A Regular Meeting of the Council of the City of Manassas, Virginia was held in Council Chambers, City Hall, on the above date with the following present on roll call: Mayor Harry J. Parrish II, Council Members Marc T. Aveni, Sheryl L. Bass, Ken D. Elston, Ian T. Lovejoy and Mark D. Wolfe; City Manager W. Patrick Pate, Deputy City Manager Bryan Foster, City Attorney Martin R. Crim, Assistant to the City Manager/City Clerk Andrea P. Madden, Police Chief Douglas W. Keen, Community Development Director Elizabeth S. Via-Gossman, Development Services Manager Jamie S. Collins, Planning and Zoning Manager Matthew Arcieri, Finance and Administration Director Paul York, Communications Manager Patty Prince, Building Maintenance Manager Tim Fitzwater, and City Horticulturist Steve Seeba.

Council Member Elston was excused from the meeting at 7:10 p.m. and was not included in the closed meeting discussion. Vice-Mayor Jonathan L. Way arrived at 7:15 p.m. and joined the City Council in its closed meeting.

Mayor Parrish called the meeting to order at 5:30 p.m. and delivered the invocation.

The Manassas City Police Department Honor Guard presented Colors as the Mayor led those present in the Pledge of Allegiance.

City Attorney Report

Mr. Crim stated that he planned to bring forward to the City Council the sale of a piece of property near the Manassas Regional Airport on Alessi Drive.

City Manager Report

Mr. Pate reported on the many seasonal activities occurring in Manassas and Historic Downtown and encouraged citizens to visit the City’s website for additional information.

Mr. Pate commented on the new birch trees that were planted at the Liberia Plantation and thanked the Beautification Committee and Olde Towne Landscaping for the great work.

Mr. Pate announced that the Manassas City Public Schools and the Manassas Police Department will participate in a Reunification Drill at Baldwin Elementary School on October 24 and October 25 to determine how best to connect children and parents in an emergency situation.

Mr. Pate encouraged residents to take advantage of the RecycleFest event scheduled for Saturday, November 5 from 8:00 a.m. to 12:00 p.m. at the Manassas Transfer Station.

Mr. Pate reminded everyone of the upcoming election and urged all voters to get out on November 8 and cast their ballot.

Chief of Police Report

Chief Keen introduced and recognized the following members of the Manassas Police Department as Employees of the Month:

Office C. Heinke as the June 2016 Employee of the Month Sergeant S.M. Bowers, Master Detective C.B. Daniels, and Police Officers J.M.

Casteline and S. Barrett as the July 2016 Employees of the Month Police Officer B.N. Alexander as the August 2016 Employee of the Month

Chief Keen introduced Officer D. Batkins to the City Council, a new member of the MCPD who will serve as the Student Resource Officer (SRO) at Mayfield.

Mayor Parrish welcomed Officer Batkins to the City and administered the Oath of Honor to all law enforcement personnel present. 5

Mayor Parrish called for a recess at 5:48 p.m.Mayor Parrish reconvened the meeting at 5:57 p.m.

Chief of Police Report (continued)

Chief Keen briefly reported on the planning and preparation done by the Police Department to ensure a safe and orderly election day in the City.

Chief Keen stated that he and some of his staff will attend the CALEA hearing to receive the organization’s findings. Chief Keen stated that he expects the report to identify space needs, staffing levels, and property storage as areas for improvement.

Council Time

Council Member Lovejoy announced that he will host the Greater Manassas Community Job Fair on October 25, 2016 at the Bethel Evangelical Lutheran Church from 1:00 p.m. to 6:00 p.m.

Council Member Bass reported on Council of Governments (COG) meetings she recently attended and announced upcoming theatric performances at Osbourn High School and the Hylton Performing Arts Center by the Prince William Little Theatre.

Council Member Elston noted that amended by-laws for many of the City’s Boards, Committees, and Commissions were included on the Consent Agenda and commented that this demonstrates a continuing commitment by staff and citizens to community involvement. Council Member Elston announced that George Mason University will perform The Threepenny Opera at the Hylton Performing Arts Center from November 3 through November 5, 2016.

Mayor Time

Mayor Parrish shared with the City Council a Press Release from the Northern Virginia Transportation Authority (NVTA) regarding public outreach efforts this fall to guide the NVTA’s plans and priorities.

Consent Agenda

Item 1. Approve Minutes of the Regular Meeting of October 17, 2016.

COUNCIL MEMBER BASS MOVED that the Minutes of the Regular Meeting of October 17, 2016 be approved. Seconded by Council Member Aveni. Roll call vote: AYES – Aveni, Bass, Elston, Lovejoy and Wolfe. ABSENT – Way. MOTION CARRIED.

Item 2. Consideration of the By-Laws of the Following Boards, Committees or Commissions: Architectural Review Board; Board of Zoning Appeals; Historic Resources Board; and Planning Commission.

COUNCIL MEMBER BASS MOVED that the By-Laws of the Architectural Review Board; Board of Zoning Appeals; Historic Resources Board; and Planning Commission be approved. Seconded by Council Member Aveni. Roll call vote: AYES – Aveni, Bass, Elston, Lovejoy and Wolfe. ABSENT – Way. MOTION CARRIED.

Item 3. Consideration of a Code of Ethics for Manassas City Employees.

COUNCIL MEMBER BASS MOVED that the Code of Ethics for Manassas City Employees be approved as presented. Seconded by Council Member Aveni. Roll call vote: AYES – Aveni, Bass, Elston, Lovejoy and Wolfe. ABSENT – Way. MOTION CARRIED.

Item 4. Consideration of Proclamation Designating November 5, 2016 as America Recycles Day in the City of Manassas.

COUNCIL MEMBER BASS MOVED that the Proclamation designating November 5, 2016 as America Recycles Day in the City of Manassas be approved. Seconded by Council Member Aveni. Roll call vote: AYES – Aveni, Bass, Elston, Lovejoy and Wolfe. ABSENT –Way. MOTION CARRIED.

Item 5. Consideration of Resolution 2017-04-R:

(A) Amending the FY 2017 Budget by Budgeting and Appropriating $97,301 in State Revenue for the Medium Approach Lighting Systems (MALS)

(B) Amending the FY 2107 Budget by Budgeting and Appropriating $44,492 in State Revenue for Airport Location Signs

(C) Amending the FY 2017 Budget by Budgeting and Appropriating $37,363 in State Revenue for Runway 17L-34R and Taxiway “B” Bridge Widening

COUNCIL MEMBER BASS MOVED that Resolution 2017-04-R be approved as presented. Seconded by Council Member Aveni. Roll call vote: AYES – Aveni, Bass, Elston, Lovejoy and Wolfe. ABSENT – Way. MOTION CARRIED.

Item 8 of the Agenda: Consideration of Resolution #R-2017-14 Approving Special Use Permit (SUP) #2016-08, Grace United Methodist Church.

Matthew Arcieri, Planning and Zoning Services Manager, explained that the Public Hearing regarding the Special Use Permit for Grace United Methodist Church was held and closed on October 17 with no speakers in opposition to the request. The Planning Commission and Staff both recommend approval of the Special Use Permit as conditioned.

COUNCIL MEMBER AVENI MOVED that Resolution #R-2017-14 approving Special Use Permit (SUP) #2016-08, Grace United Methodist Church, be approved. Seconded by Council Member Bass. Roll call vote: AYES – Aveni, Bass, Elston, Lovejoy and Wolfe. ABSENT – Way. MOTION CARRIED.

Item 11 of the Agenda: Presentation by Doug Allen, Chief Executive Officer of the Virginia Railway Express (VRE).

Doug Allen, Chief Executive Officer of the Virginia Railway Express (VRE), introduced Christine Hoeffner, the Manager of Project Development, who presented an update on the Gainesville-Haymarket Extension Study.

Cathy Lemmon, Chair of the Citizens Advisory Committee on Solid Waste, made a presentation on the activities and goals of the Citizens Advisory Committee on Solid Waste.

Item 15 of the Agenda: Presentation of Proclamation Designating November 5, 2016 as America Recycles Day in the City of Manassas.

Mayor Parrish presented the Proclamation designating November 5, 2016 as America Recycles Day in the City of Manassas to Monica Boehringer, Refuse and Recycling Coordinator, and the members of the Citizens Advisory Committee on Solid Waste.

Item 19 of the Agenda: Citizens’ Time

Ellen Purdy, a resident of the City of Manassas, spoke to the importance of healthy workplace policies.

Doug Brown, a resident of the City of Manassas, stated that he agrees with the recommendation by the City’s consultant that the GMBL ball fields remain in the current location.

Item 20 of the Agenda: Consideration of a Motion Authorizing a Closed Meeting on Subjects in Accordance with the Amended Freedom of Information Act.

Jessica Blaemire, to the Community Policy and Management Team as Parent Representative, for a four-year term ending June 30, 2020;

Zuzana Steen, to the Northern Virginia Community College Board as City Representative, for a three-year term beginning July 1, 2016 and ending on June 30, 2019;

Audrey McGlynn, to the Citizens Advisory Board for Cemeteries, for a four-year term ending June 30, 2020;

Keith Mueller, to the Prince William Library Board, for a four-year term ending September 12, 2020; and

that the following re-appointment be approved:

James L. Uzzle, to the Manassas Regional Airport Commission as the Prince William County Representative, for a four-year term ending July 30, 2020.

Seconded by Council Member Wolfe. Roll call vote: AYES – Aveni, Bass, Lovejoy, Way and Wolfe. ABSENT – Elston. MOTION CARRIED.

A motion was duly made, seconded and CARRIED UNANIMOUSLY to adjourn the meeting.

MOTION: November 14, 2016 Regular Meeting

SECOND: Res No. R-2017-16

RE: HONORING ROBIN R. PERKINS, CITY TREASURER, UPON HER RETIREMENTFROM THE CITY OF MANASSAS AFTER THIRTY-FOUR YEARS OF DEDICATED SERVICE TO THE CITY AND ITS RESIDENTS

WHEREAS, Robin R. Perkins, a resident of Manassas since childhood and a graduate of Osbourn High School, has served the City of Manassas in the Treasurer’s Office as a Tax Collector, Deputy Treasurer and, since her election in 1997, has served as City Treasurer; and

WHEREAS, as the steward of the taxpayers funds, one of Robin Perkins’ greatest accomplishments has been to create the tax receivable from ledger books and to continuously advance with technology that benefits the management of the City’s cash; and

WHEREAS, as a public servant, Robin has dedicated her career to implementing policies and procedures built upon high standards and strong ethics that are the benchmark for the daily office operations, resulting in her office being awarded an Annual Accreditation Certification as well as professional certifications for her and her staff; and

WHEREAS, Mrs. Perkins has served as Treasurer for the Prince William County Employees Credit Union for over 20 years; is a member and former Treasurer of the Manassas Rotary Club in which she spearheads the annual Birmingham Green Christmas party and is a long-time member of the Greater Manassas Christmas Parade Committee.

NOW, THEREFORE, BE IT RESOLVED that I, Harry J. Parrish II, Mayor of the City of Manassas and on behalf of the Manassas City Council, hereby publicly commend, recognize, and thank

ROBIN R. PERKINS

for her outstanding service to the City of Manassas and its citizens. The Manassas City Council wishes Mrs. Perkins good health, happiness and a joyful retirement where she will be able to spend much quality time with her grandchildren.

A recent request for blasting work in the City of Manassas has prompted an inquiry into the insurance requirements for companies doing such work in the City. Research was done to determine what surrounding jurisdictions require and, based on those findings, the Fire and Rescue Department recommends that a five million dollar ($5,000,000) policy is sufficient for the bond required for blasting work within the City of Manassas.

The City Attorney and the Risk Manager have reviewed the Ordinance and do not object to the amendment.

IN ARTICLE V OF CHAPTER 60 OF SAID CODE, RELATING TO THE BOND OR INSURANCE REQUIRED FOR A BLASTING PERMIT

BE IT ORDAINED by the Council of the City of Manassas, Virginia, meeting in regularsession this day of , 2016:

1. That the Code of Ordinances of the City of Manassas, Virginia (2002) is hereby amended and reenacted by amending a portion of Section 60-42 as follows:

Sec. 60-42. Amendments to Statewide Fire Prevention Code

3307.17 Bond required for blasting. No blasting shall be conducted without a permit from the Fire Marshal. Before a permit to do commercial blasting shall be issued, the applicant for such permit shall file with the Fire Marshal’s office a bond or liability insurance policy with minimum coverage of at least three million dollars ($3,000,000.00) for bodily injury or death of any one person in any one accident and ten five million dollars ($10,000,000.00)($5,000,000.00) for bodily injury or death of more than one person in any one accident and five million dollars ($5,000,000.00) for damage to or destruction of property in any one accident. Such bond or liability insurance policy shall become available for the payment of any damage arising from neglect of the applicant or his agents or his employees. The form of any bond shall be acceptable to the City Attorney. If the applicant uses an insurance policy instead of a bond, the applicant shall provide the City with a certificate of insurance accompanied by a policy endorsement naming the City of Manassas as an additional insured. Bonds or liability insurance policies may be for a specific operation or for an entire year, provided that the applicant shows evidence that the bonds or liability insurance policy is in continuing effect.

Each locality may grant tax incentives and provide certain regulatory flexibility in a tourism zone. The goal of the incentives is to stimulate tourism related business attraction, growth, and increased employment opportunities at Gateway and in Downtown.

Tourism Zones are passed by local ordinance and contain both requirements and benefits for existing and new tourism businesses, including lodging, dining, retail, meeting and sports facilities, outdoor recreation areas, theme parks and event venues. Localities must create Tourism Zones to utilize the Tourism Development Finance Program (TDFP).

NEW ARTICLE XII, RELATING TO TOURISM ZONES

WHEREAS, the Code of Virginia gives the City the power to create Tourism Zones within which the City can provide additional incentives to qualified businesses, and

WHEREAS, the City desires to create Tourism Zones in order to promote tourism within the

City through tax incentives, regulatory flexibility, and gap financing, as provided by Virginia Code §§ 58.1-3851, 58.1-3851.1, and 58.1-3851.2;

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Manassas, Virginia,

meeting in ___________ session this ____________ day of ______________, 2016: 1. That the Code of Ordinances, City of Manassas, Virginia (2002), is hereby amended and

reenacted by adding in Chapter 110, a new Article XII, numbered 110-370 through 110-389 as follows:

ARTICLE XII. TOURISM ZONES. Sec. 110-370. Purpose.

(a) The City of Manassas finds that becoming a flourishing regional tourism destination requires incentives and determines that an appropriate method of offering incentives is through a Tourism Zone, as authorized by the Code of Virginia §§ 58.1-3851, 58.1-3851.1, and 58.1-3851.2. The City of Manassas intends to strengthen and expand tourism-related businesses and attractions so as to create jobs, increase investment, promote local heritage, attract out-of-town visitors, and strengthen the City’s unique sense of place.

(b) This creation of a Tourism Zone does not affect any other existing requirements for businesses, including zoning regulations.

Sec. 110-371. Administration.

(a) The administrator of the Tourism Zone shall be the City Manager, or designee. The administrator shall determine and publish the procedures for obtaining the benefits created by this article and for the administration of this article.

(b) The administrator shall be the single point-of-contact for qualified business owners to take advantage of the Tourism Zone incentive described in this article.

Sec. 110-372. Definitions.

For the purpose of this article the following words and phrases shall have the meanings given below, unless clearly indicated to the contrary:

Performance agreement means the City's standard agreement form, to which is attached a business' proposed plan of development and/or business plan.

Qualified tourism business means a new or existing business whose primary purpose is to establish a destination that attracts tourists and increases travel-related revenue, including lodging, dining, retail, meeting or conference centers, sports facilities, outdoor recreation areas and event venues.

Tourism Zone means a specific geographical area or areas created to foster the development and expansion of tourism businesses in the City of Manassas.

Sec. 110-373. Boundaries.

(a) The “Downtown Manassas Tourism Zone” shall be the area defined in the City of Manassas Comprehensive Plan as the Downtown or Old Town Sector Plan.

(b) The “Gateway Tourism Zone” shall be the area defined in the City of Manassas Comprehensive Plan as Manassas Landing.

Sec. 110-374. Incentives.

(a) Qualified tourism businesses may receive any tax incentives allowed by law for a period of five (5) calendar years or until such time that the business no longer operates or qualifies as a qualified tourism business, whichever is the first to occur.

(b) The administrator of the Tourism Zone may grant permitted incentives to a qualified tourism business.

(c) A performance agreement may provide for the qualified tourism business to be exempt for a period of up to 10 years from any City ordinances, except ordinances or provisions of ordinances adopted pursuant to the requirements of the Chesapeake Bay Preservation Act (§ 62.1-44.15:67 et seq.), the Erosion and Sediment Control Law (§ 62.1-44.15:51 et seq.), or the Virginia Stormwater Management Act (§ 62.1-44.15:24 et seq.). Any exemption from a subdivision or zoning ordinance requirement shall be accomplished through an ordinance amendment.

(d) At such time as the City has by ordinance established a tourism plan and a tourism project to

meet a deficiency identified in the adopted tourism plan approved by the Virginia Tourism Authority, and if the tourism project has been certified by the State Comptroller as qualifying for the entitlement to tax revenues authorized by Virginia Code §§ 58.1-3851.1 or 58.1-3851.2, the City may make gap financing available as provided by Virginia law.

Sec. 110-375. Eligibility Requirements. (a) A business seeking the benefit of Tourism Zone incentives must be a qualified tourism

business and either located or to be located within the boundaries outlined in § 110-373.

(b) The entitlement to any incentive authorized by this article is conditioned upon the applicant paying any tax imposed by the City, including but not limited to business license taxes, business personal property, meals, transient occupancy, and admissions taxes by the date upon which the tax is due. In the event a business is 30 or more days delinquent on any local tax, such business forfeits any entitlement to any incentive authorized by this article.

Sec. 110-376. Procedure for tax exemption.

The administrator shall develop, subject to approval by the City Manager, an application form to implement the terms of this article. No incentive application shall be approved until the Treasurer makes a determination that no other unpaid taxes are outstanding. Once an incentive application has been approved and the business certified by the administrator as a qualified tourism business, the business and the City may execute a performance agreement and the business shall thereafter be entitled to the exemptions created by this article.

Sec. 110-377. Compliance.

(a) Failure of the qualified tourism business to pay in full by the due date any taxes imposed by the City shall result in the loss of the exemption for the remainder of the current year upon a finding by the administrator that such delinquency is significant. The administrator shall withdraw qualified tourism business status for any business that is not compliant with any ordinance, regulation, or other legal requirement pertaining to that business upon a finding by the administrator that such noncompliance is significant.

(b) Failure of the business to remain a qualified tourism business shall result in the loss of the exemption for the remainder of the current year. In that event, the qualified tourism business shall repay, within 30 days, to the City of Manassas the full amount of revenue that would have been generated through the full tax rate as specified in the performance agreement. If a business ceases to be a qualified tourism business during a year in which rebates or exemptions apply, the tax exemption shall apply only to those months the business was a qualified business.

(c) If this section conflicts with any gap financing agreement with the City, then the gap financing agreement controls to the extent of the conflict.
