With Cynthia on a wheel- chair and her academic qualification amounting to no value, she said she en- counters financial ordeal es- pecially that she lives with her 70 year old husband Nadaniel Monare who is short sighted and unable to walk properly and her two grandchildren one of which is still in high school. 2014 marks exactly 20 years of a democratic South Africa. This shows how far South Africa as a country comes from. To date, the country has had at least four democratically elected Presidents, namely Nelson Mandela, the founding President of a democratic South Africa, Thabo Mbeki, Kgalema Motlanthe and Jacob Zuma, respectively.

Prior to the advent of democracy in 1994, voting was a privilege not given to everyone. Simply put, only White People were allowed to vote for the country’s governing party. But today all has changed. Every South African citizen (irrespective of gender, age and race) above the age of 18 with a valid Identity Document is eligible to vote in the country’s elections.

The Independent Electoral Commissions, the body that oversees the country’s election processes, has once again opened its doors for people to register to vote in the coming elections. This is the opportunity that we should all utilize as South Africans. Even people who have registered in the past, it is still within their rights to go check with the IEC if their details still exist on the database.

Remember, voting is our constitutional right. Let’s use it accordingly. The final voting registration takes place on Saturday and Sunday 8 and 9 February 2014.

“Success in the schools is dependent on each learner and failure to achieve better results as a school must not be through you as an individual student”,this was a message by MEC Ntombi Mekgwe to the first matricu-lants of the newly built Noordwyk Secondary school.

Accompanied by Deputy Minister in the Presidency Obed Bapela and Deputy Chair of Chairpersons in the Gauteng Legislature Wally Mbatha, MEC Mekgwe officially opened the newly built school in the Midrand area.

“The principal wants 100 percent pass rate, we (the learners, parents and government) must assist him. Let us all pull our efforts to realise and achieve the 100 percent goal” MEC Mekgwe said.

Mekgwe also told the leaners that the school was new and they had found it clean and it cannot be allowed to degenerate and must remain in a pristine order.

Before Noodwyk, Mekgwe was in Alexandra to congratulate Alexan-dra High school for achieving 88 percent pass rate improving from the 51 percent it achieved in 2012.

The MEC thanked the teachers for their hard work saying “all of us will not be better people if it was not for a teacher.”

She said that the visit was to encourage the school community and make them aware that government knew their challenges and will work with them to ensure that the conditions improve.Mekgwe told both matriculants that they should seek help when they have challenges in their school work.

The MEC and the delegation also gave away 100 uniform to students from disadvantaged homes at Bovet Primary School in Alexandra.Deputy Minister Bapela thanked the Alexandra High School class of 2013 for surpassing the target of 75 percent pass rate which was going to coincide with the school being 75 years.

“As a class of 2014 you have to run and overtake number one in the province. We will be visiting you as we did with the class of 2013 to make sure that you keep the momentum,”he said.

Bapela said that they had formed an Alumni programme that will benefit the schools around Alexandra. Bapela said that among other things Minister Paul Mashatile and MEC Lebogang Maile will donate equipment for the art classes whilst Minister Fikile

of the Alexandra Heritage center “Nelson Mandela Museum” at 7th avenue. Thabo Mopasi, a volunteer who has been involved in the development and com-

pletion of the heritage cen-ter was more than proud to announce to Alex Pioneer that the completion project is quickly approaching its fi-nal stage. On 17 January, the

Alex Heritage center hosted a sight seeing of its current condition for stakeholders who will be its benefactors in the near future. Mopasi, who is also a social history researcher, devel-oped his love for the center in 2001 where he was part of the research team for the Nelson Mandela book. Thabo envisioned the com-pletion of the heritage cen-ter as it would not only tell the story of the late former president Nelson Mandela, but it would also create job opportunities for the young people of Alexandra who are still tackled by unem-ployment. “I was hoping the project would have kicked off by now this would boost job creation” Thabo said. About a month ago, Thabo secured a meeting with the MMC Rosaline Grief to ex-press and share his views of the heritage center’s prog-ress that was long over due. Thabo told the newspaper that he attended the meeting on his personal capacity to seek help from the govern-ment as he had approached minister Obed Bapela and Minister Paul Mashatile

who were also supporters of his initiative. The ministry promised Thabo a meeting with the JDA (Johannesburg Development Agency), who were more than happy to partner with him. The JDA representatives were pres-ent during the sight seeing of the center along with rep-resentatives from the city of Joburg. Project manager of the JDA Leonard Visagie reported that the depart-ment of tourism has signed

an agreement with them as-suring the community that the project is certainly in its final completion phase. “The department has already drawn up a budget for the designs, repairs, structural readjustments and other var-ious things that impact the completion of the center”. The project is set to kick off in the next six months and anticipate the completion of the project between Decem-ber and January of next year.

Who works at SASSA Having consid-ered Cynthia’s situation he said “I can advise her to go back to our offices to re-register for social grant.”Steve emphasized that there’s a protocol that SASSA officials need to follow like run-ning means test. A means test is an assessment conducted to verify if a person deserves the gov-ernment’s aid taking into account the worth of their assets and their month-ly income. “According to (the) information at our disposal, she was declined a social grant because she failed our means test, in the event, the pension amount is reduced.“Unfortunately, currently, if an applicant

receives pension from the previous employer, that is taken into consideration dur-ing the application process,” steve told Alex Pioneer. Steven explained that for one to pass the means test and qualify for govern-ment’s assistance, the appli-cant should:Married applicant•Not have a total income of more than R100 680.00 per annum•Not have total assets that exceed the worth of R1 676 400Single applicant•Not have a total income of more than R50 340 per an-num•Not have total assets that exceed the worth of R838 200. Introduction

This topic is very important as we deal with contracts and commercial transactions on a day to day basis even if we don’t realise it. For example, if you walk into a shop and buy a coke, you have just entered into a con-tract of sale between your-self and the shop.The drafting of contracts is a very broad topic and it is impossible to deal with all of the relevant points in such a short article. This article will therefore be only a very brief introduction into the drafting of contracts.

What is a contract?

A contract is an agreement between two or more par-ties which gives rise to ob-ligations and/or rights which are enforced or recognised by law. A contract must be between willing parties as consent is one of the require-ments to make a contract valid.

Parties to a contract

Not everyone can enter into a contract, you need what we call “contractual capacity” to enter into a contract. So for example you cannot enter into a contract with a three year old child (although it is possible to enter into a con-tract with the guardian or parent of the child acting on behalf of that child). Anoth-er example of someone who cannot enter into a contract by him/herself is a person who has no mental capacity.

Companies or other busi-ness entities such as close corporations need to act through the people in the organisation so for example a director would enter into a contract on behalf of the company (but he must be au-thorised to do so).

There are also other restric-tions on persons entering

into contracts for example someone married in in com-munity of property may re-quire the consent of their spouse to enter into certain contracts.

Types of contracts

In order to give a better un-derstanding of some of the contracts which someone might come into contact with on a day to day basis, a few examples of such contracts have been set out below:

• sale contract: can include for example a sale of an as-set (e.g. a car, a house) and is usually the exchange of money for goods

• lease contract: for renting of a property for residential / commercial reasons

• employment contract: en-tered into between employer and employee

• shareholders’ agreement/partnership agreement

• services contract: which is the exchange of money for services

• loan agreement: where for example a bank lends you a certain amount of money

Format

There is no set “format” for a contract, as long as all of the terms that are agreed are in the contract, the parties are clearly set out and the contract is signed, it should be enforceable.

However to give you an ex-ample of the basic format we would generally try to have:

• a “cover page” where we set out the full details of all the parties (including ID and registration numbers) and the type of contract it is;

• the “basic” provisions agreed between the parties (for example the goods be-ing sold or the property be-ing leased, the price, the

place of delivery, etc.); and

• the signature page (where the parties must sign the contract).

When you learn more about contract drafting you will then learn to insert certain “standard clauses”, however you should not worry about this at an early stage and it is most important to have all of the agreed terms in the con-tract and have it signed.

Dispute of contracts

It is very important to regu-late what happens in the case of a dispute of the contract. You can provide for “media-tion” or “arbitration” should the parties agree. It is prefer-able to settle the disputes out of court as it costs a lot of money to go to the court and may take a long time until the dispute is resolved.

However, if necessary, the courts must be used. You can then regulate which courts to go to (for example you may want to go to Small Claims Court or the Magistrates’ Court rather than going to the High Court).

Remember to be careful as to what you send in emails and other written communi-cation as this can be used in evidence in court.

Some last minute tips

Negotiation skills are very important and you should always try and end on a win/win situation for all of the parties. Preparation is very important and so is checking the contract for errors once it is drafted.

Don’t forget to number your headings and paragraphs so that they can be easily cross-referenced.

Most importantly, make sure you understand what you are putting in your contract and get expert advice where pos-sible!

• New study methods (read them on Wits website)• Attending class and managing well your time (if you miss lectures, you won’t know what is important in the course materials)• Taking responsibility (manage well your time and create a workload planner)• Working harder• Asking for help – your parents, teachers, mentor won’t know if you get into trouble, YOU have to know and ask for help (sooner rather than later)• Getting help earlier rather than later (don’t be scared to ask for help, if you need academic, psychological or financial support which exists in each Varsity) At UJ, you’ll be kicked out in November if you pass less than 50 % of your modules. But don’t be depressed if you fail the first tests. Just keep up and know your goals ! If you have a bursary, use it for yourself – resist the pressure of your family to buy food for them. In any case, ask a second year student to help you to manage your finance. Almost one third of the students fail their first year. Don’t be one of them.

Recently I have realised that Akhona’s investigation has started to shake S’busiso up and because of that, chances are great Akhona will not live to see tomorrow. The lead vocalist of Qinise-la and award winning media darling, Kelly Khumalo and her sister are set to appear in court for the assault of Man-disa Meyiwa. Kelly is said to be pregnant and tongues have been wagging that Senzo Meyiwa is respon-sible for the bun in the oven. NKANDLA REPORT RELEASED. The public protector Thuli Madonsela and her office will release the much awaited report on the spending of President’s homestead in Nkandla. The upgrading of President’s home is calculated at R208 million and the leaked pro-visional report published by the Mail & Guardian last year hinted that Zuma was aware of the costs of the up-grading.

OSCAR PISTORIOUS TO APPEAR IN COURT. Paralympic athlete, Oscar Pistorious, who allegedly shot and killed his wife in the early hours of 14 Febru-ary 2013 after mistaking her for an intruder will be go-ing on trial in March 2014. Oscar has pleaded not guilty for the murder of his girl-friend, Reeva Steenkamp.

CELEBRATING 20 YEARS OF DEMOCRACY. This year marks exactly 20 years of a democratic South Af-rica. It was in 1994 that South Africa was liberated from all white government to democratic and inclusive ruling regime that saw Nel-son Mandela emerging the first black democratically elected President. Since 1994, South Africa has had 4 democratically elected Presidents, Nelson Mande-la, Thabo Mbeki, Kgalema Motlanthe and Jacob Zuma, respectively. Under the Mbeki administration, Phumzile Mlambo-Ngcuka was elected the first female deputy President.

ELECTIONS COMING SOONThis year will also see South Africans voting in the country’s 5th democratic elections. Over and above, it will also be for the first time that born-frees take to the polls. Newly formed political parties of the likes of Mamphela Ramphela’s Agang SA, Julius Malema’s EFF and Kenny Kunene’s Patriotic Alliance will be on the ballot paper for the first time.

MAGGIE BENEDICT LEAVES GENERATIONS AND APPEARS IN COURT. Generations’ starlet Maggie Benedict who plays the role of Akhona Griffith is said to be leaving the popular soap-ie this year. Following Bafana Bafa-na’s 3-1 defeat against

Nigeria, Minister of Sports and Recreation, Fikile Mbalula, expressed how disappointment he was with the performance of the na-tional team. Mbalula called Bafana Bafana “a bunch of losers” who have “dis-graced the country”, the statement he’s adamant he won’t retract. “We indeed have a crisis of monumental proportions and this tourna-ment has proved that. The mediocrity we saw yes-terday is disgraceful. Last night, we saw a bunch of losers who conceded two useless goals. We must nev-er wake up to this situation ever again,” Mbalula was quoted as saying.

Mbalula went further to say coach Gordon Igesund cannot only take blame for Bafana Bafana’s disap-pointing performance.Is not for the first time Bafa-na Bafana fails to qualify to participate in the second round of an international soccer tournament.In 2010 during the FIFA World Cup, South Africa was the first country to be booted out of the tourna-ment, thus making a history to be the first host country not to make it to the second round of a tournament.Equally, this year South Af-rica also failed to qualify for the second round of CHAN 2014. The 2014 FIFA World Cup that will see Brazil as a host country will not have South Africa participating.

In the past, South Africa has opted to outsourcing coach-es from abroad in a bid to boost the national team’s performance. During the 2010 World Cup, a Brazil-lian coach, Carlos Alberto Parreira whose salary was estimated at R1.8 million per month was the coach of the national team. In the tournament, South Africa drew 1-1 against Mexico in the opening game, lost 3-1 to Uruguay and won 2-1 against France. But from the three games South Af-rica played at CHAN 2014, South Africa opened the game on a high note with a victory of 3-1 against Mo-zambique, then drew 1-1 with Mali and the last game saw them losing 3-1 against Nigeria.
