1. PERMITTINGPlease note that the references provided herein are taken from the City of Eagan website and are subject to change. They are provided for informational purposes only. Landlord assumes no responsibility for the accuracy of such information and tenant is solely responsible for verifying and complying with all regulations in effect at the time of Tenant’s Work to ensure that it is in compliance with all applicable laws, statutes, codes, ordinances and regulations

a. PERMITS AND APPROVALSThe city of Eagan requires that contractors performing construction work within the city obtain appropriate permits before starting work. Prior to the commencement of construction, Tenant shall obtain all required permits and shall post such permits in a prominent place within the premises. Contractors must be licensed and bonded by the State of Minnesota. Building permit fees are based on project valuation, determined by the City’s Plans Examiner. Fees are collected at the time a permit is issued. Acceptable methods of payment are: first party check, cash, Money Order, Visa, MasterCard, Discover and American Express. Please contact Building Inspections at (651) 675-5675 with any questions regarding permit requirements.

b. FIRE INSPECTIONSEagan Fire Inspectors inspect new and existing commercial and multi-family buildings within the City. Inspection duties are completed to ensure that life safety issues and Fire and Building Codes are compliant. The Fire Marshall performs plan review of Fire Suppression and Fire Alarm installations. Fire Inspection staff also address complaints relating to Fire Code issues and concerns. Please provide Landlord with the following information for LL review:

You can send the CAD and PDF files via email as an attachment or an external link directly to the Tenant Manager or mail them a CD. Your tenant improvement drawings must be approved by Landlord prior to submitting for permit. Please allow 5-10 working days for Landlord review.

Be aware that we do NOT do preliminary reviews unless you have a specific question about something. Also, be advised that you will be receiving a plan approval letter and NOT be receiving a stamped set of plans.

1. Missing “Cover Page” or incomplete cover page. At minimum the cover page should have: Name & Address of project Location Map Contact name, number AND Email address for Owner/Tenant Contact name, number AND Email address for Architect Drawing index with revision dates Building codes

2. Storefront display light fixtures are visible from the exterior. You CANNOT mount any light fixtures to the bottom of the soffit.

3. Tenant altering LL provided sign circuit or installing their own.

4. Incorrect electrical panel location and/or size.

5. Supporting/hanging from the bottom chord of the roof truss.

6. New/relocating roof top units without supplying structural drawings.

7. Installing shelving or walls up against the storefront. (must remain a minimum 24” back)

Written Criteria:Storefront Design Control ZoneThe Tenant Storefront Design Control Zone is the area of the store extending from the storefront lease line into the store a minimum of five feet (5’-0”) across the entire width of the store. Since the appearance of this zone is critical to the overall store appearance, design solutions, and materials are expected to be of the highest quality. The design zone will be closely reviewed by Landlord for design and use.

Security systems shall be fully concealed. Gate style or stanchion security systems are not permitted if visible from the mall. Security cameras, vision panels, or “bubbles” shall not be exposed to public view in the Design Control Zone.

Purpose of Criteria:The Landlord’s Storefront and Design Control Zone criteria (first 5’ into the store) requires tenants to design their stores to a high level of quality and finish so that the visual and aesthetic impact on the customer enhances the shopping experience and differentiates the image of Simon as being the best place to shop.

While we recognize that store security is important, we feel that free-standing pedestal (or stanchion) systems produce a negative connotation, are confrontational, are detrimental to impulse sales (by creating a “threshold” affect) and generally detract from the shopping experience.

Accordingly, while we do allow concealed and “discreet” systems (such as Digital Door-Max®), pedestal systems are not allowed. To quote Sensormatic: “Pedestals can provide visible deterrence while concealed systems offer more discreet protection for upscale retail environments.”

Below is the minumum design requirements that must be used by ALL Food and Food Court Tenants for all kitchen prep areas.

This requirement is to prevent any mositure or dampness penetrating the demising wall(s) that can lead to damage to the food space and/or adjoining spaces.

Demising and/or concrete walls:1. Demising walls must be moisture resistant gypsum board w/ Sporgard™ (National Gypsum)

on metal studs. Other wall options acceptable by landlord would be Hardibacker prior to installing wall finishes or Ultracode drywall, by USG.

2. Install water proof membrane a minumum of 24” above floor.

3. FRP applied to all walls to a minumum height or 48” above wall base tile, and caulked with a silicone sealant.

4. Metal or PVC corner guard must be applied to all corners and caulked with a silicone sealant.

Flooring area:1. Floor tile and flooring base installed must be sealed. This application should be re-applied

semi-annually.

2. Floor drains must be installed in any food preparation area that require cleaning methods of hosing or washing walls. It is the tenant responsibility to make certain that all flooring is sloped for proper drainage to the floor drain(s).

Tile/Grout: Must have Durock and /or equal applied to studs.

Barricades must be erected if there is any construction that goes beyond or on the front wall of the tenant space in an open center. If the center is still under construction then no barricade is needed. These barricades must be painted with 3 coats of white paint and included graphics. Barricade graphics must be approved by Landlord prior to installation. Tenant contractor must maintain a safe environment for customers and employees during construction period. All work areas must be inaccessible or blocked off from customer/employee flow.

Barricade Construction Notes:1. No openings are permitted.2. All supporting must be concealed behind the barricade3. Placement & design must be approved in writing by LL PRIOR to installation.4. Signage: 2mm black pvc, 2’x4’ with white optima bold lettering.

* Food Court Barricades MUST go to top of ceiling to prevent dust in food court area.

Twin Cities Premium OutletsTemporary Tenant Signage Criteria

The guidelines established will ensure tenants are consistent with quality and are compatible with the architectural character of the center. This criteria is for signage that will be installed for a period of (12) twelve months or less. Signs shall be located only on the spaces and on the surfaces specifically provided for same on the building elevations. The appropriate location of each sign will be the Landlord’s decision. Signage size shall be dictated by the building type the tenant is located in. One storefront sign is permitted. Because each center differs, this criteria may be altered slightly to meet all Premium Outlet Center’s requirements. Submittals, Approvals, Installation, Insurance requirements all must conform to the established sign criteria for the Premium Outlet Center.

Prior to installation, sign contractor must check in at the Construction Trailer. If local jurisdiction requires a permit, please present a copy to the on-site Landlord representative at the time of check-in. It is the tenant’s responsibility to verify with the local jurisdictions if any permits for temporary signs are required.

DesignA minimum 8” x 11” drawing of the Temporary sign must be submitted for Landlord approval at least 2 weeks before installation for review/approval. Sample color chips of any special finishes if required must be attached. Upon no circumstances can the temporary sign be installed without prior approval and/or permit as required by local ordinance.

Signs shall be limited to letters and/or logos designating the store name/logo as set forth in signed lease documents between Tenant and Landlord. Tenant shall display their registered trade name/logo only.

Registered Trademark Symbols are permitted subject to Landlord review/approval fabrication requirements.

The colors and typestyles of all signs shall be subject to Landlord’s approval. The color of all lettering shall be compatible with the building color and provide sufficient contrast with the background color of the building wall on which the sign is located.

SizeThe size of the sign will be at the discretion of the Landlord. The size is based on the elevation of the building and neighboring signs.

The sign cannot exceed the size restrictions of the Center’s Sign Criteria.

TWIN CITIES PREMIUM OUTLETSTenant Improvement Temporary Tenants/Sign Criteria

OPTION 1

MaterialsIndividual cut out letters must be fabricated from Foam Plex or Ultraboard type material, painted approved color with 1/8” plex (same color) applied to face of letters/logo. The thickness of material is to be a minimum 1/4” to a maximum of ½” to prevent distortion, warping or buckling.

Installation Tenant is responsible for design, fabrication, and installation. Approved letters and/or logo will be attached to the building only with clear silicone. The silicone must be used as sparingly as the application permits. (“Little beads” of silicone on each letter; NO PENETRATIONS!)

MaterialsIndividual ¼” – ½” thick cut out letters from Foam Plex or Ultraboard, mounted to a 1/8” thick sintra or aluminum background panel via double sided tape with silicone. Typical maximum height of the background panel is 2’ high, but varies according to permanent sign sizes required for permanent type tenant signage in Center’s criteria.

InstallationPanel to be screwed to fascia. Screw head to be covered with background panel color. Sign installer must use the minimum amount of screws to securely fasten the sign to the building.

Option 2 examples:

When Tenant vacates or installs permanent sign, Tenant is responsible for restoring the fascia of the building back to its previous condition, i.e.: removal of any silicone residue, patching holes, stucco repair, re-painting etc. Final approval and acceptance of any such repairs shall be solely at the discretion of a representative of Landlord. Inspection of completed repair must be performed by Tenant and inspected and accepted by a representative of the Premium Outlet Center.

Additional Center VisibilityAny additional visibility of a sale including flyers, etc. must be coordinated with the on-site Center Management and approved by the Tanger Outlet’s Marketing Department.
