VARANASI On the occasion of Raksha Bandhan, Union minister Piyush Goyal today said in Varanasi that as many as 51,000 women and girls of Varanasi will be insured under the Pradhan Mantri Suraksha Bima Yojana as a gift from the Prime Minister. Anup Yasodharan grew upon Marxist slogans inPattakkala, a hilly vil-

lage by the Manimala river inCentral Travancore. His grandfa-ther and father were active work-ers of the Communist Party ofIndia (Marxist) [CPI(M)].Today, the articulate and polite22-year-old is the leader of aRashtriya Swayamsewak Sangh(RSS) shakha in his village.Anup’s baptism into Hindutva isinstructive.

The rupture between the Dalitfamily and the CPI (M) partycame in 2002, when the partyunit abandoned them in favourof a rich Christian expatriate,who bought the land that laybetween their house and themain road and blocked theiraccess. “One comrade, who wasconsidered the dearest to us,shouted, ‘Why should these**** (a derogatory term for theircaste) want to drive to theirhouses?’ says Anup. Then a littleboy, Anup felt disowned by hisown people. RSS activists fromnearby helped the family. AsAnup drifted towards the RSS,his mother put up strong resist-ance. “The Party ran in theirveins,” recalls Anup.

Caste barrier

But an encounter with aHindutva polemicist changed hismother’s mind as well in 2008.“Waiting for the bus in a nearbytown, she happened to listen tothis leader,” says Anup. Of themany things she was swayed bythat day, one question still ran-kles. “A Christian comrade cango to the church, a Muslim com-rade can go to the mosque but aHindu comrade cannot go to thetemple. Why?”

Anup was then able to per-suade his mother that he wouldstart an RSS shakha in the same

courtyard where comrades hadonce assembled. The RSS for-mally arrived in this village, 83years after its birth. The shakhatoday has 17 members, includingsome Christians, and there arethree more shakhas within athree-km radius. A flag post anda Bharatiya Mazdoor Sangh(BMS) unit in the local marketcame up later, accompanied byviolent clashes between themand CPI (M) workers.

While Anup and his motherfound ‘minority appeasement’ inthe CPI (M)’s politics, that isoften a charge against theCongress, given its links withMuslim and Christian groups.Even Congress veteran A.K.Antony said a decade ago thatthe minority communitiesextracted unreasonable patron-age from the Congress. “TheBJP exploited Hindu sentimentsagainst the Congress’s minorityappeasement,” said V. S.Achuthanandan, popular Marxistleader, after the BJP performedimpressively in a recent by-elec-tion. The irony is that while afamily committed to the partyfelt that the CPI(M) was not sen-sitive to Hindu sentiments, itsmost popular leader often accus-es the UDF of ‘minorityappeasement’. But the ironiesdon’t end there.

The CPI(M) is a victim of itssuccesses in the State, particular-ly in empowering lower castes.Inter-caste marriages are quitecommon though Dalits still faceexclusion. Simultaneously, therehas been a rise in Hindu religios-ity, on the lines of, and partly inreaction to, the Christian andMuslim revivalist movementsthat accompanied the remit-tance-fuelled affluence of thesetwo communities. For instance,the Sri Krishna Jayanti proces-sions organised by BalaGokulam, an RSS-leaningforum, have become increasing-

ly popular in recent times. Anupand his friends started one in2007 with 31 people; last year ithad 220 people. Some wereChristians.

Demographic change

The three drivers of Left poli-tics — the backward castes, stu-dents and the working class —have changed their character inthe last decade. Having over-come explicit discrimination,oppressed castes are anxious toset their own terms. Self-financ-ing professional colleges haveturned Kerala’s once-robust artseducation sector into a forlorndry land, weakening theStudents’ Federation of India(SFI). And the working class?They are mostly migrants fromWest Bengal and Assam thesedays.

Demographic changes areunsettling social equations in theState in favour of the Parivar.Not only has a socially alienworking class disrupted Leftrecruitment, new social preju-dices, prompted by their pres-ence, complicate Left politics.

In Pattakkala, several dozenmigrants live a contented life butare sadly caricatured by the localpopulace as remnants of theLeft’s failure in West Bengal orare suspected to be illegalBangladeshi migrants, onlybecause many of them areMuslims.

Consequently, the Muslim inKerala is now an immigrant too,in addition to being an emigrant.The material success of the Gulfemigrants — who are now a for-midable presence in Kerala’spublic spaces — has made themtargets of jealousy. As opposedto the more prevalent stereotyp-ing of Muslims as uneducated,religious and having large fami-lies, the Muslims in Kerala face

a different insinuation — ‘whereis all this money from?’ A reportby a team led by the late JusticeV.R. Krishna Iyer, on theNadapuram communal riots innorth Kerala in 2001, cited theoverbearing social conduct ofneo-rich Muslims and theincreasing jealousy amongHindus as one of the reasons forthe violence.

The emergence of someMuslim extremist groups addsfuel to the fire. Even before itwas officially released, the 2011census data on religion wasloosely — and as it turns out,wrongly — cited by many tosuggest that Christians andMuslims constitute more thanhalf of the State’s population.Even CPI State Secretary KanamRajendran did so, suggestingthat the Left has not been consid-erate towards Hindus.

Marshalling a response

Though these changes havebeen under way for more than adecade, the 2014 elections werethe first demonstration of theelectoral implications of thesechanges, when the BJP gainedseven lakh more votes, roughlythe margin that separates thewinner from the loser, as theLDF and the UDF rotate powerin the State. Expecting to benefitfrom the growth of the BJP at thecost of the Left in the 2016Assembly elections, theCongress has taken a benignview.

Acutely aware of the situation,the LDF, and particularly theCPI(M), is trying to marshal itsresponses, through innovationsto reach out to new sections, andnegating the campaign that it isuncaring of Hindu sentiments.

Dealing with ‘Hindu senti-ments’, however, is a much morefraught challenge. DemocraticYouth Federatio of India (DYFI)workers recently carried a nilav-ilakku, the traditional Keralalamp, to a function attended byan Indian Union Muslim League(IUML) Minister who hadrefused to light one as he consid-ered it un-Islamic; but the Stateleadership disowned the protest.CPI (M) veteran PinarayiVijayan rejected KanamRajendran’s suggestion that Leftsecularism amounted to minorityappeasement, asserting that theLDF could not countenancecommunalism. Accused by bothHindu and Muslim groups of‘appeasing’ the other, and bycaste associations of being hos-tile, the CPI(M) is in an unenvi-able situation.

In all this turmoil, theCongress hopes to retain theState for a second consecutiveterm — it will be a first, if it hap-pens. But things are not that sim-ple. “Now we have Left workerscoming to us. But Congress sup-porters will soon follow,” said V.Muraleedharan, State presidentof the BJP. Meanwhile, in a first,in the forthcoming local bodyelections, the BJP will nominatecandidates in all wards inPuramatton Panchayat wherePattakkala falls.

Avideo game has recentlygone viral on socialmedia in Italy, accord-

ing to Italian news reports.Called “Marò Slug”, it has twoItalian naval officers who haveto kill scores of semi-dressedIndian warriors jumping likemonkeys from the treetops, andthen escape from the country.The background score is theItalian national anthem and thevisual background has a ship ora submarine called “Ridateci”or Italian for “Give us back”.

The game is clearly a puerileproduct of the popular frustra-tion with the Italian govern-ment’s bungling of the caseinvolving the real-life Italianmarines, Massimiliano Latorreand Salvatore Girone, held inIndia, in February 2012, for thealleged murder of two fisher-men, Jelestine and AjeeshPinku who had left for fishingin a mechanised boat, St.Antony, from Neendakara inKerala. They were shot dead inthe seas off the coast of Keralaallegedly by the two marineswho thought the fishermenwere pirates. The ship fromwhich the fishermen were firedupon was identified as theItalian oil tanker, Enrica Lexie,which was later detained andbrought to Kochi. The vesselwas flying an Italian flag ininternational waters, and wassailing from Singapore toEgypt when the incidentoccurred.

Unfortunately for the videogame’s developers, the Italiangovernment’s latest move, toapproach the InternationalTribunal for the Law of the Sea,which is the 21-member U.N.-mandated court in Hamburg,Germany, for their interimrelease, has also yielded no sig-nificant result. At the sametime, the curious order passedby the Tribunal has meant that

Italy looks like a tricksy forumshopper, India, a bureaucraticand judicial nightmare, and theTribunal itself less of a judicialforum and more a mediatorattempting to facilitate a mutu-ally face-saving, albeit unwork-able, compromise.

Exceeding its remit

The Tribunal, while stayingall proceedings in the case bothin India and Italy till the issueof jurisdiction is settled accord-ing to international law, hasrefused to interfere withthe status of the marinesthemselves. This meansthat Sergeant Latorrecontinues to be in Italyfor medical treatmentand Sergeant Gironeremains ensconced in theItalian Ambassador’s resi-dence in New Delhi.

This is a curious order forthree reasons. First, for theTribunal to award interimmeasures, it must be shown thatit would have jurisdiction overthe main dispute, that therewould be irreversible prejudicecaused if such measures werenot awarded and that there is anurgency which requires animmediate award of such meas-ures. While applying thesetests, the Tribunal has givensomething to both parties at thecost of logical consistency. Ifirreversible prejudice would becaused by the continuance ofcriminal proceedings in India,then surely the marines whowere standing trial would beprejudiced too and vice-versa.In fact, both these conclusionswere arrived at by several con-curring and dissenting judgesof the Tribunal itself. If adopt-ing such a halfway house solu-tion is an attempt by theTribunal to mediate a solution,it is most certainly well inten-tioned. However, given thefractious nature of the diplo-

matic relationship betweenIndia and Italy, as evidenced bytheir communications in thismatter, it is unlikely to succeed.

Second, as an internationaldispute resolution forum, theTribunal is duty-bound toensure the exhaustion ofdomestic remedies before tak-ing up a matter.Arguably, theq u e s -

tion ofexhaustion ofremedies in Indiabecomes a conundrum when itis India’s very jurisdiction thatItaly is contesting. While thismight be so, this is a matter thatneeded extensive discussionand reasoning of a kind that isentirely absent from theTribunal’s order. At an interimstage, to be satisfied that itwould have prima facie juris-diction without accounting forthe relevance, and consequentexhaustion of local remedies, islegally flawed.

Such a lack of reasoning alsohas the potential to strain thealready uneasy relationshipbetween domestic and interna-tional law. Given the fact thatsovereignty is national, thelegitimacy of international lawhas always been a contestedquestion. Without entering intothe fundamental debate of thelegitimacy of international law,it can safely be stated that a keyplinth of its acceptance by

nation-states rests on it beingrespectful of domestic law andremedies before being pressedinto operation. A summary dis-missal of India’s local remediesexhaustion argument by theTribunal calls such respect intoquestion.

A forum shopper

The issue of allowing thejudicial process in India to con-tinue becomes all the more cru-cial since Italy has, for threeyears, participated in theprocess, attended hearings andaccepted (or appealed) the deci-sions that courts in India havehanded down. Moreover, it hasconstantly sought appellaterecourse to the Supreme Court,which can hardly be said to beactions of a country that con-tests jurisdiction. It is only aftermore than three years since theincident, when an ultimate rem-edy from the Indian courtsseems an overly time-consum-ing possibility, that Italy hassought to use the Tribunal tostall the process altogether.This is far from a question ofprinciple. On the contrary, itmanifests a reprehensible prac-tice of shopping for a forumthat is most likely to deliver a

favourable result.

Equally, the manner in whichItaly has forum-shopped hasbeen in exceedingly poor taste.It writes in its submissions: “Atpresent, it is not knownwhether that hearing (on 26August 2015) will take place asscheduled and will see the

whether,as has invariably

been the case in the past withother hearings, the hearing datewill be adjourned to some otheras yet uncertain date in thefuture.” [The Supreme Courthas since suspended all judicialproceedings against themarines after the Indian and theItalian governments jointlyinformed it on August 26, 2015,that an international tribunalhad asked for status quo till itcleared the air on which coun-try had the jurisdiction to trythe two men. A three-judgeBench, led by Justice Anil R.Dave, posted the case forJanuary 13, 2016.]

Again: “As regards SergeantGirone, he is, for all intents andpurposes, being treated as ahostage, to be kept in Indianotwithstanding India’s failureto issue criminal charges.”

It is imperative to note thatSergeant Girone is on bail pur-

suant to an order of theSupreme Court. Even if Italywere to make the claim ofrecalcitrance against theGovernment of India, to sug-gest, as it has done, that theSupreme Court is deliberatelyslow, tardy and implicitly incahoots with the governmentdeserves strong condemnation.Further, this is not the first timeItaly has sought to cock a snookat the Supreme Court. On anearlier occasion too, contrary tothe affidavit of its Ambassadorin India, the Italian Foreign

Minister had declared thatthe marines would notreturn to India. This wasblatantly in the face of anorder from the SupremeCourt of India. It appearsthat the excessive gen-

erosity of the SupremeCourt, time and again, has

been interpreted as a sign ofweakness. Such behaviour isentirely unbecoming of a sover-eign nation.

A faltering justice system

The generosity of Indiancourts is in stark contrast to thefitness of its criminal justicesystem. Responsibility for thefaltering criminal process mustbe shared by both the judiciaryand the government. First, in apoorly reasoned order, theSupreme Court held that whileIndia had putative jurisdictionto try the marines, the samecould not be done by courts inKerala. As India does not havedistinct federal criminal courts,as a consequence of the court’sorder, a special court had to becreated or designated for thispurpose. The government wasslow in designating such acourt. The NationalInvestigation Agency, whichwas investigating the incident,took five months to complete apreliminary investigation. Thegovernment was subsequentlyslow in granting sanction for

prosecution of the marines.None of these processes werehelped by Italy constantlyappealing every order to theSupreme Court, each of whichtook considerable time to comeup for hearing.

Consequently, it is an uncon-tested fact, and one that hasweighed heavily with theTribunal, that after more thanthree years of the incident, themarines have not been broughtto trial. It is this inordinatedelay that has allowed the ini-tiative that India possessed inbringing the marines to book inIndia to slip. If the strategiclosses caused by, and interna-tional rebuke for, the delays inthe criminal justice system arenot adequate reason to reformit, one wonders what might be.

Given that the Tribunal isonly deciding on jurisdictionrather than criminality, it doesnot appear that the case is aboutto end anytime soon. Its interimdecision too has done little tomove it along, equivocating onkey legal questions. Stripped ofits legal accoutrements, thiscase is about two innocentIndian fishermen who lost theirlives and two Italian naval offi-cers who, justifiably or unjusti-fiably, killed them. The endlesscomplexities of the law havemeant that justice has provedhard to come by both for thefamilies of the victims and theaccused. If the courts, the gov-ernments and the law continueto muddle along as they havedone this far, “Marò Slug”might not simply remain aracist video game. It might, inthe popular imagination,become a preferable mode ofjustice delivery compared tothe slow and onerous rule oflaw.

In an ideal world where the rule of law mattered andgeopolitics did not dominate the conduct of interna-tional relations, Pakistan would have cooperated in the

capture and extradition of Dawood Ibrahim and the crimi-nal and mass murderer would have faced justice in thecountry of his origin. Instead, in this real world Pakistanpersists with its long-pursued policy of “plausible denia-bility”, refusing to acknowledge the presence of the under-world “kingpin”, let alone responding to accusations thathe has been sheltered by the agencies of the state. Whilehe has been absconding from Indian justice after beingidentified as a key conspirator in the 1993 Mumbai blaststhat killed hundreds of people, it has been widely reportedthat he lives a secured life of comfort in Karachi, amongother places. How Ibrahim can live such a life without pro-tection accorded by Pakistan’s security establishment isnot an unfathomable mystery. He was after all playing aleading role in Pakistan’s strategy of trying to “bleed Indiaby a thousand cuts”, that it has seemingly followed fervid-ly in the 1990s. Much water has flowed down the Indussince then; today Pakistan suffers festering wounds inflict-ed by its own strategy of terror. There is some degree ofrealisation among its civilian establishment that the nexusbetween the security establishment and the jihadi complexhas hurt its fledgling democratic institutions. This led to anassertion of civilian supremacy in the latter half of thedecade of the 2000s, and a degree of acceptance by thesecurity establishment of the need to do away with mili-tary preponderance. But there has been little reorientationin Pakistan’s overall foreign policy towards India, beyondtokenism and a grudging acceptance of a changed world atlarge that has little tolerance for terrorists and their spon-sors. Despite an Interpol Red Corner notice out for him,and notwithstanding the UN Security Council Resolution1267 that obligates UN members to help apprehend indi-viduals included in a UN sanctions list against the al-Qaeda where Ibrahim’s name figures, there has hardlybeen any action taken by Pakistan’s state establishment.Indian governments over the years have patiently built acase for his extradition through dossiers submitted toPakistan. But these have been of no avail, and unsurpris-ingly so. After all, the most wanted terrorist of the lastdecade, Osama Bin Laden, was ensconced in a compoundin Abbottabad not far from the Pakistan Military Academycampus. “Plausible deniability” did not work with theU.S., as President Barack Obama ordered an operation totake out Bin Laden, showing little regard for Pakistan’ssovereignty. It is to be hoped that the Pakistan governmentwill revisit the lessons learnt and cooperate on the issue ofIbrahim’s extradition. Among other things, such a step willaid in mending the fraught relations between India andPakistan.

GSAT-6 is the 25th geostationary commu-nication satellite of India built by ISRO and12th in the GSAT series. It provides commu-nication through five spot beams in S-bandand a national beam in C-band for strategicusers.

The cuboid shaped GSAT-6 had a lift-offmass of 2117 kg. Of this, propellants weighed1132 kg and the dry mass of the satellite was985 kg at the time of launch.

12 Soldiers Injured...Trust of India that as many as "12 soldiers

Man Tries to...The man identified as Samaresh Sarkar was

caught by his co-passengers in a ferry as hewas throwing two trolley bags, which, he toldpolice, contained body parts of a woman,with whom he was allegedly in an illicit rela-tion, and her daughter.

Hoogly SP Praveen Tripathi said Sarkar,the branch manager of PSU bank inDurgapur, was arrested after his co-passen-gers, suspecting something foul, handed himto the police in Sheoraphuli.

One trolley bag, containing the lower bodyparts of a woman, was later fished out of theriver by a diver pressed into service by thepolice, he said.

SP Tripathi said Sarkar told the police thatSucheta Chakraborty, a 34-year-old house-wife with whom he was in an illicit relation-ship, had been pressurising him to marry herand would often take money from him.

Sarkar, however, was married and his fam-ily stayed at Titagarh near Barrackpore.

When he visited Sucheta at her flat in ahousing colony in Durgapur yesterday, whereshe lived with her daughter after having sep-arated from her husband, they had a heatedargument following which she flew into arage and strangled her daughter Dipanjana todeath in front of him, Sarkar alleged.

Sucheta had then stormed into the adjoiningroom and committed suicide, he claimed.

As he did not want people to know of theincident, Sarkar claimed that he had cut upthe two bodies with a sharp weapon, stuffedthem in three trolley bags and reachedBarrackpore in North 24 Parganas district thismorning in a hired car.

SP Tripathi said Sarkar had then boarded aferry from Barrackpore for Sheoraphuli inHoogly district on the other side of the river,but could not dispose of the bags.

He had returned to Barrackpore by anotherferry and it was during the return trip that hethrew the bags mid-river and was caught byco-passengers and handed over to police.

The SP said the incident is being investigat-ed and a police team has been sent toDurgapur.

Imagine a sequence in whichtwo Indian secret agents are in theSyrian army's line of fire in rebel-controlled Qudssaya, with aPakistani operative tracking them.

The duo fights back, butPhantom is unable even in this per-ilous situation in a conflict zone togenerate the expected edge-of-the-seat tension. It feels like justanother routine action scene.

Actually that is precisely whatPhantom is like as the whole - itsflashy firepower seems like a lot ofwasted ammunition.

A mechanical spy thriller thatonly occasionally backs up all thenoise it makes with genuinely elec-trifying moments, it, however,pulls no punches in calling a spadea spade.

Although the film asserts that itscharacters are all imaginary, theprincipal antagonists are all mod-elled on the most wanted terrormasterminds that are a thorn inIndia's flesh.

Phantom begins with a car chasein Chicago, which ends with a man

plunging into the icy waters of ariver.

The protagonist (Saif Ali Khan)is convicted for murder and jailed.Cut to the office of the RAW chief(Sabyasachi Chakrabarty), wherehe and his trusted men (RajeshTailang, Mohammad ZeeshanAyyub, etc) plan a daring covertoperation.

Daniyal Khan, a dead-end ex-soldier with a completely dead-ened sense of life and death ispulled out of oblivion and pressedinto service by the spy agency towreak vengeance on the men whoplanned the 26/11 Mumbai terrorattacks.

The RAW chief who orders thekillings does not have the permis-sion of the home minister andhence he has to keep everythingunder wraps. The reclusiveDaniyal fits his plan like a glove.

This wishful construct, derivedfrom S Hussain Zaidi's bookMumbai Avengers, is pretty flatand predictable, especially in thefirst half as the angry male protag-onist, sacked from the army oncharges of desertion, grabs theopportunity to redeem himself.

It is only when the Indian agentinfiltrates Pakistan with the help ofa former RAW operative, NawazMistry (Katrina Kaif), thatPhantom springs to some degree oflife.

Obviously, the men that Daniyaltargets - they have names such asSajid Mir, Sabahuddin Umvi andHaaris Saeed - aren't easy pick-ings, but he has gutsy accomplicesin and around Mohalla Johar,Lahore.

But that is only one little cornerof the world. Daniyal, Nawaz intow, traverses virtually the entire

globe - Chicago, London, Amman,Beirut and Lahore - to pull off hismission impossible.

The sacked army man scourssome of the most dangerous placeson earth to smoke out with the aimof eliminating the terror master-minds.

But where pray is all the excite-ment that an action-packed thrillershould have generated?

Kabir Khan is on a roll afterBajrangi Bhaijaan, a film that rev-eled in celebrating the idea ofpeace in the region. Phantom goesto other end of the spectrum andharps on an eye-for-an-eye philos-ophy. The question the film posesis: if the US can do it, why can'tIndia?

We cannot because Bollywooddoes not have either a Daniel Craigor a Tom Cruise to add heft to fan-ciful actioners.

But to Khan's credit, his narra-tive eschews jingoism and stopsshort of painting the whole ofPakistan with the same brush.

He goes to the extent of under-lining that ordinary Pakistanis mayhave suffered no less at the handsof terrorists than the innocentIndians caught in the vortex of anever-ending proxy war.

The Phantom storyline includesan elderly Pakistani woman whohas lost her son to the Lashkar-e-Taiba and is sucked into the war onterrorism.

The lead actors are the weakestlinks in Phantom. Saif Ali Khan isin Agent Vinod territory here: hebelieves being poker-faced isbeing unflappable.
