SIR—You are respectfully requested to attend a meeting of the Board of Street Opening and Improvement of the City of New York, to be held in the Mayor's office in the City Hall, on Friday, the 24th day of December, 188G, at 2 o'clock P. M., to consider the proposed widening and extension of Elm street, and any unfinished business now before the Board.

The reading of the minutes of the meetings of October 21 and December io, 1886, was upon motion dispensed with.

The Secretary reported that he had caused to be published in the CITY RECORD, " New York Times," " New York News," " New York Evening Post," " Staats Zeitung " and "Journal of Commerce," a notice requesting all property-owners and persons interested in the proposed widening and extension of Elm street, from Centre street to Fourth avenue, as shown upon a certain map on file in the office of the Department of PublicWorks, to attend at the Mayor's office, on Friday, Decem-her 24, 1886, at 2 o'clock I'. hl., when they would be heard upon the proposed improvement.

The Secretary further reported that he had transmitted to the Department of Public Parks petitions of property-owners praying that proceedings be taken to acquire title to the land required for the widening of Fifth avenue, between One Hundred and Ninth and One Hundred and Eleventh streets, under chapter 421 of the Laws of 1886 ; for the opening of Bremer avenue, between Devoe street and Birch street, and for the opening of Jennings street, from Union avenue to Stebbins ave-nue, with a request for an expression of the views of the said Department of Public Parks upon the said petitions ; also a copy of a resolution adopted by the Board on December to, 1886, requesting the Department of Public Parks to furnish the Board with map, plan and profile showing Melrose avenue, eighty feet in width, between One Hundred and Forty-ninth and One Hundred and Sixty-third streets, instead of one hundred feet, as heretofore requested ; to the Commissioner of Public Works copies of resolutions adopted by the Board on December ro, 1886, requesting an expression !, of his views as to how far east of Second avenue the proposed opening of One Hundred and Twenty-seventh street should extend ; as to the feasibility of the proposed grade of One Hundred and Fortieth street, between Convent avenue and Avenue St. Nicholas, and as to the advisability of altering the map or plan of the city by laying out certain new streets and avenues in that portion of the city bounded by Uyckman street, Prescott avenue and Harlem river ; to the Counsel to the Corporation copies of resolutions adopted by the Board on Decemb-,r to, 1886, requesting his opinion as to whether the powers conferred upon the Department of Public Parks by section 972 of chapter 410 of the Laws of 1882, were transferred to this Board by chapter 185 of the Laws of 1885 ; as to whether the Board has power, under section 673 of chapter 410 of the Laws of 1882, to file maps classifying streets or avenues which have been heretofore laid out by the Park'Department, but not classified on the maps filed by them ; as to whether the Board has power to modify Corlears Hook Park, as heretofore laid out by the Board, pursuant to the provisions of chapter 529 of the Laws of 1884 ; as to whether the Board has power, under chapter 185 of the Laws of 1885, to establish the grades of streets, avenues, etc., which have been heretofore laid out by the Department of Public Parks in the Twenty-third and Twenty-fourth Wards, but grades not established or shown upon maps filed by the said Department ; also copies of resolutions requesting him to take the necessary proceedings in the name of the Mayor, Aldermen and Commonalty of the City of New York, to acquire title for the use of the public to the land required for the opening of Forest avenue, from Home street to Boston road, Dyckman street, from Harlem river to Kingsbridge road, and One Hundred and Thirty-ninth street. from Tenth avenue to Boulevard.

The Mayor laid before the Board the following communication from the Committee upon the proposed widening and extension of Elm street

street, hereby request the Board to pass a resolution empowering the Commissioner of Public Works to acquire title to tite man made by Robert L. Waters.

Upon motion, consideration of the communication was laid over.

The Board then listened to extended argument upon proposed widening and extension of Elm street from Centre street to Fourth avenue, Messrs. Schlesinger, Smith, and Stetson arguing in favor of the proposed widening, and Messrs. Cruger, Van Zant, Wetherby, Hunt and Scribner in opposition. Messrs. Christie, John Hays and Hamilton Wilcox favor the proposed widening if the city is made to bear the whole or a large portion of the expenses attending the widening.

Further consideration of the matter was, upon motion, laid over to the next meeting.

REPORT:

From the Department of Public Parks, advising the initiation of proceedings to acquire title to the land required for the widening of Fifth avenue, between One Hundred and Ninth and One Hundred and Eleventh streets, pursuant to the provisions of chapter 421 of the Laws of 1886.

The President of the Department of Public Parks offered the following resolution : Resolved, That this Board, deeming it for the public interest so to do, hereby respectfully

request the Counsel to the Corporation to take the necessary proceedings in the name of the Mayor, Aldermen and Commonalty of the City of New York to acquire title for the use of the public to ~ the land required for the widening of Fifth avenue, between One Hundred and Ninth and One Hundred and Eleventh streets, pursuant to the provisions of chapter 421 of the Laws of 1886.

The resolution was adopted by the following vote : Affirmative—The Mayor, the Deputy Commissioner of Public Works, the President of the De.

The Secretary read an opinion from the Counsel to the Corporation, under date of December 20, x886, advising the Board that they had power, under the provisions of the Consolidation Act chapter Oro of the Laws of 1882, and chapter 360 of the Laws of 1883, to close Bogart street. between Thirteenth avenue and West street, by giving the notice and filing the map required by the said acts.

The Deputy Commissioner of Public Works offered the following resolution Resolved, That this Board deem it for the public interest that Bogart street, between Thirteenth

avenue and West street, be closed, and that the Commissioner of Public Works be and he is hereby respectfully requested to furnish this Board two similar maps for filing, showing the said Bogart street, between Thirteenth avenue and West street, as close(] and discontinued, also a technical descrip-tion of the said street so closed.

The resolution was adopted by the following vote Affirmative—The Mayor, the Deputy Commissioner of Public Works, the President of the

Department of Public Parks, the President of the Board of Aldermen-4.

A petition of the Port Morris Land and Improvement Company, praying that East One Hundred and Thirty-fourth street, between St. Ann's avenue and Southern Boulevard, be legally laid out upon the map of the city, was, upon motion, referred to the Department of Public ]'arks with a request for an expression of the views of the said Department upon the petition.

The President of the Department of Public Parks offered the following resolution Resolved, That this Board, deeming it for the public interest so to do, hereby fix, establish an]

Upon motion laid over, pending the receipt of the opinion of the Counsel to the Corporation, which has been heretofore requested, as to the power of the Board in the premises.

The President of the Department of Public Parks offered the following resolution Resolved, That this Board, deeming it for the public interest so to do, hereby respectfully

request the Counsel to the Corporation to take the necessary proceedings in the name of the Mayor, Aldermen and Commonalty of the City of New York to acquire title, wherever the same has not been heretofore acquired, for the use of the public to the lands required for Marcher avenue (although not yet named by proper authority), from Jerome avenue to Featherbed lane, in the Twenty third and Twenty-fourth Wards of said city, the avenue being designated as a street of the first class.

The Secretary presented the following report, which was accepted and ordered on file

7b the Board of Street Opening and Inr/iravemeut of the City of Neu, York.

I respectfully report that on the 17th day of December, 1886, pursuant to a resolutil,n adopted by this Board on December to, 1886, I caused to be filed in the office of the Secretary of State of the State of New York, in the office of the Counsel to the Corporation, in the office of the Register of the City and County of New York, in the office of the Department of Public Parks, and in the office of the Department of Public Works, maps showing Ninety-ninth street, between Third and Fourth avenues ; One Hundred and Eighty-second street, between the lines of Tenth avenue and King.-bridge road, and certain new streets and avenues, between hdgecombe and Kingsbridge roads and One Hundred and Fifty-ninth and One Hundred and Seventy-fifth streets, laid out, opened and extended by this Board on the loth day of December, 1886, receipts for which are hereto annexed.

The Secretary reported that it had been impossible to carry out the provisions of the resolution adopted by the Board on the Toth day of December, 1886, providing for the filing of a map, plan and profile showing Audubon avenue, from Kingsbridge road to One Hundred and Fifty-eighth street, in the office of the Department of Public Parks for the inspection of property-owners, and a publica-tion of a notice of the said filing, as he had been informed by the Topographical Engineer of the De-partment of Public Parks that no such map or plan and profile, as mentioned in the said res'alution, had been prepared by the said Department of Public Parks.

At a special meeting of the Board of Docks, held March 15, 1887. Present—Commissioners Stark and Matthews ; absent—Commissioner Koch. The Board met for the purpose of receiving estimates for painting shed on Pier, new 43, North

river, and repairing its metal covering, advertised to be opened this day at 12 o'clock at. A representative of the Comptroller was present. Six estimates were received, as follows :

The following resolution was, On motion, adopted: Resolved, That the contract opened this day for painting the shed on Pier, new 43, North

river, and repairing its metal covering, be and hereby is awarded to John L. Egan, he being the lowest bidder, u ion the approval of the sureties by the Comptroller of the City.

Bidders must satisfy themselves, by personal ex-amination of the location of the proposed work, and by such other means as they may prefer, as to the accuracy of the foregoing Engineer's estimate, and shall not, at any time after the submission of an estimate, dispute or com-plain of the above statement of quantities, nor assert that there was any misund.rstanding in regard to the nature or amount of the work to be done.

2d. Bidders will be required to complete the entire work, to the satisfaction of the Department of Docks, and in substantial accordance with the specifications of the contract and the plans therein referred to. No extra compensation beyond the amount payable for the seseral classes of the work before mentioned, whic/t shall be a ttually perfornted, at the prices therefor, to be specified by the lowest bidder, shall be due or payable for the entire work.

The work to be done under the contract is to be com-menced within five days after the date of the contract, and all the work contracted foristo be fully completed on or before the first day of July, 1887, and the damages to be paid by the contractor for each day that the con-tract may be unfulfilled after the time fixed for the fulfillment thereof has expired, are, by a clause in the contract, determined, fixed and liquidated at Fifty Dollars per day.

All the material excavated is to be removed by the contractor, and deposited, in all respects, according to law, and any material dredged, not so deposited, shall not be paid for.

Bidders will state in their estimates a price for the whole of the work to be done, in each class in conformity with the approved form of agreement and the snecifications therein set forth, by which prices the bids will be tested. 'These prices are to cover all expenses of every kind involved in or incidental to the fulfillment of the contract, including any claim that may arise through delay from

'any cause, in the performing of the work thereunder. The award of the contract, if awarded, will be made to the bidder who is the lowest for doing the whole of the work comprised in the two classes, and whose estimate is regular in all respects.

Bidders will distinctly write out, both in words and in figures, the amount of their estimates for doing each class ofthe work.

The person or persons to whom the contract may be awarded will be required to attend at this office with the sureties offered by him or them, and execute the contract within five days from the date of the service of a notice to that effect ; and in case of failure or neglect so to do, he or they will be consi lered as having abandoned it, and as in default to the Corp oration ; and the contract will be readvertised and relet, and so on until it be accepted and executed.

Bidders are required to state in their estimates their names and places of residence ; the names of all persons interested with them therein ; and if no other person be so interested, the estimate shall distinctly state the fact, also that the estimate is made without any connection with any other person making an estimate for the same work, and that it is in all respects fair and without collu-sion or fraud ; and also that no member of the Common

e security required for the completion of this contract, over and above ail his debts of every nature, and over and above his liabilities, as bail, surety or otherwise; and that he has offere9 himself as a surety in good faith and with the intention to execute the bond required by section rs of chapter 7 of the Revised Ordinances of the City of New York, if the contract shall he awarded to the persor or persons for whom he consents to become surety. The adequacy and sufficiency of the security offered, to be approved by the Comptroller ofthe City of New York.

No bid or estimate will be considered unless accont-panied by either a certified check upon one of the Stair or National Banks of the City of New York, drawn to the order of the Comptroller, or money to the amount of five per confirm of the amount of the security required for tha faithful performance of the contract. Section roe.* That every owner, lessee,tenant, and occupant of any stall, stable, or apartment in wl ich any horse, cattle or swine, or any other animal shall be kept, or of any place in which manure or any liquid discharge of such animals shall collect or accumulate, within the built-up portion of said city, shall can e said liquid and manure to be at once removed to some proper place, and shall at all times keep or cause to be kept such stalls, stables and apartments, and the drainage, yard and appurtenances thereof, in a cleanly and whoiesome con- diticm, so that no offensive smell detrimental to health shall be allowed to escape there'n)m ; and when within three hundred feet of any tccupied dwelling-house, or of any matmfactory where more than file pi rsons are employed, the removal from the stables shall not be made, nor shall the manure or refuse from the stable be allowed to remain on any street or place near such stable, any time between 8 o'clock A. nL and 11 o'clock P. M., taithout a permit from this Board. Whenever there shall be it cart-load of manure un any prerui,es it shall be immediately removed, unless it be pressed or baled, She Sanitary Superintendent may issue permits for and regulate the removal of bales or pressed manure upon conditions scued in such permits, which shall prescribe not m re than ten days for such removal, and shall pre-vent a nuisance. No manure vault under the sidewalk shall be built or used. No manure vault or receptacle outside of a stable shall be built or used on any premises, except putsuaut to the terms of a permit granted therefor by the Health Department.

TERMS OF SALE. The rental shall be paid monthly in advance, and the

highest bidder shall be required to pay the aurbonex1'-fee and one month's rent, or one-twelfth of the amount of the yearly runt bid.by him at the time and place of sale.

The amount so paid for one month's rent shall be for-feited if the successful bidder does not execute the lease and bond within fifteen days after the sale; and the C(•mptroller is auth rized, at his option, to resell the premises bid off by any person failing to comply with this cond'tion of the sac ; and the person so failing to comply shall be liable for any deficiency that may result from such resale.

IN PURSUANCE OF SECTION 997 OF THE "New York City Consolidation Act of r88z," the

NOTICE TO CROTON WATER CONSUMERS.

NUMEROUS APPLICATIONS HAVE BEEN made to this Department by citizens claiming

reductions or rebates on bills for water supplied through meters. nn the alleged ground of leakage caused by de-fective plumbing and worn-out service pipes, or by willful waste of water by tenants allowing the faucets to be turned on in full force in water-closets, sinks, etc., with-out the knowledge or consent of the owners of the prem-ises. . The main object of tl:e use ofwater-meters is to enable this Department to detect and check the useless and un-warrantable waste of an element so valuable and essential to the health and comfort of all the citizens, and this ob-ject can only be accomplished by enforcing payment for the water wasted.

Under the law all charges for water supplied through meters are a lien against the respective premises, and the law therefore holds the owner of the premises re-sponsible for the amount of water used or wasted.

Notice is therefore given to all householders that, in all further applications for reduction of water rents, no allowance will be made on account of waste of water occurring through leaks, from defective service pipes or plumbing, or wasteful use of water by tenants or occu-pants of buildings, though such leakage or waste may have occurred without the knowledge or consent of the owners of the buildings.

House-owners are further notified that whenever their premises become vacant, and are likely to remain vacant, they must notify this Department in writing, and that unless this requirement is complied with no deductions in extra water rents will he allowed for any portion of one year.

Those who have not answered as to their liability, or proved permanent exemption, well receive a "jury en-rollment notice," requiring them to appear before me this year. Whether liable or not, such notices must be answered in person, if possible, and at this office only) under severe penalties. If exempt, the party must bring proof of exemption ; if liable, he must also answer in person, giving full and correct name, residence, etc. etc. No attention paid to letters.

Persons " enrolled " as liable must serve when called or pay their fuses. No mere excuse will be allowed or interference permitted. The fines if unpaid will be en-tered as judgments upon the property of the delinquents.
