The Minister responsible for health, in exercise of the power conferred by section9 of the Quarantine Act 2017, being of the opinion that a public health emergency existsand after having consulted with the Chief Medical Officer, makes the following Order:

PART 1

PRELIMINARY

CitationThis Order may be cited as the Quarantine (COVID-19) (No. 3) Order 2020.

InterpretationIn this Order—

“conveyance operator” has the meaning given in regulation 2 of the Quarantine(Maritime and Air) Regulations 2017;

“COVID-19 antigen test” has the meaning given in paragraph 2A;

“COVID-19 NAAT test” means the COVID-19 Nucleic Acid Amplification Test, whichis a type of viral diagnostic test for SARS-CoV-2, the virus that causesCOVID-19, where the SARS-CoV-2 test specifically identifies the RNA

(ribonucleic acid) sequences that comprise the genetic material (nucleic acids)of the SARS-CoV-2 virus, and includes the COVID-19 PCR test;

“COVID-19 PCR test” means a polymerase chain reaction test using reversetranscription PCR (RT PCR) for the detection of nucleic acid from SARS-CoV-2;

“COVID-19 test” means either a COVID-19 antigen test or a COVID-19 NAATtest—

recognised in Bermuda by the Chief Medical Officer by notice set out onthe Ministry of Health website;

which shall be applied in such manner and at such times, in relation totravel to Bermuda, as the Chief Medical Officer shall determine in thenotice referred to in subparagraph (a);

“COVID-19 vaccination” means a full course of vaccination against the SARS -COV2 virus using a vaccine referred to in paragraph 6A(3) that has beenapproved by a stringent regulatory body;

“electronic monitoring bracelet” means an electronic wearable device fitted underthe supervision of a Health Officer on a person to whom paragraph 20(1) and(1A) applies to track such person’s compliance with quarantine requirementsunder that paragraph;

“local air ambulance” means a Bermuda-based aircraft operating for the purposeof airlifting persons from Bermuda for medical treatment overseas or returningto Bermuda, and references to a “crew member” of a local air ambulanceincludes any medical personnel on the flight;

“Ministry of Health website” means the Ministry of Health uniform resource locatoror internet address located at www.gov.bm/coronavirus;

“place of quarantine” includes a hotel or other place where payment is made foraccommodation and board;

“quarantine” means—

staying in a place of quarantine as a Health Officer may determine, whichmay be—

the house or accommodation in Bermuda at which the person to bequarantined resides; or

a place designated by a Health Officer as a place of quarantine;

complying during the period of quarantine with such health measures asa Health Officer may specify as necessary to limit or prevent the spread ofCOVID-19; and

complying with the requirements of paragraph 11.

“stringent regulatory body” means one of the following medical regulatory bodieswhich are recognised by the Ministry of Health—

UK Medicines and Healthcare products Regulatory Agency (MHRA);

European Medicines Agency;

Health Canada;

World Health Organisation (WHO);

“traveller wristband” means a non-electronic wristband fitted under thesupervision of a Health Officer on a person required to be fitted with a travellerwristband under Parts 3A and 4 of this Order.

COVID-19 antigen testIn this Order, “COVID-19 antigen test” means a verified or supervised rapid

point-of-care test to detect the presence of the viral proteins of SARS-CoV-2 conducted inaccordance with this paragraph.

A COVID-19 antigen test shall, upon being administered, be observed orsupervised by a registered laboratory, health service provider or health professional,either—

registered in Bermuda; or

whose professional status and practicing certificates can be verified withthe applicable regulatory authority in the jurisdiction where the test isundertaken.

The registered laboratory, health service provider or health professional thathas observed or supervised the administration of a COVID-19 antigen test as provided insubparagraph (2) shall set out on the official documentation of the laboratory, health serviceprovider or health professional the COVID-19 antigen test results, and such documentationshall further state—

the name, address, telephone number and email address of the laboratory,health service provider or health professional where the COVID-19 antigentest was conducted;

the date the COVID-19 antigen test was conducted;

the full name, date of birth and home address or valid personal emailaddress of the person tested for COVID-19;

the results of the COVID-19 antigen test conducted in relation to thatperson;

such other information as may be required by the Bermuda HealthCouncil.

In this paragraph, a “health service provider or health professional ” means ahealth care or telehealth care service or a health care professional that—

provides COVID-19 antigen tests that have been approved—

by the Bermuda Health Council; or

by the applicable regulatory authority in the jurisdiction where the testis undertaken; and

provides a visual verification of the COVID-19 antigen test—

as has officially been observed at its facility; or

that can confirm electronically that the test was conducted correctly.

Application of statutory requirementsAny person who enters Bermuda and is landed in Bermuda shall comply with

applicable requirements under the—

Quarantine Act 2017 and regulations and orders made under that Act;

Public Health Act 1949 and regulations and notices made under that Act.

Exceptions to requirements of OrderThe requirements of this Order shall not apply to a person who enters Bermuda

and is landed in Bermuda, who is—

a child under the age of two years, subject to subparagraph (2);

subject to subparagraph (3), a crew member of—

a cargo or commercial aircraft;

a cargo ship; or

an aircraft operating for the purpose of giving medical attention,delivering medical supplies to Bermuda, or airlifting a patient to or fromBermuda, which crew shall be taken to include any medical personnelon the flight;

a cruise ship;

a person who has written permission of the Quarantine Authority to enterBermuda, subject to subparagraph (4).

Subject to paragraph 21, the requirements of this Order shall not apply to aship in transit and the crew members of the ship.

Where a parent or guardian having charge of a child under the age of two yearsis required to be placed under quarantine under this Order, the child shall also be requiredto be placed under quarantine together with the parent or guardian.

The exception in subparagraph (1)(b) applies only with respect to a crewmember—

who is staying in Bermuda for a period of less than 24 hours; and

who, throughout that period, shall be in quarantine in the room at theaccommodations at which he is staying.

A crew member may continue to be exempt under subparagraph (3) if he isstaying in Bermuda for a period longer than 24 hours only in the case where—

he remains in quarantine on the ship he is travelling on;

he does not take shore leave; and

he complies with health requirements as may be set out in guidance on theMinistry of Health website.

The Quarantine Authority may grant written permission for a person to enterBermuda under subparagraph (1)(c) without the application of any requirement under thisOrder or subject to the application of such requirements thereof as the QuarantineAuthority may determine necessary for the purpose of—

the health needs of the person; or

the public interest.

PRE-DEPARTURE REQUIREMENTS

Pre-departure requirementsSubject to paragraph 13B, each person who is not ordinarily resident in

Bermuda and who intends to travel to Bermuda, whether or not the person intends to belanded in Bermuda shall, not less than 24 hours before departure for Bermuda, apply for

Travel Authorisation by completing the Travel Authorisation Form set out on the Ministryof Health website, and by complying with requirements to—

obtain a negative COVID-19 NAAT result as provided in paragraph 6; or anegative COVID-19 antigen result as provided in paragraph 6AA;

pay the Travel Authorisation fee, as provided in paragraph 7;

provide proof of the person’s health insurance cover, as provided inparagraph 8;

provide personal health information as stated on the Travel AuthorisationForm;

provide proof of having obtained a COVID-19 vaccination at least 14 daysprior to date of arrival in Bermuda, as provided in paragraph 6A.

Each person ordinarily resident in Bermuda who is returning to Bermuda shall,not less than 24 hours before departure for Bermuda—

apply for Travel Authorisation by completing the Travel Authorisation Formset out on the Ministry of Health website;

pay the Travel Authorisation fee, as provided in paragraph 7;

provide personal health information as stated on the Travel AuthorisationForm;

attach to the Travel Authorisation Form—

proof of having obtained a COVID-19 vaccination at least 14 days priorto the date of arrival in Bermuda, as provided in paragraph 6A; or

declaration of recovery from COVID-19 infection, as provided inparagraph 6B;

where paragraph 6AB applies, attach to the Travel Authorisation a copy ofthe test result obtained when departing from Bermuda.

A person referred to in subparagraph (2) who fails to comply with subparagraph(2)(a) shall, upon landing in Bermuda, pay the Travel Authorisation fee as provided inparagraph 7(2)(b).

A person referred to in subparagraph (2) who has not obtained a COVID-19vaccination as provided under paragraph 6A shall, when completing the TravelAuthorization form, confirm that he is able to quarantine for a period of not less than fourdays at the house or accommodation in Bermuda at which the person is residing.

A person not ordinarily resident in Bermuda shall not be granted TravelAuthorisation to depart for Bermuda if—

he has not complied with subparagraph (1);

he has a positive COVID-19 test result; or

the information he has provided on the Travel Authorisation Formindicates that he has symptoms of COVID-19 or of a communicable diseaseof the first or second category (as defined under section 66 of the PublicHealth Act 1949).

Each person entering Bermuda shall be subject to the requirements of Part 5of this Order.

A person seeking to be exempted under paragraph 13B from the requirementto be vaccinated as provided in paragraph 6A shall—

apply to the Quarantine Authority for such exemption not less than tendays before departure for Bermuda and as directed on the Ministry ofHealth website; and

submit his application for Travel Authorisation under eithersubparagraphs (1) or (2) of this paragraph only after he has received fromthe Quarantine Authority the exemption sought.

Conveyance operators to only board travellers with Travel AuthorisationNo conveyance operator departing for Bermuda shall permit any person who is

not ordinarily resident in Bermuda to board a conveyance with the intention of travellingto, and landing in, Bermuda who is not in possession of a Travel Authorisation as requiredunder paragraph 5(1).

A conveyance operator that contravenes subparagraph (1) shall be responsiblefor the immediate repatriation, and the full costs of repatriation, of the person who is notin possession of a Travel Authorisation.

Pre-arrival COVID-19 NAAT testEach person who intends to travel to Bermuda may be required, as may be

determined by the Quarantine Authority in consultation with the Chief Medical Officer, toundergo a COVID-19 NAAT test, which must be undertaken—

not more than four days before departure from the last port prior to arrivalin Bermuda, for a person travelling to Bermuda by sea under Part 3A;

not more than four days before arrival in Bermuda, for a person travellingto Bermuda by air under Part 4.

The determination of the Quarantine Authority under subparagraph (1) shallbe made by notice set out in the Ministry of Health website.

The COVID-19 NAAT test that must be undertaken as required undersubparagraph (1) shall either be—

the nasopharyngeal swab;

the oropharyngeal swab;

a saliva test; or

a nasal, anterior nares swab.

The COVID-19 NAAT test shall be performed by a registered laboratory whoseprofessional status and practising certificates can be verified with the applicable regulatoryauthority in the jurisdiction where the test is undertaken.

Where a person has a negative COVID-19 NAAT result after undergoing aCOVID-19 NAAT test as required in subparagraph (1), the person shall carry the test resultswith him when travelling to Bermuda and shall give the test results to a Health Officer uponrequest.

The negative COVID-19 NAAT result obtained for purposes of this paragraphshall be set out on the official documentation of the laboratory that conducted theCOVID-19 test, which documentation shall state—

the name, address, telephone number and email address of the laboratoryat which the COVID-19 NAAT test was conducted;

the date the COVID-19 NAAT test was conducted;

the full names, date of birth and home address or valid personal emailaddress of the person tested for COVID-19 NAAT;

the results of the COVID-19 NAAT test conducted in relation to that person.

Pre-arrival COVID-19 antigen testEach person who is vaccinated and who intends to travel to Bermuda under

Part 4 of this Order may be required, as may be determined by the Quarantine Authorityin consultation with the Chief Medical Officer, to undergo a COVID-19 antigen test (asdefined in paragraph 2A), which must be taken not more than two days before arrival inBermuda.

Where a person has a negative COVID-19 antigen result after undergoing aCOVID-19 antigen test as required in subparagraph (1), the person shall carry the testresults with him when travelling to Bermuda and shall give the test results to a HealthOfficer upon request.

No requirement for pre-arrival COVID-19 testing for vaccinated residents off islandfor less than three days

Paragraphs 6 and 6AA requiring pre-arrival COVID-19 testing shall not applyto a person who travels outside Bermuda and returns to Bermuda within three days of hisdeparture from Bermuda, provided that he—

is ordinarily resident in Bermuda;

provides proof of having obtained a COVID-19 vaccination at least 14 daysprior to the date of his departure from Bermuda.

Notwithstanding subparagraph (1), a person referred to in that paragraph shallprovide a copy of his test result obtained when departing from Bermuda as required inparagraph 5(2)(e).

Proof of obtaining COVID-19 vaccinationEach person who intends to travel to Bermuda—

who is ordinarily resident in Bermuda may be required, as may bedetermined by the Quarantine Authority in consultation with the ChiefMedical Officer, to provide proof of having obtained a COVID-19vaccination as provided in subparagraph (3);

who is not ordinarily resident in Bermuda shall provide proof of havingobtained a COVID-19 vaccination as provided in subparagraph (3).

Subparagraph (1)(b) does not apply to a minor child below the age of 12 years.

The determination of the Quarantine Authority under subparagraph (1)(a) shallbe made by notice set out on the Ministry of Health website.

The COVID-19 vaccination that may be required under subparagraph (1) shallbe a full course of a vaccine manufactured by a company referred to in the first column,and having the generic name as set out in the second column, of the following table—

Residents may provide declaration of recovery from COVID-19 infectionA person ordinarily resident in Bermuda who has not obtained a COVID-19

vaccination under paragraph 6A, may provide, in lieu of a certificate of vaccination, adeclaration of recovery from COVID-19 infection in accordance with subparagraph (2).

A declaration of recovery from COVID-19 infection shall include—

a positive COVID-19 test result by a registered laboratory based on asample from the person taken not more than 180 days prior to the date oftravel by the person to Bermuda; or

a letter from a registered healthcare provider confirming—

the COVID-19 positive diagnosis of the person no more than 180 daysprior to his travel to Bermuda; and

that the person has subsequently recovered from COVID-19.

A person to whom this paragraph applies who has not undergone a pre-arrivaltest referred to in paragraph 6 or 6AA shall, on arrival in Bermuda, undergo a COVID-19antigen test and on the fourth day after arrival as provided in paragraph 9.

Travel Authorisation feeEach person applying for Travel Authorisation as provided under paragraph 5,

shall pay the fee set out in subparagraph (2) by electronically forwarding the applicable feeas directed on the Ministry of Health website at the time the person is submitting the TravelAuthorisation Form.

The fee referred to in subparagraph (1) is $40 for each person two years andabove who has completed the Travel Authorization form as required under paragraph 5.

A person who fails to pay the Travel Authorization fee under subparagraph (2)(b) commits an offence as provided in paragraph 27.

Health insurance policyEach person who is not a resident of Bermuda and who intends to travel to

Bermuda may be required, at the time he is submitting the Travel Authorisation Form asprovided under paragraph 5, to also provide evidence of the person’s health insurance policythat includes insurance coverage for—

COVID-19 medical costs; and

full hospitalization, doctors’ visits, prescriptions and air ambulance.

PART 3

ARRIVAL PROCEDURES

Arrival COVID-19 testing for residents without pre-arrival test and for medicallyexempt non-residents

Subject to paragraph 18, each person, to whom subparagraphs (2) and (3)applies, that is landed in Bermuda shall—

be tested for COVID-19, in the case of a person referred to insubparagraphs (2) and (3), upon arrival—

at the airport, if the person has arrived by aircraft; or

in the port of entry, if the person has arrived by ship;

be further tested for COVID-19, in the case of a person referred to insubparagraph (2)(a)(ii) and (b) and subparagraph (3), on the fourth dayafter arrival;

additionally be tested for COVID-19, in the case of a person referred to insubparagraphs 2(b) and (3), on the tenth day after arrival.

Each person ordinarily resident in Bermuda who has not undergone a pre-arrival COVID-19 test as provided in paragraph 6 or 6AA, shall, on the days such personis tested as provided in subparagraph (1), be required to undergo—

a COVID-19 antigen test in accordance with paragraph 2A, in the case ofa person—

who is vaccinated as provided in paragraph 6A; or

who has recovered from COVID-19 infection and has obtained adeclaration of recovery from COVID-19 infection as provided inparagraph 6B;

a COVID-19 NAAT test as provided in paragraph 6, in the case of a personto whom subparagraph (a) does not apply.

Each person not ordinarily resident in Bermuda who has been exempted fromthe requirement to be vaccinated under paragraph 13B, shall be required to undergo—

a COVID-19 NAAT test as provided in paragraph 6, on arrival and on thefourth day after his arrival; and

a COVID-19 antigen test in accordance with paragraph 2A, on the tenthday after his arrival.

A person referred to in subparagraphs (2)(b) and (3), as part of the public healthsupervision requirements under Part 5 of this Order—

may, upon arrival, be fitted with a traveller wristband to be worn for theperiod of his quarantine until such time as he receives a negative result forthe COVID-19 NAAT test he has undergone;

shall, if fitted with a traveller wristband, comply with the instructions ofthe Health Officer regarding the terms specified for his monitoring and theuse of the traveller wristband.

Subject to paragraph 16, a person to whom this paragraph applies shall bereleased from quarantine—

in the case of a person referred to in subparagraph (2)(a), when such personreceives the initial negative COVID-19 test result for the test taken onarrival;

in the case of a person referred to in subparagraph (2)(b), as provided inparagraph 13(3);

in the case of a person referred to in subparagraph (3), as provided inparagraph 13B(5).

Bermuda undergo a COVID-19 antigen test, in accordance with paragraph 2A, and uponreceipt of a negative COVID-19 antigen test result, be permitted to disembark from the ship.

Where a crew member of a cargo ship or cruise ship is unable to undergo aCOVID-19 antigen test a day prior to arriving in Bermuda under subparagraph (1), he mayundergo a COVID-19 antigen test, in accordance with paragraph 2A, upon arrival inBermuda before disembarking the ship, and shall be permitted to disembark from the shipupon receipt of a negative COVID-19 antigen test result.

PART 3A

QUARANTINE REQUIREMENTS FOR TRAVELLERS TO BERMUDA BY SEA

Travel Authorization and quarantine for cruise ship passengersA cruise ship passenger who intends to travel by sea to Bermuda, whether or

not the person intends to be landed in Bermuda shall, before arriving in Bermuda, applyto travel to Bermuda by sea by complying with requirements to—

obtain a COVID-19 vaccination as provided under paragraph 6A;

subject to subparagraph (2), obtain a negative COVID-19 test result, asprovided under—

paragraph 6, not more than four days before his departure; or

paragraph 6AA, not more than two days before his departure,

from the port of embarkation prior to arrival in Bermuda; and

apply for Travel Authorisation by completing the Travel Authorisation (BySea) Form set out on the Ministry of Health website.

A person referred to in subparagraph (1), who after obtaining negativeCOVID-19 test results under subparagraph (1)(b)—

travels on the cruise ship for a period exceeding four days prior to arrivingin Bermuda; or

travels to a port or ports outside Bermuda prior to arriving in Bermuda,

shall obtain a negative COVID-19 test result as provided under paragraph 6AA, not morethan two days before his arrival in Bermuda.

A person referred to in subparagraph (1) who is not ordinarily resident inBermuda and who does not have proof of obtaining a COVID-19 vaccination underparagraph 6A, shall not be landed in Bermuda and shall be required to remain on the boathe is travelling on, in the case where—

he is over the age of 12 years; or

he is under the age of 12 years and he is accompanied by a parent orguardian who does not have proof of obtaining a COVID-19 vaccinationthereof.

A person referred to in subparagraph (1) who is ordinarily resident in Bermudaand who does not have proof of—

obtaining a COVID-19 vaccination as provided in paragraph 6A; or

Requirements for mariners, crew and passengers of crafts and superyachtsThis paragraph applies to a person who intends to travel by sea to Bermuda,

whether or not the person intends to be landed in Bermuda, who is—

a mariner;

a crew member of a craft or superyacht;

a passenger of a craft or superyacht.

A person referred to in subparagraph (1) shall, before arriving in Bermuda,apply to travel to Bermuda by sea by complying with requirements to—

obtain a COVID-19 vaccination as provided under paragraph 6A;

obtain a negative COVID-19 test result, as provided under—

paragraph 6, not more than four days before his departure; or

paragraph 6AA, not more than two days before his departure,

from the port of embarkation prior to arrival in Bermuda; and

apply for Travel Authorisation by completing the Travel Authorisation(Mariners) Form set out on the Ministry of Health website.

Subject to paragraph 13B(7), a person referred to in subparagraph (1) who isnot ordinarily resident in Bermuda and who does not have proof of obtaining a COVID-19vaccination under paragraph 6A, shall not be landed in Bermuda and shall be required toremain on the boat he is travelling on, in the case where—

he is over the age of 12 years; or

he is under the age of 12 years and he is accompanied by a parent orguardian who does not have proof of obtaining a COVID-19 vaccinationthereof.

A person referred to in subparagraph (1) who is ordinarily resident in Bermudaand who does not have proof of—

obtaining a COVID-19 vaccination as provided in paragraph 6A; or

Mandatory quarantine for travellers arriving from specified countriesThis paragraph applies to a person who enters Bermuda by commercial

aircraft, private jet or ship—

from a country specified by the Quarantine Authority on the Ministry ofHealth website; or

who has travelled through such country within the last 14 days prior tohis arrival in Bermuda,

Subject to subparagraph (4), a person to whom this paragraph applies shall beplaced in mandatory quarantine—

for a period not exceeding 14 days, subject to paragraph 18;

at a place of quarantine.

Subject to paragraph 14B(1), a person quarantined as required undersubparagraph (2) shall bear the cost for accommodation and board at the place ofquarantine.

A person under quarantine as provided in subparagraph (2) shall not departfrom the place of quarantine during the period of quarantine, except for the purpose ofattending at an official place of testing for COVID-19 as directed by a Health Officer.

Subject to paragraph 16, where the person receives the additional negativeCOVID-19 test result on or after the 14th day, he shall be released from quarantine and beprovided with a written notification of his test results.

Exemption from quarantine requirements for crew member of local air ambulanceSubject to the direction of the Chief Medical Officer, paragraphs 12, 12A and

who does not have proof of having recovered from COVID-19 infection andhaving obtained a declaration of recovery from COVID-19 infection underparagraph 6B; or

who has not been exempted from the requirement to be vaccinated underparagraph 13B,

shall, upon being landed in Bermuda, be placed in quarantine for a period not exceedingfour days as provided in this paragraph.

A traveller referred to in subparagraph (1) shall—

be placed in quarantine for a period of four days at the house oraccommodation in Bermuda at which the traveller is residing and thetraveller shall be released from quarantine if he receives a negative resultfor the COVID-19 NAAT test conducted on the fourth day after his arrivalin Bermuda; and

undergo a COVID-19 antigen test on the 10th day after his arrival inBermuda, subject to paragraph 18.

A traveller who arrives in Bermuda without a Travel Authorization completedwith information as provided in paragraph 5(3A) shall—

be placed in quarantine for a period not exceeding four days at his houseor accommodation in Bermuda;

be released from quarantine if he receives a negative result for theCOVID-19 NAAT test conducted on the fourth day after his arrival inBermuda; and

undergo a COVID-19 antigen test conducted on the 10th day after thetraveller’s arrival in Bermuda, subject to paragraph 18.

The Health Officer may, during the period a traveller is placed under quarantineunder subparagraph (1A) or (1BA) at his house or accommodation in Bermuda, fit anelectronic monitoring device and a traveller wristband on the traveller.

Each minor child under the age of 12 years who is travelling with the travellerand each minor child who shall be residing in the same house or accommodation inBermuda as a traveller—

shall be placed in quarantine in the same house, accommodation or placeof quarantine as the traveller for the applicable period of quarantine of thetraveller, in accordance with either subparagraph (1A), (1B) or (1BA); and

may be fitted with a traveller wristband.

Each person, including a minor child, that is fitted with a traveller wristbandunder this paragraph shall comply with the instructions of the Health Officer regarding theterms specified for his monitoring and the use of the traveller wristband.

A person to whom this paragraph applies shall bear the cost for accommodationand board at the place of quarantine.

Where a person to whom this paragraph applies receives a negative COVID-19NAAT test result on or after a period of four days, he shall—

be released from quarantine and be provided with a written notification ofhis test results; and

undergo a COVID-19 antigen test conducted on the 10th day after hisarrival in Bermuda, subject to paragraph 18.

Exemption from mandatory quarantine and quarantine requirements for exemptedtraveller

Subject to the other provisions under this paragraph, paragraphs 12A, 13 and14 shall not apply to a person ordinarily resident in Bermuda upon being landed inBermuda who is—

medically vulnerable as certified by a licensed physician, psychologist orlocal health insurer;

a caregiver that is accompanying a person under subparagraph (a);

a minor child below the age of 12 years, travelling—

unaccompanied; or

with a parent or a guardian who is vaccinated.

A person referred to in subparagraph (1) shall provide to a Health officer, uponarrival in Bermuda, such documentary proof of the exemption from mandatory quarantinereferred to in paragraph 5(6), which he received from the Quarantine Authority .

A person who has received an exemption from mandatory quarantine referredto in subparagraph (2) shall—

place himself in quarantine at the house or accommodation in Bermuda atwhich the person is residing, under such conditions as a Health Officer

may in writing specify, for a period not exceeding 10 days as from the dateof arrival in Bermuda;

be required to undergo a COVID-19 test on such day or days within theperiod not exceeding 10 days from the date of arrival in Bermuda, as theChief Medical Officer may determine as provided in paragraph 16(2)(a); and

conduct public health checks as provided under paragraph 16(2)(b) and asa Health Officer may in writing direct.

A person under quarantine as provided in subparagraph (3) shall not departfrom the place of quarantine during the period of quarantine, except as directed in writingby a Health Officer.

A minor child referred to in subparagraph (1)(c) shall, as part of the publichealth supervision requirements under Part 5 of this Order—

be fitted with a traveller wristband for the period of his quarantine;

undergo COVID-19 testing; and

comply with the instructions of a Health Officer regarding the termsspecified for his monitoring,

in accordance with the Ministry of Health website.

Where the person under quarantine as provided in subparagraph (3) receivesthe additional negative COVID-19 test result, he shall be released from quarantine and beprovided with a written notification of his test results.

Exemption from requirement to be vaccinated for person not ordinarily resident inBermuda

Subject to paragraph 5(6) and to the other provisions under this paragraph,paragraph 5(1)(e) shall not apply to a person who is not ordinarily resident in Bermuda,upon being landed in Bermuda, who is—

medically unable to have the COVID-19 vaccine as certified by a licensedphysician;

a minor child below the age of 12 years, travelling—

with a parent or a guardian who is vaccinated.

to be vaccinated referred to in paragraph 5(6), which he received from the QuarantineAuthority.

Notwithstanding paragraph 5(1)(a) and subject to paragraph 18, a personreferred to in subparagraph (1)(a) shall—

undergo a COVID-19 NAAT test with respect to—

a pre-arrival test, as provided under paragraph 6;

an arrival test, which shall be conducted after the person is landed inBermuda as provided under paragraph 9(3); and

a further test conducted on the fourth day after the person’s arrival inBermuda; and

undergo a COVID-19 antigen test, in accordance with paragraph 2A, onthe tenth day after the person’s arrival in Bermuda.

A minor child referred to in subparagraph (1)(b) shall undergo a pre-arrivalCOVID-19 NAAT test under subparagraph (3)(a)(i).

A person referred to in subparagraph (1)(a) shall, after testing as required insubparagraph (3)—

place himself in quarantine at the accommodation at which he is residingin Bermuda until such time as he shall receive results of the COVID-19NAAT testing conducted on the fourth day as provided under subparagraph(3)(a)(iii);

upon receipt of a negative COVID-19 NAAT result, be released fromquarantine and be provided with a written notification of his test results,subject to the results for the COVID-19 antigen test conducted undersubparagraph (3)(b).

Each minor child under the age of 12 years who is travelling with a personreferred to under subparagraph (1)(a) and each minor child who shall be residing in thesame house or accommodation in Bermuda as such person—

shall be placed in quarantine in the same house or accommodation as theperson for the applicable period of quarantine, in accordance withsubparagraph (5);

may be fitted with a traveller wristband.

A person not ordinarily resident in Bermuda who intends to travel by sea to,and be landed in, Bermuda under paragraph 11B, who seeks to be exempted from therequirement to be vaccinated as provided in subparagraph (1)(a), shall—

comply with subparagraph (2), requiring documentary proof of theexemption from the requirement to be vaccinated referred to in paragraph5(6);

Mandatory quarantine for travellers refusing to comply with Part 5A person who, upon arrival in Bermuda, refuses to be tested and to comply with

public health supervision requirements as provided in Part 5, shall be placed inquarantine—

for a period not exceeding 14 days, subject to paragraph 18;

at a place of quarantine.

A Health Officer shall, during the period a traveller is placed under quarantineunder subparagraph (1), fit an electronic monitoring device and a traveller wristband on thetraveller.

PART 5

PUBLIC HEALTH SUPERVISION REQUIREMENTS FOR TRAVELLERS

Public health supervision during first 14 days after arrivalSubject to paragraph 18, each person who is landed in Bermuda shall comply

with public health supervision requirements for a period not exceeding 14 days after hisarrival in Bermuda.

Public health supervision shall include conducting—

COVID-19 tests on such day or days in relation to a person referred to inparagraph 11A, 11B, 12, 12A, 12B, 12C, 13, 13A or 14, as the ChiefMedical Officer may determine by notice set out on the Ministry of Healthwebsite.

public health checks as directed by a Health Officer,

and reporting the findings of the tests and checks conducted as provided in subparagraph(3).

The COVID-19 NAAT tests and the public health checks required undersubparagraph (2) shall be communicated between the person under public healthsupervision and a Health Officer—

by means of an online application; or

by such other means as the Health Officer may determine.

Where a person conducts a COVID-19 antigen test required undersubparagraph (2), and receives a positive COVID-19 antigen test result, he, the registeredlaboratory, and the health service provider or health professional shall notify a HealthOfficer by such means as the Health Officer may determine.

Online application to be installed in mobile deviceFor the purposes of the public health checks referred to in paragraph 16, a

person to whom that paragraph refers shall have the online application to be used for publichealth checks installed—

in his mobile device; or

in a mobile device rented from the Ministry of Health, in the case where theperson does not have a suitable mobile device or does not wish to installthe application in his mobile device.

The mobile device referred to in subparagraph (1)(b), may be rented at a fee of$50 from the Ministry of Health for the duration of the period of public health supervisionas provided in paragraph 16.

following COVID-19 tests conducted under Parts 3, 4 and 5 of this Order(or COVID-19 tests conducted at any other time) receives a positiveCOVID-19 result;

is a close contact of a person who has a positive COVID-19 result; or

is symptomatic,

shall be subject to public health supervision, active monitoring or isolation as providedunder Part 3 of the Public Health (COVID-19) Regulations 2020.

A person referred to under subparagraph (1)—

may be placed under public health supervision, active monitoring orisolation for a period not exceeding 14 days—

at such person’s home or accommodation; or

at a place approved by the Quarantine Authority; and

if found not improved after treatment under subparagraph (a), may beplaced under isolation for an extended period at a place approved by theQuarantine Authority until such time as the person is found to have anegative COVID-19 result.

Cost of treatment and accommodationA person referred to in paragraph 18 who is made subject to public health

Travellers required to be fitted with electronic monitoring deviceA person referred to in paragraph 18 may, for the purpose of monitoring his

public health supervision, active monitoring or isolation as provided under Part 3 of thePublic Health (COVID-19) Regulations 2020, be required to be fitted with an electronicmonitoring bracelet.

A person referred to in paragraphs 4(2), 13 or 14 may, during the period of hisquarantine, be required to be fitted with an electronic monitoring bracelet, as theQuarantine Authority may in writing determine.

A person fitted with an electronic monitoring bracelet under this paragraphshall comply with the instructions of the Health Officer regarding—

the terms specified for his monitoring; and

the use of the electronic monitoring bracelet.

PART 7

SHIP IN TRANSIT

Ship in transitA conveyance operator of a ship and the crew who, for purposes of regulation

8 of the Quarantine (Maritime and Air) Regulations 2017, have entered Bermuda on transitshall—

anchor or berth the ship at a location approved by the QuarantineAuthority;

remain confined to the ship for the duration of the transit stop, except inthe case of crew transfer; and

clearly display on the ship a yellow quarantine flag.

The conveyance operator shall forthwith notify Bermuda Maritime OperationsCentre or Bermuda Radio, on marine VHF Channel 16, in the case where the ship inquarantine is required to shift anchorage as a result of—

weather disturbances; or

other circumstances (such as where an anchor drags or does not hold),

and the Bermuda Maritime Operations Centre shall advise the Quarantine Authority anddirect the ship in accordance with any additional requirements the Quarantine Authoritymay impose.

The conveyance operator who, for purposes of the ship and crew, needs toperform crew transfer or take on fuel, food or water shall notify Bermuda MaritimeOperations Centre of the need.

Form and application of quarantine penalty ticketIn accordance with section 11C(3) of the Act, a quarantine penalty ticket shall

contain information as provided in paragraphs 21D and 21E of this Order and be in theform as set out under the “Publications and Forms” section on the website:www.bermudapolice.bm/.

The quarantine penalty ticket shall apply to an offence referred to underparagraph 27 of this Order and listed in column 1 of the Schedule.

Procedure for issue and delivery of quarantine penalty ticketA police officer who has determined, pursuant to section 11E of the Act, to issue

a quarantine penalty ticket to any person shall ascertain the identity of such person byrequesting the name, address and date of birth of the person.

A police officer issuing a quarantine penalty ticket shall—

complete the ticket and affix his signature on the summons portion of theticket; and

deliver the summons portion of the ticket personally to the person to whomthe quarantine penalty ticket has been issued.

The police officer shall request the person to whom a quarantine penalty tickethas been issued to enter his signature on the information portion of the ticket and suchsignature shall be sufficient proof of receipt of the quarantine penalty ticket by that person.

The police officer shall direct the person to whom a quarantine penalty tickethas been issued regarding the following information on the ticket—

the date by which the penalty is to be paid and the address of themagistrates’ court where payment is to be made; and

the requirement for the person to attend the magistrates’ court on a dateand time as stated in the quarantine penalty ticket, with respect to a personwho does not pay the penalty within 28 days after receiving the ticket orwithin an extended period of time as may be granted under section 11G ofthe Act.

Information of the offenceIn accordance with section 11C of the Act, the information portion of the

The information portion of a quarantine penalty ticket shall further—

give reasonably detailed information or particulars of the circumstancesalleged to constitute the offence;

state that proceedings will not be instituted for the offence if payment ofthe penalty is made within a period of 28 days from the date of issue of thequarantine penalty ticket;

specify the amount of the penalty.

Every quarantine penalty ticket information shall be—

signed by the police officer issuing the ticket;

signed by the informant and sworn before a justice of the peace.

A quarantine penalty ticket information need not be sworn to before thesummons portion is delivered and the informant need not be the same person as issued thesummons.

List of offences, descriptions and penaltiesFor the purposes of this Order and with respect to the Schedule—

a quarantine penalty ticket may be issued for the offence of breach of thisOrder as provided in column 1 of Part 1;

the penalty for breach of the offence under subparagraph (a) is the amountset out in column 2 of Part 1;

the offence under subparagraph (a) for which a quarantine penalty ticketmay be issued includes the offences that are contrary to the provisions ofthis Order, as listed in column 1 of Part 2;

the description of an offence that is contrary to a provision listed in column1 of Part 2 is the description set out in column 2 of Part 2.

MISCELLANEOUS

Persons unable to quarantineA person who has satisfied a Health Officer that he is unable to comply with

quarantine requirements under this Order shall—

comply with such directions as the Health Officer may give; and

quarantine to the best of his ability as directed by the Health Officer.

Traveller who fails to comply with requirements to be quarantinedAny person not belonging to Bermuda and not ordinarily resident in Bermuda who

has arrived by aircraft or ship, and who—

has failed to apply for, or has given false information when applying for,the Travel Authorisation under paragraph 5; or

refuses to undergo quarantine as required by a Health Officer under thisOrder,

shall be placed in quarantine at a place designated by the Health Officer for the purposeuntil such time as he is able to board a returning flight or ship to his place of origin andsuch person shall bear all costs for accommodation and board while on quarantine.

Detention of persons refusing to undergo quarantineFor the avoidance of doubt, where a person not belonging to Bermuda and not

ordinarily resident in Bermuda fails to comply with the requirements of a Health Officerunder this Order, Regulations 19(2) and 20 of the Quarantine (Maritime and Air)Regulations 2017 shall apply.

Duty of Public Health OfficerA Public Health Officer responsible for a person quarantined or placed in public

health supervision, active monitoring or isolation under this Order, shall notify the personas provided under regulation 12 of the Public Health (COVID-19) Regulations 2020.

Avoiding serious risk to public healthWhere a person is placed under public health supervision, active monitoring or

isolation for an extended period as provided in paragraph 18(2)(b) of this Order, suchplacement of the person must be expressed by the Public Health Officer as necessary toprevent the risk of transmission of COVID-19 constituting a serious risk to public health.

fails to complete, or gives false information when completing, the TravelAuthorisation Form under paragraph 5;

fails to comply with the requirement to pay the Travel Authorisation feeunder paragraph 7(2)(b);

refuses to, or without reasonable excuse omits, to comply with arequirement to quarantine as directed by a Health Officer or other personacting under such authority; or

subject to subparagraph (2), otherwise, without reasonable excuse,contravenes the provisions of this Order,

commits an offence under section 11 of the Quarantine Act 2017 and is liable to the penaltyunder that section.

Any person who, without reasonable excuse, removes or causes to be removeda traveller wristband fitted on the person under this Order—

commits an offence under section 11 of the Quarantine Act 2017 and isliable on summary conviction to a fine not exceeding $500; and

shall, upon being discovered to have removed the traveller wristband, beplaced in quarantine for a period not exceeding 14 days and be fitted withan electronic monitoring bracelet during that period.

Revocation of Order and SavingsThe Quarantine (COVID-19) (No. 2) Order 2020 is hereby revoked.

Where under the Order referred to in subparagraph 1, a determination,designation or decision was made—

by the Quarantine Authority, such determination, designation or decisionshall continue to have force as if made by the Quarantine Authority underthis Order;

by a Public Health Officer, Health Officer or medical practitioner, suchdetermination, designation or decision shall continue to have force as ifmade by the Public Health Officer, Health Officer or medical practitionerunder this Order.
