LEHIGH COUNTY LAWYER’S CHARITABLE FUND GRANT The Bar Association of Lehigh County (“BALC”) has established a fund with the Lehigh Valley Community Foundation known as the Lehigh County Lawyer’s Charitable Fund. The Fund is made possible by the generosity of our members. On an annual basis, BALC awards grants of up to $5,000.00 each to selected Lehigh Valley 501(c)(3) organizations. Interested Lehigh Valley 501(c)(3) organizations are invited to submit a grant Application to BALC in accordance with the below Application Guidelines. 2021-2022 Campaign has an open theme. All Greater Lehigh Valley 501(c)(3) organizations are invited to apply. Application Guidelines To apply for a Lehigh County Lawyer’s Charitable Fund Grant, Applicants must comply with each of the following:

1. Each Applicant must be a 501(c)(3) corporation in good standing, which maintains an active presence in the Lehigh Valley, and provides a product or service which benefits Lehigh Valley communities and/or residents.

2. Complete the attached Application and required narrative. 3. E-mail the completed Application and the narrative as a single file to the BALC Executive Director, Ray

Bridgeman at: [email protected]. In the Subject Line reference: Application for Lehigh County Lawyer’s Charitable Fund Grant. Questions regarding the grant process should be directed to Mr. Bridgeman at (610) 433-6204, ext. 15.

4. Applications must be received by 5 p.m., October 31st. Applications not received by the deadline will not be considered.

Please note that: • $5,000 USD is the maximum award (unless special approval is received by the BALC Community Service

Committee). Smaller grant requests are encouraged. • The proposed use of Lehigh County Lawyer’s Charitable Funds must provide some clear benefit to the Lehigh

Valley as a whole, its communities, and residents in the form of providing needed services, new knowledge, developing or sharing of resources, or good practice in learning, teaching, or assessment, or providing disaster relief.

• Applicants not selected for grants are encouraged to submit an application the following year. • Successful applicants agree to provide to BALC, no later than July 1st of the year in which the grant is awarded, a

brief written summary detailing how the Grant was utilized or will be utilized by the end of the calendar year, and authorizing BALC to post the summary on the BALC website.

• Funds from the LCLC Fund Grant may not be used for: o Registration for, travel to, or accommodation at conferences. o Internal staff training and development (although this may be a secondary outcome); and o Fundraising.

Process for Making Awards The BALC Community Services Committee will evaluate the applications and award grants based on guidelines, committee procedures and approval processes. Grants will be awarded in the first quarter of the year following the Application deadline.

Negligence—Effect of Guilty Plea.

Jason Mertz was a Whitehall Township police officer who was dispatched to the home of the Defendant, William Sturtevant. When Mertz entered his home, Sturtevant fired his shotgun, seriously injuring the officer. Sturtevant pleaded guilty to Aggravated Assault, and during his allocution, admitted to the facts alleged against him. Officer Mertz and his wife then filed a civil action against Sturtevant, and moved for partial summary judgment on the issues of negligence and causation, based on Sturtevant’s guilty plea al-locution.

In a negligence case, a plaintiff must demonstrate that the defendant owed a duty, that he breached that duty, that the breach caused the injury, and the actual loss suffered. Summary judgment may be granted in a civil case based upon a guilty plea in a criminal case where the operative facts are identical. A guilty plea constitutes an admission to all of the facts alleged in a criminal indictment.

The Court found that the operative facts in the criminal case were identical to those that could be litigated in the civil case. Sturtevant’s guilty plea contained every fact neces-sary to enter summary judgment on the issues of liability and causation. The Court granted Mertz’ motion for partial summary judgment.

MEMORANDUM OPINION

JohNsoN, P.J., June 17, 2021. On September 9, 2017, Plaintiff, Jason Mertz, was employed as a Whitehall Township police officer. On the above-stated date, Defendant, William Sturtevant, was the owner of a home located at 4721 Main Street, Whitehall, PA 18052. Prior to the incident giving rise to this complaint, Defendant’s home had been burglarized. On the evening of September 9, 2017, Defendant armed himself and went to his home and secreted himself in a second-floor closet armed with a shotgun in anticipa-tion of the burglars returning. During that evening, Defendant believed he heard suspicious noises in the home and contacted the Whitehall Police Department. Plaintiff was one of the police of-ficers dispatched to Defendant’s home. Plaintiff and another of-ficer entered the home through a basement entrance when De-

fendant kicked open the basement door and fired a shotgun blast striking and seriously wounding Plaintiff. Thereafter, Defendant was charged by the Lehigh County District Attorney with Aggra-vated Assault.

On November 18, 2019, Defendant entered a guilty plea to Aggravated Assault which stated that Defendant “recklessly caused serious bodily injury to an officer, Officer Jason Mertz of the Whitehall Township Police Department, while in the performance of his duty to wit: shot Officer Mertz with a shotgun, causing seri-ous bodily injury.” As part of the guilty plea, Assistant District Attorney Diane Marakovits set forth the underlying facts to the Aggravated Assault and at the conclusion of the review of facts, the Court asked Defendant whether he agreed with those facts. Under oath and on the record, he stated that he did agree with those facts. Based on the guilty plea and admissions made during that plea, Plaintiff argues that this Court should grant partial summary judg-ment on the issues of liability and causation finding that Defendant was negligent and the negligence caused bodily harm to the Plain-tiff. For the reasons set forth below, we agree.

To prevail in a negligence case, a plaintiff must demonstrate the following elements: (1) the defendant owed a duty to the plain-tiff; (2) the defendant breached that duty; (3) a casual relationship between the breach and the resulting injury suffered by the plain-tiff; and (4) actual loss suffered by the plaintiff. Schemberg v. Smicherko, 85 A.3d 1071 (Pa. Super. 2014). In Com., Dept. of Transp. v. Mitchell, the Supreme Court of Pennsylvania held that summary judgment in a civil case could be granted based upon a guilty plea in a criminal case, the operative facts of which were identical to those which would be litigated in a civil case, and which, if proved, would establish civil liability. Commonwealth of Penn-sylvania Department of Transportation v. Mitchell, 517 Pa. 203, 535 A.2d 203 (1987). Further, for purposes of whether summary judgment could be granted based upon guilty plea in criminal case, the fact that defendant pled guilty to one count of indictment did not produce a different result than if he had been convicted after a jury trial, as a guilty plea constituted an admission to all of the facts alleged in the indictment. Id.

“History and Expansion of the Panama Canal”

Originally, the widening of the Panama Canal by 130 feet for its entire length of approximately 50 miles was slated for completion in 18 to 20 years but was then reduced for completion within 4 to 6 years while still under USA control. This meant that a tremendous amount of blasting at simultaneous points along the canal would be necessary to achieve the new completion deadline. Come and hear from one of the experts on the job how the accelerated program imposed many challenging and logistical concerns and why each and every blast had to perform flawlessly.

R. Frank Chiappetta. MSc., P.Eng., has been the President and Explosives Applications Engineer with Blasting Analysis International, Inc., (BAI) since 1988. BAI is an independent international consulting group based out of Allentown, PA, and works in all 50 States and 26 other countries.

Specialties include: • Custom blast designs; Safety and blasting audits • Vibration/airblast/fumes and dust controls • Blast damage inspections • Electronic detonator applications • Presplitting and highwall controls; On-site training

Some of Frank’s more notable projects with BAI include the First Major Expansion and Deepening of the Panama Canal between 1994 and 2002, and Construction of Lehigh Tunnel No. 2.

Frank has a MSc. degree in Mining Engineering from Queen’s University Canada, with a specialty in explosives applications. He is currently the principle blasting consultant to many mining, quarrying and construction companies worldwide.

He is one of four authors for the textbook entitled “Explosives and Rock Blasting”. In this publication, Frank was directly responsible for the Blasting Theory and Ground Vibration/Airblast Control chapters, and he also contributed to the Presplitting, Construction, Explosive Safety and Blast Design chapters.

In 1990, Frank received the Distinguished Service Award from the International Society of Explosives Engineers (ISEE).

A recovering lawyer herself, Jennifer received her law degree from New York University School of Law in 1996 and her undergraduate degree from Brandeis University, magna cum laude, in 1993. She began her legal career as a litigation associate at Sills Cummis & Gross, spent many years practicing employment law at Littler Mendelson’s New York office and was in-house with a former client for two years.

Edward C. Miller has spent his entire career creating effective and profitable marketing and business development strategies at large and small law firms, for practice areas and industry groups, and individual attorneys.

Prior to launching ESQuisite Marketing, Miller was the Chief Marketing Officer of Norris McLaughlin, a mid-sized law firm with offices in Bridgewater, NJ, New York, NY, and Allentown, PA for nearly 20 years. Before that, Ed was the Practice Development Coordinator at Riker Danzig Scherer Hyland & Perretti in Morristown, NJ.

Ed earned his B.S. in Marketing Management from Syracuse University.

Steven Bergin, a Digital Forensics Examiner with Cybertek Forensics, Inc., has over 13 years of combined experience in the Information Technology field with the United States Air Force and the Federal Bureau of Investigation – Philadelphia Division.

Steve worked as a Digital Forensics Examiner at the Philadelphia Regional Computer Forensics Laboratory, (RCFL), located in Radnor, PA and Network Administrator for the Technical Surveillance squad for the Federal Bureau of Investigation (FBI) Philadelphia division.

Prior to his time with the FBI, Steve served with the United States Air Force. He also served on active duty for 5 years with the United States Navy, stationed in Long Beach, CA where he was honorably discharged after the first Persian Gulf war.

Research has shown that within weeks, only about 10% or so of the resolvers accomplish their resolutions – with the majority of the other resolvers abandoning them. And lawyers?? How many of those in practice do “take five”, or even four? How many don’t take anything? We feel we have to be super lawyers.

In this informative presentation you will hear several suggestions on how to make New Year’s resolutions stick and not fizzle out like fireworks on a rainy night. But in this case they may not just light up the sky, but brighten your life – both personally and professionally.

Recent studies have shown that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession. The statistics are compelling and clearly indicate that 1 out of 3 attorneys will likely have a need for substance use or mental health services at some point in their careers.

Mr. Quinn will discuss: 1. The early warning signs of impairment, with special

emphasis on stress, burnout and trauma, including the mental health impact of the COVID-19 pandemic.

2. Well-being strategies that really work. 3. The free services that Lawyer Assistance Programs

provide to lawyers, judges, their family members and law students.

4. A close look at what barriers exist that prevent lawyers and judges from seeking the help they need.

Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. She was one of the first 20 in the nation to have achieved this designation. (Currently less than 200 in the nation have earned the degree.) She holds a Certification in Computer Programming from Maxwell Institute, a Certification in Web Site Design from Temple University, and a B.A. from Temple University, where she also did two years of graduate studies in Criminology.

Ellen managed inside law firms for twenty years. Most of that time was spent in a mid-size (35+ attorney) firm environment. She launched her consulting practice in 1998, and joined the Pennsylvania Bar Association in 1999.

Ellen has been a frequent author and speaker on law firm management issues on a national, regional and local level.

In this case, Defendant’s guilty plea itself contained every operative fact to enter summary judgment against Defendant on the issues of liability and causation in the above-captioned civil case. The operative facts of the criminal case are identical to those which would be litigated in the above-captioned civil case, and which, if proven, would establish civil liability. Here, the very terms of Defendant’s guilty plea acknowledge that Defendant “reck-lessly” caused “serious bodily injury” to the Plaintiff by shooting him with a shotgun. Based on this guilty plea, which also included an extensive review of the operative facts of the criminal case which are identical to the above-captioned civil case, the Court finds that summary judgment must be entered in favor of Plaintiff and against Defendant as to liability and causation.

Therefore, Plaintiff ’s Motion For Partial Summary Judgment On Liability And Causation filed January 15, 2021 is GRANTED.

ORDER

AND NOW, this 17th day of June, 2021, upon consideration of Plaintiff ’s Motion For Partial Summary Judgment On Liability And Causation filed January 15, 2021, after Argument held May 11, 2021 and for the reasons set forth in the accompanying Mem-orandum Opinion;
