A. Board Policy 6Hx-18-1.02 authorizes the President to approve routine business items and administrative appointments that would have appeared on the December Board meeting agenda. These items will be submitted for confirmation at the January Board meeting.

B. The College will be closed in observance of the Thanksgiving Holiday on November 23-24, 2017. There are no classes scheduled to begin at 5:00p.m. or later on the Wednesday prior to Thanksgiving Day. However, any class already in progress at 5:00p.m. on that Wednesday should be completed. There are no classes scheduled for the Saturday and Sunday immediately following the Thanksgiving break.

C. Fall Commencement Exercises will be held on December 19, 2017 at the Palm Beach County Convention Center, Exhibit Hall, 650 Okeechobee Boulevard, West Palm Beach, Florida. The ceremony for the Bachelor's, Associate in Science, Associate in Applied Science Degrees and Certificate Programs will be held at 10:00a.m. The ceremony for the Associate in Arts Degree Program will be held at 2:00p.m.

D. The College will be closed for Semester Break from December 20, 2017 through January 1, 2018. The College will re-open on January 2, 2018. To accommodate student registration during the winter break, the Student Services Offices on the Lake Worth Campus will open 9:00a.m. - 6:00p.m. on Wednesday December 20, Thursday December 21, Wednesday December 27, and Thursday December 28. Campus representatives from admissions/registration, academic advisement, disability services, and financial aid will be available to assist students. In addition, the Student Services Offices at all campuses will be open from 9:00a.m. - 6:00p.m. on Saturday January 6, 2018.

E. On January 9-10, 2018, representatives from the College will attend Palm Beach County Days in Tallahassee, Florida. On January 10-11, The Board will also attend the AFC Trustees Legislative Summit in Tallahassee, Florida.

F. The next regular District Board of Trustees meeting will be held on Tuesday January 16, 2018 at 5:00p.m. in the Multi-Media Board Room at Palm Beach State College in Lake Worth.

13. ADJOURNMENT *Palm Beach State College District Board of Trustees welcomes public comments during its regular monthly meetings. Any person or group wishing to make public comments must complete a “Public Comment Card”. Procedures for making public comments are as follows:

1. Complete comment card including your name, address, telephone number and agenda item number (if

appropriate).

2. Submit the completed card to the executive administrative assistant to the board (seated on the right side of the dais) following the Approval of the Board Agenda. Anyone wishing to speak must submit a completed card at this time. Comment cards will not be accepted at any other time of the meeting.

3. When your name is called, approach the podium with the microphone, and state your name and address for the record.

a) Connecting Anthropology Lecture virtually from the Lawrence E will Museum of glades connecting with the lecture hall at the Loxahatchee campus. Students can view and participate in the lecture by asking questions through the chat feature.

a) “Tracy Talks’ Students research topics and create TED talk presentation to the viewed online. After assessing this research writing assignment, the professor produces a short video highlighting the areas of excellence found across the video submissions.

3. Respondus

a) application for creating and managing exams that can be printed to paper or published directly to blackboard learn. It is a tool securing online exams in classrooms.

4. Blackboard Collaborate Ultra

a) A level of engagement that makes learners feel like they are together in the same room via collaboration and conference tools. Screen sharing and student collaborations through breakout groups.

Summary:

Background/Pertinent Facts: Florida Statute 273.055 provides for disposal of obsolete and irreparable equipment to be auctioned to the highest bidder, or may be transferred to non-profit organizations as designated by statute and the Internal Revenue Service code section 501. The Procurement Director reviewed the surplus equipment and has determined that the attached items be recommended for auction or transfer. The Controller and Vice President, Administration & Business Services have approved this recommendation. Financial Impact: The obsolescence and ultimate disposition of this equipment will have no financial impact for the 2017/2018 fiscal year. All of the inventory listed has been previously depreciated to a book value of zero through the prior fiscal years. Strategic Goal(s) Addressed: The College will promote and practice operational efficiencies in all areas. Duration of Contract: N/A

I. Statement of Nondiscrimination:

Palm Beach State College is an equal access equal opportunity institution. The College

complies with all state and federal laws granting rights to applicants for employment or

admission to the College, employees, and students.

II. Scope of Policy:

The College prohibits unlawful discrimination on the basis of race, color, creed, ethnicity,

national origin, gender, sexual orientation, age, religion, marital status, veteran status,

disability, or genetic information, or pregnancy status in any of its employment, or

educational programs or activities.

Harassment of any kind, including sexual harassment, is prohibited.

III. Procedures:

The complaint procedures as outlined in the Sexual Harassment Policy and Complaint

Procedure for Sexual Harassment and other types of Harassment or Discrimination (6Hx-

18-5.86) are applicable to employee and student complaints of sexual harassment as well

as any other form of harassment or discrimination. These procedures are also applicable

to applicants for employment.

If a student believes that he or she has been subjected to discrimination during the

process for admission to the College, the student may file a written complaint to the

District College Registrar.

IV. Prevention:

The College website and various internal and external College publications provide

notification of the Nondiscrimination Policy to students, applicants, employees and the

general public. Information regarding the Nondiscrimination Policy may be obtained

760.10 Unlawful employment practices.—(1) It is an unlawful employment practice for an employer:(a) To discharge or to fail or refuse to hire any individual, or otherwise to discriminate against any

individual with respect to compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(b) To limit, segregate, or classify employees or applicants for employment in any way which would

deprive or tend to deprive any individual of employment opportunities, or adversely affect any individual’s status as an employee, because of such individual’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(2) It is an unlawful employment practice for an employment agency to fail or refuse to refer for

employment, or otherwise to discriminate against, any individual because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status or to classify or refer for employment any individual on the basis of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(3) It is an unlawful employment practice for a labor organization:(a) To exclude or to expel from its membership, or otherwise to discriminate against, any individual

because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.(b) To limit, segregate, or classify its membership or applicants for membership, or to classify or fail

or refuse to refer for employment any individual, in any way that would deprive or tend to deprive any individual of employment opportunities, or adversely affect any individual’s status as an employee or as an applicant for employment, because of such individual’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(c) To cause or attempt to cause an employer to discriminate against an individual in violation of

this section.(4) It is an unlawful employment practice for any employer, labor organization, or joint labor-

management committee controlling apprenticeship or other training or retraining, including on-the-job training programs, to discriminate against any individual because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status in admission to, or employment in, any program established to provide apprenticeship or other training.

(5) Whenever, in order to engage in a profession, occupation, or trade, it is required that a person

receive a license, certification, or other credential, become a member or an associate of any club, association, or other organization, or pass any examination, it is an unlawful employment practice for any person to discriminate against any other person seeking such license, certification, or other credential, seeking to become a member or associate of such club, association, or other organization, or

seeking to take or pass such examination, because of such other person’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(6) It is an unlawful employment practice for an employer, labor organization, employment agency,

or joint labor-management committee to print, or cause to be printed or published, any notice or advertisement relating to employment, membership, classification, referral for employment, or apprenticeship or other training, indicating any preference, limitation, specification, or discrimination, based on race, color, religion, sex, pregnancy, national origin, age, absence of handicap, or marital status.

(7) It is an unlawful employment practice for an employer, an employment agency, a joint labor-

management committee, or a labor organization to discriminate against any person because that person has opposed any practice which is an unlawful employment practice under this section, or because that person has made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under this section.

(8) Notwithstanding any other provision of this section, it is not an unlawful employment practice

under ss. 760.01-760.10 for an employer, employment agency, labor organization, or joint labor-management committee to:

(a) Take or fail to take any action on the basis of religion, sex, pregnancy, national origin, age,

handicap, or marital status in those certain instances in which religion, sex, condition of pregnancy, national origin, age, absence of a particular handicap, or marital status is a bona fide occupational qualification reasonably necessary for the performance of the particular employment to which such action or inaction is related.

(b) Observe the terms of a bona fide seniority system, a bona fide employee benefit plan such as a

retirement, pension, or insurance plan, or a system which measures earnings by quantity or quality of production, which is not designed, intended, or used to evade the purposes of ss. 760.01-760.10. However, no such employee benefit plan or system which measures earnings shall excuse the failure to hire, and no such seniority system, employee benefit plan, or system which measures earnings shall excuse the involuntary retirement of, any individual on the basis of any factor not related to the ability of such individual to perform the particular employment for which such individual has applied or in which such individual is engaged. This subsection shall not be construed to make unlawful the rejection or termination of employment when the individual applicant or employee has failed to meet bona fide requirements for the job or position sought or held or to require any changes in any bona fide retirement or pension programs or existing collective bargaining agreements during the life of the contract, or for 2 years after October 1, 1981, whichever occurs first, nor shall this act preclude such physical and medical examinations of applicants and employees as an employer may require of applicants and employees to determine fitness for the job or position sought or held.

(c) Take or fail to take any action on the basis of age, pursuant to law or regulation governing any

employment or training program designed to benefit persons of a particular age group.(d) Take or fail to take any action on the basis of marital status if that status is prohibited under its

antinepotism policy.(9) This section shall not apply to any religious corporation, association, educational institution, or

society which conditions opportunities in the area of employment or public accommodation to members of that religious corporation, association, educational institution, or society or to persons who subscribe to its tenets or beliefs. This section shall not prohibit a religious corporation, association, educational institution, or society from giving preference in employment to individuals of a particular religion to

perform work connected with the carrying on by such corporations, associations, educational institutions, or societies of its various activities.

(10) Each employer, employment agency, and labor organization shall post and keep posted in

conspicuous places upon its premises a notice provided by the commission setting forth such information as the commission deems appropriate to effectuate the purposes of ss. 760.01-760.10.

Introduction

The Department of Education’s (ED) Office for Civil Rights (OCR) enforces several

statutes that protect the rights of beneficiaries in programs or activities that receive financial assistance from ED. These laws prohibit discrimination on the basis of race, color, and national origin (Title VI of the Civil Rights Act of 1964), sex (Title IX of the Education Amendments of 1972), disability (Section 504 of the Rehabilitation Act of 1973), and age (Age Discrimination Act of 1975). OCR also has enforcement responsibilities under Title II of the Americans with Disabilities Act, which prohibits state and local governments from discriminating on the basis of disability. In addition, OCR enforces the Boy Scouts of America Equal Access Act, which addresses equal access to meet on school premises or in school facilities for the Boy Scouts of America and other designated youth groups.

This fact sheet explains the requirements for schools, colleges, and state and local governments that receive federal funds to issue notices of non-discrimination, clarifies the information that they should include in their non-discrimination notices, and provides a sample notice of non-discrimination. This fact sheet is designed to assist education institutions in establishing a notice of non-discrimination that meets the requirements of the applicable regulations.

Notice of Non-discrimination Requirements

The regulations implementing Title VI, Title IX, Section 504, the Age Discrimination Act, and the Boy Scouts Act contain requirements

for recipients to issue notices of non-discrimination. (See 34 C.F.R. Sections 100.6(d), 106.9, 104.8, 110.25, and 108.9, respectively.) The Title II regulation also contains a notice requirement that applies to all entities of state or local government, whether or not they receive federal financial assistance. (See 28 C.F.R. Section 35.106.)

These regulations require that recipients notify students, parents and others that they do not discriminate on the basis of race, color, national origin, sex, disability, and age, and, if applicable, that they provide equal access to the Boy Scouts of America and other designated youth groups. However, these regulations contain minor differences relating to the required content of recipient notices of non-discrimination and the methods used to publish them.

The Title VI regulation requires schools and colleges to notify students and others of the regulatory provisions in a manner that a responsible ED official would find necessary to tell students of their protections against discrimination under the statute and regulation.

The Boy Scouts Act regulation incorporates the Title VI regulatory provision concerning notice of non-discrimination. Public elementary and secondary schools and local and state educational agencies that receive funds made available through ED must make available information regarding the provisions of the Boy Scouts Act. This information must be made available in a manner that a responsible ED official would find necessary to inform people of the protections provided under the Boy Scouts Act and its regulation. Entities other than public elementary and secondary schools

and local and state educational agencies that receive funds made available through ED need not provide this notice, as the Boy Scouts Act does not apply to them.

The Title IX and the Section 504 regulations both contain more detailed requirements that specify the information that must be included in a notice of non-discrimination. These regulations also require recipients to designate at least one employee to coordinate efforts to comply with and carry out responsibilities.

The Title IX regulation requires schools and colleges to implement specific and continuing steps to inform students and others of the protections against discrimination on the basis of sex. The notification must state that the requirement of non-discrimination in educational programs and activities extends to employment and admission. It also must say that questions about Title IX may be referred to the employee designated to coordinate Title IX compliance or to the assistant secretary for civil rights. Schools are required to include the name, address, and telephone number of the designated coordinator in their notifications.

The Section 504 regulation requires that schools and colleges employing 15 or more persons implement appropriate, continuing steps to notify students and others that the school does not discriminate on the basis of disability in violation of the statute and regulation. The notification must state, where appropriate, that the school or college does not discriminate in admission, treatment, or access to its programs or activities. The notification also must state that the school or college does not discriminate in employment in its programs or activities. The employee designated to

coordinate compliance with the Section 504 regulation must be identified in the notification.

The Title II regulation requires that a public entity generally make information regarding the provisions of Title II available to applicants, participants and other interested persons in such a manner as the head of the entity finds necessary to apprise such persons of the protections against discrimination under the Americans with Disabilities Act. The regulation implementing the Age Discrimination Act requires a school or college to notify its students and applicants, in a continuing manner, of information regarding the provisions of the act and these regulations. The notice must identify the compliance coordinator by name or title, address, and telephone number.

Methods of NotificationIn accordance with the Title IX and Section

504 regulations, notification may include posting information notices, publishing in local newspapers, publishing in newspapers and magazines operated by the school or its students, publishing in alumnae or alumni newspapers or magazines, or distributing memoranda or other written communications to students and employees. In addition, recipients are required to include a statement of nondiscriminatory policy in any bulletins, announcements, publications, catalogs, application forms, or other recruitment materials that are made available to participants, students, applicants, or employees. As noted in the pertinent Section 504 regulatory provision, schools may meet this requirement either by including appropriate inserts in existing materials and publications

or by revising and reprinting the materials and publications.

Neither the Title VI regulation, the Boy Scouts Act regulation, the Age Discrimination Act regulation, nor the Title II regulation specifies the methods to be used by recipients in publishing notices of non-discrimination.

Combined RequirementsOCR recognizes the variations among the

regulations governing notice requirements and understands that schools and colleges may wish to use one statement to comply with all requirements of the regulations implementing Title VI, Title IX, Section 504, the Age Discrimination Act, and, if applicable, the Boy Scouts Act. Public institutions also may wish to include Title II of the Americans with Disabilities Act in their statement. OCR encourages one combined notice for the regulations.

A combined non-discrimination notice should contain two basic elements: (1) a statement of non-discrimination that specifies the basis for non-discrimination; and (2) identification by name or title, address, and telephone number of the employee or employees responsible for coordinating the compliance efforts.

The regulations do not require that a recipient identify the pertinent regulations by title. Please see the sample notice at the end of this pamphlet.

The Title IX regulation requires a recipient to provide the name of the person responsible for its compliance effort in addition to the address and telephone number where that person may be contacted. However, because OCR recognizes that the inclusion of a person’s name

in a non-discrimination notice may result in an overly burdensome requirement to republish the notice if a person leaves the coordinator position, it is acceptable for a recipient to identify its coordinator only through a position title.

The Section 504 regulation does not require a recipient to include the address or telephone number of the responsible employee assigned to coordinate its compliance efforts. However, OCR considers that identifying the responsible employee without information on how to contact that person does not constitute an effective notice. An acceptable non-discrimination notice should provide information on how to contact the responsible employee.

Compliance with the notification requirements of Section 504 will also generally satisfy the notification requirements of Title II for state and local governments.

Although the Section 504 and Title IX regulations state that schools and colleges, where appropriate, shall specify non-discrimination in the areas of admission and employment, a general statement indicating non-discrimination in all programs is acceptable.

The Title IX regulation indicates that inquiries concerning the application of the Title IX regulation may be referred to the coordinator or to the assistant secretary for civil rights. An acceptable notice may include the names and titles of either one or both individuals.

However, since the Section 504 regulation requires identification of a coordinator, a combined non-discrimination notice should

include the name and/or title of the responsible employee. If a recipient designates two different people to coordinate compliance with Section 504 and Title IX, both names or titles should be included in the notice.

I. Statement of Harassment Policy: Policy Statement

Palm Beach State College is committed to an academic and working environment free

from harassment, sexual harassment, discrimination, and retaliation. Referred to

collectively and further defined below, Harassment, sexual harassment, discrimination, or

retaliation, of any nature is prohibited whether based on an individual’s race, color, creed,

ethnicity, national origin, gender, sexual orientation, age, religion, marital status, veteran

status, disability, or genetic information threatens the legitimate expectation of all

members of the College community, that the campus environment will be conducive to

work or study. Specifically, sexual harassment is a form of sex discrimination, which is

in violation of Title VII of the 1964 Civil Rights Act for employees as amended by the

Equal Employment Opportunity Act of 1973, Florida Civil Rights Act, and under Title

IX of the Education Amendments of 1972 for students. Discrimination is prohibited and

in violation of these laws and College policy. Preventing harassment, sexual harassment,

discrimination, and retaliation is the responsibility of the entire College. It is contrary to

the College policy for any individual to engage in retaliatory action against a person who

files a harassment, sexual harassment, and/or discrimination complaint. Accordingly,

Palm Beach State College encourages all employees and students who believe they are

being subjected to harassment, sexual harassment, discrimination, or retaliation to follow

the outlined complaint procedures. The College will take prompt disciplinary action

against individuals, including third parties, at any locations who engage in actions that

violate this policy. The college will comply with all said laws in the legal authority

section of this policy, investigation, review and disposition of matters involving students

to include compliance with Title IX.

II. Scope of Policy:

This policy applies to all full-time, part-time and temporary employees, administrators,

faculty, staff, students, applicants for employment, applicants for student admission,

volunteers, and contractors, or and visitors. Student matters will be resolved in

compliance with the law and the Student Code of Conduct.

III. Definitions:

Harassment is defined as any unwelcome conduct or request for favors verbal or physical

conduct or any action based on an individual’s race, color, creed, ethnicity, national

origin, gender, sexual orientation, age, religion, marital status, veteran status, disability,

or genetic information, or pregnancy status that adversely affects an individual’s

educational or employment opportunities.

Harassment may include, but is not limited to, repeated remarks of a demeaning nature,

implied or explicit threats, slurs, innuendoes or gestures, demeaning jokes, stories,

pictures, objects or activities directed at an individual based on any of the above

categories or groups.

Sexual harassment is defined to be any unwelcome conduct of a sexual nature. It includes

sexual advances, requests for sexual favors, or other verbal, non-verbal, or physical

conduct of a sexual nature, when. This includes, but not limited to:

1. Submission to such conduct is made either explicitly or implicitly a term or condition

of an individual’s employment or a student’s status in a course, program, or activity;

2. Submission to, or rejection of such conduct by an employee is used as a basis for

employment decisions affecting the individual. In the case of a student, it is used as a

basis for academic or other decisions affecting a student; or,

3. Such conduct has the purpose or effect of unreasonably interfering with the

individual’s employment (or the student’s educational experience) by creating an

intimidating, hostile, or offensive environment.

Sexual harassment may occur within any relationship. It may occur between

supervisor and employee or instructor and student; it may be directed by students

towards a student, faculty or staff. It may occur among peers. It may occur where no

relationship exists between the parties other than being co-employees or co-students.

Sexual harassment may occur between persons of the same or different genders.

Discrimination is defined as treating any member of the College community different

from the way others are treated based on race, color, creed, ethnicity, national origin,

gender, sexual orientation, age, religion, marital status, veteran status, disability or

genetic information, or pregnancy status without lawful justification.

Retaliation is defined as unlawful adverse or negative action taken against the person

who makes or supports a complaint of harassment or discrimination.

IV. Examples of Prohibited Conduct:

Examples of prohibited conduct related to sexual harassment, as defined above, may

include, but are not limited to, the following:

1. Direct or implied threats that submission to sexual advances will be a condition of

employment, work status, promotion, grades or letters of recommendation;

2. Unwelcome physical contact, including unnecessary touching, patting, hugging or

brushing against a person’s body;

3. Unwanted flirtations or advances of a sexual nature;

4. Inappropriate or unwelcome sexual remarks about a person’s clothing, body or sexual

relations;

5. The display in the workplace or classroom of sexually suggestive objects, pictures,

posters or cartoons which are without defensible educational purpose;

6. Inappropriate or unwelcome conversation of a sexual nature or similar jokes and

stories; and

7. Sexual assault.

Examples of harassment, as defined above, other than sexual harassment, may include,

but are not limited to the following:

1. A disparity of treatment in the recruitment and hiring process.

2. A disparity of treatment to an individual or group, in the reassignment, termination,

layoff, recall, leave of absence, salary, and other economic benefits that result in a

significant change in employment status.

V. Reporting and Complaint Procedures for Sexual Harassment or any other types of

Harassment, or Discrimination or Retaliation:

If an employee or a student feels that he/she has been the subject of sexual harassment or

any other type of harassment, or discrimination and retaliation, the employee or the

student must report the incident within 60 days to the Executive Director of Human

Resources or Assistant to the President for Equity Programs. If a faculty or staff member

is informed by a student of a situation involving a student(s) and employee of the College

that could possibly be considered sexual harassment or any other type of harassment, or

discrimination and retaliation, the employee has a duty to inform the Executive Director

of Human Resources or the Assistant to the President for Equity Programs, who will take

prompt action to investigate the complaint. In no case will a complainant be required to

personally report such behavior to the person accused of the misconduct.

Sexual harassment or any other types of harassment or discrimination involving only

students shall be investigated by the Vice President of Student Services Campus Dean of

Students or designee. The procedures for student on student complaints are listed in the

Student Handbook.

VI. Reporting:

1. Palm Beach State College requires any person who believes that he or she has been

subjected to sexual harassment or any other type of harassment or discrimination to

report within 60 days the incident to the Executive Director of Human Resources or

Assistant to the President for Equity Programs.

2. When a supervisor or faculty member receives a complaint of harassment or

discrimination, of this nature, he/she shall immediately inform advise the complainant

of the harassment that he/she must to notify the Executive Director of Human

Resources or Assistant to the President for Equity Programs. The Ssupervisor or

faculty member shall also notify the Executive Director of Human Resources or

Assistant to the President for Equity Programs of the complaint. Failure to notify the

Executive Director of Human Resources or the Assistant to the President for Equity

Programs of suspected sexual harassment or any other type of harassment or

discrimination is a violation of this policy.

VII. VI. Complaint Investigation:

1. In order to initiate the investigation process, the complainant may provide written

details of the conduct that is the subject of the complaint on the official harassment,

discrimination or retaliation complaint form or relay the information to the Executive

Director of Human Resources or Assistant to the President of Equity Programs who

will reduce the information to writing which must be reviewed and signed by the

complainant. The complainant shall complete the Harassment, Sexual Harassment,

Discrimination, and Retaliation Complaint Form. Complaints will be investigated by

the Executive Director of Human Resources, the Assistant to the President for Equity

Programs or designee. To the extent possible, complaints will remain confidential and

information about them will be provided only to those persons who need to know in

order to achieve a timely resolution of the complaint. Similarly, both the complainant

and accused party shall be treated respectfully and with sensitivity at all times.

Complaints involving only students shall be investigated by the Vice President of

Student Services or designee.

2. The Executive Director of Human Resources, Assistant to the President for Equity

Programs or designee will interview the accused employee regarding the nature of the

complaint and will provide the accused employee with a copy of the complainant’s

written complaint within 15 working days. If so desired, the accused employee may

have five (5) working days to respond in writing to the complaint.

3. Any persons reasonably thought to have significant information relevant to the

complaint shall be interviewed and such interviews shall be appropriately

documented. It is expected that employees would cooperate in providing requested

information and refusal to do so will result in termination of employment. Other

acceptable methods for gathering information include, but are not limited to, visual

inspection of offensive materials and follow-up interviews as necessary.

4. The investigation of a complaint will be concluded as soon as possible after receipt of

the written complaint. Investigations exceeding 30 days shall be reviewed by the

Executive Director of Human Resources or the Assistant to the President for Equity

Programs, and justification for the delay will be documented.

5. Upon completion of the investigation, the Executive Director of Human Resources or

the Assistant to the President for Equity Programs or designee will prepare a written

report of the investigation. The report shall include: a summary of the findings, a

recommendation as to whether disciplinary action should or should not be pursued

against the accused individual; a proposed disciplinary penalty, and the basis for the

recommended action. a summary of the complaint; the findings of the investigation; a

determination as to whether a violation of College policy was found; and a

recommendation of disposition.

6. If either the complainant or the accused party disagrees with the determination, an

appeal may be made to the College President within 15 working days of receipt of the

written report. The College President shall review all such appeals and has discretion

to further investigate the matter. The President shall issue a decision within 30 days

of receiving the request. The determination of the College President shall be the final

step of the internal review procedure. Any discipline administered for full-time

faculty shall be subject to the grievance and arbitration procedures as outlined in the

faculty union contract.

VIII.VII.Confidentiality:

Confidentiality shall be maintained to the greatest extent possible within the law and the

requirements for conducting appropriate investigations.

IX.VIII.Retaliation:

Retaliation against individuals who have filed a charge or participated in an investigation

or opposed any unlawful practice is prohibited and will subject the person who retaliates

to disciplinary action, up to and including termination of employment.

X. IX. False or Malicious Complaints:

Complainants found to have been dishonest in making the allegations or to have made

them maliciously are subject to disciplinary action, up to and including termination of

employment.

XI. X. Prevention:

Palm Beach State College further recognizes that prevention is the best tool for the

elimination of sexual harassment and any types of harassment or discrimination.

Therefore, the College will take necessary steps to prevent and eliminate all forms of

harassment or discrimination including, but not limited to:

1. Publishing this policy for present, or future employees, and students.

2. Ensuring that training on the prevention of harassment or discrimination is

established and offered to College employees.

3. Publishing harassment or discrimination materials where appropriate.

4. Including an explanation of the College’s harassment policy including sexual

harassment during student and employee orientation.

760.10 Unlawful employment practices.—(1) It is an unlawful employment practice for an employer:(a) To discharge or to fail or refuse to hire any individual, or otherwise to discriminate against any

individual with respect to compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(b) To limit, segregate, or classify employees or applicants for employment in any way which would

deprive or tend to deprive any individual of employment opportunities, or adversely affect any individual’s status as an employee, because of such individual’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(2) It is an unlawful employment practice for an employment agency to fail or refuse to refer for

employment, or otherwise to discriminate against, any individual because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status or to classify or refer for employment any individual on the basis of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(3) It is an unlawful employment practice for a labor organization:(a) To exclude or to expel from its membership, or otherwise to discriminate against, any individual

because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.(b) To limit, segregate, or classify its membership or applicants for membership, or to classify or fail

(c) To cause or attempt to cause an employer to discriminate against an individual in violation of

this section.(4) It is an unlawful employment practice for any employer, labor organization, or joint labor-

management committee controlling apprenticeship or other training or retraining, including on-the-job training programs, to discriminate against any individual because of race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status in admission to, or employment in, any program established to provide apprenticeship or other training.

(5) Whenever, in order to engage in a profession, occupation, or trade, it is required that a person

receive a license, certification, or other credential, become a member or an associate of any club, association, or other organization, or pass any examination, it is an unlawful employment practice for any person to discriminate against any other person seeking such license, certification, or other credential, seeking to become a member or associate of such club, association, or other organization, or

seeking to take or pass such examination, because of such other person’s race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status.

(6) It is an unlawful employment practice for an employer, labor organization, employment agency,

or joint labor-management committee to print, or cause to be printed or published, any notice or advertisement relating to employment, membership, classification, referral for employment, or apprenticeship or other training, indicating any preference, limitation, specification, or discrimination, based on race, color, religion, sex, pregnancy, national origin, age, absence of handicap, or marital status.

(7) It is an unlawful employment practice for an employer, an employment agency, a joint labor-

management committee, or a labor organization to discriminate against any person because that person has opposed any practice which is an unlawful employment practice under this section, or because that person has made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under this section.

(8) Notwithstanding any other provision of this section, it is not an unlawful employment practice

under ss. 760.01-760.10 for an employer, employment agency, labor organization, or joint labor-management committee to:

(a) Take or fail to take any action on the basis of religion, sex, pregnancy, national origin, age,

handicap, or marital status in those certain instances in which religion, sex, condition of pregnancy, national origin, age, absence of a particular handicap, or marital status is a bona fide occupational qualification reasonably necessary for the performance of the particular employment to which such action or inaction is related.

(b) Observe the terms of a bona fide seniority system, a bona fide employee benefit plan such as a

retirement, pension, or insurance plan, or a system which measures earnings by quantity or quality of production, which is not designed, intended, or used to evade the purposes of ss. 760.01-760.10. However, no such employee benefit plan or system which measures earnings shall excuse the failure to hire, and no such seniority system, employee benefit plan, or system which measures earnings shall excuse the involuntary retirement of, any individual on the basis of any factor not related to the ability of such individual to perform the particular employment for which such individual has applied or in which such individual is engaged. This subsection shall not be construed to make unlawful the rejection or termination of employment when the individual applicant or employee has failed to meet bona fide requirements for the job or position sought or held or to require any changes in any bona fide retirement or pension programs or existing collective bargaining agreements during the life of the contract, or for 2 years after October 1, 1981, whichever occurs first, nor shall this act preclude such physical and medical examinations of applicants and employees as an employer may require of applicants and employees to determine fitness for the job or position sought or held.

(c) Take or fail to take any action on the basis of age, pursuant to law or regulation governing any

employment or training program designed to benefit persons of a particular age group.(d) Take or fail to take any action on the basis of marital status if that status is prohibited under its

antinepotism policy.(9) This section shall not apply to any religious corporation, association, educational institution, or

society which conditions opportunities in the area of employment or public accommodation to members of that religious corporation, association, educational institution, or society or to persons who subscribe to its tenets or beliefs. This section shall not prohibit a religious corporation, association, educational institution, or society from giving preference in employment to individuals of a particular religion to

Policy Statement

The Probationary Observation Period is intended to give new employees the opportunity to

demonstrate their ability to achieve a successful level of performance and conduct. The College

uses this period to evaluate employee capabilities, work habits and overall performance. Either

the employee or the College may end the employment relationship. The probationary observation

period shall not create an expectation of continued employment.

All regular full-time and part-time newly hired non-unit employees and employees rehired

following a break in service are required to serve a 90 calendar day probationary observation

period.

Employees who are promoted or transferred within the college must complete a 90 calendar day

probationary observation period.

A review of the employee’s performance and conduct during this probationary observation

period must be completed and sent to the Office of Human Resources. In the event an employee

does not perform satisfactorily or conduct themselves appropriately during this period, his/her

employment with the College will be terminated.

Definition of Term in Statement

Probationary Observation Period - the period of initial employment that provides the employee

and the College the opportunity to assess whether the employee is suited for the position.

Policy Statement

Palm Beach State College recognizes that our employees are one of our greatest assets. The

overall success of our organization is supported through the employee review process. The aim

of this process is to maximize the potential of each employee by evaluating and acknowledging

performance, accountability and job knowledge in order to set and achieve objectives. This

policy provides for retention of highly qualified and diverse faculty and staff in support of the

college’s commitment to student success. By the use of an approved form, such evaluation shall

become part of the employee’s file.

1. Non-Bargaining Unit Employees

a) New Hire/Transfer/Promotion Review – new non-unit employees of the college and

current employees who transfer to, or are promoted to another position, will receive

introductory appraisals shall receive 3-month and 6-month introductory reviews.

b) Annual Review - by July 1 of each year the supervisor shall review each employee.

2. Part-Time Instructor

Each department Department chair shall visit the classes of each part-time instructor in the

department supervised. Written reports on the visit and the administrator/instructor

conference shall be held after the visit.

3. Bargaining Unit Members

The performance appraisal of bargaining unit members shall be completed by May 30 of

each year. Frequency of observations, methods of evaluation, discussion and response of

bargaining unit members shall follow the bargaining unit agreement.

Background/Pertinent Facts: In August 2017, Palm Beach State College contracted with 180

Systems to conduct an independent assessment of the Workday Enterprise Resource Planning

project. As part of the project methodology, 180 Systems reviewed project documentation, met

and interviewed key College executives and project personnel, and conducted a survey with

project personnel. Michael Burns, 180 Systems consultant, was on-site during much of the

activities (although the visit was shortened due to Hurricane Irma). Mr. Burns will be presenting

the executive report of findings including assessment of whether the project is on track.

satisfactorily performed.

Palm Beach State College shall established a scheduled maintenance

window. All changes affecting user connectivity, security, and access to IT

services must be scheduled within this window of time unless otherwise

approved by the CAB.

1. Full-time 12-month employees shall be eligible for paid vacation leave in accordance

with the following schedule:

A. Continuous service during the first five (5) years of service. One day of

vacation leave for each calendar month, or major fraction of a calendar month, of

service during the vacation year.

B. Continuous service during the next five (5) years of service. One and one-

fourth (1-1/4) days of vacation leave for each calendar month, or major fraction of

a calendar month, of service during the vacation year.

C. Continuous service of more than ten (10) years. One and one-half (1-1/2) days

of vacation leave for each calendar month, or major fraction of a calendar month,

of service during the vacation year.

Continuous Service is defined as service in a full-time position during which the employee’s

employment relationship with the District Board of Trustees has been unbroken and

uninterrupted. Absences due to any kind of approved leave of absence or layoff of less than 6

months will not be deemed as breaking or interrupting continuous service, although an

employee’s total continuous service credit will be reduced by the length of any unpaid leave or

layoff.

Vacation year is the year commencing first day of the employee’s full-time continuous service.

2. An employee’s continuous service at any public Florida community, junior, or state

college other than Palm Beach State College will be added to the employee’s continued

service at Palm Beach State College for purposes of computing vacation leave. The

following conditions apply:

A. The employee must begin full-time 12-month employment in a position at Palm

Beach State College at the beginning of Palm Beach State’s next regular term

following the end of the last regular term of the previously employing college.

B. Termination of employment at the other college must not have been for cause.

C. Non-unit personnel must begin work at Palm Beach State College within thirty

(30) days of termination of prior employment.

3. No employee shall have accumulated more than fifty (50) days of unused vacation leave

as of December 31 of each calendar year. Vacation time accumulated in excess of fifty

(50) days on December 31 shall be forfeited, unless otherwise approved by the board.

4. The scheduling of vacations shall be subject to the approval of the College

administration, which will approve requests submitted so long as there is minimum

disruption of the operation of the College.

5. Persons employed at the College who are granted professional, sabbatical, or non-paid

leave will not accumulate annual leave during the period for which the leave has been

granted.

Summary:

Background/Pertinent Facts: Due to the implementation schedule of the enterprise resource planning (ERP) system, employees working on this initiative are in high demand and are required in the office. As a result, these employees have been asked to limit the number of days they may use their vacation leave. This Authorization Resolution would allow employees who work 100% on the ERP project to accumulate more than 50 days by December 31st of each calendar year during the ERP conversion period and not be subject to the loosing these days as is otherwise required by policy. These employees will be required to come back into compliance with this policy within 3 years after the conclusion of the ERP project. Financial Impact: N/A Strategic Goal(s) Addressed: The College will foster ethical standards and practices within the College and the community it serves. Duration of Contract: N/A

Subject: Architectural Firm Selection - Dental and Medical Services Technology Building

Summary:

Background/Pertinent Facts: On August 28, 2017, the Procurement Department issued a Request for Qualifications (RFQ) for Architectural Design Services for the planned Dental and Medical Services Technology Building. At that time, the campus location of the building had yet to be determined. The Procurement Department intentionally started the solicitation without a campus location with the intention that selection and contracting be completed by January. Seven applications were received with two of those companies certified as Women/Minority Business Enterprises (W/MBE). The applications were reviewed and scored by a College Evaluation Committee and the following top five companies have been selected for the presentation and interview phase of the evaluation.

Song + Associates, Inc. Harvard Jolly Architecture Zyscovich Architects ACAI Associates, Inc. HKS Architects, Inc.

Presentations and interviews are in the process of being scheduled. It is anticipated that this final stage of the evaluation will be completed by early December. College administration desires to have the selected firm under contract and beginning design in early January. In lieu of a December District Board of Trustees meeting to approve a recommendation, College administration is asking the District Board of Trustees to grant President Parker the authority to move forward the contracting process with the Committee recommended architectural firm. Financial Impact: The College has received funding from the State of Florida for the first phase of this capital project.

Background/Pertinent Facts: On October 2, 2017, the Procurement Department issued a Request for Proposals (RFP) for District Building Cleaning and Grounds Care Services. This RFP left open a College option to contract separately for Building Cleaning Services and Grounds Care Services or as a combined services contract if there appeared to be fiscal or service related advantages to do so. The following table summarizes the proposals received for these services:

Board of Trustees to grant President Parker the authority to move forward the contracting process with the Committee recommended building cleaning and grounds care service provider(s). The authority granted by the District Board of Trustees to President Parker would be under the condition that annual building cleaning services not exceed $1,658,500 and that annual grounds care services not exceed $360,000 for budgeted fiscal year 2017-2018. Financial Impact: None. Annual facilities operational funds have been budgeted for these services. Strategic Goal(s) Addressed: The College will promote and practice operational efficiencies in all areas. Duration of Contract: Two years, with three one-year renewal options.

RECOMMEND APPROVAL

Enrollment Increase enrollment in the 2017-2018 Academic Year by 3% more than the 2016-2017 Academic Year enrollment. Diversify the enrollment considering the use of Fridays, weekends and distance learning options. College Foundation Implement the new structure for the Foundation, to include hiring the new Vice President of Advancement and Director of College Relations & Marketing. Develop a Strategic Plan for the Foundation. Expand and diversify donor pools.
