Judy finally felt it was time to straightenBob out.

They’d been married 10 yeas and therumors about him had to be straightenedout. John’s business had gottenvery huge and what was worsehe had gotten so busy. In factevery week or so, he seemed tohave to go out of town to put onedeal or another together. Whatbothered her more was that thefamily attorney, Eric, seemed tobe with him when these dealswere going through.

Always the same call “Honey, Eric (theattorney ) and I are in the midst of the dealand we can’t even talk to you until afterthe weekend. Don’t expect to hear fromme.”

She decided that maybe the rumors weretrue and if so she would find a way tocatch him in the act and go in for the kill.

Judy called one of her closest friends tolisten to what Bob would say when he wasaway for the weekend on business... withEric, the attorney.

That weekend Bob was awayon business and she invited herfriend to be with her as a wit-ness. Sure enough, right aftermidnight the call came: “HoneyI’m giving you a quick call. Ericis in the other room negotiatingthe deal, and I snuck out to callyou. We’ll be staying a day moreand I’ll be back in a few days.”

Judy turned to her friend sitting with her inher bedroom, “Think I can get him good?You can’t be in two places the same time,can you Eric?”

Then she turned off the bedroom lights.Judy got herself an excellent settlement.Fact... she and Eric are on the second

month of their world’s cruise.

Vi Living in Aventura was the host for theWrap-Up party for the young singers andsponsors of the recent 2nd annual AT&TYoung Stars Showcase at the Aventura Arts& Cultural Center produced by the AventuraMarketing Council.....and just having somegreat food and showing the video from thatevening would have been enough. ViLiving, an upscale senior lifestyle center,held the party in their beautiful EvergladesRoom and brought out an array of delicioushors d’oeuvres for the party. Costco inNorth Miami Beach baked a huge sheet cakewith the YSS signature purple colorsdecorating the frosting.

But to Ran Oz, Creative Director of thelast two AT&T YOUNG STARS SHOW-CASE productions, a ‘real’ party has tohave more than a great ambience and food,and he had some plans up his sleeve forthat evening. Ran owns CooLAM DanceStudios and CooLAM Dance Productions,and to him, everything should be a‘production’!

As the young singers arrived with theirfamilies, they were only too happy to seeeach other and re-live some of the greatmemories from the show...and since theywere backstage for most of the show, theydidn’t have the opportunity to see it.

The show’s title sponsor, AT&T, was wellrepresented by Dr. Tee Holloway, Directorof Corporate & External Affairs, and hiswife Linda; and other sponsors, the“Friends of the Young Stars” attending theWrap-Up party were Aventura Comm. Boband Arlene Diamond, Ken Bernstein, Normafrom Miami-Dade Comm. Sally Heyman’soffice, Alex and Monique Halbertsein,Fernando Levy Hara and Howard and ElaineAdler. Special guest, recording star ChloeDolandis, who was co-emcee for the show-case, was also there with her mother Mindy.

Fortunately, Ira Haber, owner of All in 1Productions, videotaped the entire show andhad DVDs available... but he went the extramile and created a 14-min. show recap andplaced it on YouTube for the world to seeand enjoy. (Youtube 2nd annual Young StarsShowcase 2012).

The DVD of the show ran for about 30 minutes,and then the real fun began! Ran divided theyoung singers into two teams...but one teamhad the advantage of having Dr. Tee Holloway

Just about everyone has their momentin life, a special time when they are orwere the star. It might have been thetouchdown pass or the leading role onstage, or the life-changing invention. Youcould have been the brilliant scientist, car-ing humanitarian or a part of a “powercouple”.

Then time passes and your glory dayspass as well. So many things can changeyour identity. Injury, sickness, divorce,death and age have an impact on yourimage of yourself and on the world’simage of you.

This is a difficult adjustment unlessyou know how to handle it. When yourstar dims, it is still possible to keep yourglory from fading. Stay in the samemilieu. Don’t get benched so to speak.Don’t sit on the sidelines. Don’t stray toofar afield. Get back in or stay in the sameenvironment in which you shine. Find

something else you can do within the samesphere that will showcase your talents.Perhaps, you could coach or teach.Perhaps, you could endow an organizationthat will foster your ideals. Perhaps, youcould volunteer and support and encour-age others. The best option of all would beif you could still do what you love to do ona different scale. Instead of singing onBroadway or at the opera you might singfor organizations or community groups orcharities. The list of possibilities is endlessand unlimited.

If you stay in the same field then yourglory stays with you. Your past remainsalive. Your story is told and retold. Youridentity is reinforced. Your celebrity isassured. Your sense of yourself and yourself-worth is enhanced. Your life has cred-ibility and meaning and purpose. Youhave the opportunity to leave a bit of alegacy and to impart the knowledge andexperience you have amassed to others.You will be a true philanthropist whichmakes you a true star and that glory willnever fade.

patiently waited their turn to be seen by thedoctors and hygienists from the Dental CareGroup/Aventura Pediatric Dentistry andOrthodontics team. Volunteers aboundedat the registration area set up in the parkinglot.....offering water and snacks. The daywas long...the line of patients was never-ending, but the professionals pushed

on...knowing the need was there. Dr. Marssaid that at the end of the day, when thedoctors were thanking all the staff andvolunteers for this ‘service from the heart,’their response was to thank Dental CareGroup/Aventura Pediatric Dentistry andOrthodontics for allowing them thisopportunity to give back.

“This was an incredible day,” said Dr.Mars. “It was a coming together of ourteam and a community of patients,volunteers and generous corporate part-ners to provide dental care to hundreds ofpatients who would not have received den-

tal care without our efforts. Most of thepatients were either unemployed ordisabled or in a serious financial situation,so this made our efforts all the moregratifying. One patient said, ‘I have notbeen able to go to the dentist in years andyou doctors gave me a gift today.’ Onepatient even gave us a box of candy and athank- you card!”

Added Dr. Coussa, “Dentistry from ourHearts” was our way of giving back to thecommunity. By volunteering our team, dentaloffice and time, we were able to put smileson the faces of hundreds of people today.”

In fighting the Great Depression in1934, President Roosevelt’s New Dealadministration chose as a test case the mostunlikely defendants in criminal proceedingsfor allegedly violating the Code of FairCharges by the newly adopted NationalRecovery Administration (NRA). Chargeswere leveled against four first generationimmigrant sons of a rabbi, the Schechterbrothers of Brooklyn, who engaged in theKosher chicken business in strict conformitywith Jewish dietary law. The Schechter broth-ers would soon move from obscurity to the“center of the debate about the New Deal.”

According to author Amity Shlaes, “TheForgotten Man,” the indictment charged thatthe method that the brothers engaged in busi-ness violated the Code, including refusal toprice fix. Consumer prices went up marked-ly under the Code. Small businessmen com-plained that without the right to compete onprice, the giant corporations were price fixingthem out of the marketplace. At trial, Martin

Schechter testified that the chicken businesswas highly competitive, that customerswould shop around, “Chicken dealers willwalk into my place and wouldn’t like myprice, they would go out again.” The chargeof selling unfit chickens came down to onequestionable chicken, which, on autopsy,would have been difficult for Schechters todetect before sale. The jury found the broth-ers guilty. They became the shame of theJewish neighborhood.

The Schechter appeal soon reached theSupreme Court. The Schechter’s attorneyargued, among other points, that his clientsdid not engage in interstate commerce andadherence to the Code would drive them outof business. He argued, “The whole Codemust fall.” “Nine to nothing,’ the Schechterbrothers kept repeating, with tears in theireyes, as the Supreme Court declared theNRA unconstitutional. “Mrs. JosephSchechter, of Brighton Beach, displayed herpoem to the press, entitled, “Now That It’sOver.” No more excuses to hide our dis-grace, With pride and satisfaction I’mshowing my face. For a long long time to bekept in suspense, sarcastic remarks made atour expense. I’m through with that experi-ence I hope for all my life, and proud againto be, Joseph Schechter’s wife.”

from AT&T on their side. (Who knew Teecould sing!) Each group was given 5 secondsto sing at least 1 line from a song with the word“love” in it, and the first ten rounds were fairlyeasy — after all — don’t most songs have theword “love” in them somewhere!

As the game progressed, and it became harderand harder to come up with songs, the parentsand sponsors started chiming in...by the end of

the game, practically the entire room wasparticipating, and laughing so hard they couldhardly talk. Afterwards, the young singersstarted singing... some with songs they knew,and some with songs they never rehearsedbefore...parents and siblings sang and danced aswell... and the energy level kept on growing!

How many of you remembered tochange your clocks this past weekend; set-ting the time to “Spring Forward” and startthe week with a fresh perspective on time?

This seemed like the perfect opportunityto discuss the passage of time and whatseems to be something of an epidemic forsuccessful professionals: career transition.

Since stepping away from my owncareer with WTVJ-NBC 6 in October,2009 I have noticed I am far from alone inmy new, unchartered and still frighteningnew world of “reinvention.” The first fewweeks after making such a drastic changefelt euphoric. Like a kid who gets to spendday after day at Disneyworld. The next fewmonths felt like the most amazing vacationever; doing whatever I wanted, when Iwanted and sleeping until I felt rested. Butthen weeks, turned into months and thenbeyond. Now I have begun to wonder, “AmI losing my mind? Does this lack of specif-ic career direction make me a bum? Whydoes everyone else seem to know what theywant out of their careers, but I still can’tdecide?” A small voice in my head whis-pers... L-O-S-E-R...

BUT HOLD ON! Turns out I am not los-ing my mind, nor am I a bum. I have cometo this conclusion based on an extremelyunscientific poll - basically chatting withothers who are in the same boat.

Exhibit A: My dear friend RhondaSmith. After years of climbing the careerladder as a high-powered marketing con-sultant, breast cancer changed the course ofher life. She beat the disease but since, hasbeen on a new career path that focuses on

bringing education and awareness to otherwomen to make healthier life choices. It’sa slow transition to turn her passion,www.breastcancerpartner.com into a rev-enue supporting project. We often teaseeach other of who will be living under abridge first.

Exhibit B: My friend Johnny Holliday.He is a devoted husband and father andserves the U.S. Air Force. He loves hiswork. But his heart’s passion is music.Johnny is a South Florida jazz musicianwho plays a mean saxophone! He too is ina transition of sorts. He would love formusic to take a larger role in his life. Thusfar, reality and economics dictate-his pas-sion remains second string.

Exhibit C: A good friend, John is apharmacist by trade. A very successful oneat that. But like many Americans, downsiz-ing and cutbacks changed his world. Hehas dibbled and dabbled in various posi-tions, wanting to apply his scientific expe-rience but doing so with a passion to helpothers. We spoke recently and I asked himwhat he was up to. He paused, smiled,shrugged his shoulders and said, “Well... alittle of this, a little of that. I haven’t quitefigured out what comes next.”

Phew! I feel validated. It’s not just me.Many of us - women and men - with amaz-ing talents, passions, drive and focus are inthe same boat. Maybe with a new season ofchange the answers will come to all of uswho are in career transition.

“I never dreamt Goldie Hawn would be follow-ing me around,” says CIA President Stuart Geller.

But not long after Geller’s organization—CIA in this case stands for Citizens Interested inArts, not that federal agency—announced theImagINation Initiative, a part-nership with the Dade CountySchool Board to fund arts pro-grams, the film star alsoannounced funding to benefitchildren at two county elemen-tary schools. Coincidence?

ImagINation Initiative,Geller explains, is to make itpossible for children in publicschools to have arts again.Fundraising for the initiativegot off to a healthy start duringa recent “Sail Away with theCIA” cruise. “We took 60 ‘CIAoperatives’ aboard the luxuri-ous celebrity cruise shipEclipse for one week, stoppingat San Juan, Puerto Rico, St.Maarten and St. Kitts,” Geller says. The cruise,organized by Geller and Patty Soffer, CIA vicepresident & director of strategy, raised morethan $30,000.

Since 1997, the non-profit CIA has beencommitted to preserving the visual and per-

forming arts in South Florida. Each year, it pro-vides grants to qualified members of the SouthFlorida artistic community. The theme of the2012 Champion of the Arts Gala Luncheon,benefiting the grants program, is “Love and

Inspiration Through the Arts.” Itwill be held March 22 atFontainebleau Miami Beach.

I found out that my exchanged the address at theschool to his address only.Now I don’t get the kids’report cards and other noti-fications. Is there legalaction I can take?

Rule #1, avoid legal recourse if at all pos-sible. So many times people run to their attor-ney to show their ex “who’s boss”. The finan-cial and emotional toll it will take on youisn’t worth it. Very simply, go to the school’sregistrar and explain the situation. Thereshould be a way that they can flag youraccount so no changes can be made thatinvolve your name and address. Then takethat money you would have spent on an attor-ney and go have a spa day.

My ex will never accommodate any sched-ule changes that I may have, yet he expectsme to accommodate all of his. How can I co-parent with someone who is unreasonable?

Simply put, you can’t. There are twoissues here — one is scheduling and theother is co-parenting. Let me address thescheduling problems. Depending on yourMSA, there might be certain times spelledout that you will need to accommodatehim. But, in general, it is your choice if youwant to change the schedule. If he is askingyou to change and it benefits your child orit is not an imposition for you, then by allmeans do it, but do it with the acceptancethat it might not be reciprocated. Leave thatexpectation at the door. Divorce is not atwo-way street; depersonalize it. Stop look-ing at his refusal to switch as a way to getback at you. That might be the case, but ifit is, do you think you are going to changethat? Change if you want and if not, justtell him by email or text that the switchisn’t possible this time. The second issue

here is the term co-parenting. Let medefine terms here as I’m applying them.

There is joint custody/parallel parentingwhere each parent does their own thingwhen they have the children. Rules, values,parenting style and philosophy are differ-ent. Then there is co-parenting where theparents work together on every aspect oftheir children’s upbringing. If you aredivorced from someone who is unreason-able, trying to get back at you or using thekids as a pawn, the reality is such that youwon’t be able to co-parent. The focus is notthe child, but you. If you have an ex thatdoesn’t see parenting the same way you do,take a deep breath, know that you are inthis for the long haul and be consistent withthe structure you have set up in your home.Let go of trying to get him to see parentingyour way. Put your focus on being the bestparent you can be.

I am going through a divorce and my exwants to settle this between “us”. Is this asmart thing to do?

You might want to explore the option ofyou and your ex coming up with an agree-ment and then you have an attorney look itover for your protection. Remember the say-ing, “Every man for himself”? I think theperson who said that was going through adivorce.

Madison, turning 6 years old this year,was born on October 4, 2006. She was senthome from the hospital with a clean bill ofhealth. By her first birthday, Madison wasdiagnosed with Spinal Muscular Atrophy(SMA), Type 2. An almost certain death-sentence for children, it is the 2nd worsttype of SMA and the #1 genetic killer ofchildren. Due to rapid deterioration ofMadison’s muscles, she lost her ability tocrawl or walk, like other children. By theage of 2 years-old Madison used a powerwheelchair for everyday movement likeplaying in her home or going out with herfamily. She depended on a BiPap machine

for breathing support to sleep at night andthe Vest for lung therapy including respira-tory support. She must wear feet braces,knee braces, wrist splint and a critical bodybrace to support her spine. Her home isredesigned with ramps, therapy equipmentand more just so this bright and playfulchild has the same comforts we all take forgranted.

Madison, from birth, was healthy andright on target in all milestones and she waseven considered a strong baby up until 6months. At around seven months of age,they noticed that Madison was having diffi-culty bearing weight on her legs andstopped using her walker and bouncy seataltogether at eight months. After repeatedappointments to the Pediatrician,Orthopedic and Neurologist her parentswere able to get some testing done. TheNeurologist ordered blood work be taken onMadison because she suspected SpinalMuscular Atrophy; if she had it, the bloodwork would be definitive since this is genet-ic. When they went to the Neurologist to getthe test results the specialists confirmedMadison had SMA (Spinal MuscularAtrophy) Type II. and then told them to takeher home, make her as comfortable as pos-sible until the end. They were handed thephone number of pediatric hospice and leftfeeling an overwhelming despair.

Determined to fight for their daughter’slife her parents tried to reach out to findsupport groups, organizations and otherfamilies within the community to help themand their family cope. After months ofsearching and not finding any, Jennifer,Madison’s mom decided to start the 1stSouth Florida SMA Chapter to bring fami-lies of this rare disease together for support.

Jennifer holds SMA support meetings,raises awareness in the community, doesnumerous fundraisers to raise funds for

research, she makes hospital and home vis-its to newly diagnosed families and getsthem needed resources. In past years,Jennifer and her family decided not toexchange Christmas presents and insteadadopted another SMA family who neededit more than they did.

The Smith family are currently organiz-ing fundraisers for Madison, with the goalof raising enough money for a much need-ed power wheelchair that costs approxi-mately $30,000.00. Madison’s insurancebenefit only covers up to $2,000. Her pre-vious fundraisers helped pay for adequatewheelchair van transportation, home acces-sibility modifications, copays for special-ists & hospitalizations, an iPad for anotherfriend suffering with SMA, and also funer-al costs for her friend, William Odgen, whopast away from SMA at age 9.

In today’s economy, rising gasoline

prices affect not only what it costs to fuel

our cars but every aspect of our lives.

For example, the groceries we buy —

which arrive in gasoline-powered trucks —

go up as well. Although it not only causes

consumers to stay home, it causes everyone

to have to cut their budget to accommodate

other important areas.

It turns out domestic oil demand is near

record lows at the very same time U.S. oil

supplies remain at high levels, according to

the U.S. Department of Energy.

I spoke to one Miami driver who blames

speculators for hiking the price of whole-

sale oil. He said that is who is behind the

recent spikes in local gas prices.

In fact, some stations by Miami

International Airport already are selling

Regular-Unleaded for $4.39 a gallon!

“The politicians better watch out what

they are doing to the investors who are

driving up prices?” this driver insisted.

According to a report by the House

Natural Resources Committee, between

1999 and 2007 the number of drilling per-

mits on public lands has increased by more

than 361 percent, yet gasoline prices con-

tinued to skyrocket. However, increased

leases have not reduced the price of gas.

With consumer prices up about 3 percent

since last year, overall food and energy

costs have risen at their fastest annual rate

since 2008. They’re up more than 6 percent

for energy-related costs, and almost 4.5

percent for food prices.

So do oil companies need new leases

along the OCS (Outer Continental Shelf)?

According to the U.S. Minerals

Management Service, only 20 percent of

the 38.5 million acres of existing leases

along the OCS are being used for produc-

tion. The vast majority of oil and gas

deposits along the OCS already are open to

drilling. What’s more, 82 percent of the gas

in the OCS and 79 percent of the oil in the

OCS is available for leasing.

Local produce buyers say if gas prices

keep rising, food costs will keep climbing

too following the expected extra fuel sur-

charges from shippers.

One Norman Brothers produce manager

told me, “We’re not seeing it just yet, but

it’s coming. It’s still early.”

Consequently, a Kendall consumer com-

plained, “I think that’s terrible having to

pay extra for fuel products.”

Her sentiments are commonplace. The

price of oil on world markets climbed

again recently, closing above $106 a barrel.

Tension in the Middle East is partly to

blame, but the rising price of gas at the

pump provided political fuel for

Republican presidential hopefuls.

The surprisingly swift rise in oil prices

recently has sent the average price of gaso-

line up and it’s hurting many families that

were already fighting to survive tough eco-

nomic conditions.

The Obama administration says it’s not

responsible for this rise in gas prices and

insists that the solution to the problem is

difficult. According to the administration,

there is no easy answer to this problem.

MCollections of delinquentmaintenance fees for commu-nity associations have unfortu-nately become a reality thesedays, a process that can bebroken down into three dis-tinct phases:

(1) Action when a unit owner misses pay-menment;(2) The nitty-gritty of collection;(3) How delinquency is resolved.

Step one is making contact with thedelinquent unit owner in a timely manner,usually with a courtesy letter. (People for-get, checks get lost). And there are timeswhen people simply can’t afford the currentmonth’s payment. That’s when they wouldwelcome a friendly note letting them knowa payment plan can be worked out.

In its early stage, sending a delinquen-cy to a collection agency or an attorney isnot the way to go. Only if the owner failsto contact the association directly is it nec-essary to escalate a recovery effort, such ascalling a professional collections servicethat has the expertise, systems andresources to resolve such issues.

Professional collection companieswill contact delinquent owners and advisethem of the association’s intentions regard-ing collection, providing the resources andassistance to an owner to resolve a situa-tion. If initial collection efforts are unsuc-cessful, the unit can then be scheduled fora lien notice in advance of a foreclosure.The plain and simple fact is that attorneysfocus only upon two steps for an associa-tion: (a) a notice of lien and (b) foreclosureof title.

It’s a good idea for an association toenter into an agreement with collection pro-fessionals to defer legal costs and fees untilthe time when a unit ‘settles out,’ at which

point such costs would be collected. When it comes to the touchy subject of

collection legal costs and fees once an asso-ciation forecloses on title, new options open.With title in hand, the association has powerand control over the unit. It can first decidewhether or not to rent the unit, monetizing itfor the association. A second option is to donothing and await a bank foreclosure filingfor the unit collateral value. The final ‘settleout’ phase is tied to timing in one of threeways: •iWhen the bank finally comes for itscocollateral; • When the unit owner pays up (unlikely, butitit does happen); • When a short sale is made before a bankfoforeclosure.

If a short sale occurs, both new and oldowners are jointly and severally liable for allfunds legally owed to the association.Associations should resolve each case in themost favorable manner possible, and as soonas possible. This means maximizing theamount collected and eliminating any out-of-pocket costs or risks to the association.

Association boards should also remem-ber that when it’s time for a unit to settle out,it’s the title company doing the work for thebank (in most cases). Thus a collections firmworking on a merit basis has a great incen-tive to battle it out with the title company inbehalf of the association’s interests. That’swhy collection professionals are best suitedfor collections — because of the time they’lldevote, their strategy and great negotiatingskills, as well as their knowledge, experienceand the incentive to do the job right.
