to as Mail Box Baseball. Numerous Mail Boxes along Callender Lake

Drive and Dogwood have been hit, literally as well as on other streets.

Please keep an eye out and call the Sheriff if your box gets van-

dalized.

We have been alerted by the Sheriff's Dept. that they cannot respond

to a call on a persons property unless it is "THAT INDIVIDUAL" call-

ing in to make the complaint. Please work with your weekender or

sometimes neighbors, checking out for them on their absence and

make immediate contact with them and have them call if you see their

box has been damaged.

Texas Leafcutting Ants

At the CLPOIA Board meeting on June 8, it was announced that a serious 'sink hole' at the

edge of the 300 block of Long Shadow was the result of an infestation of Texas leaf cutting

ants. This pest builds large homes that resemble gopher mounds. These mounds tend to be

congregated in colonies that resemble prairie dog towns. In building the mounds, the large

red ants mine the soil into BB sized balls and bring them to the surface. When water collaps-

es the mound, a hole as deep as three to five feet is left.

There is a product that acts as a bait rather than a contact poison. When spread around a

collection of mounds, the granules are taken inside and eaten as food. The effect is noticed in

24 hours. The product is AMDRO Ant Block Home Perimeter Ant Bait. AMDRO is also the

name of a fire ant bait. This new product is recommended for a wide variety of ants, including

fire ants. I used this bait on a large colony of about 10 mounds and saw very satisfactory re-

sults. E.H.

May's luncheon was at D' Barn in Mur-chison. We had a great turn out. It was a real treat to have Joann Seberger joining us.

It has been a long time. Joan Baker was the hostess.

The June 20 at 12:30 luncheon has been moved. We will be going to Currents Restaurant. It serves French and American Cuisine and is locat-ed at 6011 South Broadway, Tyler. It look like a great menu, with Wild Mushroom Ravioli, Saumon Provencale, Moroccan Chicken and much more. Ann Faulkner is the hostess .

July 18 at 12:30 we will be heading to the Cozy Kitchen Bakery and Café on 701 East Pine Street ( Hwy 80) Edgewood. Joyce Cox is the hostess.

The Red Hats are looking forward to doing the July 4th parade again this year.

Boat Parade The Fish and Wildlife Committee invites everyone to join them for the 4th of July Boat Parade.

There has undoubtedly been a time when you have needed various services, such as a plumber, an

electrician, a tree trimmer, a painter, etc. You have probably even asked a neighbor or friend if they

knew someone. We would like to take opportunity to help provide that ever asked question, “Who do I

call?” It is sometimes as important to know who not to call, as it is who to call. The intent is to develop a

dependability, price, customer service, and quality of work. We would like for anyone who wishes, to fill

out the form below and give your rating. We will then publish the list in the Lines and keep a list

available at the Callender Lake Office. You can submit your list directly to the Callender Lake office via

hardcopy or by email at [email protected] or you can also email your submission to

When providing a rating, please rate from 1 to 5, with 1 being very dissatisfied to 5 being very satisfied.

Board Meeting Minutes

Callender Lake Property Owners Improvement Association

8 June 2013

The Board meeting was convened by President John Bradfield at 1:00 p.m. in the CLPOIA Community Center. Board members Rick Tavern and Dennis Keith were absent. Board members present included; President John Bradfield, Vice President, Bill Faulkner, Treasurer, Jo Ann Ishmael, and Directors, Don White, Ted Caro, John Harwood, and Eddie Hueston. Twenty one guests were present.

The invocation was given by Eddie Hueston who also lead the pledge of allegiance.

The agenda was approved as written.

OPENING COMMENTS

President John Bradfield opened with a few brief remarks of welcome and announced that Eddie Hueston would serve as Acting Secretary in the absence of Rick Tavern. John also welcomed Ted Caro following his recovery. John also renewed his request for the names of people to serve on the nominating committee which has to be in place well in advance of the fall elections. He mentioned that at least three positions on the Board are anticipated to become vacant.

OFFICER REPORTS

Secretary's Report - Acting Secretary Eddie Hueston noted that minutes of the previous meeting had been circulated via email and were found to be correct as written. Then, with no objections, the Board dispensed with reading of the minutes from the May 2013 meeting. Eddie Hueston moved that the minutes be approved as circulated and be filed for record. The motion was seconded by Bill Faulkner and passed unanimously.

Treasurer's Report - The Treasurer's report attached to these minutes was reviewed. Jo Ann Ishmael moved that the report be approved and filed for audit. The motion was seconded by John Harwood and passed unanimously.

UNFINISHED BUSINESS

A. Update on Slater Creek silt issue, No report or action taken.

B. Office Remodel Update - John Harwood gave a brief review of changes to the flooring, cabinets, counter and lighting which are estimated to cost $3,100. The work is being scheduled to reduce the impact on normal office activities.

NEW BUSINESS

A. Maintenance Agreements - Jo Ann Ishmael reported one new maintenance agreement and moved for approval. Ted Caro seconded and the motion passed unanimously.

B. Proposal for storage addition to Community Center - President Bradfield reported that there was no additional information or action at this time.

C. Classification for improved lots with demolished houses.- Jo Ann Ishmael expects the ACC to recommend a new classification.

D. Liens on property owners - President Bradfield to talk to Board attorney about receivership and foreclosures.

COMMITTEE REPORTS

Recreation Committee - (sent directly by Ted Caro)

Public Area Maintenance - (sent directly by Eddie Hueston)

Road Maintenance - Bill Faulkner reported that 4 yards of gravel and 10 tons of oil sand had been delivered. A sink hole at the edge of the roadway in the 300 block of Long Shadow, caused by a large colony of leaf harvester ants, was filled and compacted by Doug Ferris.

Dam Maintenance Report - President Bradfield reported that the vegetative cover on the new section was taking hold and growing.

Architectural Control Committee - Jo Ann Ishmael reported that there were three building permits and no notices of property clean up were sent. She also reported that a letter to the Monarch water company would be sent regarding the condition of their building and grounds east of the community entrance.

Publicity - John Harwood reported that the new email system seems to be working and is well received.

Audit - Eddie Hueston reported that the chair of the Audit Committee was still vacant and in need of being filled very soon. He also reported that the existing audit team was still intact and ready to serve with a new chair.

Security and Fire - John Bradfield reported that the person who caused $2,680 in damage to the entrance gate had made full restitution. He also reported that a fire in the large dumpster had to be put out by the Volunteer Fire Department. John reported that the Memorial Day patrols by the Sheriff's Department were very effective and that there would be unannounced patrols continuing through Labor Day.

Fish and Wildlife - No report

Sanitation and Pollution - Don White reported that the large dumpster was not picked up on time by the company and that the fire occurred after the date the unit should have been removed. Don did not feel any charges for damage or the late removal should be the responsibility of CLPOIA.

There were statements and questions from the audience regarding the 'neat and orderly' language from the attorney, to include solar panels and wind turbines in next restrictions and notice of low hanging branches on some roadways.

Ted Caro moved for adjournment at 1:50 p.m. which was seconded by John Harwood. Motion passed unanimously.

83rd Legislative Review (2013) by C. A. Cockrell

The Texas Legislature is coming to a close. There were more than 50 bills filed that directly or significantly will affect HOA/POA’s and their membership. This update will focus primarily on the HOA/Water Rate Bills that appear likely to pass and become law. 1436 bills have been signed by both the House & Senate and sent to the Governors office. He has signed 207 bills, allowed 4 to become law without his signature and has vetoed 2. The last day for the Governor to sign or veto bills is June 16th. Any unsigned bill will automatically become law on September 1, 2013. Hopefully at next months Board meeting I will be able to provide a FINAL report for this legislative session. HOA Bills HB 35 Prohibits HOA Boards from adopting or enforcing a provision in dedicatory document that prohibits or restricts an owner from using an adjacent lot for residential purposes; basically the bill allows an owner to build on a contiguous lot either that fronts on the same street or as to a corner lot either by the side or back property line. It allows for approval by either the HOA or ACC, to the extent that a dedicatory instrument imposes reasonable restrictions-This law becomes effective immediately! HB 198 Prevents HOA from placing any restrictions on installation of drought resistant landscaping or water proof turf- scheduled to become law September 1, 2013 HB 503 HOA’s were not permitted to enter into a contract with a Board member, relative, or entity in which Board member owns more than 51% interest; this bill went from prohibiting contracts between HOA/POA’s and Board members to affirmatively allowing, if the following 4 specific stipulations are met:

1. Board obtains at least 2 other competing bids, if reasonably availability 2. Relationship of Board member to the Company is disclosed or known to the Board

& the contract is approved by Majority vote of the disinterested Directors 3. The interested Board member is not given access to other competing bids, is not

HB 699 Extends the locations of certain public sales of real property; Courthouse steps are no longer the only place to announce such sales; becomes law Oct 1. 2013. HB 818 Governance-Voting-bill would have amended the existing signed ballot requirement passed at the last legislative session in 2011 and would have amended the requirement to allowing a Board to choose between signed & secret ballots-did not pass. HB 2978 Pertains to service for expedited judicial foreclosure and court ordered mediation of a contract lien on real property if a judge so orders. Went from speeding up the process to clarifying what constitutes a service of citation. Scheduled to become law September 1, 2013 HB 3176 Existing law permits the Board to fill an unexpired term in the event of a vacancy caused by death, disability, or resignation;This bill removes all the limitations. This law becomes effective immediately! HB 3800 Relating to the filing (refilling) of HOA/POA Management Certificates recorded in the county real property records. The county clerk of each county in which a management certificate is recorded as required by this section shall file the management certificate in the real property records of the county labeled as "Property Owners' Association Management Certificate." Scheduled to become law September 1, 2013. HB 3803 Relating to the municipal and county regulation of and the oversight by the Attorney General of property owners' associations and unit owners' associations; providing penalties. Did not pass

TAMER WATER BILLS There were 5 Senate Bills & 6 House Bills filed pertaining to water & sewer rate issues that impacted Callender Lake/Hickory Hills and other rural unincorporated areas. 1 Senate & 2 House Bills passed and will become law effective September 1, 2014 (transition time is required for state agencies transfer of authority and personnel staffing review) and those 3 Bills were the TAMER Bills we have been fighting far for over 8 years.

HB 1600 Sunset Commission Bill-Relating to the continuation and functions of the Public Utility Commission of Texas(PUC), to the transfer of certain functions from the Texas Commission on Environmental Quality (TCEQ) and to the functions of the Office of Public Utility Counsel (OPUC). SB 567/HB 1307 Relating to rates for water service, to the transfer of functions relating to the economic regulation of water & sewer service from the TCEQ to the PUC and to the duties of the OPUC regarding the economic regulation of water service.

HOW WILL THIS LEGISLATIVE ACTION AFFECT T.A.M.E.R. RATE PAYERS

HB 1600 is the Public Utility Commission (PUC) “Sunset Bill;” it provides that the PUC will not be “sunset” or eliminated. Governor Perry filed HB 1600 without a signature on May 25th, making it a law. His official statement was "While I have concerns about transferring the ratemaking functions for water and wastewater to the Public Utility

Commission, I agree with the overall goal of improving the rate process for the affected customers. Therefore, I will allow SB 567 and HB 1600 to become law without my signature."

Of most interest to customers of investor-owned utilities providing water and sewer service in unincorporated areas, the bill transfers rate and CCN regulation from Texas Commission on Environmental Quality (TCEQ) to the PUC on September 1, 2014. The bill also adds to the duties of the Office of Public Utility Counsel (OPUC), namely, allowing that office to represent residential and small commercial water and sewer customers in rate cases and in rulemaking proceedings beginning in September of this year. That office is also scheduled to get a few new staff positions to help handle the extra work load. The bill divides the state’s investor-owned utilities into three classes based on size. Class A utilities have 10,000 or more water or sewer connections, Class B utilities have 500 to 9,999 connections, and Class C utilities have fewer than 500 connections. TCEQ data indicate there are roughly four (4) Class A utilities, 61 Class B utilities and 442 Class C utilities. For Class A investor-owned utilities, like Monarch and Aqua Texas, the bill changes the rate-increase process to resemble the one already at the PUC for regulated electric utilities. The bill contemplates a process where the utility, e.g., Monarch, files all its supporting documentation for the increase with the PUC at the same it notices the rate increase, and the PUC suspends the rate increase until there is a hearing and decision on the reasonableness of the proposed increase. The PUC decision is supposed to be had within 185 days of the utility’s notice of the rate increase; there is a way to increase this time a little, but not much. The ratepayers and OPC may intervene in the hearings. It will no longer be necessary to file petitions and so forth to get hearings. The “big picture” idea is that rates will no longer be raised automatically in the environs, ratepayers can expect some help from OPC in most cases, and the utilities will get the benefits of a known and rather short timeline to a final decision. There will be a lot of new rules promulgated by the PUC and TCEQ in the next year to clarify the details of these changes. There will also be a “memorandum of understanding” developed by TCEQ and PUC to control the mechanics of transferring duties from TCEQ. The fight is not over! It will be very important for TAMER to participate in the rulemakings, in particular; these will likely set the ground rules for rate and CCN cases for years to come.
