Industrial Training (Apprenticeship Training) Amendment Regulations (No. 6) 2006

Made by the Governor in Executive Council.

1. Citation

These regulations are the Industrial Training (Apprenticeship Training) Amendment Regulations (No. 6) 2006.

2. Commencement

These regulations come into operation on 1 November 2006.

3. The regulations amended

The amendments in these regulations are to the Industrial Training (Apprenticeship Training) Regulations 1981*.

8. Transitional

(1) Subject to this regulation the Industrial Training (Apprenticeship Training) Regulations 1981 as in force immediately before 1 November 2006 continue to apply to and in relation to —

(a) an apprentice who commenced service in an old trade under an apprenticeship agreement before 1 November 2006; or

(b) a person who —

(i) commenced employment as a probationer in an old trade before 1 November 2006; and

(ii) completes that probationary employment after 1 November 2006; and

(iii) on completing that probationary employment commences service under an apprenticeship agreement,

(an “existing probationer”).

(2) The parties to the apprenticeship agreement of an existing probationer may, with the approval of the Director, agree in the apprenticeship agreement —

(a) if the probationer was employed in a trade that is also a new trade, that the apprentice is to be employed in the same trade but that the term of the apprenticeship is to be the new term for that trade; or

(b) that —

(i) the apprentice is to be employed in a trade (instead of the old trade in which he or she was employed as a probationer); and

(ii) the term of the apprenticeship is to be the new term for that new trade.

(3) If the parties to an apprenticeship agreement agree in the manner described in subregulation (2)(a) or (b), subregulation (1) ceases to apply to and in relation to the apprentice when he or she commences service under the apprenticeship agreement.

(4) In this regulation —

“new trade” means —

(a) Cabinet Maker;

(b) Furniture Maker;

(c) Glazier and Glass Processor;

(d) Timber Furniture Finisher;

(e) Upholsterer;

(f) Wood Machinist;

“new term”, in relation to a trade, means the term prescribed in relation to that trade in the Industrial Training (Apprenticeship Training) Regulations 1981 Schedule 1, as amended by these regulations;

“old trade” means —

(a) Art Glass;

(b) Cabinetmaking;

(c) Chairmaking;

(d) French Polishing (Including All Wood Finishing);

(e) Furniture Making;

(f) Glass Bevelling;

(g) Glass Designing and Sandblasting;

(h) Glazing — Bevelling;

(i) Glazing;

(j) Machine Woodworking;

(k) Metal Furniture Making;

(l) Soft Furnishing Making;

1. Citation This Instrument may be cited as the Ashburton Land Conservation District (Appointment of Members) Instrument 2006.

2. Appointment of members Under section 23(2b) of the Act and clause 5(1) of the Soil and Land Conservation (Ashburton Land Conservation District) Order 1989*, the following members are appointed to the land conservation district committee for the Ashburton Land Conservation District— (a) on the nomination of the Shire of Ashburton: Peter Foote of Tom Price; (b) to represent the Pastoralists and Graziers Association of Western Australia: John “Digby”

ENTRY OF PLACES IN THE REGISTER OF HERITAGE PLACES Pursuant to directions from the Minister for Heritage, notice is hereby given in accordance with section 49(1) of the Heritage of Western Australia Act 1990 that it is proposed that the places described in Schedule 1 be entered in the Register of Heritage Places on a permanent basis. The Heritage Council invites submissions on the proposal, which must be in writing & should be forwarded to the address below not later than 8 December 2006. The places will be entered in the Register on an interim basis with effect from today in accordance with section 50(1) of the Heritage of Western Australia Act 1990.

NOTICE OF ADVICE REGARDING REGISTRATION OF CROWN PROPERTY In accordance with section 47(5) of the Heritage of Western Australia Act 1990, the Heritage Council hereby gives notice that it has advised the Minister for Heritage that it has resolved that— 1. the places listed in Schedule 2 are of cultural heritage significance, and are of value for the

present community and future generations; 2. the protection afforded by the Heritage of Western Australia Act 1990 is appropriate; and 3. the places should be entered in the Register of Heritage Places on an interim basis. The places will be entered in the Register of Heritage Places on an interim basis with effect from today in accordance with section 50(1)(b) of the Heritage of Western Australia Act 1990. The places listed in Schedule 2 are vested in the Crown, or in a person on behalf of the Crown, in right of the State. The Heritage Council hereby invites submissions as to whether the places listed in Schedule 2 should be entered in the Register of Heritage Places on a permanent basis. BUSH FIRES ACT 1954 City of Bunbury

BUSH FIRE NOTICE AND REQUIREMENTS Pursuant to the powers contained in Section 33 of the Bush Fires Act, 1954, it is hereby notified that owner/occupiers of land with the District of the City of Bunbury are required to carry out fire prevention work in accordance with the provisions of this notice. This work must be carried out no later than 30 November 2006 and kept maintained throughout the summer months until 10 May 2007. The penalty of non-compliance with this notice is a maximum of $1000, and not withstanding prosecution, Council may enter upon the land and carry out required works at the owners/occupiers expense.

REQUIREMENTS 1. Rural and Townsite Land (includes residential, commercial and industrial) (a) Where the area of land is 2024m² (approximately 1/2 acre) or less, remove all flammable material on the land except living standing trees, from the whole of the land; and (b) Where the area of land exceeds 2024m² provide firebreaks free of all flammable material and at least 3 metres wide, immediately inside all external boundaries of the land and also immediately surrounding all buildings and haystacks situated on the land. Where several adjoining lots are held or used by the owner/occupier, the firebreaks may be provided inside and along the external boundaries of the group or lots.

2. Rural Land The owners of all rural holdings zoned as Rural under Town Planning Schemes must maintain clear of all flammable materials, a firebreak not less than three (3) metres wide immediately inside all external boundaries of the land.

3. Fuel and Gas Depots In respect of land owned and/or occupied by you on which is situated any container normally used to contain liquid or gas fuel, including the land on which any ramp or supports are constructed, you shall have the land clear of all flammable material.

4. Plantations Boundary Firebreaks—

On the horizontal plane a firebreak shall be provided 15 metres wide and immediately adjoining all external boundaries of the planted area. The outer 10 metres will be cleared of all flammable material while the inner 5 metres, i.e. that portion closest to trees may be kept in a reduced fuel state, i.e. by slashing or grazing grass provided that the height of the grass does not exceed 8cm. On the vertical plane a clear space 4 metres high will be maintained above the outer 10 metres of the firebreak.

Internal Firebreaks— Plantations shall be subdivided into areas not exceeding 30 hectares by firebreaks 6 metres wide, which shall be cleared of all flammable material. In the vertical plane a clearance of a minimum height of 4 metres from the ground level will be maintained above the firebreak.

5. Burning Permits, Burning of Bush, Grass and Garden Refuse Burning of anything including bush, grass and garden refuse is totally prohibited from 30th December 2006 to 28th March 2007 (inclusive). Permits to burn are required for any burning including garden refuse at any time between 15 November 2006 and 29 December 2006 (inclusive) and between 29 March 2007 and 10 May 2007 (inclusive). Permits to burn will only be issued to land owners/occupiers for hazard reduction burning until 30 November 2006 (inclusive). From 1 December 2006 to 29 December 2006 (inclusive), permits to burn will not be issued to land owner/occupiers for hazard reduction burning. Permits to burn will only be issued to fire brigades established in accordance with the Fire Brigades Act 1942 or the Bushfires Act 1954 and for any other burning as approved by the Councils Chief Bush Fire Control Officer.

6. Campfires Campfires are totally banned within the whole of the District of the City of Bunbury from 15 November 2006 until 10 May 2007 (inclusive).

Prohibited and Restricted Burning periods Prohibited Burning Period: The ‘prohibited burning’ period that applies within the District of the City of Bunbury is 30 December 2006 to 28 March 2007 (inclusive). Restricted Burning Period: The ‘restricted burning’ periods that apply within the District of the City of Bunbury are 15 November 2006 to 29 December 2006 (inclusive) and 29 March 2007 to 10 May 2007 (inclusive). These dates may be subject to variation according to seasonal conditions, but any changes will be advertised in a newspaper circulating the Bunbury District. If it is considered for any reason to be impractical to clear firebreaks as required by this notice or if natural features render fire-breaks unnecessary, you may apply to the Council or its duly authorised officer not later than 15 November 2006 for permission to provide firebreaks in alternative positions or to take alternative action to abate fire hazards on the land. If permission is not granted by the Council or its duly authorised officer, the requirements of this notice shall be complied with. If the requirements of this notice are carried out by burning, such burning must be in accordance with the relevant provisions of the Bushfires Act.
