Thesis:

Entrenching the right to regulate in the international investment legal framework:

the African experience

Description:

Talkmore criticises the existing international and African foreign investment (FDI) regimes for

its lack of protection of “host government policy space”. The current regime regulates in

favour of foreign investors at the expense of domestic public policy objectives. He

successfully argues in favour of entrenching the host governments’ right to regulate in

Africa’s international investment law regime in aid of the realisation of sustainable

development and the protection of human rights, including public health and safety, labour

rights and environmental protection. He off ers suggestions on how African governments

can adequately entrench their right to regulate without undermining the potential benefi ts

from FDI. The study includes a proposed International Investment Agreement that can be

used to achieve these goals.

Thesis:

The interface between customary laws of succession in the traditional justice system and

the formal justice system in Kenya

Description:

Using Historical School of Jurisprudence as its theoretical framework, Ms Mutema’s study

sought to determine the interface between African customary laws of succession in the

traditional justice systems and the formal justice systems (FJS) in Kenya. The major fi ndings of

the study indicated that though progressive recognition and application of customary laws in

Kenya has been realised, there are several impediments to the integration and enforcement

of customary succession decisions within the FJS. In order to enhance this integration and

enforcement, Ms Mutema’s novel approach is the development of a set of guidelines.

Thesis:

The intersection between food security and food control imperatives and the distribution

of powers between diff erent levels of government within the South African multilevel

governance system

Description:

South Africa produces enough food to feed its people, yet household food insecurity is

unacceptably high. It is easy to argue that addressing food insecurity is the responsibility of

national and provincial governments because they regulate food production and agriculture.

However, Ms Johnstone argues, combining a rights-based and a food systems approach, that

municipalities must help realise the right of access to food. She motivates this with an interpretation

of local government’s constitutional powers. She further unpacks local government’s role in

more detail with respect to two issues. The fi rst is a municipality’s role in preventing agricultural

land from being converted for development. The second is how a municipality can use its town

planning powers to create towns and cities where everyone can make healthy food choices.

Thesis:

Decentralisation and recentralisation waves in Anglophone Southern Africa: Factors

Driving the Ebb and Flow of Power

Description:

Madhekeni observed in South Africa, Zimbabwe, Namibia, Botswana and Malawi that once

reforms that promote decentralisation have been adopted, they are shortly followed by a wave of

recentralisation, which lasts until it, in turn, is replaced by a fresh push for decentralisation. In

explaining the ebb and fl ow of power, Madhekeni argues that governments always prefer to

centralise power and maintain the status quo until a political or economic crisis arises, which opens

up spaces in which other actors are able to negotiate for decentralisation. However, because

decentralisation is driven by crisis resolution negotiations, when it comes to implementation, it is

always accompanied by a fresh wave of recentralisation. Decentralisation can, however, be

sustained by measures that include constitutional protection and strengthening the rule of law.
