TERMS & CONDITIONS:BIDDING DISPUTES: The auctioneer is in charge and will settle any disputes as to bids, and his decision on such matters shall be final.

TERMS: Terms of the sale are cash. All settlements will be made with the clerks of the sale immediately following the conclusion of the sale and before cattle will be released.

PURCHASER’S RISK: Each animal becomes the risk of the purchaser as soon as sold. Insurance will be available sale day.

CERTIFICATE OF REGISTRY: A certificate of registry and transfer will be furnished for each animal sold as a registered animal, after settlement has been made.

BREEDER’S GUARANTEE: All bulls are guaranteed to be breeders. All claims for adjustment of refund must be made in writing within six months of the sale date. In the event a bull is claimed to be a non-breeder, the purchaser may return the animal to the ranch of the Seller if in good condition and complying with the health requirement of the Seller’s state. The Seller will be entitled to six months trial following the return of the animal in which to prove that the animal is a breeder. If at the end of the six months the Seller is unable to prove the animal is a breeder, the Seller shall be obligated to replace the animal with another of equal value or to refund the purchase price. The return of the full purchase price shall in any case be deemed full satisfaction and settlement. If the Seller proves the animal to be a breeder, it shall be the obligation of the purchaser to take delivery of the animal at the purchaser’s expense.

SELLER’S SEMEN RIGHTS: Seller reserves the right to keep a breeding interest in any bull so designated in the cata-log or during the auction. In the event Seller elects to collect semen from a designated bull it will be done at Seller’s expense and during such time when purchaser is not using the bull for breeding.

IDENTIFICATION: Each animal carries a readable tattoo.

LIABILITY: Neither owners, sale manager, clerks nor anyone connected with the sale assumes responsibility, legal or otherwise, for damage of any kind.

CONTRACT: The above terms and conditions shall constitute a contract between the buyer and seller of each animal sold.

IMPLIED WARRANTY: Except for those stated in the terms and conditions, there are no warranties, either expressed or implied, as to merchantability or fitness for a particular person with respect to the cattle being sold in this auction. The warranties set forth in the terms and conditions are in lieu of all other warranties, either expressed or implied, and the remedies provided therein shall be the sole and exclusive remedy of the buyer, or any party claiming through the buyer, for any breach of warranty or guarantee therein provided and all other obligations or liabilities.

Bred heifers fed and managed the same as Badlandsreplacements are normally managed. They were at Badlands

by February 1, 2010, fed our replacement ration, given all breeding shots, wormed and culled for soundness

and disposition.

Welcome to our annual production sale . We are thankful to our valued cus-tomers and friends. Our quest to produce cattle that are right for the times with real merit of performance in today’s high energy costs will be evident in this sale offering. Generations of profit making cattle to ensure our customers the most return for their investment. As times change our cattle still continue to have pay weight, ease of calving, soundness, longevity, and disposition. All are taken very serious and our cow herd reflects generations of rigid culling. No animal is allowed to be hard calving or slow at birth. Mothering ability is important with an aggressive baby at birth. Fleshing abil-ity on native grass to bring in a heavy calf

means net profit. Identifying elite producers to propagate and concentrate their superior genetics. Every bull has not only been screened for all performance but also for soundness and disposition. Our bulls are fed to show growth and feed efficiency but in a modest feed ration also they are fed and exercised in a 15 acre pasture. Feed efficiency and fleshing ability has improved each year, with less feed being fed to our bulls, replacement heifers and cow herd. Every year our ration has more roughage with bulls harder muscled and free moving. Bulls must pass our disposition timed event test. Sorted off from the group and held with three people in a small pen for two minutes. Bulls have several examinations, weights and measurements before they make the sale. Customer satisfaction is our first and foremost commitment. Stringent demands have been measured on our sale cattle with only the best for your consideration. Welcome to this year’s sale from Severance Red Angus. Before starting this year’s letter, I looked back at last year’s catalog to see how things were last year. I had said something about -26 degrees. Hmm, -27 degrees a couple nights ago in Williston. I also made a statement about “more snow than I care to remember”. Well, to tell the truth, I’m pretty sure we have even more this year. It appears a lot of things stay the same here in North Dakota, but there is one significant difference this year. Have you checked the cattle market lately? (Of course you have!) These markets are really picking up momentum; 700lb steers at $1.30 fat cattle at $1.08 and stock cows demanding $1,600.00. I was listening to the US Farm Report and they made a statement that this is the smallest US cow herd since 1951. That’s 60 years ago! I realize this is one man’s opinion, but his next statement was this, “Boys, buy every cow you can get your hands on!” His thoughts were this strong market should last through 2011 and 2012, maybe longer. I hope people are starting to realize cattlemen deserve to get paid for all their hard work! We sure invite you to come and take a look at this year’s two year old offering. They were fed a developing ration last winter and grazed out this summer with another round of culling this fall. We feel they are developed right on target and will be a good addition to your herd.
