RECOMMENDATION:

THAT the report dated January 7, 2020 titled Coastal Marine Management Plan Working Group – Interim Report be received for information.

9. Climate Emergency – Bylaw and Policy Amendments

(File: 0332-03 / 1610-20-5054/5055/5056 / 0282-20-0014)

Bylaws are passed by a simple majority affirmative vote unless otherwise noted.

RECOMMENDATION:

THAT opportunities for consultation on the proposed Official Community Plan amendment, with persons, organizations, and authorities, as outlined in the report from the Senior Planner dated January 21, 2020, be endorsed as sufficient consultation for purposes of section 475 of the Local Government Act.

NOTE: Each reading of an Official Community Plan bylaw must receive an affirmative vote of a majority of all Council members (4 members) in order to proceed (Local Government Act, s. 477)

RECOMMENDATION:

THAT proposed “Official Community Plan Bylaw No. 4985, 2018, Amendment Bylaw No. 5054, 2020” be read a first time.

RECOMMENDATION:

THAT proposed “Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 5055, 2020” be read a first time.

THAT proposed “Official Community Plan Bylaw No. 4985, 2018, Amendment Bylaw No. 5054, 2020" and proposed "Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 5055, 2020" be presented at a public hearing scheduled for February 25, 2020 at 6 p.m. in the Municipal Hall Council Chamber, and that statutory notice be given of the scheduled public hearing.

RECOMMENDATION:

THAT proposed “Building Bylaw No. 4400, 2004, Amendment Bylaw

No. 5056, 2020" and proposed "Sustainable Buildings Policy 0014" be presented

at a public meeting scheduled for February 25, 2020 at 6 p.m. in the Municipal

Hall Council Chamber, to be held concurrently with the public hearing scheduled

for February 25, 2020 at 6 p.m. in the Municipal Hall Council Chamber, and that

notice be given of the scheduled public meeting.

RECOMMENDATION:

THAT the Province of B.C. be requested to include the District of West Vancouver as a municipal partner in the CleanBC Better Homes Program.

RECOMMENDATION:

THAT the Province of B.C. be requested to include the District of West Vancouver as a participating local authority in the Tall Wood Early Adoption Initiative.

10. Proposed Road Closure and Removal of Highway Dedication Bylaw No. 5052, 2020 at Uplands Way in Rodgers Creek, Area 6 (File: 1610-20-5052)

RECOMMENDATION:

THAT

1. Proposed “Road Closure and Removal of Highway Dedication Bylaw No. 5052, 2020” be read a first time; and

2. Staff be directed to issue statutory notices of road closure and removal of highway dedication in connection with proposed “Road Closure and Removal of Highway Dedication Bylaw No. 5052, 2020”.

11. Cancellation and Rescheduling of Public Hearing regarding Proposed Heritage Designation Bylaw No. 5053, 2020 (1143 Eyremount Drive – the Forrest-Baker House) (File: 1610-20-5053)

RECOMMENDATION:

THAT the public hearing scheduled for March 9, 2020 at 6 p.m. regarding

proposed “Heritage Designation Bylaw No. 5053, 2020” (1143 Eyremount Drive –

the Forrest-Baker House), be cancelled.

RECOMMENDATION:

THAT proposed “Heritage Designation Bylaw No. 5053, 2020” be presented at a

public hearing scheduled for March 10, 2020 at 6 p.m. in the Municipal Hall

Council Chamber, and that statutory notice be given of the scheduled public

hearing.

RECOMMENDATION:

THAT a special Council meeting be called for March 10, 2020 in the Municipal

Hall Council Chamber, to be held at 6 p.m. or immediately following the close of

the public hearing and concurrent public meeting scheduled for 6 p.m. on

March 10, 2020, whichever is later.

BYLAWS

12.1. Proposed: Heritage Revitalization Agreement Bylaw No. 5030, 2019; and Heritage Designation Bylaw No. 5031, 2019 (985 Duchess Avenue – the Boyd House) (File: 1610-20-5030/5031)

RECOMMENDATION:

THAT the memorandum from the Senior Community Planner dated February 5, 2020, titled Modifications to Heritage Revitalization Agreement Bylaw No. 5030, 2019 and to associated Heritage Designation Bylaw No. 5031, 2019 – 985 Duchess Avenue, be received for information.

The proposed bylaw received first reading at the December 2, 2019 Council meeting, was the subject of a public hearing held and closed on January 13, 2020, and received second reading at the January 13, 2020 Council meeting. As the public hearing has closed Council is not permitted to receive any further submissions regarding the proposed bylaw.

RECOMMENDATION:

THAT proposed “Heritage Revitalization Agreement Bylaw No. 5030, 2019” be modified by replacing Section 1.8 of Schedule A to the proposed bylaw with the text contained in Appendix A of the memorandum from the Senior Community Planner dated February 5, 2020, titled Modifications to Heritage Revitalization Agreement Bylaw No. 5030, 2019 and to associated Heritage Designation Bylaw No. 5031, 2019 – 985 Duchess Avenue.

RECOMMENDATION:

THAT proposed “Heritage Revitalization Agreement Bylaw No. 5030, 2019” be read a third time as modified.

The proposed bylaw received first reading at the December 2, 2019 Council meeting, was the subject of a public hearing held and closed on January 13, 2020, and received second and third reading at the January 13, 2020 Council meeting. As the public hearing has closed Council is not permitted to receive any further submissions regarding the proposed bylaw.

RECOMMENDATION:

THAT third reading of proposed “Heritage Designation Bylaw No. 5031, 2019” be rescinded.

RECOMMENDATION:

THAT proposed “Heritage Designation Bylaw No. 5031, 2019” be modified by deleting the text that reads “attached as Schedule A to this bylaw” from section 6.1.

RECOMMENDATION:

THAT proposed “Heritage Designation Bylaw No. 5031, 2019” be read a third time as modified.

12.2. Proposed: Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 5044, 2019;

Official Community Plan Bylaw No. 4985, 2018, Amendment Bylaw No. 5045, 2019; Phased Development Agreement Authorization Bylaw No. 5041, 2019; and Development Permit 19-061 (Areas 5 and 6 of Rodgers Creek) (File: 1610-20-5041/5044/5045 / 1010-20-19-061)

On November 18, 2019 the November 19, 2019 public hearing was cancelled and rescheduled for December 3, 2019. As the public hearing has closed Council is not permitted to receive any further submissions regarding the proposed bylaws.

RECOMMENDATION:

THAT proposed “Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 5044, 2019” be adopted.

RECOMMENDATION:

THAT proposed “Official Community Plan Bylaw No. 4985, 2018, Amendment Bylaw No. 5045, 2019” be adopted.

Proposed Phased Development Agreement Authorization Bylaw No. 5041, 2019 received first reading at the October 28, 2019 Council meeting and Council scheduled a public hearing to be held on November 19, 2019. On November 18, 2019 the November 19, 2019 public hearing was cancelled and rescheduled for December 3, 2019. The December 3, 2019 public hearing was held and closed and the proposed bylaw received second and third reading at the December 3, 2019 Council meeting. As the public hearing has closed Council is not permitted to receive any further submissions regarding the proposed bylaw.

RECOMMENDATION:

THAT proposed “Phased Development Agreement Authorization Bylaw No. 5041, 2019” be adopted.

If the proposed bylaws are adopted Council may consider proposed Development Permit 19-061 for approval.

RECOMMENDATION:

THAT proposed Development Permit 19-061, which would amend existing Development Permit 16-079 for Area 6 of Rodgers Creek to enable subdivision of the lands, including environmental requirements related to tree removal and protection, wildfire management and creek protection, be approved.

RECOMMENDATION:

THAT the oral reports from the Mayor and Councillors be received for information.

PUBLIC QUESTIONS AND COMMENTS

Questions may be referred by Council to staff for subsequent response. Questions and comments relating to the following are not permitted: a reading or adoption of a bylaw after the close of a statutory public hearing on the bylaw; and an issue which is before the courts on which Council has authorized legal action.
