Report No. 67 To the Mayor and Members of Council: The Chief Administrative Officer reports and recommends as follows: All matters listed on the Consent Report are considered to be routine and are enacted by one motion. There is no separate discussion on these items. If discussion is desired upon request of a Member of Council, that item is removed from the Consent Report and is considered separately. Council Members may request that an item be considered separately if they have a conflict of interest. THAT Council consent to the approval of the following routine items: (a) THAT Council authorize a by-law such that the President & CEO of Utilities Kingston or his/her designate is hereby

authorized to approve and sign applications to the Ministry of the Environment, under Sections 52 and 53 of the Ontario Water Resources Act, on behalf of the City of Kingston as stated client on these applications. (File No. CSU-C01-000-2003) (See By-Law No. (1), 2003-170)

(b) THAT the 2003 Gas Utility Capital Budget be amended to enable Utilities Kingston to proceed with the installation of

temporary generation at the Gas Regulator Station located on Railway Street at a cost not to exceed $825,000.00, and; THAT the work be subject to an agreement that is satisfactory to the Director of Legal Services between Utilities Kingston and Ontario Energy Management Inc., which will include a provision that all costs incurred by Utilities Kingston are to be reimbursed. (c) THAT Council approve that 1425445 Ontario Limited (operating as Utilities Kingston) be authorized to open an account with the Hong Kong & Shanghai Bank of Canada (HSBC) for the purposes of the banking of the telecommunications business. (File No. CSU-F04-000-2003)

CARRIED (d) WHEREAS Council approved $330,000.00 in the 2003 Operating Budget and committed $25,000.00 of this amount to

the Festival on the St. Lawrence, and; WHEREAS Community Development staff have consulted with stakeholders regarding the Healthy Community Fund, as well as monitored feedback and concerns about the 2002 program; THEREFORE BE IT RESOLVED THAT the recommended eligibility criteria for the 2003 Healthy Community Fund, as outlined in Report No. 03-107, be approved;

–and further– THAT the “status quo” option for fund distribution, which maintains the same funding categories and maximum grant size as 2002, be approved;

–and further– THAT staff be directed to put out a call for proposals by the middle of August and adopt a similar review process as 2002;

–and further– THAT Council appoint a Council representative to sit on each of the five review committees. (File No. CSU-F05-000-2003; CSU-C12-000-2003) (See Miscellaneous Business Item No. (3)

(e) THAT Council authorize staff to renew the City of Kingston’s agreement with the Kingston, Frontenac, Lennox &

Addington Health Unit, inclusive of an increased administrative fee of 8%, for a three-year period, effective August 1, 2003, and; THAT the renewed agreement be in a form satisfactory to the Director of Legal Services. (File No. CSU-L04-000-2003)

(f) THAT the 2003 Capital Budget be amended to enable the Solid Waste Division to proceed with the replacement of

two steel conveyor belts at the Kingston Area Recycling Centre at a cost not to exceed $60,000.00, with funds to come from the Recycling Equipment Replacement Reserve Fund, and; THAT the work be awarded to Machinex Recycling Technologies in the amount of $53,128.00 and that a contract be negotiated to the satisfaction of the Director of Legal Services, and; THAT an amount of $6,870.00 be approved for equipment rental, electrical work required for installation of the automatic oilers, and contingency purposes. (g) THAT Council approve the purchase of one 2004 Model Year, 19,000lbs. GVWR, single-axle dump truck from Edwards Ford Sales for the tender amount of $44,693.00 + applicable taxes. (File No. CSU-F18-004-2003)

(h) THAT Council accept the low bid from The Canadian Salt Company of $73.82 per tonne, including all taxes and

freight, for the supply of approximately 14,000 tonnes of coarse crushed salt for winter road and sidewalk maintenance. (File No. CSU-F18-000-2003)

CARRIED Councillor Pater withdrew from the meeting. (i) THAT Council, on behalf of the City of Kingston, enter into a license agreement with the owners of Queen’s University

Grad Club for the lease of City property for the purpose of operating a sidewalk patio, and; THAT the license agreement be in a form acceptable to the City Solicitor. (File No. CSU-D23-000-2003)

CARRIED Councillor Pater returned to the meeting. (j) THAT Council authorize the Mayor and City Clerk to execute a Lease between the City of Kingston as Landlord and

the Frontenac Community Mental Health Services as Tenant, in a form that is satisfactory to the Director of Legal Services, for the building known as Tercentennial Lodge, municipally known as 372 King Street West, for a period of twenty years, commencing April 1, 2003 and ending on March 31, 2023. (k) THAT Council endorse the continuation of the use of the land known as Part 1, Registered Plan BR 5695, in the City of Kingston, for the purpose of a community garden plot, and; THAT Council authorize the Mayor and City Clerk to execute a License Agreement between the City of Kingston as Landlord and the Elmwood & Sir John A. Macdonald Garden Community as Tenant, in a form that is satisfactory to the Director of Legal Services, for the lands known as Part 1, Registered Plan BR5695 in the City of Kingston for a period of five years, commencing June 15, 2003 and ending on June 14, 2008. West Street in front of City Park on Wednesday, September 3, 2003 from 4:00 pm to 5:30 pm for community purposes (Queen’s Alma Mater Society Bigger & Better Event & Parade), subject to the following conditions: • That the applicant shall pay for the cost of advertising the temporary street closure as invoiced by the Council

Support Division. • That the applicant shall be responsible for the acquiring/renting, placing and removal of all barricades

necessary to fully close the roadway(s) affected and install advance signage to indicate the street closure and install detour signage.

• That the applicant shall agree to take out sufficient public liability property damage insurance in the amount of $2,000,000.00 to cover all risks. The policy shall be in a form and in an amount satisfactory to the City of Kingston and shall be kept in full force during the period of the proposed street closure. The City of Kingston shall be named as a party insured on the policy and the applicant shall provide the City of Kingston with a copy of the insurance policy.

(m) THAT a by-law be presented to temporarily establish the following streets as one-way traffic patterns from 8:00 am to 5:00 pm, with two-way traffic resuming at 5:01 pm, on Sunday, August 31, 2003 for community purposes (Queen’s Alma Mater Society Moving-In Day) as follows:

Collingwood Street from King Street to Union Street one-way northbound

Albert Street from Union Street to King Street one-way southbound

Queen’s Crescent from University Avenue to Collingwood Street one-way westbound

Stuart Street from University Avenue to Lower Albert Street one-way westbound subject to the following conditions: • That the applicant shall pay for the cost of advertising the temporary one-way street patterns as invoiced by

the Council Support Division. • That the applicant shall be responsible for the acquiring/renting, placing and removal of all barricades

necessary to fully change these streets to one-way and install signage to indicate the streets are one-way. • That the applicant shall agree to take out sufficient public liability property damage insurance in the amount of

$2,000,000.00 to cover all risks. The policy shall be in a form and in an amount satisfactory to the City of Kingston and shall be kept in full force during the period of the proposed street closure. WHEREAS the City of Kingston has duly advised the County of Frontenac of its interest and intent in renegotiating the terms of the Local Services Realignment (LSR) Agreement, including, but not limited to, the apportionment of costs for a period of time commencing January 1, 2004, and; WHEREAS City staff has analyzed the current Local Services Realignment agreement and noted significant inequities in the current methodologies of apportioning costs, and; WHEREAS staff has carried out municipal benchmarking research and analyzed the available cost sharing methodologies to assess more viable cost sharing options; THEREFORE BE IT RESOLVED THAT senior staff and the City’s Rural Urban Liaison Affairs Committee (RULAC) members enter into negotiations with the County of Frontenac for a new cost-sharing agreement and recommend the utilization of weighted assessment to apportion net costs for Social Housing, Land Ambulance, Social Services, and Provincial Offences (POA);

–and further– THAT, if agreement cannot be reached with the County of Frontenac on this issue, staff be authorized to take the necessary steps to proceed with arbitration. (File No. CSU-L04-000-2003)

OTHER BUSINESS Councillor Garrison expressed concern that, although Bombardier is not located within the City limits, decisions being made will have negative effects on residents. Mayor Turner indicated that she is hopeful that another contract can be secured. Councillor Meers was pleased to report that construction on Bulter Street has been finalized. Councillor Meers expressed concern about a dilapidated garage on Division Street and Kirkpatrick Street and any liability the City might face due to the damage to the garage doors. He noted that this is a Property Standards issue and would like their involvement in resolving this matter. Councillor Meers advised that he had been contacted by Harvey Schachter about providing personal opinions about his collegues. He stated that he was elected to debate issues and not to provide personal opinions.
