steinberg, J., December 7, 2015. The defendant, Darren James, is charged with Persons Not to Possess, Use, Manufacture, Control, Sell or Transfer Firearms,1 Possession With Intent to Deliver a Controlled Substance,2 Possession of a Controlled Sub-stance,3 and Possession of Drug Paraphernalia.4 A search of an apartment where he resided uncovered both a Taurus .45 cal. firearm and marijuana. The defendant was statutorily prohibited from possessing a firearm.
On September 18, 2015, a “Motion To Suppress” was filed by counsel for the defendant challenging the search of the apart-ment, which was rented by Valencia Glover. It is alleged that the probation officers, who initiated the search, lacked “reasonable suspicion” to do so, and the evidence seized must be suppressed.

A suppression hearing was held on November 9, 2015, during which the Commonwealth presented the testimony of Officer Robert Nichelson, who is assigned to the Gang Intelligence Unit of the Lehigh County Probation Department, and Officer Miguel Villa of the Allentown Police Department. The Commonwealth also introduced into evidence a written consent form signed by Ms. Glover and the defendant permitting the search of the apart-ment identified as 35 North 10th Street, 4C in Allentown.
BACkGROUND
On June 16, 2015, Officer Robert Nichelson and Officer Michael Zagorski went to the aforementioned apartment as part of their supervision of the defendant. The defendant was under supervision due to convictions for Possession With Intent to De-liver a Controlled Substance and Resisting Arrest. The defendant was previously made aware of the conditions of his supervision, which included prohibitions regarding any departures from the Commonwealth of Pennsylvania.
Officer Nichelson had received information that the defen-dant had recently traveled to New York with Shane Preston, who was also under Officer Nichelson’s supervision. The information regarding Mr. Preston, a confirmed Blood gang member, was provided by the N.Y.P.D.
Based upon the information in his possession, Officer Nichel-son decided to conduct a supervisory interaction with the defendant at his identified residence. When the probation officers arrived at the apartment, the defendant was in the living room, and Ms. Glover was in the bathroom. The defendant was confronted with information regarding traveling to New York with Mr. Preston, and admitted he had done so. However, he denied any gang affiliations, but admitted that he “did things” for gang members for “protec-tion.” According to the defendant, he claimed that he went to New York with Mr. Preston to pay a fine.
Officer Nichelson, with the information provided by the defendant, requested to search the apartment. Ms. Glover con-sented to the search, and became agitated when she learned that the defendant had provided Mr. Preston a key to the apartment.

The defendant told Mr. Nichelson that if he found anything, the items were placed in the apartment by Mr. Preston.
The search of the apartment focused on a bedroom closet with men’s clothing, and any evidence of “gang affiliations.” The search uncovered what is called “color banging” or clothing with colors associated with known gangs. Additionally, marijuana was located in a container within a blue hamper bag.
The probation officers stopped their search upon the discov-ery of the marijuana, placed the defendant in custody, and called the Allentown Police Department. Officer Villa arrived and the written consent form was signed by the defendant and Ms. Glover. The firearm was located in the same hamper bag.
DISCUSSION
“Probation is a form of authorized supervision aimed at re-habilitating and reintegrating a law breaker into society as a law-abiding citizen … [and] is deemed a constructive alternative to imprisonment. ... One basic assumption of the institution of proba-tion is that the probationer is more likely than the ordinary citizen to violate the law. ... As a result, individuals under supervision generally have limited Fourth Amendment rights, but they are still entitled to certain constitutional protections.” Commonwealth v. Chambers, 55 A.3d 1208, 1212 (Pa. Super. 2012) (internal quota-tions and citations omitted); 42 Pa. C.S. §9912(a).
Even though a probationer has a diminished expectation of privacy, there are statutory limits on a probation officer’s author-ity to search the property of a probationer. Commonwealth v. Wilson, 620 Pa. 251, 256-57, 67 A.3d 736, 738 (2013); 42 Pa. C.S. §9912. Section 9912 permits a probation officer to conduct a war-rantless search of the property of an individual under supervision if the officer has reasonable suspicion to believe that the property contains contraband or other evidence of violations of the of-fender’s conditions of probation. Id. at 257, 67 A.3d at 739. “Pa-rolees agree to ‘endure warrantless searches’ based only on reason-able suspicion in exchange for their early release from prison.” Commonwealth v. Curry, 900 A.2d 390, 394 (Pa. Super. 2006) (citation omitted).

In establishing reasonable suspicion, the fundamental in-quiry is an objective one, namely, whether “the facts available to the officer at the moment of the [intrusion] … warrant a man of reasonable caution in the belief that the action taken was appropri-ate.” Terry v. Ohio, 392 U.S. 1, 21 (1968) (internal quotations omitted); Commonwealth v. Zhahir, 561 Pa. 545, 551, 751 A.2d 1153, 1156 (2000). “The determination of whether reasonable suspicion exists is to be considered in light of the totality of the circumstances.” Commonwealth v. Colon, 31 A.3d 309, 315 (Pa. Super. 2011) (citation omitted); see also, Commonwealth of Penn-sylvania v. Moore, 805 A.2d 616, 620 (Pa. Super. 2002). For ex-ample, in Curry, supra at 395, the observation of a crack pipe in plain view provided a parole officer with reasonable suspicion to conduct a property search of a defendant’s apartment.
Section 9912 provides a list of factors as guidance in deter-mining the existence of reasonable suspicion: (1) the observations of officers; (2) information provided by others; (3) the activities of the offender; (4) information provided by the offender; (5) the experience of the officers with the offender; (6) the experience of officers in similar circumstances; (7) the prior criminal and super-visory history of the offender; and (8) the need to verify compliance with the conditions of supervision. 42 Pa. C.S. §9912(d)(6).
All of the information in Officer Nichelson’s possession is relevant in reaching a reasonable suspicion conclusion that either contraband or other violations of supervision would be uncovered by searching the defendant’s apartment. “[R]easonable suspicion is a less demanding standard [than probable cause] and can arise from information that is less reliable than that required to establish probable cause.” Commonwealth v. Lechner, 454 Pa. Superior Ct. 456, 466, 685 A.2d 1014, 1018 (1996), citing Alabama v. White, 496 U.S. 325, 330 (1990); Moore, supra.
Officer Nichelson, who has significant gang training and knowledge of gangs, was made aware that the defendant left the Commonwealth of Pennsylvania without permission with a known gang member. Prior to any search, the defendant confirmed Of-ficer Nichelson’s suspicions, and also admitted that he permitted the known gang member seemingly unfettered access to the apart-

ment of Ms. Glover, where he resided. Although he did not admit gang membership, he conceded he did favors for “protection.” See 42 Pa. C.S. §9912(d)(6).
All of the information in Officer Nichelson’s possession, in-cluding the admission by the defendant that he violated conditions of supervision by traveling to New York, more than satisfied the reasonable suspicion threshold, and justified the search of the apartment. Commonwealth v. Williams, 547 Pa. 577, 588, 692 A.2d 1031, 1036 (1997) (“A search will be deemed reasonable if the totality of the evidence demonstrates: (1) that the parole officer had a reasonable suspicion that the parolee had committed a parole violation, and (2) that the search was reasonable related to the parole officer’s duty.”). See United States v. Benjamin, 2010 WL 2978042, *5 (E.D. Pa. July 26, 2010) (if reasonable suspicion ex-isted that defendant was violating a condition of supervision, the officer surely had reasonable suspicion that evidence related to the violation might be found in the defendant’s home).
For all the foregoing reasons, the motion to suppress must be denied.5
ORDER
AND NOW, this 7th day of December, 2015, upon consid-eration of the defendant’s “Motion to Suppress” filed on Septem-ber 18, 2015, and after a hearing held in this matter on November 9, 2015;
IT IS HEREBY ORDERED that said motion is DENIED.

Judge Richard E. Fehling was appointed as United States Bankruptcy Judge for the Eastern District of Pennsylvania on Valentine’s Day, February 14, 2006. Prior to his appointment, Judge Fehling had been an associate, shareholder, director, and General Counsel at Stevens & Lee. He had been Co-Chair of the Stevens & Lee Bankruptcy Group for 17 of those years. He has served as the Chair of the Pennsylvania Bar Association Bankruptcy Committee (1992-95), of the Berks County Bar Association Bankruptcy Committee (1993), and of the Eastern District of Pennsylvania Bankruptcy Conference (1996-97). He received his B.A. from Yale University and his J.D., magna cum laude, from Dickinson School of Law, where he received the Walter Harrison Hitchler award for graduating first in his class.

Explore how the new Federal Rule of Civil Procedure 37(E) affects e-discovery in the Cloud. The new FRCP went into effect in December 2015. These rules will alter the way companies establish and maintain their information retention policies and will change the way lawyers conduct discovery.
