site for the freedisposal of appropriate metal ilems and other large iterns. This service is covered underthis contract with proof of residency.

20. This Contract assumes diesel fuel costs of $4.25lgallon or less. Should the fuel pricesrise above this for over half a pay period, the Contractor shall be entitled to a fuelallowance for that pay period. The allowance shall increase the monthly payment by$250 for a fuel cost of 4.2 6 - 4.50 per gallon, $500 for a fuel cost of 4.51 - 5.00 pergallon, $1000 for a fuel cosl of 5.01 5.50 per gallon and so on.

GENITRAL CONDITIONS

1. Performance Bond: The contractor shall furnish a performance payment bond in theamount of half of the amual conlract amounl lo be in full force and effect during the entire termhereof In the event the named surely is required 1o le-insure the performance bond, it shall be

re-insured in a corporation authorized to do business in Wisconsin and shall be in such form as

will enable the City to bring an action against the company re-insured and the reinsuler. Thisrequirement may be waived at the discretion of the City Council.

2. Emplovment: The Conlractor specifically agrees to pay all claims for labor performedor materials furnished or consumed in completing the within contract. The Board of PublicWorks rnay demand the dismissal of any person employed by the Contractor in, about, or uportthejob who misconducts himself, or is incompetent or negligenl in the course ofthe properperformance ofhis duty, or who neglects or refuses to comply with direclions given, and suchperson shall not be employed again witbout the written consent ofthe Board ofPublic Works.

listed in the telephone directory, which shall be manned in such a manner as to receivecomplaints and give information between the hours of 8:00 a.m. and 5:00 p.m., Monday throughFriday except holidays.

The bodies shall be ofaspecialized type for the handling ofgarbage, refuse and recyclable rnaterial. The Contractorshall furnish a sufficient number of such trucks to perform services in accordance withestablished schedules. All trucks and other mobile equipment used by the Contractor in theperformance of services shall be uniform in color and the name ofthe Contractor shall beprominently displayed thereon. The Contractor shall not use a firm name containing "CITY" or"SPARTA" oT other words implying municipal ownership. Any changes in the type ofcolleclion units shall be made only upon the approval ofthe Board ofPublic Works after such

contemplated changes have been subrnitted in writing to the Board. In cases beyond theContractor's control, substitutions may be made on a temporary basis to insure continuousservice. The Contractor shall maintain all equipment in good working condition at all limes, and

shall rinse and treat truck container bodies with a disinfectant. The Contractor shall withdrawfi'om service and promptly repair any piece of equipment which in the opinion of re Board ofPublic Works is unsafe, fails to operate properly or otherwise does not meet other provisions ofthis contract. The Contractor shall maintain garaging and maintenance facilities for allequipment in a condition and at a location acceptable to the Board ofPublic Works in so far as

zoning, traffic, home parking and nuisance considerations are concerned.

6. Insurance and Indemnification: The Contractor shall maintain and shall file with theCity policies for workers compensation insurance and liability insurance which shall be effective

during the entire period covered under this Contract. Such policies of insurance shall provide theminimunr as follows:

These policies shall name the City as an insured party and such policies must meet the approvalof the City Attorney. No policy is acceptable to the City which can be cancelled by the insurer inless than 1en (10) days after the insured and the City have received written notice ofsuchcancellation.

The Contractor shall indemnify and hold the City harrriless fi'om any and all claims ordamage that are alleged or adjudicated to have occurred as a result ofthe Contractor's activiliesin the performance of this Contract. Such indemnification shall apply to any and all claims andinjuries, regardless oftheir nature, and to any and all damages claimed or adjudicated to'haveresulted therefrom. The Contractor shall defend the City, its ofhcers, agents and employees atthe Contractor's sole expense in all litigation relative to such claims or injuries arising out oftheContractor's performance hereunder, shall pay all attorneys' fees and costs in conjunction withsuch litigation, and shall satisfy and cause to be discharged anyjudgments which may beobtained against the City, its officers, agents or employees as a result of such litigation.

7. Educational Requirements: It shall be the Contractor's obli gation from tirne to time toinform the units it will be servicing pursuant to this Contract ofthe rules and regulationsapplicable to its collection. The City agrees to provide reasonable newspaper announcements toinform the public of their obligations prior to the commencement of this Contract.

8. Affirmative Action: The Contractor shall hire local help whenever possible andpracticable to carry out the provisions ofthis Contract, and cerlihes herein that the Conlractor isnow and will continue to be an equal opportunity empioyer.

9. Alcohol and Illegal Chemical Substances: The Contractor and its employees shallprohibit and restrict the consumption or use ofalcohol and illegal chemical subslances by any ofthe employees while they are in the course of performing their duties under this Contract.

10. Independenl Conhactor: The relation of the Contractor to the City shall be that of anindependent contractor. The presence ofany represenlative, officer, agent or employee oftheCity during any work performed under the Contract shall not relieve the Contlaclor ofanyliability for acts or omissions ofthe Contractor.

Notice of Rate lncreaseWater Customers of the Sparta Municipal Water Dept

This is to give you notice that the Sparta l\4unicipal Water Dept will file an application on May 10, 2018,with the Public Service Commission of Wisconsin (PSC), for authority to increase water rates. Rates forgeneral service will inctease 3.0 percent. The increase is necessary to reduce the existing deficiency inpresent rates. The request is being made underWis. Stat. 196.'193. Rate increases granted underthisstatute do nol requke a public hearing. The effect of the increase for some selected customers isshown below. Public Fire Protection and Wholesale rates (if applicable) will also increase 3.0 percent.
