1 The Virginia Voice Winter/January 2011 Message from the President Dear Unified VCA Colleague: T he other day, while I was caring for the people who have entrusted the health of their spines and nervous systems to chiropractic and me, I reflected on why we as chiropractors need to stop apologizing for what we do. Listening to my patients tell me how their lives have changed because they chose to become chiropractic patients made me smile. It was extremely heartwarming to hear how the grandmother is moving better than she has in decades; how the construction worker is back on the job a few short days after hurting his back; how the housewife whose debilitating headaches and numbness in her hands resolved by being adjusted. The stories go on and on. Yes, I know each of those stories are anecdotal and we need to increase our research efforts; but for each those individuals, the results are real. Sometimes we get caught up in all the negativity involved with the business and political end of chiropractic that we forget the positive effect we have on the people we serve. Alleviating pain and suffering and improving the quality of life of our patients are something to celebrate. The pleasure of helping those who have suffered for so long is truly remarkable. That feeling makes all the “stuff” we have to deal with politically, worthwhile, at least I hope. With that said, it is imperative that we as doctors remain vigilant in providing the appropriate documentation to show medical necessity for insurance reimbursement. We also must be careful to avoid promising “cures” for various diseases and/or disorders. Traditional chiropractic teaches we do not treat any disease or disorder but by correcting subluxation, we remove the interference to the body’s innate ability to heal itself. After nearly 25 years in practice, it never ceases to amaze me as to the inherent power of the body to repair and maintain itself. We offer a true alternative to medical care and should be proud. When you touch your next patient and give them the best adjustment you possibly can, have a little faith in that patient’s body to heal and your ability to deliver the goods. I heard this quote many years ago, “He heals most, in who most have confidence.” Be confident in your abilities and Chiropractic. The second issue related to the effectiveness of omega-3 fatty acid supplements is the relative concentrations of EPA and DHA. Earlier studies have predominantly looked at outcomes using sources of omega-3s that are dominant in EPA. Some research has suggested that a broader range of positive physiologic effects may occur with DHA and that the use of sources richer in DHA may be advantageous. This understanding is not fully developed and will take additional research to clarify. The third factor that may be involved in the inconsistent response to omega-3 fatty acids is the concurrent use of COX inhibitors such as NSAIDs. The omega-3 Continued on page 3

Dear Unified VCA Colleague:

The other day, while I was caring for the people who have entrusted

Why Omega-3 Fatty Acids May Not Always

Omega-3 fatty acids are commonly used to mitigate chronic inflammatory

symptoms. However, the response to such therapy is not always consistent. This is typically related to a few parameters of how the therapy is given. These include:• Dosage• EPA: DHA ratio• Concurrent use of other anti-

fatty acids derive their effect from the increase in resolvin expression. The

family of resolvins results in final inflammatory resolution but require the COX2 enzyme for production. Excessive suppression of COX2 reduces the expression of highly pro-inflammatory prostaglandins but does not allow tissue resolution which may correct the inflammatory signal.

DHA also leads to the production of a broader group of resolvins compared to EPA. This is another factor suggesting that sources with higher DHA content may be better for anti-inflammatory purposes. Discussion with patients about using high amounts of NSAIDs with omega-3s is important. While the suppression of the COX enzymes with NSAIDs provides symptomatic relief, it interferes with the resolution of the ongoing inflammatory process. This is the likely mechanism of the dystrophic or pro-degenerative effect of NSAIDs. As an alternative to NSAIDs, several herbs contain polyphenolic compounds that more mildly suppress the COX enzymes which reduces PGE2 production somewhat but allows resolving production. These herbs include boswellia serrata, ginger, turmeric, celery seed and others. The use of herbal polyphenolics that create only mild suppression of the COX pathways with omega-3s may result in slightly less early symptomatic suppression but better long-term symptomatic resolution and control. Appropriately considering these three factors will often enhance the consistency of outcomes with omega-3 fatty acid supplements.

and executive editor of the parenting blog, “Traveling with Baby”, (http://travelingwithbaby.net) offers the following: “Personally, I recommend a stretchy wrap-type of carrier for newborns. There are several versatile carry positions where a newborn can nurse in a side position instead of the upright position that the Ergo requires. Ergo is nice with the buckles, but it doesn’t fit every torso length -- in many cases, I’ve seen it’s too long for very short torsos (both mom and baby). I like Mei-Tai type carriers for bigger babies, although it can hold newborns, too -- plus hefty toddlers and preschoolers in a back carry. The wrapping on a Mei-Tai is simpler than a single fabric wrap. For more experienced babywearers, woven wraps are awesome -- there are at least eight different carry positions. Ultimately, for babywearing a newborn to a toddler, a mom will most likely need to invest in at least two types of slings/carriers. The key is to try them on WITH her baby to find out what type is best for both. I recommend slings/carriers that don’t put a lot of strain on the pelvis (”V”-shaped crotch area on carriers tend to do this). Rather, I recommend carriers that distribute the baby’s upright weight on the thighs as well. For the moms’ postural considerations, I encourage them to avoid ring slings and pocket slings -- limited use with them, and they tend to cause major postural imbalances and

sore neck/shoulder when worn for long periods of time -- and moms tend to avoid using them once baby is in the 18-22 pound range. An Ergo, Mei-Tai, and even Moby wrap have longer usage life per baby, and the even distribution of baby’s weight on the adult wearer makes it more comfortable for longer wear time.”

October marked the beginning of “collection season” for agencies; a roughly six-month period of mostly increasing

recoveries bookended by the dog days of summer and April’s tax deadline. Mike Dunn, IC System’s Chief Executive Officer, recently shared his thoughts on collection season and why NOW is the time for chiropractic practices to submit debts. “Collections always increase in the fall/winter. We speak to more debtors since they are home more than they were during the summer. We experience a slight leveling off in collections over the holidays as some debtors refuse to pay us and opt to spend discretionary income on gifts. However, we do not decrease our efforts during that critical timeframe. Rather, we offer various collector incentives to promote full staffing and collectors spend time closely evaluating each debtor’s financial situation. Based on our investigation, we can tell how a debtor is handling his/her other debts. In some cases, we can tell if their mortgage is current and if their credit cards are paid up. If so, we encourage him/her to take a cash advance or discuss other options to pay the client’s account TODAY. If we think, however, that a debtor can’t pay the full balance, we proceed with our tax-refund talk-off and set up a payment plan with the expectation we’ll receive a few smaller, manageable payments followed by a large final payment in early 2011. Essentially, the brief leveling-off timeframe around the holidays is a golden opportunity to ensure we’ll maximize client recoveries in Q1. The annual tax-time lift occurred in March and April for years; however, e-filing and direct deposits mean more debtors get refunds earlier and the new tax-time lift starts in January and peaks in February. Historically, our first-month collection percentage is 10% more on debts submitted in these months

compared to the rest of the year. And last but definitely not least… There is a credit-reporting factor in play throughout collection season. If a client has authorized credit reporting, and ALL clients should, we report the account to the national bureaus approximately 45 days after receiving and working the account. Debtors use refunds to make purchases (TV’s, down payments on cars, etc.) or to refinance; if we had the OK to credit report those accounts, purchases/refinances often mean a client gets PAID.”

Deadlines Work

As I sit here writing this column against the deadline, I’m reminded of my days as a young advertising copywriter when

I occasionally needed a deadline as motivation to finish a boring project. The deadline did more than motivate me to finish -- more often than not, it was what finally stimulated enough creative thinking to move me forward -- in other words, it motivated me to think outside of the box. “Thinking outside of the box.” Boy, has that phrase become overused. People are so often telling us that we need to think outside of the box that it has fallen into the realm of cliche. Never-the-less it is still true. Sometimes, however, we need to be put into a box first before we can think outside of it. A deadline is just such a box. I used to believe that the more freedom I had, the more creative I could be. But it doesn’t necessarily work that way. Ingenuity needs to be motivated by something, and if the desire to achieve isn’t there, then an uncomfortable boundary may work. Have you ever watched a man or a woman with one leg running a marathon or competing in downhill snow skiing? I have, and every time I’m deeply impressed because I have both of my legs and I can’t do either one. I used to wonder why they were able to do so much more than me when I was the one born with the greater advantage. Now I can see that the difference is that they were challenged by a boundary and I wasn’t. Some of them might even argue that they were the ones born with the greater advantage. Being unable to walk made them uncomfortable, and conquering their disability became a powerful motivating factor. They had to get out of that box! are limited you must become innovative. A good illustration of this is the World War II movie The Great Escape. It is an amazing tale of ingenuity. Men with little to work with escape from a German POW camp. In addition to digging three tunnels without shovels, they made hand drawn traveling documents and identification papers that looked authentic enough to pass for ones made on a printing press. Now that was a box to get out of! I have enjoyed working for myself most of my adult life. People frequently tell me they wish they could be self-employed like I am. They say things like, “If I could just get one client then I could quit my job.” My response is always the same, “Until you quit your job, you are never going to find that first client. There is nothing like the deadline of a rent or mortgage payment staring you down at the end of the month to motivate you to get out and look for clients.“ Everyone works under some kind of deadline. They force us to prioritize our responsibilities; they limit procrastination; and they help us achieve our work related goals. But, we often lack them in our private lives. We are not given deadlines to accomplish our most important personal goals and without those boundaries procrastination can creep in and destroy our best intentions. The trick is to impose a deadline on yourself. But it has to have some teeth to work. Here’s how to do it: Write down your goal. Then set a reasonable date in which you can achieve it. Next, go to your bank or attorney and set up an escrow account. Now add the teeth -- put into the account an amount of money that will hurt to lose: $1,000... $10,000... $100,000... you decide! Set it up so that if you haven’t achieved your goal by the deadline then the funds go to a favorite charity... or make it even more motivating: let the funds go to your worst enemy! Not ready to try that? Then try the buddy system. Pair up with a friend and each of you take responsibility to follow up on the other one. You can get together once a week and check on each other’s progress. If goals aren’t being met, then nag each other into the UnComfort Zone!

Assignment of Benefits Q&A

It is now clear that PI liability and Med-Pay carriers will no longer be able to send payment for your services directly to your patient

when you have a properly executed Assignment of Benefits signed by your patient and you notify the carrier. The Unified VCA legal/legislative teams requested and received an official Virginia Attorney General’s opinion on this important chiropractic issue.

Q: At the bottom of the new form, under “Health Care Provider:” there are a few blanks to be filled in. What goes in “By” and “Its?”A: Under “Health Care Provider,” put your clinic name if you are a Corporation. “By” would be your signature and “Its” would be your position in the corporation (owner, president, etc). If you are not a corporation, “Its” can be eliminated. For non-corps, the Doctor’s name and his/her signature is all that is needed.

Q: Does the patient have to sign a new assignment form every time he/she comes in?A: No. Have the patient sign the assignment form and then keep it on file. When you submit your claims, indicate that you have an assignment on file or photocopy the assignment and send it with your claims whenever you submit.

Q: Are docs getting paid directly by the liability carrier in PI cases? Due to the recent AG’s opinion?A: Yes and yes! The document is on the Unified VCA website, along with instructions on how to properly use it. Do NOT take short cuts. Follow the instructions exactly. This only works if the patient does not have an attorney as their lien goes to the front of the list by law and they get paid first. Don’t be confused by the term “lien” here: you will use a contractual “Assignment of Benefits.”

Q: What if the lawyer says he doesn’t want to sign my assignment?A: The attorney does not have to sign the Assignment or agree to it, he only needs to know that the benefits in the case has been assigned to you. Send him the Assignment by certified mail and stamp each bill you send him “Benefits Assigned” and he is obligated to honor the Assignment.

If we want to have any influence as to what our future will look like, we must dig DEEP by giving to CPAC and supporting our legislators locally. We must meet them, go to their fundraisers and help in their campaigns. It is critical to support CPAC, which gives to legislators who have no chiropractor living in their district -- several of which are on key committees and in leadership positions. This past year was monumental for us concerning “Assignment of Benefits”. Assignments are a transfer of ownership of benefits such as insurance benefits from Med-pay. It is a contract obligating attorneys, liability carriers and med-pay carriers to honor. The Assignment of Benefits protects your entire bill per a recent official opinion issued by Virginia’s Attorney General, Kenneth T. Cuccinelli, II. In 2010 part of our scope of practice was modified by the Physical Therapy Bill which would have taken away our ability to perform and bill for Physical Therapeutic Services. This year is going to be really tough. The state’s congressional districts will be redefined due to population

changes. ALL of the legislative seats are up for reelection. Our newfound allies in the General Assembly will look to CPAC for assistance with their re-election campaigns. It is even more important that we maintain and strengthen our voice and access to legislators serving on committees which control the future of our practice. Only 20% of the Unified VCA membership gave to CPAC in 2010. Is it fair for20 % of the members to work for the other 80%? What is your excuse? We ask that each member and non-member consider $720 for 2011. That breaks down to $60 per month or $15 per week -- just ONE adjustment per month! That would give CPAC a war chest of $360,000! Wouldn’t the legislators sit up and listen to us then?!
