COOKERPressure cooking is a way of cooking food in liquid using a gasket-sealed pan to retain steam and build pressure.

By increasing the pressure inside the pan, the boiling point of the liquid in the pressure cooker is raised to 120˚c to 125°c, some 20˚c to 25°c higher than normal boiling point.

The increased temperature of the water and steam causes the fibres of the food to break down more quickly, and shortens the cooking time by up to 70 per cent.

PRESSURE

Pressure cooking is a way of cooking food in liquid using a gasket-sealed pan to retain steam and build pressure. This is a general overview of Pressure Cooking. Specific models may vary in temperature and pressure configurations.

PROBLEM POSSIBLE SOLUTION

Where can I find basic instructions on how to use the Pressure Cooker?

In the User Manual enclosed in your pressure cooker box. Download the User Manual by searching your Pressure Cooker model using the Search bar on the website and click on the Downloads Tab at the bottom of the page. www.tramontina.com.au.

The pressure indicator does not rise.

This is perfectly normal in the first few minutesIf this persists, check whether:• There is enough liquid inside the cooker(at least 250ml)• The pressure regulator valve is set to “0” position. As the zero position does not build pressure,

change pressure setting to number 1 or 2.• The pressure cooker is closed properly.• The sealing gasket is in good condition and rim of the cooker is damaged. (in case of damage,

contact Tramontina Customer Service at 1800 110 885 or send and email to [email protected])

The safety pin has risen, and during the cooking process no steam escapes from the pressure regulator valve.

Remove pressure cooker from the heat source and wait until the pin has come down. Open and cooker and clean the Pressure Regulator Valve & Safety Valve. Make sure there is enough liquid inside the cooker (at least 250ml).

Steam or liquid escapes from the lid or handles.

Check whether lid is properly closed. Check the sealing ring is properly fitted and clean. Check the condition of the sealing ring. It is recommended that the sealing gasket is changed once every year.Check whether the rim of the cooker is in good order and there are no bumps or damages on the cooks pot body and lid.

The lid can not be opened. Generally, the lid can not be opened during or after cooking due to the Pressure Cooker internal Pressure. Check whether the safety pin has dropped down completely; if not, release the pressure using one of the methods described in the User Manual or simply by removing the cooker from the heat source and waiting until the safety pin has dropped down.Check whether lid has been placed correctly when closing the cooker. Closing the lid in the wrong way can cause the lid to get stuck.

The food is either not fully cooked or overcooked.

Verify the cooking time. The recipe book cooking time is a reference only. Tenderness and texture tend to vary on meats and vegetables. Please adjust the cooking time accordingly.Check the amount of liquid inside the cooker (at least 250ml)Check the hotplate output. The heat may be too high during the cooking process, what makes the liquid evaporated quicker and burn food.Check whether you are using the correct Pressure Setting (1 or 2) for the cooking time.

One of the safety devices was triggered.

• Carefully turn off the heat source and remove the cooker from it.• Allow the cooker to cool down naturally. (Do not force cooling or moving the cooker or lid.)• Open it, following the user manual instructions• Check whether the Pressure Regulator valve, Sealing gasket and other valves are not clogged.

Clean them.

The lid, handles or any other spare part broke and needs to be replaced.

Use only original spare parts from Tramontina Pressure Cookers. Each Pressure Cooker model has its own spare parts and they can not be reused in another model. Find Spare parts online on Tramontina website under Cookware > Pressure Cookers > Spare Parts or call +61 (02) 9674 1799.

Why some spare parts can not be shipped to me?

Although the current Tramontina Pressure Cooker models are of the highest quality and has a variety of safety mechanisms, some precautions must be taken when using and replacing spare parts.For safety reasons and warranty assurance, all spare parts physically connected to the lid need to be replaced by Tramontina’s technical support in Sydney.

I couldn’t find the answer on this troubleshooting list.

THE RANGE

Tramontina was founded in 1911 in the town of Carlos Barbosa, Rio Grande do Sul. Today it has a presence in more than 120 countries with more than 18,000 different products.

Like all Tramontina products, the cutlery range has been developed to high quality standards. This work has resulted in another great success: ISO 9001: 2008 certification, demonstrating that product quality results from pursuit of qualification in everything that Tramontina does.

Tramontina’s modern production methods, finishes, capacity for innovation and design are constantly being adapted to the requirements of its clients. Environmental preservation is one of Tramontina’s missions, investing in wastewater treatment, recycling of industrial waste and reforestation of natural reserves. Tramontina is technologically equipped to face the challenges of the future and to develop product ranges aimed at increasingly improving the lives of its consumers.

Tramontina has used all this technology to develop the Professional Master range as an evolution of its professional products. To achieve this result Tramontina listened to professionals from the meat packing industry in Brazil, in order to meet all their requirements. The Professional Master product range guarantees the comfort and safety that these professionals are looking for in their work, conforming to quality specifications and using materials that undergo the strictest testing for strength and durability. In addition to knives, the range also includes spatulas, sharpening steels, shears and various accessories.

The Professional Masters handle colours were developed to not simply fulfil personal preferences, but to facilitate the production processes in abatoirs and other meat, fish and poultry processing plants. Due to processing plants’ busy routines, knives need to be sharpened and ready to go in order to improve the outcome of that specific working shift.

The Professional Master’s range offers the same knife models in different colours just so each working shift can can perform at its best. Morning shifts use the red, afternoon shift uses the red and night shift uses the blue, for example. This process allows all knives to be properly sharpened before hand and ready to go for that specifi shift. Colour coding is a simple and effective way to achieve better results.

LASER CUTTINGThe external shape/profile of the blades is obtained by laser cutting rolls of stainless steel.

• After heat treatment the blades are machined in five different operations:

• Profile trimming: improving the blade-profile finish.• Face trimming: producing angles on the blade faces.• Satin finish of faces: final finish to blade faces.• Grinding of rough edges: “rounding rough edges” of profile

opposite edge.• Sharpening: producing the edge.

Since Tramontina obtained NSF (National Sanitation Foundation) certification, it has used the symbol next to its brand name, representing recognition of Tramontina’s Professional Knife range by an independent and international organisation.

This organisation operates throughout the world, concentrating on consultancy, inspection and training focused on ensuring the hygiene of food, water, air and the environment.

As the knives are used for various types of meat, it is essential that these assessments are carried out by specialist professionals, so that product quality and materials used can be verified.

NSF inspections show that Tramontina has suitable conditions for producing professional knives for the meat packing industry, and that its technologies conform to international quality standards.Knives intended for the meat packing industry require this certification.

• This takes place in the final manufacturing stage.• Blades are given polypropylene (PP) handles.• Microban® antimicrobial treatment (see page 26) is added to

the polypropylene.• To prevent the formation of gaps between the parts, where

waste might gather, and also to facilitate cleaning, the handle is injected directly onto the tang of the blade itself.

• Handles are produced in a variety of colours to facilitate knife cleaning and hygiene inside the packing houses and conforming to health-inspection requirements.

By Applying heat treatment to the Professional Master blades, it ensures the proper resistance to edge wear is achieved, it changes the steel structure to increase blade strength and hardness. The heat-treatment process is completely controlled with temperature and hardness gauges and by analysing the internal structure of the steel with a microscope. The heat treatment is divided into three stages, as below.

HARDENINGSUBZEROTEMPERING

• Blades are heated to temperatures of over 1000˚C, then quickly cooled.

• The stainless steel blade becomes hard and resistant to wear but with low resistance to impact and flexing.

• At this stage the structure of the stainless steel still needs improvement because some parts are still not completely hardened.

• Improvements to the structure occur after freezing the blades at a temperature well below 0˚.

• The blades are frozen to give the stainless steel excellent stability and resistance to wear.

• Solves the problem of low impact and flex resistance mentioned in the TEMPERING stage.

• The blades are heated to temperatures above 300ºC, leaving the items with hardness levels of between 55 and 58 HRC.

• At this stage the blades display excellent resistance to wear, impact and flexing.

• Steel tensions generated in the earlier stages are removed.

Tramontina Machetes come with two different types of handles: ABS handles and Wooden handles. WHAT IS POLYWOOD?Polywood® is a special treated timber manufactured by Tramontina in Brazil. Although Polywood is more resistant than normal timber, some precautions need to be take when utilized in a restaurant or industrial pace.

HOW TO CARE FORPOLYWOOD®?After use, rinse immediately in warm soapy water and wipe dry with a clean cloth.

Do not leave unwashed cutlery overnight or for extended periods. Rinse food, salt or detergent off used knives promptly.

Do not use knives to open cans, cut bones and other materials that might damage the edge and its cut.Tramontina recommends the use of commercial plastic dishwasher racks/container when using any type of dishwasher, both commercial or residential.

In order to avoid damage during dishwasher cycle, please follow these steps:

Do not use any abrasive materials and chemicals in the dishwasher, they may damage the knife rivets and handle natural shine. Just soap and water is recommended to extend the cutlery’s lifespan.

Place knives and other point cutlery downwards in the dishrack to avoid blades to damage the Polywood ® handles and other items.

Store knives in a safe place with the blades facing the same direction (inside the drawer, for example). This way, the blades do not scratch or damage the knife handles.

Polywood ® is dishwasher safe, impact and heat resistant, however, when in contact with blades and sharp surfaces, handles may be scratched and damaged.

HOW TO CARE FORWOODEN PRODUCTS?Prior the � rst use, wash with mild neutral soap and run water thoroughly to remove all soap. Thoroughly dry itwith a clean cloth.

After the � rst clean, it is recommended to rub a little bit of olive oil around the whole board.

After each use, clean with mild neutral soap and thoroughly dry the board with a clean cloth.

Never soak a wooden board or wooden product.

Do not let the product dry under the sun or any other heat source. This process may deform, break and cause other damages the board.

Do not place boards inside the oven. Boards need to be at a minimum distance of 1.5m of a direct or high heat source not to deform - e.g. Heating Lamps, Ovens and � re.

Do not place boards inside a fridge or freezer. It may deform the board the same way a heat source does.

Do not stack boards over each other whilst wet.

Do not let the product dry on a table or � at surface. The bottom of the board may be wet. Instead, dry it with a clean cloth and let it stand vertically in a dish rack.

Store your boards in a clean, dry and ventilated place in order to avoid bacteria and fungus to attach to the wood.

Wooden boards are NOT DISHWASHER SAFE.

Knowing how to care for your kitchen and professional knives properly means that they will last longer, work more ef� ciently, and be safer to use. Handling a knife is all about precision and control.

Dull, unkempt knives slip easily and that can mean stitches or worse. Keep you knives clean, sharp, and ready for use at all times.

GENERAL CARE INSTRUCTIONS• Keep knives away from children’s reach at all times

• Always pay attention and keep focused when handling knives. Damage can happen very quickly otherwise.

• Use knives for its intended purpose only, such as cutting food.

• ! Do not attempt to open cans or other objects.

• !Do not attempt to cut frozen food unless the knife is speci� cally design for that. In order to do it with a Cook’s knife, use a Forward and Backward movement carefully.

• ! Keep knives sharp by regularly honing and sharpening depending on usage. Cutting is about precision. When using a dull knife, you need to put more effort to cut. Dull, unkempt knives slip easily and may cause damage to yourself or surfaces and objects around you.

CLEANING & WASHING• Never leave uncleaned knife in the sink. Always rinse it

and wipe it down until you have the chance to wash it.

• When washing, always keep the knife tip and blade away from your body.

• If food is stuck to the blade or handles, let it soak in hot water for a few minutes ONLY. Keep the water clear and shallow so that you can see the knife clearly.

• Do not soak knife for a long period and wash knives individually. This prevents cutting yourself when trying to reach for a soaked knife.

• Although most Tramontina knives are dishwasher safe, Handwash is recommended in order to prolong its lifespan. Handle with care when loading the knife into the dishwasher. Place in a stable position to avoid the knife moving around during the cycle. Although this item is dishwasher safe, it is recommended to hand wash immediately after use in warm soapy water. Before placing in the dishwasher, refer to speci� c knife model for instructions.

• Always dry knife after hand/dishwashing with a clean dry cloth.

STORAGEKnives are sharp and must be stored in a suitable place. A knife block or magnetic rack is recommended for storage in order to avoid causing any damage to knives or surrounding objects

Tramontina recommends using a Magnetic Rack, Knife Block or Knife Pouches to store your knives.

EXTRA TIPS! Always use wood, bamboo, or specialty plastic cutting boards or surfaces. Avoid cutting on glass, granite, marble, porcelain, and other surfaces that can damage the knife blade and slip easily.

! Small knives (Paring, Peeling) are ideal for cutting small foods such as vegetables. As a reference, change from a small paring knife to a 6” or 8” Cooks/Chef’s knives when cutting any foods which are larger than a tomato.

COOKWAREINOX

1 - WATER & CLOTHRoutine cleaning can be accomplished by using warm water and a cloth. This is the least risky option for cleaning stainless steel, and honestly just plain water works to clean in most situations. Dry with a towel or cloth to prevent water spots. This is really important, since minerals in water can leave marks on stainless steel. Wipe in the directions of the polish lines for best and most beautiful results. Micro� ber cleaning cloths can be a great option to use when cleaning stainless steel because they do a great job of absorbing all of the water without scratching the surface.

2 - MILD DETERGENT, WATER & CLOTHFor cleaning that needs more power, mild detergent and warm water can do a great job without damaging your stainless steel. A drop of mild dish detergent and warm water is often all you need to get tougher dirt off of your stainless steel. You can start with a small sink of warm water with a few drops of dish soap. You can also have a small drop of dish soap on a cloth. Add warm water to the cloth and rub the dish soap to suds up your cleaning cloth. Wipe down the dirty area. After you’ve � nished washing away the dirt, make sure you rinse the surface thoroughly to prevent staining and spotting. It is important to towel dry to prevent water spots which can be caused by minerals in water.

Stainless Steel is known for its ability to be a clean surface that resists corrosion and rust. Because of this stainless steel is a popular choice in kitchens. Dirt, dust and grime, however, put stainless steel at risk for corrosion and rust. Luckily, it responds well to cleaning, as long as certain rules are followed. If you’ve invested the money to upgrade your appliances, sink, and cookware to stainless steel, make sure you invest the time and energy into keeping it clean and polished, so you will be able to enjoy its beauty for many years to come. In general, you want to start with the basics, and work your way up from there as needed.

3 - SOFT BOIL WITH WATER & CLOTHIf you have caked-on food in the bottom of your pan or if your pan has burn marks, but no food chunks, put about 2 cups of water in your pan and put it back on the stove. Once it starts to boil, add 1 tablespoon of baking soda. Allow the liquid to simmer (which means very lightly boiling) for 30 minutes, adding more water so it never goes dry. If there are any chunks of food caked-on in the bottom of the pan, use a plastic or wooden spatula to scrape the bottom of the pan. Continue this process until all the food chunks have released. If the inside of the pot only has burn marks, remove the excess of liquid remaining from the boil and simply rub some baking soda with a soft cloth until marks are removed. Rinse the pan with clean water and throughly dry the surface immediately. If burn marks remain after this procedure, use a Stainless Steel Cleaning paste to remove marks and regain shine.

4 - STAINLESS STEEL CLEANING PASTEIf you have had staining or scratching, or need to polish your stainless steel, a stainless steel cleaner may be a good option. Some of these cleaners and polishes can help minimize scratching and remove stains. They also can polish surfaces nicely. Read the directions on the stainless steel cleaner and test in an inconspicuous spot. Be sure to rinse thoroughly and towel dry. HOW TO CARE FORSTAINLESS STEEL CUTLERY?Clean and dry your cutlery as soon as possible after use.

Do not soak or let it stand in the dishwasher overnight after running a rinse programme. Mineral salts found in water may cause unsightly stains onto the metal. In the humid atmosphere of a dishwasher, mineral salts can dry onto cutlery, starting the process that leads to corrosion.

Do not use any abrasive cleaners to remove food residue. Scouring with an abrasive pad will leave tiny scratches in the surface of the metal, which will reduce the shine.

Do not expose Stainless Steel cutlery to a high heating source. High direct heat can damage the surface of the metal leaving discoloured marks.

When using a dishwasher to clean your cutlery, dry your cutlery right after the cycle is � nished. Dry the cutlery thoroughly to avoid watermarks to appear.

In case watermarks and stains appear on your cutlery from time to time, polish them off with a proprietary stainless steel cleaner. Ensure you follow the manufacturer’s instructions.

NEVER use a silver cleaner/polish with stainless steel cutlery. Silver polishes will will damage the metal and are not suitable for stainless steel.

1. Definitions 1.1 “Tramontina” means Tras Marketing & Sales Pty Ltd T/A Tramontina Australia, its successors and assigns or any person acting on

behalf of and with the authority of Tras Marketing & Sales Pty Ltd T/A Tramontina Australia. 1.2 “Client” means the person/s buying the Goods as specified in any invoice, document or order, and if there is more than one Client is a

reference to each Client jointly and severally. 1.3 “Goods” means all Goods or Services supplied by Tramontina to the Client at the Client’s request from time to time (where the context

so permits the terms ‘Goods’ or ‘Services’ shall be interchangeable for the other). 1.4 “Price” means the Price payable for the Goods as agreed between Tramontina and the Client in accordance with clause 6 below. 2. Acceptance 2.1 The Client is taken to have exclusively accepted and is immediately bound, jointly and severally, by these terms and conditions if the

Client places an order for or accepts delivery of the Goods. 2.2 These terms and conditions may only be amended with Tramontina’s consent in writing and shall prevail to the extent of any

inconsistency with any other document or agreement between the Client and Tramontina. 2.3 The Client accepts and acknowledges that Tramontina is a registered and protected trade name and Goods supplied by Tramontina

should be acknowledged as such. 3. Change in Control 3.1 The Client shall give Tramontina not less than fourteen (14) days prior written notice of any proposed change of ownership of the

Client and/or any other change in the Client’s details (including but not limited to, changes in the Client’s name, address, contact phone or fax number/s, or business practice). The Client shall be liable for any loss incurred by Tramontina as a result of the Client’s failure to comply with this clause.

4. Electronic Transactions Act 2000 4.1 Electronic signatures shall be deemed to be accepted by either party providing that the parties have complied with Section 9 of the

Electronic Transactions Act 2000 or any other applicable provisions of that Act or any Regulations referred to in that Act. 5. Online Ordering 5.1 The Client acknowledges and agrees that:

(a) Tramontina does not guarantee the websites performance or availability of any of its Goods; and (b) on-line ordering may be unavailable from time to time for regularly scheduled maintenance and/or upgrades; and (c) there are inherent hazards in electronic distribution and as such Tramontina cannot warrant against delays or errors in transmitting

data between the customer and Tramontina including orders, and you agree that to the maximum extent permitted by law, Tramontina will not be liable for any losses which the Client suffers as a result of online-ordering not being available or for delays or errors in transmitting orders.

5.2 Tramontina reserve the right to terminate your order if it learns that you have provided false or misleading information, interfered with other users or the administration of Tramontina Services, or violated these terms and conditions.

6. Price and Payment 6.1 At Tramontina’s sole discretion the Price shall be either:

(a) as indicated on any invoice provided by Tramontina to the Client; or (b) the Price as at the date of delivery of the Goods according to Tramontina’s current price list; or (c) Tramontina’s quoted price (subject to clause 6.2) which will be valid for the period stated in the quotation or otherwise for a period

of thirty (30) days. 6.2 Tramontina reserves the right to change the Price:

(a) if a variation to the Goods which are to supplied is requested; or (b) in the event of increases to Tramontina in the cost of Goods (including but not limited to overseas transactions that may increase

as a consequence of variations in foreign currency rates of exchange and/or international freight and insurance charges) which are beyond Tramontina’s control.

6.3 At Tramontina’s sole discretion a non-refundable deposit may be required. 6.4 Time for payment for the Goods being of the essence, the Price will be payable by the Client on the date/s determined by Tramontina,

which may be: (a) on delivery of the Goods; (b) before delivery of the Goods; (c) thirty (30) days following the end of the month in which a statement is posted to the Client’s address or address for notices; (d) thirty (30) days following the date of any invoice given to the Client by Tramontina; (e) the date specified on any invoice or other form as being the date for payment; or (f) failing any notice to the contrary, the date which is seven (7) days following the date of any invoice given to the Client by

Tramontina. 6.5 Payment may be made by cheque, bank cheque, electronic/on-line banking, credit card (plus a surcharge of up to two percent (2%) of

the Price), or by any other method as agreed to between the Client and Tramontina. 6.6 Unless otherwise stated the Price does not include GST. In addition to the Price the Client must pay to Tramontina an amount equal to

any GST Tramontina must pay for any supply by Tramontina under this or any other agreement for the sale of the Goods. The Client must pay GST, without deduction or set off of any other amounts, at the same time and on the same basis as the Client pays the Price. In addition the Client must pay any other taxes and duties that may be applicable in addition to the Price except where they are expressly included in the Price.



7. Delivery of Goods 7.1 Delivery (“Delivery”) of the Goods is taken to occur at the time that:

(a) the Client or the Client’s nominated carrier takes possession of the Goods at Tramontina’s address; or (b) Tramontina (or Tramontina’s nominated carrier) delivers the Goods to the Client’s nominated address even if the Client is not

present at the address. 7.2 At Tramontina’s sole discretion the cost of delivery is either included in the Price or is in addition to the Price. 7.3 The Client must take delivery by receipt or collection of the Goods whenever they are tendered for delivery. In the event that the Client

is unable to take delivery of the Goods as arranged then Tramontina shall be entitled to charge a reasonable fee for redelivery and/or storage.

7.4 Tramontina may deliver the Goods in separate instalments. Each separate instalment shall be invoiced and paid in accordance with the provisions in these terms and conditions.

7.5 Any time or date given by Tramontina to the Client is an estimate only. The Client must still accept delivery of the Goods even if late and Tramontina will not be liable for any loss or damage incurred by the Client as a result of the delivery being late.

8. Risk 8.1 Risk of damage to or loss of the Goods passes to the Client on Delivery and the Client must insure the Goods on or before Delivery. 8.2 If any of the Goods are damaged or destroyed following delivery but prior to ownership passing to the Client, Tramontina is entitled to

receive all insurance proceeds payable for the Goods. The production of these terms and conditions by Tramontina is sufficient evidence of Tramontina’s rights to receive the insurance proceeds without the need for any person dealing with Tramontina to make further enquiries.

8.3 If the Client requests Tramontina to leave Goods outside Tramontina’s premises for collection or to deliver the Goods to an unattended location then such Goods shall be left at the Client’s sole risk.

8.4 The Client accepts that any broken or damaged Goods resulting from fair wear and tear is not deemed as being a defect for the purposes of a warranty claim under clause 13, and all costs associated with the procurement of spare parts shall be borne by the Client.

9. Specifications 9.1 The Client acknowledges that:

(a) all descriptive specifications, illustrations, drawings, data, dimensions and weights stated in Tramontina’s fact sheets, price lists or advertising material, are approximate only and are given by way of identification only. The Client shall not be entitled to rely on such information, and any use of such does not constitute a sale by description, and does not form part of the contract, unless expressly stated as such in writing by Tramontina;

(b) while Tramontina may have provided information or figures to the Client regarding the performance of the Goods, the Client acknowledges that Tramontina has given these in good faith.

9.2 The Client shall be responsible for ensuring that the Goods ordered are suitable for their intended use. 10. Title 10.1 Tramontina and the Client agree that ownership of the Goods shall not pass until:

(a) the Client has paid Tramontina all amounts owing to Tramontina; and (b) the Client has met all of its other obligations to Tramontina.

10.2 Receipt by Tramontina of any form of payment other than cash shall not be deemed to be payment until that form of payment has been honoured, cleared or recognised.

10.3 It is further agreed that: (a) until ownership of the Goods passes to the Client in accordance with clause 10.1 that the Client is only a bailee of the Goods and

must return the Goods to Tramontina on request. (b) the Client holds the benefit of the Client’s insurance of the Goods on trust for Tramontina and must pay to Tramontina the

proceeds of any insurance in the event of the Goods being lost, damaged or destroyed. (c) the Client must not sell, dispose, or otherwise part with possession of the Goods other than in the ordinary course of business and

for market value. If the Client sells, disposes or parts with possession of the Goods then the Client must hold the proceeds of any such act on trust for Tramontina and must pay or deliver the proceeds to Tramontina on demand.

(d) the Client should not convert or process the Goods or intermix them with other goods but if the Client does so then the Client holds the resulting product on trust for the benefit of Tramontina and must sell, dispose of or return the resulting product to Tramontina as it so directs.

(e) the Client irrevocably authorises Tramontina to enter any premises where Tramontina believes the Goods are kept and recover possession of the Goods.

(f) Tramontina may recover possession of any Goods in transit whether or not delivery has occurred. (g) the Client shall not charge or grant an encumbrance over the Goods nor grant nor otherwise give away any interest in the Goods

while they remain the property of Tramontina. (h) Tramontina may commence proceedings to recover the Price of the Goods sold notwithstanding that ownership of the Goods has

not passed to the Client.

11. Personal Property Securities Act 2009 (“PPSA”) 11.1 In this clause financing statement, financing change statement, security agreement, and security interest has the meaning given to it

by the PPSA.



11.2 Upon assenting to these terms and conditions in writing the Client acknowledges and agrees that these terms and conditions constitute a security agreement for the purposes of the PPSA and creates a security interest in all Goods that have previously been supplied and that will be supplied in the future by Tramontina to the Client.

11.3 The Client undertakes to: (a) promptly sign any further documents and/or provide any further information (such information to be complete, accurate and up-to-

date in all respects) which Tramontina may reasonably require to; (i) register a financing statement or financing change statement in relation to a security interest on the Personal Property

Securities Register; (ii) register any other document required to be registered by the PPSA; or (iii) correct a defect in a statement referred to in clause 11.3(a)(i) or 11.3(a)(ii);

(b) indemnify, and upon demand reimburse, Tramontina for all expenses incurred in registering a financing statement or financing change statement on the Personal Property Securities Register established by the PPSA or releasing any Goods charged thereby;

(c) not register a financing change statement in respect of a security interest without the prior written consent of Tramontina; (d) not register, or permit to be registered, a financing statement or a financing change statement in relation to the Goods in favour of

a third party without the prior written consent of Tramontina; (e) immediately advise Tramontina of any material change in its business practices of selling the Goods which would result in a

change in the nature of proceeds derived from such sales. 11.4 Tramontina and the Client agree that sections 96, 115 and 125 of the PPSA do not apply to the security agreement created by these

terms and conditions. 11.5 The Client waives their rights to receive notices under sections 95, 118, 121(4), 130, 132(3)(d) and 132(4) of the PPSA. 11.6 The Client waives their rights as a grantor and/or a debtor under sections 142 and 143 of the PPSA. 11.7 Unless otherwise agreed to in writing by Tramontina, the Client waives their right to receive a verification statement in accordance with

section 157 of the PPSA. 11.8 The Client must unconditionally ratify any actions taken by Tramontina under clauses 11.3 to 11.5. 11.9 Subject to any express provisions to the contrary nothing in these terms and conditions is intended to have the effect of contracting out

of any of the provisions of the PPSA. 12. Security and Charge 12.1 In consideration of Tramontina agreeing to supply the Goods, the Client charges all of its rights, title and interest (whether joint or

several) in any land, realty or other assets capable of being charged, owned by the Client either now or in the future, to secure the performance by the Client of its obligations under these terms and conditions (including, but not limited to, the payment of any money).

12.2 The Client indemnifies Tramontina from and against all Tramontina’s costs and disbursements including legal costs on a solicitor and own client basis incurred in exercising Tramontina’s rights under this clause.

12.3 The Client irrevocably appoints Tramontina and each director of Tramontina as the Client’s true and lawful attorney/s to perform all necessary acts to give effect to the provisions of this clause 12 including, but not limited to, signing any document on the Client’s behalf.

13. Defects, Warranties and Returns, Competition and Consumer Act 2010 (CCA) 13.1 The Client must inspect the Goods on delivery and must within seven (7) days of delivery notify Tramontina in writing of any evident

defect/damage, shortage in quantity, or failure to comply with the description or quote. The Client must notify any other alleged defect in the Goods as soon as reasonably possible after any such defect becomes evident. Upon such notification the Client must allow Tramontina to inspect the Goods.

13.2 Under applicable State, Territory and Commonwealth Law (including, without limitation the CCA), certain statutory implied guarantees and warranties (including, without limitation the statutory guarantees under the CCA) may be implied into these terms and conditions (Non-Excluded Guarantees).

13.3 Tramontina acknowledges that nothing in these terms and conditions purports to modify or exclude the Non-Excluded Guarantees. 13.4 Except as expressly set out in these terms and conditions or in respect of the Non-Excluded Guarantees, Tramontina makes no

warranties or other representations under these terms and conditions including but not limited to the quality or suitability of the Goods. Tramontina’s liability in respect of these warranties is limited to the fullest extent permitted by law.

13.5 If the Client is a consumer within the meaning of the CCA, Tramontina’s liability is limited to the extent permitted by section 64A of Schedule 2.

13.6 If Tramontina is required to replace the Goods under this clause or the CCA, but is unable to do so, Tramontina may refund any money the Client has paid for the Goods.

13.7 If the Client is not a consumer within the meaning of the CCA, Tramontina’s liability for any defect or damage in the Goods is: (a) limited to the value of any express warranty or warranty card provided to the Client by Tramontina at Tramontina’s sole discretion; (b) limited to any warranty to which Tramontina is entitled, if Tramontina did not manufacture the Goods; (c) otherwise negated absolutely.

13.8 Subject to this clause 13, returns will only be accepted provided that: (a) the Client has complied with the provisions of clause 13.1; and (b) Tramontina has agreed that the Goods are defective; and (c) the Goods are returned within a reasonable time at the Client’s cost; and (d) the Goods are returned in as close a condition to that in which they were delivered as is possible.

13.9 Notwithstanding clauses 13.1 to 13.8 but subject to the CCA, Tramontina shall not be liable for any defect or damage which may be caused or partly caused by or arise as a result of: (a) the Client failing to properly maintain or store any Goods; (b) the Client using the Goods for any purpose other than that for which they were designed;



(c) the Client continuing the use of any Goods after any defect became apparent or should have become apparent to a reasonably prudent operator or user;

(d) the Client failing to follow any instructions or guidelines provided by Tramontina (e) any abuse, misuse or incorrect and/or improper use of the Goods; (f) fair wear and tear, any accident, or act of God.

13.10 Tramontina may in its absolute discretion accept non-defective Goods for return in which case Tramontina may require the Client to pay handling fees of up to fifteen percent (15%) of the value of the returned Goods plus any freight costs.

13.11 Notwithstanding anything contained in this clause if Tramontina is required by a law to accept a return then Tramontina will only accept a return on the conditions imposed by that law.

14. Intellectual Property 14.1 Where Tramontina has designed, drawn or developed Goods for the Client, then the copyright in any designs and drawings and

documents shall remain the property of Tramontina. 14.2 The Client warrants that all designs, specifications or instructions given to Tramontina will not cause Tramontina to infringe any patent,

registered design or trademark in the execution of the Client’s order and the Client agrees to indemnify Tramontina against any action taken by a third party against Tramontina in respect of any such infringement.

14.3 The Client agrees that Tramontina may (at no cost) use for the purposes of marketing or entry into any competition, any documents, designs, drawings or Goods which Tramontina has created for the Client.

15. Default and Consequences of Default 15.1 Interest on overdue invoices shall accrue daily from the date when payment becomes due, until the date of payment, at a rate of two

and a half percent (2.5%) per calendar month (and at Tramontina’s sole discretion such interest shall compound monthly at such a rate) after as well as before any judgment.

15.2 If the Client owes Tramontina any money the Client shall indemnify Tramontina from and against all costs and disbursements incurred by Tramontina in recovering the debt (including but not limited to internal administration fees, legal costs on a solicitor and own client basis, Tramontina’s contract default fee, and bank dishonour fees).

15.3 Without prejudice to any other remedies Tramontina may have, if at any time the Client is in breach of any obligation (including those relating to payment) under these terms and conditions Tramontina may suspend or terminate the supply of Goods to the Client. Tramontina will not be liable to the Client for any loss or damage the Client suffers because Tramontina has exercised its rights under this clause.

15.4 Without prejudice to Tramontina’s other remedies at law Tramontina shall be entitled to cancel all or any part of any order of the Client which remains unfulfilled and all amounts owing to Tramontina shall, whether or not due for payment, become immediately payable if: (a) any money payable to Tramontina becomes overdue, or in Tramontina’s opinion the Client will be unable to make a payment when

it falls due; (b) the Client becomes insolvent, convenes a meeting with its creditors or proposes or enters into an arrangement with creditors, or

makes an assignment for the benefit of its creditors; or (c) a receiver, manager, liquidator (provisional or otherwise) or similar person is appointed in respect of the Client or any asset of the

Client. 16. Cancellation 16.1 Tramontina may cancel any contract to which these terms and conditions apply or cancel delivery of Goods at any time before the

Goods are delivered by giving written notice to the Client. On giving such notice Tramontina shall repay to the Client any money paid by the Client for the Goods. Tramontina shall not be liable for any loss or damage whatsoever arising from such cancellation.

16.2 In the event that the Client cancels delivery of Goods the Client shall be liable for any and all loss incurred (whether direct or indirect) by Tramontina as a direct result of the cancellation (including, but not limited to, any loss of profits).

16.3 Cancellation of orders for Goods made to the Client’s specifications, or for non-stocklist items, will definitely not be accepted once production has commenced, or an order has been placed.

17. Privacy Act 1988 17.1 The Client agrees for Tramontina to obtain from a credit reporting body (CRB) a credit report containing personal credit information

(e.g. name, address, D.O.B, occupation, previous credit applications, credit history) about the Client in relation to credit provided by Tramontina.

17.2 The Client agrees that Tramontina may exchange information about the Client with those credit providers and with related body corporates for the following purposes: (a) to assess an application by the Client; and/or (b) to notify other credit providers of a default by the Client; and/or (c) to exchange information with other credit providers as to the status of this credit account, where the Client is in default with other

credit providers; and/or (d) to assess the creditworthiness of the Client including the Client’s repayment history in the preceding two years.

17.3 The Client consents to Tramontina being given a consumer credit report to collect overdue payment on commercial credit. 17.4 The Client agrees that personal credit information provided may be used and retained by Tramontina for the following purposes (and

for other agreed purposes or required by): (a) the provision of Goods; and/or (b) analysing, verifying and/or checking the Client’s credit, payment and/or status in relation to the provision of Goods; and/or (c) processing of any payment instructions, direct debit facilities and/or credit facilities requested by the Client; and/or (d) enabling the collection of amounts outstanding in relation to the Goods.

17.5 Tramontina may give information about the Client to a CRB for the following purposes:



(a) to obtain a consumer credit report; (b) allow the CRB to create or maintain a credit information file about the Client including credit history.

17.6 The information given to the CRB may include: (a) personal information as outlined in 17.1 above; (b) name of the credit provider and that Tramontina is a current credit provider to the Client; (c) whether the credit provider is a licensee; (d) type of consumer credit; (e) details concerning the Client’s application for credit or commercial credit (e.g. date of commencement/termination of the credit

account and the amount requested); (f) advice of consumer credit defaults, overdue accounts, loan repayments or outstanding monies which are overdue by more than

sixty (60) days and for which written notice for request of payment has been made and debt recovery action commenced or alternatively that the Client no longer has any overdue accounts and Tramontina has been paid or otherwise discharged and all details surrounding that discharge(e.g. dates of payments);

(g) information that, in the opinion of Tramontina, the Client has committed a serious credit infringement; (h) advice that the amount of the Client’s overdue payment is equal to or more than one hundred and fifty dollars ($150).

17.7 The Client shall have the right to request (by e-mail) from Tramontina: (a) a copy of the information about the Client retained by Tramontina and the right to request that Tramontina correct any incorrect

information; and (b) that Tramontina does not disclose any personal information about the Client for the purpose of direct marketing.

17.8 Tramontina will destroy personal information upon the Client’s request (by e-mail) or if it is no longer required unless it is required in order to fulfil the obligations of this agreement or is required to be maintained and/or stored in accordance with the law.

17.9 The Client can make a privacy complaint by contacting Tramontina via e-mail. Tramontina will respond to that complaint within seven (7) days of receipt and will take all reasonable steps to make a decision as to the complaint within thirty (30) days of receipt of the complaint. In the event that the Client is not satisfied with the resolution provided, the Client can make a complaint to the Information Commissioner at www.oaic.gov.au.

18. Unpaid Seller’s Rights 18.1 Where the Client has left any item with Tramontina for repair, modification, exchange or for Tramontina to perform any other service in

relation to the item and Tramontina has not received or been tendered the whole of any moneys owing to it by the Client, Tramontina shall have, until all moneys owing to Tramontina are paid: (a) a lien on the item; and (b) the right to retain or sell the item, such sale to be undertaken in accordance with any legislation applicable to the sale or disposal

of uncollected goods. 18.2 The lien of Tramontina shall continue despite the commencement of proceedings, or judgment for any moneys owing to Tramontina

having been obtained against the Client. 19. General 19.1 The failure by Tramontina to enforce any provision of these terms and conditions shall not be treated as a waiver of that provision, nor

shall it affect Tramontina’s right to subsequently enforce that provision. If any provision of these terms and conditions shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

19.2 These terms and conditions and any contract to which they apply shall be governed by the laws of New South Wales in which Tramontina has its principal place of business, and are subject to the jurisdiction of the courts in New South Wales.

19.3 Subject to clause 13, Tramontina shall be under no liability whatsoever to the Client for any indirect and/or consequential loss and/or expense (including loss of profit) suffered by the Client arising out of a breach by Tramontina of these terms and conditions (alternatively Tramontina’s liability shall be limited to damages which under no circumstances shall exceed the Price of the Goods).

19.4 The Client shall not be entitled to set off against, or deduct from the Price, any sums owed or claimed to be owed to the Client by Tramontina nor to withhold payment of any invoice because part of that invoice is in dispute.

19.5 Tramontina may license or sub-contract all or any part of its rights and obligations without the Client’s consent. 19.6 The Client agrees that Tramontina may amend these terms and conditions at any time. If Tramontina makes a change to these terms

and conditions, then that change will take effect from the date on which Tramontina notifies the Client of such change. The Client will be taken to have accepted such changes if the Client makes a further request for Tramontina to provide Goods to the Client.

19.7 Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm or other event beyond the reasonable control of either party.

19.8 The Client warrants that it has the power to enter into this agreement and has obtained all necessary authorisations to allow it to do so, it is not insolvent and that this agreement creates binding and valid legal obligations on it.
