Sir,

I am directed to invite your attention to the subject mentioned above and to State thatfollowing the supreme Court Judgement in the Indira Sawhney and others versus Union of India case,the Haryana Government vide nitification dated 12.10.1993 had set up the Haryana second BackwardClasses Commission. The terms of reference of this Commission were to entertain examine andrecommend upon requests for inclusion and complaints of over-inclusion and under-inclusion in thelist of Backward Classes. Vide notification dated 26.5.1994, the Commission was also assigned thefunction of specifying the basis applying the relevant the requisite socio-economic criteria to excludesocially advanced persons/sections (Creamy Layer) from Backward Classes.

In its report submitted on 16.5.1995, the Haryana Second Backward Classes Commission hasrecommended the criteria for excluding socially advanced persons/sections (Creamy Layer) fromBackward Classes. After considering these recommenddation, the Government has decided that thebenefit of reservation shall not apply to persons/sections mentianed in Annexure ‘A’ which is enclosed.

All the departments are requested to bring the above instructions to the notice of all the Headof Departments and appointing authorities under their control for necessary compliance.

(b) A lady belonging to OBC category has got married toaClass-I Officer, and may herself like to apply for a job.

(d) parents of whom the husband is a Class I Officer (directrecruit or pre-forty promoted) and the wife is a Class IIofficer and the wife dies; or suffers permanentincapacitation; and

(e) parents, of whom the wife is a Class I Officer (DirectRecruit or pre-forty promoted and the husband is aClass II Officer & the husband dies or suffers permanentincapacitation.

Provided that the rule of exclusion whall not apply inthe following cases :—

(a) Parets, both of whom are Class II officers and one ofthem dies or suffers permanent incapacitation.

(b) Parets, both of whom are Class II officers and both ofthem die or suffer permanent incapacitation, eventhough either of them has had the benefit of employmentin any International Organisation like U.N., I.M.F.,World Bank, etc. for a period of not less than 5 yearsbefore their death or permanent incapacitation.

C. Employees in Public Sector The criteria enumerated in A & B above in this

Undertaking etc. category will apply mutatis mutandis to officersholding equivalent or comparable posts in PSUs,Banks, Insurances Organisations Universities, etc.Pending the evaluation of the posts on equivalent orcomparable basis in these institutions, the criteriaspecified in Category V below will apply to the officersin these institution.

III. Armed Forces including Son(s) and daughter(s) ofPara Military Forces parents either or both of whom is or are in the rank of(persons holding civil Colonel and above in the Army and to the equivalentposts are not included) posts in the Navy and the Air Force and the Para Military

Forces,

Provided that :

(i) if the wife of an Armed Forces Officers is herself in theArmed Forces (i.e.) the category under consideration)the rule of exclusion will apply only when she herselfhas reached the rank of Colonel;

(ii) the service ranks below Colonel of husband and wifeshall not be clubbed together;

(iii) If the wife of an officer in the Armed Forces is in Civilemployment, this will not be taken into account forapplying the rule of exclusion unless she falls in theservice category under Item No. II in which case thecriteria and conditions enumerated therein will apply toher independently.

IV. Property Owners Agricultural Son(s) and Daughters of

holdings persons belonging to a family (father, mother and minor-children) which owns land more than land permissible underthe Ceiling Act of Haryana State.

V. Income/Wealth Test Son(s) and Daughters of

(a) persons having gross annual income of Rs. 1,00 lakh orabove or possesing wealth above the exemption limitas prescribed in the Wealth Tax Act for a period of threeconsecutive years.

(b) Persons in Categories I,II,III & IV who are not disentitledto the benefit of reservation but have income fro othersources of wealth which will bring them within theincome/weaktg criteria mentioned in (a) above.

Explanation :

(i) Income from salaries or agricultural land shall not beclubbed.

(ii) The income criteria in terms of rupee will be modifiedtaking in to account the change in its calue every threeyears. If the situation, however, so demands theinterrugnum may be less.

(iii) Where the husband is in some profession and the wifeis in a Class II or lower grade employment, the income/wealth test will apply only on the basis of the husband’sincome.

(iv) If the wife is in any profession and the husband is inemployment in Class II or lower rank post, then theincome/wealth criterion will apply only on the basis ofthe wife’s income and the husbands’ income will not beclubbed with it.

Explanation : Wherver the expression‘ Permanent incapacitation’ occur inthis shcedule, it shall mean incapaci-tation which results in putting anofficer out of service.

I am directed to refer to State Government letter No. 22/36/2000-3GSIII, dated 9.8.2000 onthe subject noted above wherein it was clarified that the income from salary will not be taken intoaccount for the purpose of income/wealth test in respect of service category and while calculatingincome or wealth test of the Government employee of Backward Classes and to say that the matter hadbeen under consideration of the State Government, whether to determine the creamy layer status of aBC candidate, the income of the applicant or income of his/her parent will be taken into account. Now,in consultation with the Government of India, it has been decided by the Government of Haryana thatcreamy layer status of a BC candidate is to be determined with reference to the income/status of theparents of the candidate and not his/her own income/status. The above decision may be kept in viewwhile issuing BC certificate.
