Tacay v. RTC of Tacum, Davao Del Norte

Facts:An action for recovery of possession and damages was filed by Pineda. Tacay moved to dismiss the case on the ground that the court has not acquired jurisdiction over the case.

Issue:Whether or not the court acquires jurisdiction over the case even if the complaint does not specify the amount of damages.

Ruling:Yes. The SC ruled that the court acquired jurisdiction over the case which involves real property upon payment of the related fees. However, the SC also ruled that it may not have acquired jurisdiction over the accompanying claims for damages due to lack of specification.The petition is DISMISSED.
