Mayor Dugatto called the meeting to order at 7:00 PM. 2. Pledge of Allegiance. Mayor Dugatto led the Pledge of Allegiance. 3. Roll Call. Mayor Dugatto requested roll call. The Board of Aldermen members present were Barbara DeGennaro, Thomas Donofrio, Arthur Gerckens, Ronald Sill, Carmen DiCenso, Peter Olenoski and Mr. Staffieri. Joseph DiMartino was excused. Stephen Iacuone arrived at 7:01 PM. 4. Additions, Deletions, Corrections and Adoption of Agenda Mr. DiCenso motioned to add item 10.7 Building Committee for Field House and Baseball Field. Mr. Olenoski seconded and the motion carried. 5. Public Portion Leslie Creane – Gave a presentation on downtown Derby. Mr. Staffieri asked about the added streets and parking and who would be paying for them. She said that they are working with DECD for funding options. Ms. DeGennaro said she didn’t get her monthly report until just before this meeting and this has happened for the past two months. She doesn’t understand why the reports are not submitted timely. Ms. DeGennaro asked for a moment of silence for retired Derby Detective Robert Donohue who recently passed away Lynette Jordan – Spoke about the hearing concerning Sarah Munio and asked the Board to support the petition. Carolyn Sires, 20 Linden Shores, Branford from United Seniors for America – Spoke regarding Sarah Munio and stated that Sarah had volunteered to sell bingo tickets for an event they were holding and she kept the money. She also stated that Sarah has a lifelong history of scamming people and accelerated rehabilitation is not in the best interest of the seniors or citizens of Derby. Mary Oliveira, 260 Hawthorne Avenue - Spoke about the picnic grove and feels that the security deposit for Derby residents should be increased. Mr. Sill feels that raising the fee will not have any effect on noise or drinking. Laura Wabno – 147 Ida Avenue – Spoke regarding Item 8.3.4. She submitted the following statement:

1. Call to Order.

Mayor Dugatto called the meeting to order at 7:00 PM.

2. Pledge of Allegiance.

Mayor Dugatto led the Pledge of Allegiance.

3. Roll Call.

Mayor Dugatto requested roll call.

The Board of Aldermen members present were Barbara DeGennaro, Thomas Donofrio, Arthur Gerckens, Ronald Sill,

Carmen DiCenso, Peter Olenoski and Mr. Staffieri. Joseph DiMartino was excused. Stephen Iacuone arrived at 7:01 PM.

4. Additions, Deletions, Corrections and Adoption of Agenda

Mr. DiCenso motioned to add item 10.7 Building Committee for Field House and Baseball Field. Mr. Olenoski seconded

and the motion carried.

5. Public Portion

Leslie Creane – Gave a presentation on downtown Derby. Mr. Staffieri asked about the added streets and parking and

who would be paying for them. She said that they are working with DECD for funding options.

Ms. DeGennaro said she didn’t get her monthly report until just before this meeting and this has happened for the past

two months. She doesn’t understand why the reports are not submitted timely.

Ms. DeGennaro asked for a moment of silence for retired Derby Detective Robert Donohue who recently passed away

Carolyn Sires, 20 Linden Shores, Branford from United Seniors for America – Spoke regarding Sarah Munio and stated

Laura Wabno – 147 Ida Avenue – Spoke regarding Item 8.3.4. She submitted the following statement:

Fred Picroski – spoke regarding a “don’t lock the box” at the intersection of Main Street and Derby Avenue. He stated

that Sarah Munio victimized people. He also asked the Board to write to state representatives to request that they stop

increasing taxing.

Laura Brezina – Spoke about littering in the parking area between the gas station and House of Bones.

6. Approval of Minutes

6.1. Meeting – February 23, 2017

Mr. Sill motioned to approve the minutes, Ms. DeGennaro seconded with the following corrects: page 3 second

paragraph should state $250 and Item 9.13 add Attorney Welch stated that only 5 or less would be allowed without

the fire watch. Motion carried.

7. Administrative & Appointments

7.1 Move to approve refund of excess taxes paid in the amount of $3,592.70 as recommended by the Tax

Collector Denise Cesaroni.

Motioned by Mr. Sill, seconded by Ms. DeGennaro and the motion carried.

7.2 Move to abate taxes due from the 2015 Grand List for City owned property at 187-189 Derby Avenue in

the amount of $1,186.55 as requested by Tax Collector Denise Cesaroni.

Motioned by Mr. DiCenso, seconded by Mr. Sill and the motion carried.

7.3 Move to approve the following appointments to the Board of Ethics as recommended by Mayor Anita

Dugatto:

7.3.1 Andrew Baklik – Republican – Regular Member (expires 3/30/18)

7.3.2 Gerardo Borelli – Republican – Regular Member (3/31/17-19)

7.3.3 Kara Rochelle – Democratic – Regular Member (3/31/17-20)

7.3.4 Peter Campolattano – Democratic – Regular Member 3/31/17-21

7.3.5 Pam Ortiz– Unafilliated – Regular Member 3/31/17-22

7.3.6 William Boland – Unaffiliated – Alternate Member expires 2018

7.3.7 James Stadt – Democratic – Alternate Member expires 2019

7.3.8 Carolyn Duhaime – Republican – Alternate Member expires 2020

Motioned by Mr. Gerckens and seconded by Mr. Sill.

Ms. DeGennaro asked Attorney Welch about the terms as they are not accurate based on the opinion he issued. All

the appointments would be new except for the term of one member whose term didn’t expire yet. She also stated

that Carolyn Duhaime is on the pension board and therefore, cannot be on the ethics board. Mr. Garofalo said she

is not on the pension board.

Mr. Gerckens and Mr. Sill amended their motions to include the terms. The motion carried.

8. Sub-Committee Reports

8.1. Blight Committee

8.1.1. No Action Items

8.2. Community Relations

8.2.1. Move to authorize the use of the Derby Green by the Derby Cultural Commission on Sundays

beginning June 4, 2017 until October 29, 2017 between the hours of 9:00 am and 4:00 pm to conduct

a Farmers Market.

Motioned by Mr. Sill, seconded by Mr. Staffieri and the motion carried.

8.2.2. Move to waive the Picnic Grove fee for the North Star organization on Sunday, July 16, 2017.

Motioned by Mr. Sill, seconded by Mr. DiCenso and the motion carried. Ms. DeGennaro asked that the motion

add that the security deposit is still to be paid. Mr. Sill and Mr. DiCenso agreed to the addition and the

motion carried.

8.2.3. Move to recommend to the full Board of Aldermen/Alderwomen to waive the Picnic Grove fee,

excluding the security deposit, for Derby Cub Scout Pack 3 on Monday, June 12, 2017.

Motioned by Mr. Sill, seconded by Mr. Staffieri and the motion carried.

8.3. Operations & Procedures

8.3.1. Move to approve the Recognition Policy for teams and individuals who win championships and/or

league titles.

Motioned by Mr. Gerckens and seconded by Mr. DiMartino.

Mr. DiCenso stated that he’d like the Tax Board and Board of Education reserve $2,000 each year towards

the payment of awards, etc.

The motion carried.

8.3.2. Move to approve the Director of Public Works, Anthony DeFala to purchase a John Deere TS 4x2

Gator using proceeds received from a recent auction of old vehicles. The purchase price of the Gator

is not to exceed $6,875 subject to the approval of the BOAT and Capital Planning Board if needed.

Motioned by Mr. Gerckens and seconded by Mr. Olenoski.

Mr. Iacuone asked that the motion include that the bid requirements stated in the Charter be followed. Mr.

Gerckens and Mr. Olenoski agreed and the motion carried.

8.3.3. Move to approve the Picnic Grove Regulations that institute a $250 security deposit for Derby

residents.

Motioned by Mr. Gerckens and seconded by Mr. Olenoski.

The Board discussed lowering the rental fee and increase the security deposit instead. Mr. Gerckens said he

feels the sub-committee process is not being respected.

Mr. DiCenso asked to lower the rental to $150 for Derby residents with a security deposit of $200.

Mr. DiCenso motioned to change the rental to $150 for Derby residents with a refundable security deposit of

$250. DiMartino seconded. Mr. Donofrio opposed. Motioned carried.

Operations & Procedures Subcommittee Title: “Picnic Grove Regulations” – Adopted March 23, 2017 Board of Aldermen/Alderwomen, Taking into account the City of Derby Picnic Grove is a valuable asset, Realizing “Closed at Dusk” may cause confusion to those who rent the Picnic Grove, Deeply concerned with quality of life issues for the residents who live next to the Picnic Grove, Believing the Picnic Grove is not being vacated at dusk, Recognizing a more costly security deposit may alleviate some complaints, 1. Proclaims the Picnic Grove will be closed at 1900 hours (7 p.m.);

2. Requests the Town/City Clerk to provide the Police Department with a list of those renting the Picnic Grove each Friday so they know who is authorized to be on the premises;

3. Further requests the security deposit fee be raised to equal the park use fee. The fee structure would look as follows: Residents or organizations from Derby:

$150.00 (for park use) – due with contract signing.

$ 250.00 (for security) due with contract signing.

$400.00 Total Non Resident or organizations:

$400.00 (for park use) – due with contract signing.

$400.00 (for security) – due with contract signing.

$800.00 Total

Supports the forfeiture of security deposits if the Police Department responds to two

documented noise complaints and/or a documented complaint that the Picnic Grove has not

been vacated by 1900 hours (7:00 p.m.).

8.3.4. Move to approve the resolution titled, “Time Sheets Elected Officials”.

Motioned by Mr. Gerckens and seconded by Mr. Olenoski.

Ms. DeGennaro said she doesn’t understand why the resolution was needed for timesheets if a written legal

opinion would suffice. Attorney Welch said that the salary is based on the calculation of 35 times the

assessor’s hourly wage times 52. It is clear it is a salary position; however, the Board could decide to add the

additional duty of submitting timesheets. Mr. Gerckens stated that they were asked by the finance director

to clarify if this was a full time salaried position.

Ms. DeGennaro and Mr. Staffieri opposed and the motion carried.

8.3.5. Move to approve the PNP Master E-Services Agreement for Credit Card Services.

Motioned by Mr. Gerckens, seconded by Mr. Sill and the motion carried.

Mr. Olenoski asked about the leak at DHS. Dr. Conway said they were looking into it yesterday and he does not

have a report yet.

9.2. Cultural Commission

Ms. DeGennaro asked for the financial report to include specifics for revenue and expenditures.

9.3. Public Works

Nothing was discussed.

9.4. Building Department

Nothing was discussed.

9.5. Facilities Inspectors

Nothing was discussed.

9.6. Fire Marshal

Nothing was discussed.

9.7. Fire Department

Nothing was discussed.

9.8. Office of Emergency Management

Ms. DeGennaro asked why the Ansonia HS was chosen as the emergency center. Mayor Dugatto said Mr. Sugar

will get back to the Board with an explanation.

Mr. Gerckens stated OEM did a good job during the last storm as did Mr. DeFala and his department.

Mr. Olenoski said we need to be more proactive with advising our citizens on where to go during an emergency.

9.9. Parking Division

Nothing was discussed.

9.10. Police Department

Mr. Gerckens said he has been discussing the monthly reporting with Chief Narowski and it will be addressed at

the next meeting.

9.11. Water Pollution Control Authority

Nothing was discussed.

9.12. Chief of Staff

9.13. Corporation Counsel Update

The insurance company conducted the walk through at the opera house and they are awaiting the report.

Mr. DiCenso motioned to enter into executive session and invite Attorney Welch. Mr. Sill seconded and the motion

carried at 8:37 pm.

The meeting reopened to the public at 8:47 PM.

Mr. DiCenso motioned to authorize Corporation Counsel to settle as discussed. Mr. Sill seconded and the motion

carried. Mr. Staffieri abstained

Mr. DiCenso motioned to approve the bid and authorize the sale of the property and further authorize Mayor

Dugatto to execute any and all documents to effectuate said bid and sale. Mr. Staffieri seconded and the motion

carried.

Mr. Sill motioned to adjourn at 8:48 PM, seconded by Mr. Staffieri and the motion carried.
