City of Kenmore City Council Regular Meeting Study Session Minutes July 20, 2009 CALL TO ORDER - The regular meeting of the Kenmore City Council was called to order by Mayor David Baker at 6:00 p.m. EXECUTIVE SESSION - Mayor David Baker adjourned the regular meeting at 6:01p.m. to an executive session to discuss Property Disposition Pursuant to RCW 42.30.110(1)(c). He stated that the executive session will last for approximately 30 minutes and that no action is anticipated when the meeting is reconvened back to regular session. CALL TO ORDER - The regular meeting of the Kenmore City Council was called to order by Mayor David Baker at 6:00 p.m.

EXECUTIVE SESSION - Mayor David Baker adjourned the regular meeting at 6:01p.m. to an executive session to discuss Property Disposition Pursuant to RCW 42.30.110(1)(c). AGENDA APPROVAL

Deputy Mayor Milton Curtis moved to add an additional item "Acknowledge Stacy Denuski and Volunteers for Kenmore Elementary Day Proclamation" to the agenda following the Citizen Comments portion of the meeting. Councilmember Glenn Rogers seconded the motion. The motion passed unanimously.

Council approved the agenda as amended.

Task Force Meeting; Motion Canceling all August, 2009 Regularly Scheduled Council Meetings; Motion to Cancel the Monday, September 7, 2009 Regular Council Study Session Meeting Due to the Legal Holiday; Set a Special Council Meeting for Friday, July 31,2009,11:30 a.m., to be held at Northshore Utility District, to Review Status of Council 2009 Priorities, Administration Work Programs and for Mid-year Evaluation of City Manager; and Set a Special Council Meeting for Monday, August 17, 2009, 5:00 p.m., to be held at Kenmore City Hall, for Discussion and Approval of Claims. The motion passed unanimously.

CITIZEN COMMENTS

Todd Ramsey, 18815 17th Ave. NW, Shoreline, was present to request that a turn lane pocket be required on SR 522, between the Sherwin Williams Store and Ostrom's Drug Store, as part of the SR 522 Phase I, Stage II construction project.

PROCLAMATION

Proclaim July 21st as Stacey Denuski and Volunteers for Kenmore Elementary Playground Day - Mayor David Baker read the proclamation into the record honoring Stacey Denuski and Volunteers for their tremendous effort and contributions to our community for the purchase and installation of new playground equipment at Kenmore Elementary School.

RESOLUTION

Adopt Resolution No. 09-170 Authorizing the City Manager to Apply for Financial Assistance to Assist in Implementing City Council Approved Projects and Programs -Fred Stouder, City Manager, was present to give a report in which he stated that this resolution would allow the City Manager to apply for fmancial assistance as needed for approved Capital Projects or Council priorities instead of bringing each individual application to Council for approval. He stated that the adoption of the resolution will streamline the grant application process and allow it to move forward at an accelerated pace. He stated that all grant awards and agreements accepting grant funds would continue to require City Council authority. He was also available to answer any questions.

Councilmember Glenn Rogers moved to Adopt Resolution No. 09-170 Authorizing the City Manager to Apply for Financial Assistance to Assist in Implementing City Council Approved Projects and Programs. Deputy Mayor Milton Curtis seconded the motion. The motion passed unanimously.

Authorize the City Manager to Execute Contract No. 09-C807 in the Amount of $104,091 with Susan Zoccola for Final Design, Fabrication, and Installation of the New City Hall Public Art Project - Nancy Ousley, Assistant City Manager, was present to give a brief report in which she reviewed that Council adopted a public art budget line item of $129,000 in the budget; Council appointed a City Hall Public Art Advisory Committee in April, 2008; and Council approved the selection of Susan Zoccola as the City Hall public artist and development of a contract for conceptual design. She stated that Administration recommends authorization to execute Contract No. 09-C807 with Susan Zoccola for the final design, fabrication and installation of a public art piece for the City Hall. She was also available to answer any questions.

Kath Bruhner, 4Culture and Susan Zoccola were present to review the proposed public art piece. They were also available to answer any questions.

Members from the City Hall Public Art Advisory Committee were also present to answer any questions.

Deputy Mayor Milton Curtis moved to Authorize the City Manager to Execute Contract No. 09-C807 in the Amount of $104,091 with Susan Zoccola for Final Design, Fabrication, and Installation of the New City Hall Public Art Project. Councilmember Laurie Sperry seconded the motion. The motion passed unanimously.

Authorize the Appropriation of $334,000 of Real Estate Excise Tax from the Municipal Capital Fund for Street Improvements and Undergrounding of Overhead Utilities in the 6500 Block of 181st Avenue NE & Authorize the City Manager to Execute Interlocal Agreement No. 09-C808 with the King County Library System (KCLS) in the Amount of $215,217 to extend the Library's NE 181st Street Sidewalk Improvements East to 67th Avenue NE - Ron Loewen, City Engineer, was present to give a brief report in which he reviewed that as part of the condition of approval the King County Library (KCL) project will be required to construct half-street improvements along their NE 181 st Street property frontage. He stated that the City is currently improving NE 181st Street up to 67th Avenue NE as part of the SR 522 Phase 1, Stage 1 project. He stated that between the two projects, there would be a one-parcel gap in the sidewalk on the south side ofNE 181st Street. He stated that the interlocal agreement would extend the Library's project limits east to 67th Ave. NE to close the gap. He stated that the City would be responsible for reimbursing the KCLS for the additional cost. He stated that the agreement also includes the City installing a new fire hydrant on SR 522, and the KCLS would be responsible for reimbursing the City for this cost. He stated that the project costs would be funded with a transfer of Real Estate Excise Tax from the Municipal Capital Fund to the Arterial Street Fund. He was also available to answer any questions.

Discussion followed.

In response to Council questions, Ron Loewen, City Engineer, stated that they could add a

clause to the ILA that would allow the City to review the bids prior to wording the contract to ensure that it is within budget and that the City wants to proceed with the work.

Mayor David Baker called a 5-minute recess to allow Rod Kaseguma, City Attorney, the opportunity to write a clause to be included in the ILA.

Mayor David Baker reconvened the meeting back to regular session at 8:20 p.m.

Deputy Mayor Milton Curtis moved to amend the ILA No. 09-C808 by adding a sentence at the end of Section lA to read as follows: "The City shall approve the invitation to bid for the ILA Street Project before issuance by the Library. " Councilmember Randy Eastwood seconded the motion. The motion passed unanimously.

Deputy Mayor Milton Curtis moved to add a second amendment to the ILA No. 09-C808 that would, for clarification purposes, include the addition to the agenda title the words "and installation of fire hydrant on SR 522." Mayor David Baker seconded the motion. The motion passed unanimously.

CITY MANAGER REPORT(S)

Discussion ofSR 522 Phase I Stage 2 (57th to 67th Avenues) Left Turn and U-Turn Locations - Ron Loewen, City Engineer, was present to give a brief report in which he reviewed

that the SR 522 Corridor Improvements in the City will provide comprehensive access management and channelization improvements. He stated that the Washington State Department of Transportation (WSDOT) controls access to SR 522. He reviewed that WSDOT approved the access management and channelization. He stated that Council has expressed a desire to review and possibly suggest additional locations for left turns and U-turns. He stated that any changes to the existing/proposed plans would require the plans to be resubmitted to WSDOT for approval. He was also available to answer any questions.

Discussion followed.

Councilmember Allan Van Ness moved to direct staff to proceed with plan revisions and contact WSDOT to add two additional left turn pockets for east bound traffic on SR 522 at 63th and at 64th. Councilmember Glenn Rogers seconded the motion. The motion passed unanimously.

Discussion and Council Direction Regarding the First Annual Observance of Jack V. Crawford "Courtesy is Contagious in Kenmore" Day - Nancy Ousley, Assistant City Manager, was present to give a brief report in which she reviewed that the Council proclaimed October 24, the birth of Kenmore's first Mayor Jack V. Crawford, to be observed each year as Jack V. Crawford Day. She reviewed some of the potential options for activities on the first Jack V. Crawford Courtesy is Contagious in Kenmore Day on Saturday, October 24. She was also available to answer any questions.

It was Council consensus that staff would incorporate some of the ideas discussed this evening and staff would report back once the celebration activities were finalized.

Briefing Regarding Policy Direction on Illicit Discharge Detection and Elimination (IDDE) and Surface Water Runoff Ordinances to Achieve Compliance with the City's NPDES Phase II Permit - Ron Loewen, City Engineer and Kent Vaughan, Senior Engineer, were present to give a report in which they reviewed the new Illicit Discharge Detection and Elimination ordinances to achieve compliance with the City's NPDES Phase II Permit. They stated that City staff recommends adopting the new 2009 King County Surface Water Design Manual and apply slight modifications to remove specific County references not applicable to Kenmore. They stated that some provisions for low impact development (LID) are included in the new 2009 KCSWDM. Council will have the opportunity to consider adding more LID measures later this fall as part of the LID Ordinance development process. They reviewed the IDDE schedule. They were also available to answer any questions.

Kate Rhodes, Otak, was also present to answer any questions.

Councilmember Glenn Rogers moved to postpone the consideration of this item and move it forward to an upcoming Council meeting. Deputy Mayor Baker seconded the

motion. The motion passed 6-1 with Councilmember Laurie Sperry voting no.

COUNCILMEMBER COMMENTSIINITIATIVES

Councilmember Allan Van Ness provided a brief update on the recent Suburban Cities Business Meeting he attended with Mayor David Baker. He reviewed the highlights of a recent Environmental Protection Agency webcast he participated in regarding social marketing.

Mayor David Baker passed out photos of the Kenmore Kaboom playground build he participated in over the weekend. He recommended that Council adopt a proclamation establishing a City-wide play day in Kenmore. He discussed the importance of having candidates names on their campaign signs.

Councilmember Laurie Sperry provided an update on the recent WRIA8 meeting she attended. She reviewed that the King County Conservation District is proposing legislation which wi11lessen the amounts allocated to the jurisdictions. She recommended that the Council send out a letter in opposition of changing the funding allocations.

Councilmember John Hendrickson distributed a 2-page budget hand out.
