These cemeteries, which are owned by death industry conglomerates, are providing misleading information to encourage their lot owners who are purchasers of prepaid, preneed contracts for concrete burial vaults to terminate their statutory protected trusting agreement and to switch to a "delivered" plastic vault which is touted as "superior to burial containers offered in the past." When the switch is approved and implemented, the cemetery pockets the substantial monetary difference between the principal and accrued interest in the statutory required preneed trust fund and the wholesale cost of the plastic vault. The same thing happened in Florida. You may remember the raiding of the funeral trust funds in Florida to the tune of $84 million by these same conglomerates for the same purpose, i.e., increased unrestricted cash flow to repay huge debts and avoid creditor-induced bankruptcy. In September, NCBVA filed statements with the FTC, SEC and AARP requesting that these two federal agencies and the watchdog organization for the elderly consumers review our submitted information, conduct their own respective investigations, and implement whatever action they deem appropriate. Why is NCBVA concerned? It's obvious that our industry may lose tens of thousands of concrete burial vault sales which would be required to fulfill such prepaid, preneed concrete vault contracts now being terminated by this scheme. F or the past year NCBVA has received information and concerns from some members about certain cemeteries throughout the USA that may be involved a vault switching scheme. These cemeteries, which are owned by death industry conglomerates, are providing misleading information to encourage their lot

owners who are purchasers of prepaid, preneed contracts for concrete burial vaults to terminate their statutory protected trusting agreement and to switch to a "delivered" plastic vault which is touted as "superior to burial containers offered in the past."

When the switch is approved and implemented, the cemetery pockets the substantial monetary difference between the principal and accrued interest in the statutory required preneed trust fund and the wholesale cost of the plastic vault. The same thing happened in Florida. You may remember the raiding of the funeral trust funds in Florida to the tune of $84 million by these same conglomerates for the same purpose, i.e., increased unrestricted cash flow to repay huge debts and avoid creditor-induced bankruptcy.

In September, NCBVA filed statements with the FTC, SEC and AARP requesting that these two federal agencies and the watchdog organization for the elderly consumers review our submitted information, conduct their own respective investigations, and implement whatever action they deem appropriate.

Why is NCBVA concerned? It's obvious that our industry may lose tens of thousands of concrete burial vault sales which would be required to fulfill such prepaid, preneed concrete vault contracts now being terminated by this scheme. We pointed out to the federal agencies that this potential loss of sales is our own industry's marketplace problem and challenge at the national and local level.

Our industry's primary concern is for the consumer purchasers of prepaid, preneed concrete burial vaults who are being misled about the qualifications and protective custody of the substituted plastic vault and the potential further public relations damage to the entire death industry with the elimination of the trust funds and the reliance on the cemeteries to purchase a substitute vault after paying off the debts.

NCBVA members are well aware that such fiberglass or plastic vaults do not come close to meeting the PSI testing requirement which standard is necessary to withstand the earth load, the lateral pressure when a neighboring grave is excavated, as well as the additional weight of maintenance equipment.

A Hope for Peace

B y the time you read this, the holidays will be upon us. For most of our nation it is a time of high stress. As I write this message, we have lost some lives of service men from

friendly fire. It is a very sad situation. We tell ourselves that war will have causalities but it is still hard to accept. The new high tech warfare has insulated us from the reality of the danger our ground forces are facing and will continue to face.

The Christmas season should be full of joy as we celebrate the birth of the Christ child, a symbol of hope and promise for Christians.

This year we must all support and more especially pray for the safety of our service men and women. May God bless and comfort you all.

Committee Report

Marketing Campaign Planned To Promote Concrete Vaults By Linda Darby-Sempsrott Marketing Committee Chairman

T he NCBVA Marketing Committee has been hard at work since last October developing a marketing plan that will not only help vault dealers, but will appeal to funeral directors, and ultimately our consumers. We are asking four marketing

firms to submit proposals to the committee by February, 2002. From those proposals, we will choose a plan we feel meets our directives as an association. We will then submit that plan to the board for fmal approval.

We have had some real thought provoking conversations, which have enlightened us all. Our proposals will emphasize the need for a concrete lined burial vault, as well as help our consumers become better educated as to the need for the ceremony, both of which create value for our products and service.

One of our conversations regarding this marketing plan is the role that we as vault producers play in this program. We are all fully aware that we can have a great marketing campaign, but without your quality of products and services, we are nothing.

Remember, consumers are buying these products from us because they trust us. With this trust comes the responsibility of delivering the best product and service these families deserve. THAT IS AN IMPORTANT ROLE! We trust that as members of the NCBVA, we will not take this responsibility lightly.

We want to thank those of you that took the time to fill out the survey that was mailed earlier in the year. It is important that we understand your needs from the association as well as in the marketplace.

Be Like Firemen, Ready to Roll By Earl J. Brutsche

A Monday morning, or any morning in a vault company office is "just like the fire department."

It is 9:05 a.m. and the phone rings. It's Mr. Jones from Jones Funeral Home. He says he didn't want to bother you on Sunday with a vault order but he needs an "XYZ" vault by 1:00 p.m. at Riverside Cemetery—with full equipment!

Mr. Jones thinks you always have a man and a truck ready to go. We all know that could be the case sometimes, but on this day, everyone has obligations elsewhere. So what do you do? You make it happen by rearranging your deliveries and production—but at what cost?

Similarly, a cemetery calls you at 10:45 a.m. inquiring about the vault that should have been delivered for the 11:00

a.m. service. You ask who the vault is for and the sexton at the small

township cemetery replies that it is for the Smith Funeral Home. When you call the. funeral home, Mr. Smith says he forgot. But, he says, you can do it because you have

done it before! Things like this happen.

They shouldn't, but they do. So what can a vault man do to

prevent such emergencies from happening? Have the cemetery call earlier? You check the newspapers and pray that these things don't happen. And like the fire department, you drop everything and go!

that such vaults are "stored" on the premises of the manufacturer. You know what that means. They are probably stacked up out in the back yard of the plant suffering under various weather conditions. We advised the federal agencies that such vaults are not "tagged" or identified with the purchaser's name and are not placed in an independent bonded warehouse and thus, in a legal sense, are not "delivered."

NCBVA wants to hear from any member who is knowledgeable about such switching schemes being perpetrated in their local area and to see any marketing literature connected to promoting such scheme. We understand that there are now several groups seriously concerned with the scheme that have also filed complaints and statements with the federal agencies.

/ n an effort to provide association members with the latest state of the arts information services, the National Concrete and Burial Vault Association has upgraded its Internet website to an all new dynamic, interactive format.

Members logging on to the site will be able to utilize new features usually only available to the largest U.S. associations and companies. The site located at http:// www. ncbva.org, now allows members to establish their own home page which includes the latest information that can affect their businesses in many ways. A feature of the member home page provides instant access to industry news as it happens, bringing the latest information to the member almost immediately.

"We want our members to know of changes affecting the burial vault industry all over the country that could affect our businesses. We need to let them know what's going on as soon as we get that information," said NCBVA President Jack Swihart. The updated information is a compilation of stories from wire services and other services condensed for easy and quick reading by the vault manufacturer. Once at the NCBVA site, simply click on "My Home Page" on the index on the left hand site.

The NCBVA is using the largest part of the home page for promotion to funeral directors and consumers on the value of utilizing a concrete burial vault over that of other materials.

Members may also utilize the membership directory which includes a listing of all companies belonging to the organization cross referenced by type of vault and dealership/franchise. You can also verify the plant certification status on any member with the new system.

"We're hoping this might be of assistance to the vault manufacturer member in facilitating vault transfers to other parts of the country," said Swihart.

Members may also check in to get the latest updated information on the NCBVA convention including program and the ability to register on line.

Members interested In communicating with the leadership of NCBVA will be able to do it through a new leadership section. You can find names, addresses, telephone numbers and available e-mail addresses of the NCBVA Board of Directors, all committees and staff members of the organization.
