Circular 197/2009/TT-BTC supplemented payment of VAT in accordance with the tax credit method and payment of CIT as a percentage of assessable turnover (Circular 134/2008/TT-BTC mentioned about payment of VAT directly on the basis of added value).
Pursuant to Circular 197/2009/TT-BTC, in the case of foreign contractor’s contract and foreign sub-contractor’s contracts which signed before 1 Jan 2009 shall be applied according to Circular 05/2005/TT-BTC dated 11 Jan 2005 issued by the MOF. In the case foreign contractor or foreign sub-contractor is an individual and his/her income has been paid from 1 Jan 2009, it shall be applied according to laws on PIT.
