SECTION 1 WHO IS WHO IN TWINNING

1.1 DELEGATION OF THE EU IN ZAGREB Trg žrtava fašizma 6, 10 000 Zagreb Tel: +385 (1) 48 96 500 Fax: +385 (1) 48 96 555 [email protected] The Delegation of the EU (DEU) in Zagreb is involved in a Twinning project throughout its life cycle: it supervises project preparation, endorses contracts and monitors implementation. Two groups of people deal with Twinning projects in the Delegation: the Twinning Coordination and Sector Task Managers. The Twinning Coordinator of the DEU, Ms Caroline Frieh-Chevalier reports directly to the Head of the Operations Section for Economic Development, Justice and Home Affairs, civil Society in the Delegation, Mr Paolo Berizzi. The Twinning Coordination is responsible for providing guidance on, and ensuring proper application of, the Twinning rules and procedures. His/her main tasks are:

• Instrument management responsibilities: assisting with all aspects of the procurement process, participating in evaluation committees as well as providing ex-ante control of files coming from the Contracting Authority - CFCA, assisting with contract preparation (including budget)/ commenting and endorsing TW contract addendum, checking side letters, monitoring ongoing twinning projects and respect of contractual obligations, facilitating RTA installation.

• Horizontal tasks: acting as Help Desk on Twinning procedures and as a focal point for coordination between the different actors involved in Twinning (i.e. CODEF, CFCA, DG Enlargement, Sector task managers of the DEU, Resident Twinning Advisers, Member State administrations, etc).

è Newly arriving RTAs are requested to get in contact with the Twinning Coordinator for all issues related to their installation in Croatia. The Twinning Coordinator is also the primary contact point for Member States’ administrations during the drafting phase of the contract.

Sector Task Managers (DEU and CFCA) are responsible for monitoring project implementation and progress. They are the main interlocutors of the RTAs and the Project Leaders for all sector-specific matters and project substance. During the lifetime of a Twinning project it is essential that RTAs and Task Managers meet regularly to discuss progress and any difficulties, as well as changes to the work programme (in most cases Project Implementation Unit (PIU) monthly meetings are defined in Contract). To facilitate

follow-up, it is also essential that Task Managers be invited to attend the meetings of the Steering Committees or corresponding working groups. The list of Task Managers responsible for the CARDS, PHARE and IPA twinning projects in Croatia is included in Annex B 4.

Ulica grada Vukovara 284 (building C), 10 000 Zagreb Tel: +385 (1) 4591-245 Fax: +385 (1) 4591-075 Email: [email protected] The Central Finance and Contracting Agency (CFCA) is the Contracting Authority for Institution Building programmes which have been decentralized, including Twinning. CFCA has been nominated as an Administrative Office as well as the National Contact Point by the Ministry of Foreign Affairs and European Integration in their letter of 24 August 2005. The office of the Croatian National Contact Point (NCP), is responsible for parts of the life cycle of a Twinning project, in particular for selection of partners. The preparation of contracts as well as monitoring of project implementation, including budget control and payments, is done directly by the CFCA. From the moment of accreditation for decentralization is provided to the Croatian authorities, the Croatian NCP became responsible for the complete life cycle of the Twinning projects. The Croatian NCP for Twinning is Ms. Štefica Belčić The CFCA currently has cca 100 employees, including the Executive Director’s Office, Directorate for Preparation and Implementation of Projects, Contracting Directorate, Quality Assurance Directorate. Finance and Accounting Directorate, Common Affairs Directorate, Education and HRD Directorate, Independent Internal Audit Department and Twinning Instruments Coordination Office. Please refer to the table in Annex B3 to find out about CFCA staff. Reporting to the PAO, the CFCA is responsible for financial issues related to Twinning, including:

• Budget control: monitors budget expenditure, approves amendments to the budget and assures cash flow in the project’s accounts;

• Payments: checks quarterly invoices and requests for advances and verifies their conformity with the financial rules. Prepares orders for payment on behalf of the PAO. The CFCA is also responsible for the non-Twinning part of programmes, i.e. investment and technical assistance; it is responsible for procurement and tenders, and finalises contracts with external contractors.

The CFCA is the chief coordinating body for Twinning issues from the Croatian side during contract preparation. In practice, this means:

• The CFCA coordinates the Twinning selection meetings with the Croatian line ministries;

• During the contract preparation and endorsement phase, the CFCA liaises with the beneficiary ministries. It provides advice and support to the ministries regarding procedures, rules and budgetary matters; puts forward comments on successive drafts.

• Any formal correspondence coming from the Croatian administration to the Commission should be copied to the NCP’s office.

1.5 CHANGES IN TWINNING The new Common Twinning Manual (hereinafter 2009CTM) was introduced partly to bring the Twinning rules into line with the IPA implementing regulation, partly to provide a

common set of rules for Twinning across all programmes in which it is an instrument and partly to take account of changes flowing from enlargement. It does not overhaul the existing Twinning rules and procedures, but aims at adjusting them in view of experience and lessons learned. The New 2009CTM is applicable to all Twinning Contracts for which the official letter of selection will be issued as from 1 September 2009.

Ø This means that "soft" implementation issues for ALL Twinnings (such as reporting requirements/formats, issuing of side letters or addenda, procurement procedures for concluding contracts, etc) are to be handled according to the 2009CTM.

Ø For those issues, however, those have budgetary consequences as they are connected with budget lines which are different in the different manuals that TW Manual has to be applied under which the contract had been signed.

Compared to the previous Twinning Manual, there have been some changes:1 New definition of geographical areas for the authorisation of a possible third assignment for RTA’s: art 2.2.2 (page 16)

As a rule, RTAs are seconded for at least twelve consecutive months, but no more than three years in total in any one country. They must serve on a full-time basis. The duration of the secondment is fixed at the outset in the Twinning Contract. RTAs may only take up two (2) successive Twinning assignments, regardless of the programme that is the source of funds. Thereafter, RTAs must return to their home administration to reacquaint themselves with the latest developments in the relevant sector and, if applicable, the relevant acquis and related administrative practice. A third assignment as RTA will only be possible under the following conditions: (1) It must take place in a geographical area which is different from the one in which the two preceding RTA assignment took place. The five (5) areas which are presently open to Twinning are:

(i) 12 countries of the 5th and 6 th Enlargement2, (ii) Candidate Countries3, (iii) Potential Candidate Countries4, (iv) Southern Mediterranean region and (v) Newly Independent States

(2) The RTA must, within the period stretching over the three RTA assignments have returned once to his/her home administration for a period of at least 6 months for re-acquaintance with the Community Acquis /European Union Policies. There can be no third RTA assignment in the same geographical area. New terminology used for ‘legal duration’: art 4.2 and Annex A ‘Special Conditions’ of the Twinning Manual (page 56)

To be in line with the ‘Special Conditions’ of a grant contract as outlined in the Practical Guide, the ‘legal duration’ is defined as the ‘execution period’ and the duration of the Work Plan is defined as the ‘implementation period of the Action’. The execution period of the Twinning project will end 3 months after the implementation period of the Action (Work Plan). The legal starting date of projects is determined by the date of notification by the Contracting Authority of the contract signed by all parties. The implementation period of the Action is starting with the arrival of the RTA.

Harmonisation of the role for study visits by BC officials to MS under IPA: art 5.7.2.

The PHARE selection proceedings have in so far as possible been aligned on the IPA (TF) selection format. Costs for travel by BC officials from their capitals to a MS or between MS under IPA costs have to be carried by the BC administration as co-financing.

Uplift of the ceiling for supply of services has been incorporated in the manual: art 7.6.

The uplift of the ceiling for the supply of services under a Twinning contract to € 10.000 per budget item has been incorporated in the Twinning Manual.

Twinning Review Missions: art 9.2.2.

The objective of these Twinning Review Missions are the assessment of the sustainability of the Twinning project’s results and the long term impact on the project’s objectives and dissemination of good practice via a database of Twinning Review Mission reports.

Uplift of the ceiling for visibility costs: art 9.4.

The ceilings for visibility costs in Twinning projects have been raised to € 5.000 for projects up to € 1.000.000 and to € 10.000 for projects over € 1.000.000.

To be in line with the "Model Expenditure Verification Report" of a grant contract as outlined in the Practical Guide, Annex A6 has been thoroughly reviewed.

Selection Fact Sheet for IPA has been refined: Annex C7

In order to improve the quality of the feedback to successful and non-successful bidders, the Selection Fact Sheet for selection under IPA has been modified. A proposal can now receive the score "adequate", "partly adequate" or "non adequate" for each of the different criteria, and there is more room for comments.

Templates for Side Letter and Addenda: Annexes C12, C13 and C14

Following several requests from Twinning partners and other users of the Manual, optional templates for side letters and addenda to Twinning contracts and instructions for their preparations have been added in new annexes to the manual.

SECTION 2 RTA INSTALLATION TIPS

The information presented in this section is largely based on the experience of the RTAs who have been working in Croatia since 2002. Every future RTA should attend a two-day seminar organised by the Twinning Coordination Unit in DG Enlargement in Brussels. The participants will receive guidance on the procedures governing Twinning, as well as have a chance to discuss the substance of their projects with representatives of the relevant DGs. The seminars are held every six months and each RTA receives an individual invitation to the training. The twinning coordinator of the DEU will contact the newly RTAs for every session of RTAs training organised by DG ELARG. It is strongly recommended that RTAs prepare their request for advance payment while still in the home country and send it to the Contracting Authority as soon as they are notified of the project’s endorsement (see Financial Management, Section 3). It usually takes a couple of weeks for the money to be transferred to the RTA’s account. Some RTAs prefer to wait until they receive the advance before moving to Croatia; others start moving immediately after endorsement, especially if they are accompanied by family members or involved in a project that needs to begin urgently. The choice is yours. Upon arrival in Croatia, you should contact the Twinning Coordinator at the DEU. The Twinning Coordinator will arrange a short meeting with you and the Sector Task Manager to discuss your installation answer any questions and discuss any important issues of substance related to your project. You are also requested to fill out a registration form attached to the mission letter and fax or e-mail it to the ECD so that we have your contact details in Croatia. (See 2.1.2 of the welcome pack for the mission letter) Before moving, the RTA must find a suitable hotel where he/she is to stay for a maximum of 30 days (see the list of hotels in Chapter 2 of this section). In case of moving, the RTA must obtain prior approval from the CFCA for his/her removal estimates. The RTA must obtain at least 2 quotes from removal companies. They are expected to choose the most economically advantageous offer and present it to the CFCA for approval prior to effecting the removal. There is no longer any need for customs clearance for EU citizens arriving from other EU countries. Once in Zagreb, the RTA must find a flat (see the list of selected real estate agencies operating in Zagreb, pp 13-14).

è Newly arriving RTAs are requested to get in contact with the DEU or CFCA Twinning Coordinator. They will be of assistance in case of any installation problems and will provide guidance on financial reporting and eligibility of costs.

2.1 STATUS OF RTA IN THE REPUBLIC OF CROATIA Visas are not required for EU citizens. In order to cross the border of the Republic of Croatia an EU citizen needs a valid travel document or another document certifying his/her identity and citizenship. 2.1.1 Residence Permit

All foreigners that reside in Croatia need to register with the authorities. For this purpose, there is a need to submit an application for the issuance of a permit for the first temporary residence to a police station. In case if the residence permit needs to be prolonged, this must be requested from the police station at least 30 days before the expiry of the valid temporary residence permit. All EU citizens will obtain an EU citizen's residence card or a temporary residence card. A dependant family member who is not an EU citizen will also be issued with a document of residence. In order to request the residence permit, the RTA and his dependants must accompany the application by the following documents: • A copy of the valid travel document. • Two (2) photographs - size 3x3,5 cm. • A proof of a guaranteed place to live. • A proof on medical insurance (foreign medical insurance is also valid, i.e. a certificate

from the Croatian Institute for Health Insurance which is issued to a foreigner on the basis of the certificate issued by a police precinct/station).

• Mission Letter from the DEU indicating the duration of stay and monthly income and allowances (see section 2.1.2 on mission letters); the mission letter is issued upon the request of the RTA.

• A certificate that he/she has not been sentenced (convicted) from the state of which he/she is a national or in which he/she has his/her permanent residence (it is enclosed only to an application for the issuance of a permit for the first temporary residence).

Parents are obliged to enclose to an application for their children for the issuance of a permit for the temporary residence the following: • form of application 1a • Two (2) photographs - size 3x3,5 cm • a copy of the valid travel document

• birth certificate • a proof on medical insurance (foreign medical insurance is also valid, i.e. a certificate

from the Croatian Institute for Health Insurance, which is issued to a foreigner on the basis of the certificate issued by a police precinct/station).

• If children will attend a school in Croatia, it is necessary to enclose a proof that they are signed in one school.

Parents present the application at Police Headquarters Zagreb, Department for Foreigners, Petrinjska 30. Members of the RTA’s family who want to regulate a temporary residence need to present the same documents as stated above except the mission letter. In addition to that, spouses are bound to enclose a wedding certificate. If a common – law marriage is concerned, birth certificates of both the common – law partners should be enclosed to an application for the issuance of a permit for temporary residence. Birth certificates for children also need to be attached.

èèèè Any documents attached to the application that was issued by foreign authorities or institutions should be translated into Croatian by an authorized translator.

The body that issues these documents is the Police Headquarters Zagreb. In Zagreb, the Department for Foreigners is located at:

Since there are usually long queues (especially in the Zagreb Office), you are advised to inform CFCA about your planned visit. CFCA will make arrangements for you to be attended to at a fixed time without waiting in the queue. The contact person èèèè Ms. Štefica Belčić, Phone: +385 (0) 1 4591-060, e-mail: [email protected] Residence permits are valid for one (1) year and can also be issued for family members who are EU citizens, as well as dependant family members who are not EU citizens. A RTA coming to Croatia with his/her family would be well advised, in order to save time and trouble, to apply for the residence permits for all the family members at the same time, regardless of whether they are arriving at the same time. The residence card will be replaced in the event of a change in the personal data mentioned in the document, change in the appearance of the holder, or damage or loss of the document. It is advisable to keep copies of the entire documentation presented to the office for future reference.

2.1.2 RTA Mission Letters

Mission letters are intended to facilitate the installation of RTAs and, in particular, to accelerate administrative procedures for registering in the country. They certify that the RTA is a long-term expert working on an EC-funded project. These official documents must be presented when applying for residence cards, registering your car and, if necessary when renting an apartment.

There are two types of mission letters:

1. The DEU prepares the first type (see model in Annex A4) and transmits it to the RTA at his/her home country work address, once the Steering Committee in Brussels approved the TW contract. This letter is issued in English and Croatian and co-signed by the Head of Delegation. It confirms that the individual is a RTA in a specific project.

2. The DEU can also supply a RTA with a mission letter containing additional information. This may be needed when applying for a residence permit. Such letters contain information about the exact duration of stay of the RTA and his/her monthly income. This type of mission letter is only issued to a RTA who is already in Croatia upon their request.

2.1.3 Customs

As the RTA is working for a project assisting Croatia under EU financial assistance, no customs duties are due for imports of personal belongings. However, if a RTA is moving house, he/she should provide the removal company with a detailed list of possessions, specifying the value of each item in case of a random check. The list should consist of (an) item(s), the quantity and value (e.g. 10 pairs of shoes, €800). Such a list should be accompanied by a copy of the passport, or ID document with a photo, and a Mission Letter from the DEU (first type of letter, mentioned above).

RTA must buy form "Certificate for exemption from customs duties for goods released for free circulation" at "Narodne novine" stores. He/she filles it and gets verification from beneficiary institution.

2.1.4 Tax Exemptions

A RTA is exempted from personal income tax on all income arising from the performance of his/her duties as RTA, in line with the Framework Agreement between the European Commission and the Government of Croatia, signed on 27 March 2002 (in Annex A: General Conditions relating to the Financing Memoranda, Article 13§5).

The RTAs are usually not exempted in their home country ex lege if their family doesn’t move to Croatia, because there is a place for “coming home and living”. RTAs should check the tax law in their home country and the conditions for not being ought to pay taxes at home.

2.2 ACCOMMODATION

2.2.1 Permanent housing

General information Rents in Croatia vary depending on the region. The rents in Zagreb are higher than those in other Croatian cities. The DEU has issued a note indicating the maximum amounts allowed for rent for RTAs (see Annex D.1). This maximum amounts are based on real estate market situation in Zagreb. Lease agreement The RTA and the landlord should use the standard lease agreement provided by the Delegation (see Annex A.2 Model Lease Contract). The agreement should at least fulfil the following requirements: • Identify the landlord’s bank account number • Indicate the number of bedrooms • State an end-date no later than the end of the project’s work schedule If the lease agreement follows the standard format, meets the above requirements, and does not exceed the rent approved in the budget, the cost is eligible. In all other cases, prior approval of CFCA is required. If required, CFCA will indicate in its approval which part of the rent is considered as eligible and which is to be financed by the RTA himself. The RTA must keep the original of the lease agreement with the rest of financial documents of the project, for verification by auditors and eventual check up by the contracting authority. Real Estate Agents There are many Real Estate agents in Zagreb. Lists are available in information brochures in hotels. To avoid possible legal problems, RTAs are advised to use a reputable agent. The agent’s fee varies but generally is equivalent to one month’s rent. Fees are eligible if budgeted in the contract budget (the ceiling is one months’ rent). 2.2.2 Hotel accommodation

The RTA is entitled to up to 30 days of additional full allowance to stay in a hotel during the first days of his/her stay in Croatia. The spouse and the children of the RTA are entitled to 50% of that rate. Booking through the internet could be cheaper, but we also recommend checking the price over the telephone and, if you plan to stay longer than one week, negotiating the price. The DEU has obtained preferential rates for staff of the European Commission in 4 hotels in the city centre: Sheraton (115 EUR), Westin (115 EUR), Four Points Panorama (109 EUR) and Dubrovnik (104 EUR). We recommend RTAs to negotiate the price of their stay on the basis of the preferential rates obtained by the DEU. If you are looking for a lower priced hotel in the centre of the city, then the Jägerhorn is located on Ilica 14 (although it may be noisy due to the tramway passing in front of hotel). The Aristos is also very practical, being the nearest hotel to Pleso Airport (6-7 km).

2.3 ASSISTANTS While the ministry or agency in which you are working should take care of the secretarial assistance needs of the project, you are responsible for selecting your assistant. Assistants should be of Croatian nationality and must not come from the Croatian institution that you are working with. The rule is that they cannot have had a contractual relationship with the host institution in the 6 months preceding their contract within a Twinning project. Getting an assistant with good English in Zagreb should not be a problem. The maximum salary for an assistant is € 1,800 per month. The CFCA recommends a salary level between 1,500 and 1,800 €. It is important to bear in mind that your assistant should be a good organiser – he/she does not have to be an expert in the area in which you work. It might be an idea to get in contact with other RTAs in Croatia and ask them about their experiences in searching for assistant. 2.3.1 Recruitment

The RTA and the project leaders are responsible for the recruitment of the RTA assistant. Please note that the selection process must be competitive. You are required to keep at least three (3) offers, (CVs, resumes, etc) on file. Please also note that the costs of recruitment (press advertisements, interviews, employment agency fees, etc.) cannot be refunded from the Twinning budget. Advertisements on internet websites

Many RTAs in Croatia find their assistants by advertising the vacancy in a very popular website visited by individuals looking for a job: www.posao.hr. Placing an advert in this website is free of charge. The Twinning partners only need to send an advertisement to the e-mail address (word form) and in about one hour it will be published on the front page. Another website for this kind of advertisements is www.moj-posao.net. It has various prices, it depends on the place. For example advertisement on the front page including company logo costs 2090,00 kn for one week, and 3400,00 kn for two weeks. The procedure is the same as above. Advertisements in Daily newspapers

2.3.2 Contracting

The MS Project Leader is responsible for recruiting the assistant, the most common way to do it is through a simple service contract, piece work agreement. All payments (taxes, insurance,…) in accordance to the Croatian law should be responsibility of RTA Assistant. In practice this means that the RTA takes care of all legal issues related to the contract which should be signed by the Project Leader as he/she is ultimately responsible for the implementation of the project. In order to have a proper file concerning this recruitment, we recommend keeping the following documents in English:

• Terms of Reference for the position (a short job description)

• CVs from three candidates

• Justification of the choice signed by the RTA Since the contracting process may take several weeks, and it is very useful if the assistant is available at the beginning of the project, the Project Leader from the assisting Member State may contract the assistant directly for an interim period, provided that it does not exceed 2 months, and that the assistant’s contract does not take effect before the Twinning contract is notified to the Member State. Alternatively, in order not to delay the process, the assistant can be selected even during the preparation of the contract and contracted at the same time as the contract is signed.

2.4 TELECOMMUNICATIONS

2.4.1 Fixed Telephone

The fixed telephone service providers existing in Croatia are T-Hrvatski Telekom, Optima telekom (www.optima.hr) and H-1 (www.h-1.hr/index.php).

For T-Hrvatski Telekom are three (3) tariffs of the prices varying from 0.28 Kuna to 1.95 Kuna per minute. A price list can be seen on T-Hrvatski Telekom's Web page - http://www.t-com.hr/privatni/kzona/cjenici/tel_tarife_start.asp.

The same company can provide you with ISDN, DSN and ADSL connections to Internet. All apartments are equipped with at least one fixed telephone line.

Public telephones can be used only with telephone cards bought in a post office or at a kiosk. They cost 50, 100 or 200 kuna. Long- distance calls

Access to international numbers through the Internet is also available. Telephone operators offer various internet connection services that you can find on their web pages.

2.4.2 Mobile telephones

There are three (3) GSM network providers in Croatia: Vip, T-Mobile and Tele2. The services they provide are comparable in terms of quality of connections and coverage of the territory of Croatia. They all have roaming agreements with GSM networks in all countries of Europe and most countries in the rest of the world. Small price differences occur between different types of services of these providers. NB: Please note that the purchase of a mobile Tel and the cost of the Tel bills can under no circumstances be financed out of the Twinning budget. The information here is provided in case you might want to purchase a mobile Tel for yourself. There are two (2) ways of getting a mobile telephone: Pre-paid service

This option is the easiest. All you need is a copy of your passport and the money to buy the prepaid card. The services are called: VIPme, SIMPA and Tele2 . Charge cards for these telephones can be purchased at newsagents, petrol stations, supermarkets and authorised dealers. You can also load up your account in any Euronet cash dispenser. Standard mobile account

In order to purchase the standard mobile account you will need to provide the operator with your passport, or another ID card with a photo, mission letter (specifying the duration of your participation in the project), proof of registration in the place of residence. All three providers have dealers all over the country. Their main sales offices in Zagreb are listed below. 2.5.1 Postal services

The Croatian postal service is a dependable one. It takes approximately a week for a standard letter to reach the EU countries. The price of a standard letter sent locally is 2.80 Kn while the price of a standard letter for abroad is 7.20 Kn. To make sure your letter arrives to the addressee, it is advisable to send a registered letter with an acknowledgement of receipt that should be returned to you when the addressee signs it.

Letter boxes are yellow and the mail is collected every day by 6 pm. Post offices are open from 7 am to 7 pm, on Saturdays from 7 am to 1 pm. 2.6 TRANSPORT AND TRAVEL

2.6.1 Driving

You can drive your car with plates from your country of origin while you are a temporary resident in Croatia. This is allowed for a maximum period of three months. As RTAs are going to be resident in the country for more than three months, they must register their cars in Croatia. This is regulated in "Road Traffic Safety Act", articles 246 and 249 which are at your disposal from DEU and CFCA. The maximum duration of temporary registration is 12 months. After that period, the registration has to be renewed to another 12 months. Registration of the car is only possible once you are registered as temporary resident. Temporary plates have green letters and numbers. In order to register the car, the RTA gets from CFCA a form, where it is stated that he or she is free of customs duties. The RTA should request this from the National Twinning Contact Point, in writing. The address where cars have to be registered is Zagreb, Heinzelova 98, room 35. Working hours are 7.30-19.00, Monday to Friday. In order to register the car you will need: • car registration documents (doesn't have to be translated). • proof of ownership (invoice - doesn't have to be translated). It doesn’t have to be

specifically invoice. It could be anything that proves that car is RTAs own property. Invoice is the most suitable proof.

• proof of registration in your place of residence • proof that car has passed a technical examination in Croatia. Technical examination has

• passport and residence permit • car insurance in Croatia. The vast majority of technical check stations have car insurance

desk, so it can be done at the same place.

Prices: 90 HRK - plates, 35 HRK - driving license, technical examination - around 800 HRK, car insurance - depends from car to car. Driving licences International and other European driving licences are recognised in Croatia. Buying a car in Croatia RTAs who have a residence permit and are registered in their place of residence in Croatia can purchase a car here. When buying a new car, you are not entitled to VAT exemption. If you choose to buy a used car, you have to pay tax on the transaction. When buying a used car, you sign a sales contract with the previous owner, who is also obliged to give you the

registration documents. Once you have settled the tax payment at the tax office in your place of residence, you have to register your car. The documents you require are: • passport or ID card • residence permit • registration in place of residence • old number plates • old car registration documents • sales contract • proof of payment of tax

The office to go to is the Police Headquarters Zagreb, Heinzelova 98, Zagreb, Tel. 01/63-33-333 Traffic regulations Traffic regulations in Croatia are similar to those in other EU countries. Speed limits are 50 km/h in built-up areas, 90 km/h outside of cities, 110 km/h on roads restricted to motorcar traffic and 130 km/h on motorways. Roads in Croatia are generally in fairly poor repair. There is a number of motorways that link the main cities. The wearing of seat belts in both front and rear seats is obligatory at all times. Use of a mobile Tel when driving is prohibited (unless it is a hands-free set). The use of daytime lights is obligatory during the standard time, as oppose to the daylight saving time when it is not. The Croatian traffic police are very tough on drunk driving. The alcohol limit is 0.5 per mill. A driver who is found to be above the limit is liable to have his/her driving licence taken away. In certain cases confiscation of the car and a prison sentence may be imposed. Fines for speeding and other road offences vary between 300 Kn and 2 000 Kn.

2.6.2 Parking in Zagreb

Parking in the streets of central Zagreb can be a problem. There are several guarded car parks (indoor and outdoor), but it is cheaper to park in the street. Parking zones are always clearly indicated and it is prohibited to park anywhere else. In order to park in the centre of Zagreb, from Monday to Friday between 7 a.m. and 7 p.m., you need to purchase a parking ticket from a parking meter. These are located every 100 meters in a parking zone. Parking zones are divided into 3 zones. Each zone has its own parking price as well as the allowed time of parking. With numeric signs of parking zone there are also differences in the colour of each zone that can be finding on the proper traffic signalization. 1. Zone is marked with red colour maximum parking time is 60 minutes. 2. Zone is marked with yellow and maximum parking time is 120 minutes. 3. Zone is marked with green and maximum parking time is 180 minutes.

Parking prices in each zone is 1. zone........ 16 kn/hour 2. zone........ 8 kn/hour 3. zone........ 4 kn/hour The valid parking ticket should be placed on the dashboard inside the car for inspection. If driver does not buy the parking ticket or crosses the parking time he will get a fine on his windshield with order to pay the ticket fine. The control of the parking spaces in the centre of Zagreb is done by the controllers that are working for the city company Zagreb parking, witch gives out ticket fines but you can't buy parking ticket there. In order to pay parking space there are couple of way to be done. You can buy ticket: • at the newspaper stand • with coins that you put in the parking machine that gives out the tickets; • by using subscription on the magnetic parking card; • by using a mobile Tel service in order to pay with M-parking (for more information see

www.zagrebparking.hr) Subscription stickers are allowed on to be both by those who live or work in that area, or those who have their residents or headquarters in one of those streets that are in parking zone. If you happen to live in the paid parking zone and would like to park your car within the area between 7.00 a.m. and 7.00 p.m. on weekdays, you can apply for a special parking permit. In order to request a permit you have to be registered in your apartment. Subscription stickers are sold on this address, Zagrebparking, Ilica 45. Public Garages In public garages the way of zone parking is not in use nor there is a time limit. Prices are different for each garage individually. 2.6.3 Public transport

Zagreb City Transport

Zagreb can boast a reliable, well-integrated and cheap bus and tram network. Maps and timetables can be found at www.zet.hr . As this web site is currently in it's early stages of development, there is not much information in English. Apart from fares information and tariff regulations, little is available in English at this time. Buses and trams cover most of the city. The major points where ground public transport lines meet are Trg Stjepana Radića and Trg bana Jelačića. All services can be crowded at peak hours, but by and large they are remarkably punctual. Regular bus and tram routes close down around 11-11.30 p.m. From 11.15 p.m. to 4.45 a.m. drive night buses and trams. For timetables check www.zet.hr. Tickets for trams and buses can be bought in any kiosk with «Duhan», «Tisak» etc. logo. The price of a tramway/bus ticket bought on the tram is 10 Kuna while the same ticket bought on a kiosk or in a post office costs 8 Kn. Two single tickets are required for a journey on a night bus. You can even buy a daily ticket for 25 Kn or a monthly subscription for the price of 290 Kuna, which is valid for bus and for tram as well. Children under 6 and persons over 65 years ride free. Validate the ticket(s) in the machines next to the doors on buses and trams. Failure to validate your ticket will cost you a fine of 150 kn. Nevertheless, you should always ask the inspector to show his ID and issue you with a receipt for the fine. Map is completely free and full of useful information in Croatia, English and German language. Taxi

Taxi services in Zagreb are expensive. It is always advisable to call a taxi (number is 970) or to pick one up from a taxi rank. Very seldom taxis can be hailed in the streets of Zagreb. They are normally waiting at taxi ranks. There is just one Taxi Company in Zagreb. Taxi tariffs are as follows:

Every taxi driver is required by law to exhibit a card with the standard km rate they apply – it should be placed on the rear door window. If no such card is exhibited you are strongly advised against taking the taxi. Drivers generally speak a little English and German.

2.6.4 Inter-city transport

According to the Twinning Manual, inter-city travel of experts is reimbursed up to the equivalent of a 1st class return train ticket to the place of destination. For travel within Croatia, buses are the most rapid and cost effective form of transport and there are regular departures to all major towns. Trains also run to Istra, Slavonia and Dalmatia (to Split via Knin). Trains in Croatia, however, are rarely faster than bus travel. The Croatian rail system is quite well developed. However, journey times tend to be long. Detailed information about the timetable and cost of tickets to all destinations is available from the Internet http://www.hznet.hr/eng/. Tickets can be purchased at railway stations or at most travel agencies. Some travel agents deliver tickets to your office, but may charge a small fee for this service. There are airports in major Croatian cities: Zagreb (Pleso), Zadar, Split, Dubrovnik, Osijek. Zagreb is directly connected with almost all European capitals, but still does not have direct flights to North America. Zagreb’s Pleso airport is at 17 km from the city centre. There is a Croatia Airlines airport shuttle bus between the airport and the city centre. The buses depart from the city's main bus station (Autobusni kolodvor), in front of Croatia Airlines office every half-hour, the first leaving at 5.30 am, the last at 7.30 pm. From the airport arrivals terminal they depart daily at 7 and 8 am and then every half-hour until 8 pm. It takes 30 minutes from the airport to the city centre. 2.6.5 Travel agents

Flight, rail and coach tickets can be purchased through travel agencies. Since you will be booking quite a lot of travel, it may be a good idea to sign an agreement with a selected

agency. Under such an agreement you could enjoy special discounts and, in some cases free delivery of the tickets you order to your office or home. One Kuna is made up of 100 lipa. The current exchange rate is approximately of 7.25 Kuna to the EURO, and 9 Kuna to One Pound Sterling. Kuna banknotes come in 1000, 500, 200, 100, 50, 20, 10 and 5 denominations. Coins are delivered in 5, 2 and 1Kn amounts and 50, 20, 10, 5, 2 and 1 lipa amounts. Banks in Croatia provide the best personal banking services. To open a current bank account you must be in possession of your passport/driving licence or an identity card. 2.8 MEDICAL SERVICES

2.8.1 Health insurance

As specified in the Twinning Manual, all RTAs and their families must be insured either by themselves or through their home administration. At a minimum, the insurance should cover the following: • Full cover for health care costs arising from sickness or accident (in-patient and

emergency out-patient) • Transport to the medical centre • Sending of a doctor • Sending of essential medicines which are not available on the spot • Transport in case of emergency from the place where the RTA is assigned • Return flight ticket for one relative • Emergency dental care costs • In case of death, reimbursement of the costs of the coffin, including its repatriation to the

country of origin

2.8.2 General health care

The Croatian public health care system has been badly managed and underfinanced for years. The state hospitals are in debt and poorly equipped, so if you need health care it would be advisable to use a private facility rather than a public one. In case of emergencies you can call 94 or 112 for the free-of-charge emergency service.

2.9.1 Broadcasting

Croatian Public Radio broadcasts on 3 national and several regional channels. There are also several private radio stations broadcasting nationwide for example, Otvoreni radio as well as numerous regional and local radio stations. Most radio stations transmit the RDS signal. Croatian Public Television broadcasts on 2 national channels and 1 satellite channel. There are also several commercial TV channels: Nova TV, RTL Televizija. Programmes are transmitted in stereo NICAM by the PAL system. Most homes are fitted with cable TV offering more than 60 channels in Polish, English, German, French, Spanish, Swedish, Arabic, etc.

SECTION 3 FINANCIAL MANAGEMENT

Your main contact for financial management issues related to your contract is the CFCA. You will find the project manager for your contract in Annex B4. Please refer any queries related to the financial management and reporting to that person. The DEU and CFCA have developed a set of clear guidelines regarding invoicing and payment procedures applicable to specific groups of contracts (depending on the date of endorsement). 3.1 GENERAL RULES For contracts signed on or after 1 May 2004, Art. 4.2 of the special conditions provides for an initial pre-financing instalment of 80% of the estimated budget for the first 12 months to be paid. At the beginning of the project (once the contract has been endorsed) it is strongly recommended that your administration apply for a pre-financing instalment.

Upon completion of each quarter of the project the administration of the assisting member state should prepare an interim quarterly report, including section 3, which sets out the total amount of disbursements in the reporting period for key groups of costs. According to Art.15 of Annex A2 to the contract, further pre-financing may only be given if the expenditure actually incurred equals at least 70% of the previous payment (and 100% of any earlier payments) as attested in the corresponding interim report and, where applicable, in an audit report (for pre-financing sums exceeding € 750,000, Art. 15.6.). The total sum of pre-financing under the contract may not exceed 90% of the overall amount. The remaining 10% can be recovered at the end of the project upon presentation of the final report supported by an audit certificate.

In some cases, the allowances for the RTA are taken out of the main budget and are payable to the RTA directly and not through his/her administration (provisions in Annex A5 to the Twinning contract). In such cases, separate requests for pre-financing instalments should be presented. The RTA should in any case send all supporting documentation (invoices, etc) to their home administration, which will be audited for the entirety of the costs incurred during the project.

Templates for requests for pre-financing instalments are included in Annex V to the Twinning contract. 3.2 VAT RECLAIMS According to the Framework Agreement between the EU and Croatia, VAT and other taxes on items purchased as part of Twinning projects cannot be charged to EC financed project budgets. The VAT can not be refunded to the RTA. The invoices should contain the net amounts as well as the clause on VAT exemptions.

3.3 BUDGET REALLOCATIONS AND OTHER MODIFICATIONS There are two ways to change the provisions of your contract – through a side letter or through an amendment (see two templates in Annex A3). Which you use depends on the type of change being made (see below). The two types of document follow different procedures:

2. Amendments The modifications will only apply to subsequent implementation and cannot apply retroactively. 1. Side Letters: The following changes require a Side letter: ♦ Changes which do not affect the basic purpose of the project, including: Changes of the

STEs, Introduction/prolongation of activities related to original work plan ♦ Reallocations below 15% of the total Twinning budget

Practical issues: ♦ Side letters must be signed by the BC and MS PL: MS PL can delegate RTA to sign side

letters on his/her behalf for the lifetime of the project (BC PL cannot delegate) ♦ Side letters are not needed for the notification of changes in the price of travel costs and

per diems (use of the provision for changes in prices) or for changing the time schedule of STEs missions

♦ All relevant pages of the Twinning contract which are being modified by the Side letter need to be annexed; e.g. relevant sections of the budget in case the change introduced in the narrative part has budgetary implications (please bear in mind that the budget should correctly present the introduced change), CVs of the new experts

♦ If the expert which is being introduced through side letter is of a different category than the one from the original contract (or any previous side letter/addenda) than this change implies budgetary changes

♦ Side letters are expected to be submitted 48 hours to the CFCA and the DEU before use is made of the change concerned

♦ Side letters enter into force on the date of arrival of the Side Letter (signed, in hard copy) at the CFCA, unless any of its parts is in conflict with the Twinning rules

♦ Rejection of the Side letter (rejection of the change which is intended to be introduced) by the CFCA suspends the implementation of the proposed change (if carried out the cost are not eligible for financing)

♦ The page with the signatures needs to contain additional text from the preceding articles; the signatures cannot be placed on a blank page without any text from the Side letter

♦ Experts who do not comply with the requirements of the section 5.3.2 of the twinning manual could be introduced in the twinning in an exceptional basis through a side letter and with a throughout justifications that the expertise of the STE introduced cannot be found in the public sector of the MS or of another MS.

Instructions for filling in the relevant parts of the Side letter: ARTICLE 1: Objective; should provide information related to the change (describing the modification) and stating the purpose of this alternation(s); in addition to that this article should provide justification for the every change which is intended to be introduced ARTICLE 2: Modification; should provide information related to the articles and the annexes of the original contract which are being modified (stating every article/annex) ARTICLE 3: Cumulative modifications notified; this article should show the aggregate amount of reallocations made through side letters including the side letter in question ARTICLE 4: Confirmation of validity; should be directly transferred from the template ARTICLE 5: Annexes; should list and number all annexes of the Side letter

2. Addenda: The following changes require an addendum:

The following changes do not require the binding opinion of the Steering Committee at Headquarters in Brussels:

♦ Addenda introducing replacement of the BC PL or the main short term experts are approved at the level of the DEU and do not need to receive the binding opinion of the Steering Committee at Headquarters in Brussels

♦ Addenda prolonging period for the implementation of activities (work plan duration), within the legal duration, are approved at the level of the DEU and do not need to receive the binding opinion of the Steering Committee at Headquarters in Brussels.

Practical issues:

Ø All changes which are intended to be introduced through an addendum should be discussed and agreed by all stakeholders before the submission (at the level of the project’s Steering Committee)

Ø Addenda should be submitted to the CFCA at least one moth (preferably two) before the date on which the amendment should enter into force.

Ø Relevant parts of the contract which are being changed need to be annexed to the

addenda; e.g. in case of the change of the implementation period of the action (legal duration) the following parts of the contract should be annexed:

o Original and amended text of the article 2 of the Special conditions, o New budget since the prolongation implies budgetary changes (please note that the

new budget should present column with the original budget, column with the budget

after the last side letter (showing the number of the side letter which introduced the modification), column with the budget after the addendum and the columns showing savings/reallocations o Relevant articles of work plan which are affected with this change, including Article 5.

(Schedule) Ø Signatories of the Addenda should be the same as the signatories of the original

contract + BC PL; Signatory of the contract on behalf of the MS can delegate this right to the MS PL (with the exception of the case in which the purpose of the Addenda is replacement of the MS PL)

Ø All pages before signatures must be initialled by the CFCA and all annexes numbered, if the amended parts of the workplan and/or the budget are annexed to the addendum, then these annexes should be initialed by the PLs (as in the original contract)

Ø Addenda enter into force upon the notification from the CFCA of the endorsement by the DEU, all changes described in the addendum which are implemented before that point are not eligible for financing

Ø The page with the signatures needs to contain additional text from the preceding articles; the signatures cannot be placed on a blank page without any text from the addenda

Please, remember�

• All modifications must be numbered and dated, allowing for easy identification and reference.

• Side letters must be submitted in parallel to CFCA and DEU. They can be transmitted by fax, as there is no need for an original copy.

• Formal amendments require submission to the Contracting Authority in four originals signed by the original signatories of the contract.

• All amendments and side letters that affect the budget must be accompanied by a comparative table showing the modified sections of the budget – their original and current shape.

• Side letters and amendments are never retroactive. Expenditure incurred prior to notification or approval cannot be reimbursed.

• All changes must be in line with the Twinning rules: they must respect agreed unit costs (i.e. per diem, flat rate, short-term experts’ fees), represent eligible costs and be clearly linked to project implementation.

Delegation of signature is possible. The Project Leader of the assisting Member State may mandate the RTA to sign side letters on his/her behalf. For formal amendments, the signatory of the contract may mandate the Project Leader to sign on his/her behalf.

A1 VISIBILITY GUIDELINES Below are excerpts from the Practical Guide and the EU Visibility Guidelines to the requirements regarding publicity and information. The entire text can be obtained from the Delegation, or from the DEU website: http://www.delhrv.ec.europa.eu/en

The RTAs are requested to follow these guidelines to ensure the visibility of EU funding in the Twinning projects. Information and publicity measures should accompany all activities that are part of the implementation of the Phare/IPA Programmes (publications, conferences and other public events, briefings, purchase of equipment, press conferences, commemorative plaques etc.). The RTA should contact CFCA twinning coordinator and DEU twinning coordinator well in advance of any press release, publications of leaflets, or organizing a public event linked to the project in order to be instructed by the ECD Press and Information Office in further implementation of the exercise. 1. CORRECT USE OF THE EU LOGO

All the visual applications of the publicity and information measures require the use of the EU logo and text describing the funds involved.

The logo has 12 yellow five-pointed stars on a blue background. The number of stars does not change according to the number of EU Member States as twelve is a symbol of perfection, completeness and unity. The blue and yellow colours should be used whenever possible since the logo is more striking in colour. The standard colours are "Pantone Reflex Blue" and "Pantone Yellow”.

A frequent mistake is to position the logo upside down. In order to avoid this, please check carefully the position of the stars. They should be placed horizontal to the upper border, with one point pointing upwards and two points pointing downwards:

room and measuring approx. 0.7 m x 1.0 m. These billboards should be placed in a position visible to participants at the conference. The above instructions should also be followed in the case of other events (cultural, educational, sporting or other) co-financed by the EU under the Phare/IPA Programmes. 4. EQUIPMENT PURCHASED WITH FINANCIAL SUPPORT FROM THE EU

6. ORGANISATIONS OF KICK-OFF AND FINAL EVENTS Two visibility events have to be organised in the course of implementation of the project, one at the beginning and one at the end of the project. These public events have to be organised in co-operation with the CFCA PR Office and Project Manager and the DEU Press and Information Office and Task Manager. The date of the last Steering committee of the twinning project should be combined with the closure event of the project in order to limit travel costs of the MS Project Leader. These events represent an occasion to reach the largest possible public about the project in question financed by the EU and implemented in partnership by Croatia and the Member State partner. In practice this means that not only direct beneficiaries of the twinning should be invited, but also of course media, people from other departments of other ministries or agencies, civil society working in the sector of the project, Embassies of Member States the administrations of which have presented an application at the time of selection of the twinning. The organisation of these events is the responsibility of the RTA and her/his assistant as well as the Beneficiary Administration. This is the reason why the costs for STEs to prepare these events should be limited to the strict minimum in case the STEs are doing a presentation during the visibility event. The CFCA PR Officer ([email protected]) and the DEU Press and Information Office ([email protected]) will support the RTA in the organisation of these events. Should the RTA start the preparation of these events with delays, the CFCA PR Officer will remind the RTA about the delays necessary to properly involve the various partners in this organisation. Checklist to organise kick-off and final event of twinning projects: - One month before the event takes place, the CFCA PR Officer and the CFCA Project Manager should be provided with the list of participants to be invited and the draft agenda. These documents will be examined and sent to the DEU Task Manager, Press and Information Office and Twinning Coordinator. At this stage, suggestions as to the list of participants and/or on the order of speakers might be given. The Head of Delegation should be invited as a speaker for the opening and the closure of twinning events. The DEU Task Manager will inquire with the HoD Secretariat on the availability of the Head of Delegation to attend the event. If the Head of Delegation is not available, he will be replaced by one of the DEU Head of Sections. The DEU Task Manager will provide information on the speaker on behalf of the DEU to all parties in the process. Also, the CFCA Director should be invited as a speaker for the opening and closing events. The invitation should be sent to the CFCA Project Manager and the CFCA PR Officer who will provide information on availability of the CFCA Director to attend the event(s).

- Once the list of participants and speakers has been agreed the project can send out invitations together with the draft agenda. The DEU Press and Information Office must approve the EU visibility part of all materials of the EU-funded project (brochures, leaflets etc.). The contents of the materials must be first approved by the CFCA Project Manager and then sent to the DEU Task Manager for a final check. Table flags (EU, MS, Croatian) must be displayed at the event. These flags, together with the EU big flag can provide the DEU ([email protected]). -5 days before the event takes place, the CFCA and DEU counterparts should receive the final agenda and draft press release for approval. - 2 days before the event, the Beneficiary institution may send out the press release to the media if it wishes to do so

- 1 day before the event takes place, the DEU Press and Information Office will send out the Press Release to the media and upload it on the Delegation’s web page

Prior to being sent to the CFCA and DEU all documents, must undergo grammar and

spell check (English UK). To attract more media attendance, it is advisable that the Beneficiary institution

publishes the press release on its web page only after the event has taken place. After the beginning of the project event, the RTA must send to the DEU Press and

Information Office and the CFCA PR Officer a Project Identity Card (Annex A5) so that the project can be listed and presented on the DEU web page under EU-funded projects section. All visibility materials published during the project implementation, photos etc. should be sent for update of information on the project to the DEU Press and Information Office and the CFCA PR Officer. 7. PROJECT WEBSITE It is recommended to develop a website for the project, explaining to the public the issues addressed in the framework of the twinning, as well as the objectives of the projects and the means to achieve them, to present the partners involved in the projects, etc. This website should be developed in partnership with the Press and Information Office of the DEU to make sure that the EU visibility of the website is appropriate. This website should be regularly updated with the outputs of the activities of the project.

spite of having been reminded, utilises the Property in a way contradictory to the agreement or its purpose or in a way causing extraordinary wear and tear, or the Property is neglected to such an extent that the LESSOR becomes exposed to material loss or damage - upon one month's notice.

5). The LESSOR may dissolve the Agreement if the LESSEE fails to pay rent for a period longer

than one month after the due date of the rent despite a written notice provided by the LESSOR and delivered by registered mail. The LESSOR may dissolve the Agreement if the LESSEE does not pay the outstanding rent within 14 days from the receipt of the written notice provided by the LESSOR. Should the LESSEE not answer this within the next seven days, the LESSOR is entitled to take over the PROPERTY.

6). The LESSEE may dissolve the Agreement without the required notice period if the subject

of the Agreement becomes unfit for use through no fault of the LESSEE or in the event the LESSOR fails to provide those items listed in par. 5 point 6 or if the LESSOR, in spite of having been reminded, does not perform any of his obligations under this Agreement.

7). Notice of termination of the Agreement must be made in writing and should be delivered

by registered mail or delivered by hand and and then confirmed otherwise being null and void.

§4 Duties of the Lessee

1) The LESSEE is obligated to take good care of the subject of the lease and to use it according to its designated purpose. He has a duty to care for its cleaning, proper ventilation and heating of those rooms given to the disposal of the LESSEE.

If it becomes apparent that the subject of the lease has serious faults and if it becomes necessary to take such action as is needed to protect the subject of lease against any unexpected damage, then the LESSEE should immediately inform the LESSOR about the said faults and the LESSOR is obligated to make good the faults without delay.

2) The LESSEE is responsible for any heavy damage arising from having failed to take proper

care of the Property, and for informing the LESSOR in such an event. The LESSEE is also responsible for any heavy damage caused by persons staying in the

house, in excess of normal wear and tear.

3) The LESSEE is obligated to enable the LESSOR to make necessary repairs with advance notice, at a mutually agreed upon time.

4) The LESSEE cannot change the designated purpose of the subject of the lease or to make

any adaptation without the LESSOR'S approval. 5) The LESSEE cannot sublet the subject of the lease, or any part of it. § 5 Duties of the Lessor

1) For the duration of the lease, the LESSOR is not allowed to register any third parties at the Property but he is obligated, at the LESSEE's request, to register the LESSEE and members of his family.

2) In connection with the lease, the LESSOR is not allowed to terminate any contracts with

the suppliers of electricity, gas and water as well the Telecommunication Company throughout the duration of the lease.

3) The LESSOR bears the costs of any taxes concerning this agreement and the costs of the

insurance of the Property with the exception of its contents. 4) The LESSOR will undertake all necessary repairs during the term of the Agreement with

the exception of those cases provided in § 4, point 2. 5) If, after having received written notification, the LESSOR fails - within 3-5days - to do

important repairs that negatively influence the quality of the subject of the lease, then the LESSEE has the right, to make the repairs at the LESSOR’s expense and after showing the bills to withhold the relevant amount from the next rental payment.

During the final month of the Twinning project the RTA-ASSISTANT should prepare a Final report in English (up to 10 pages) summarising the actions undertaken in the project, highlighting any previously unforeseen activities or unexpected difficulties and confirming that the required result has been delivered. Together with the final report and executive summary (about 1 page) is also to be submitted. Article 8 – Probation Period The probation period will run for a maximum of 2(two) months. Until the expiry of the probation period the CoNTRACTING AUTHORITY, upon request by the RTA, or the RTA-ASSISTANT may terminate the Contract giving three days notice of termination.

Article 9 – Particular Conditions Discretion The RTA-ASSISTANT is under an obligation of discretion on all matters concerning the activities of the project. Thus the RTA-ASSISTANT shall not make any statements publicly or to the media regarding the project or its activities unless the CoNTRACTING AUTHORITY has given its written permission to do so. This obligation shall apply after the engagement with the CoNTRACTING AUTHORITY has been completed. The RTA-ASSISTANT shall under no circumstances disclose to unauthorised persons any information of a sensitive or confidential nature relating to matters concerning the project. The RTA-ASSISTANT’s conduct in connection with the work and otherwise must not cause offence to the population in general or to public opinion. Liability The CoNTRACTING AUTHORITY shall not under any circumstances or for any reason whatsoever be held liable for injury sustained, or damage caused, by the RTA-ASSISTANT during the performance of the contract. The CoNTRACTING AUTHORITY shall not be subject to any claim for compensation or repairs in respect of any such injury or damage. The RTA-ASSISTANT shall be liable to CoNTRACTING AUTHORITY for full performance of all obligations resulting from the Contract, repair any damage caused to the objects and persons to whom the services are provided as a result of any action or omission relating to the performance of the Contract, which is attributed to him/her as a result in particular of his/her warranty or negligence, errors or omissions. Article 10 – Working Hours • The RTA-ASSISTANT will deliver the services normally on an eight-hour daily basis,

overtime and weekend work will be required depending on the needs of the twinning activity and will be defined by the Resident Twinning Advisor.

• Overtime and weekend work, where performed, will not be paid out as remuneration. Article 11 – Tax and Social Security Payments The RTA-ASSISTANT shall be solely liable for complying with all obligations relating to National Insurance, social security charges or any other similar tax or contribution due under local law including income tax in respect of the sums paid under this contract. ASSISTANT shall register as self-employed freelancer and shall be subject to and responsible for all liabilities related to local social security system and income tax obligations. Article 12 – Expiry and Termination This Contract can be terminated forthwith, upon written notice, as follows: 1. When the RTA-ASSISTANT is unable to perform his/her duties due to an illness causing

disability of exceeding 15 working days of sick leave. 2. Where the RTA-ASSISTANT fails to perform his/her duties to the satisfaction of the

Resident Twinning Advisor. 3. Where the RTA-ASSISTANT fails to perform his/her duties according to the terms of the

Contract. Outside of the aforementioned conditions the contract can be terminated by either party giving;

• 2 (two) weeks advance notice in writing, for contracts with less than 6 months duration;

• 4 (four) weeks advance notice in writing, for contracts with 6 months to 1,5 year duration;

• 6 (six) weeks advance notice in writing, for contracts with 1,5 year to 3 year duration.

Article 13 – Law of the Contract and Disputes The Law of Croatia shall govern all matters not covered by the contract. If any dispute arises under this contract, which can not be amicably settled, it shall be referred to the Courts of Croatia, which courts shall have jurisdiction. Summers are usually hot and dry with temperature reaching over 30’C. If you are staying in Zagreb, make sure that your apartment has an air conditioning system installed. Autumns are rainy and cold while in winter the snowy period usually lasts no more than 15 days. The Mediterranean climate along the coast insures warm and pleasant weather from March until October, sometimes even November.

C3. ENTERTAINMENT There are many cultural events all year organised in the form of exhibitions, festivals and concerts in the capital as well as in other cities, especially on the coast in summer. Interesting sites to visit in Zagreb are its old town with the City museum, Museum of Naive Arts, Mimara Museum and Museum of Arts and Crafts. It is also worth seeing green surroundings of the city, particularly attractive can be the city of Samobor at about 30 km West from Zagreb (famous for its kremšnita – custard slice – and its carnival), and the castles and parks of Hrvatsko Zagorje (Trakošćan, Miljana, Bežanec etc…). The coast can be reached at any time of the year (in winter preferably by plane because of possible snow in the mountainous regions of Lika and Gorski kotar) and if it is not very windy, your stay there can be pleasant since even in winter the temperatures go over zero. The only problem you might encouter on the coast in winter is the lack of heating in hotels and private accommodation. While booking your apartment or hotel room check the state of the heating system.
