INTELLECTUAL PROPERTY

• Intellectual property (IP) refers to creations of the mind, such as inventions, literary and artistic works, designs, and symbols, names and images used in commerce.

Page 15: Blue sky studios

• Intellectual property rights include patents, copyright industrial design rights, trademark, trade dress, and in some jurisdictions trade secrets.

• There are also more specialized varieties of sui generis exclusive rights, such as circuit design rights (called mark work  rights in U.S. law, protected under the integrated Circuit Topography Act  in Canadian law, and in European Union law  by Directive 87/54/EEC of 16 December 1986 on the legal protection of topographies of semiconductor products), plant breeder’s right, plant variety rights , industrial design rights, supplementary protection certificates  for products and database rights  (in European law).

Page 16: Blue sky studios

INTELLECTUAL PROPERTY IS DIVIDED INTO TWO CATEGORIES:

• Industrial Property includes patents for inventions, trademarks, industrial designs and geographical indications.

• Copyright covers literary works (such as novels, poems and plays), films, music, artistic works(e.g., drawings, paintings, photographs and sculptures)and architectural design.

• Rights related to copyright include those of performing artists in their performances, producers of phonograms in their recordings, and broadcasters in their radio and television programs.

Page 17: Blue sky studios

• Literature• Music• Painting• Sculpture

Computer program• Indigenous intellectual property• Internet domain name• InventionTrademark

• Service mark• Trade secret

Page 19: Blue sky studios

WHAT ARE INTELLECTUAL PROPERTY RIGHTS?

Intellectual property rights are like any other property right.• They allow creators, or owners, of patents, trademarks or copyrighted works to benefit

from their own work or investment in a creation.

• The importance of intellectual property was first recognized in the Paris Convention for the Protection of Industrial Property (1883) and the Berne Convention for the Protection of Literary and Artistic Works (1886). Both treaties are administered by the World Intellectual Property Organization (WIPO).

• These rights are outlined in Article 27 of the Universal Declaration of Human Rights, which provides for the right to benefit from the protection of moral and material interests resulting from authorship of scientific, literary or artistic productions.

Page 20: Blue sky studios

WHY PROMOTE AND PROTECT INTELLECTUAL PROPERTY?

There are several compelling reasons.• First, the progress and well-being of humanity rest on its capacity to create and invent

new works in the areas of technology and culture.• Second, the legal protection of new creations encourages the commitment of additional

resources for further innovation.• Third, the promotion and protection of intellectual property spurs economic growth,

creates new jobs and industries, and enhances the quality and enjoyment of life.

Page 21: Blue sky studios

HOW DOES THE AVERAGE PERSON BENEFIT?

Intellectual property rights reward creativity and human endeavor, which fuel the progress of humankind. Some examples:• The multibillion dollar film, recording, publishing and software industries – which bring

pleasure to millions of people worldwide – would not exist without copyright protection.

• Without the rewards provided by the patent system, researchers and inventors would have little incentive to continue producing better and more efficient products for consumers.

• Consumers would have no means to confidently buy products or services without reliable, international trademark protection and enforcement mechanisms to discourage counterfeiting and piracy.

Page 22: Blue sky studios

INTELLECTUAL PROPERTY RIGHTS ARE CUSTOMARILY DIVIDED INTO TWO MAIN AREAS:

Copyright and rights related to copyright

• The rights of authors of literary and artistic works (such as books and other writings, musical compositions, paintings, sculpture, computer programs and films) are protected by copyright, for a minimum period of 50 years after the death of the author.

• Also protected through copyright and related (sometimes referred to as neighbouring) rights are the rights of performers (e.g. actors, singers and musicians), producers of phonograms (sound recordings) and broadcasting organizations. The main social purpose of protection of copyright and related rights is to encourage and reward creative work.

Page 23: Blue sky studios

Industrial property can usefully be divided into two main areas:• One area can be characterized as the protection of distinctive signs, in particular

trademarks (which distinguish the goods or services of one undertaking from those of other undertakings) and geographical indications, (which identify a good as originating in a place where a given characteristic of the good is essentially attributable to its geographical origin).

• The protection of such distinctive signs aims to stimulate and ensure fair competition and to protect consumers, by enabling them to make informed choices between various goods and services. The protection may last indefinitely, provided the sign in question continues to be distinctive.

Page 24: Blue sky studios

• Other types of industrial property are protected primarily to stimulate innovation, design and the creation of technology. In this category fall inventions (protected by patents), industrial designs and trade secrets.

• The social purpose is to provide protection for the results of investment in the development of new technology, thus giving the incentive and means to finance research and development activities.

• A functioning intellectual property regime should also facilitate the transfer of technology in the form of foreign direct investment, joint ventures and licensing.

• The protection is usually given for a finite term (typically 20 years in the case of patents).

Page 25: Blue sky studios

• The Difference Between Copyright and Trademark. While both offer intellectual property protection, they protect different types of assets. Copyright is geared toward literary and artistic works, such as books and videos. A trademark protects items that help define a company brand, such as its logo.

• Copyright Protection - According to the United States Copyright Office, copyright protects original works including "literary, dramatic, musical, artistic, and certain other intellectual works.

• Trademark Protection - The United States Patent and Trademark Office indicates that a trademark protects words, names, symbols, sounds or colors that distinguish goods and services from those manufactured or sold by others and to indicate the source of the goods.

Page 26: Blue sky studios

A trademark •  A trademark is a word, phrase,

symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others.

• A trade mark is a sign which can distinguish your goods and services from those of your competitors (you may refer to your trade mark as your "brand").

•  Trade marks identify the goods and services of particular traders.

• A copyright gives the creator of an original work exclusive rights to it, usually for a limited time.

• Copyright may apply to a wide range of creative, intellectual, or artistic forms, or "works".

• Copyright does not cover ideas and information themselves, only the form or manner in which they are expressed.

Intellectual property• Intellectual property includes

works,  patents, copyright, industrial design rights, trademarks, trade dress processes, symbols and designs that were created or are owned by a company.

• Under intellectual property laws, owners of intellectual property are granted certain exclusive rights.
