Mental Capacity Act 2005• For the purpose of your work in
health or social care it is important that you are aware of the individual’s agreement to your support or care.
• The presumption of capacity under the Mental Capacity Act takes effect at the age of 16.

she has had a stroke she is keen to carry on and has had a kitchen assessment from the Occupational Therapist who has said that she should carry on but have help with chopping the vegetables. Her support worker is worried about this, however, and insists on taking over all the cooking.
