This emergency rulemaking action by the Department of Corrections and Rehabilitationamends four sections in title 15 of the California Code of Regulations to allowtransgender inmates and inmates having symptoms of gender dysphoria that arehoused at designated. institutions to have access to state-issued. and authorizedpersonal property items in accordance with their gender identities. The Department isalso adopting two new property lists for transgender inmates and inmates havingsymptoms of gender dysphoria for use in designated institutions, which are incorporatedby reference. This action. was certified as an operational necessity by theUndersecretary an March 2, 2017.
OAL approves this emergency regulatory action pursuant to sections 11346.1 and11349.6 of the Government Code, and section 5058.3 of the Penal Code.
This emergency regulatory action is effective on 4/28/2017 and will expire on 10/612017.The Certificate of Compliance for this action is due no later than 10!5/2017.

Section 3000, Definitions.
Section 3000 is amended to .alphabetically merge the definitions below with those already inthe regulations.
Gender Dvsphoria means distress caused by a conflict between a person's fender identity andthe sex the person had or was identified as having at birth.
Gender Identity means a person's sense of identification as male female neither or both
Trans6ender means a person whose gender identity is different from the person's assigned sexat birth.

Section 3030. Issuance and Possession of State Clothing and Linen.
Subsections 3030(x) and 3030(b) are unchanged but are shown for reference.
(a) Each inmate shall be provided state clothing and Linen pursuant to this section, Each itemissued: shall remain s#ate property' for which the inmate shall be accountable. State .items: shall berecalled and exchanged as directed by the institution head.
(b) Inmates shall possess. only those items of state clothing and linen issued to them. Below .arethe standard inmate
issues.

New Subsection 3190(d) is adopted to read:
~d) The Trans ender Inmates Authorized Personal Property Schedule (TIAPPS) (4/28/17)
identifies a separate list of allowable personal ~ropertv afforded to trans ender inmates and
inmates with symptoms of fender dysphoria as identified and documented in SOMS by medical
or mental health personnel within a CDCR institution and is incorporated by reference. The
TIAPPS shall be updated through the collaboration of all mission-based pro~irams within the
Division of Adult Institutions no more frequently than twice yearly. All changes to the TIAPPS
shall be adopted in accordance with the rulemakin~requirements of the Administrative
Procedure Act (Government Code Sections 11340 through 11350.3) and if applicable Penal
Code Section 5058.3.
