A Special Meeting of the Council of the City of Manassas, Virginia, for the purpose of conducting a work session, was held in the second floor conference room at City Hall, on the above date with the following present on roll call: Mayor Harry J. Parrish II, Vice Mayor Sheryl L. Bass, Council Members Marc T. Aveni, Ian T. Lovejoy, Pamela J. Sebesky, and Mark D. Wolfe; City Manager W. Patrick Pate, Deputy City Manager Bryan Foster, Assistant to the City Manager/City Clerk Andrea P. Madden, and City Attorney S. Craig Brown.

Mayor Parrish called the meeting to order at 5:35 p.m.

Council Member Ken D. Elston arrived at 5:45 p.m.

The City Clerk reported that the news media had been notified of the meeting in accordance with the Freedom of Information Act.

1) Work Session

1.1 Discussion: Request for Code and Policy Changes- Meeting Minutes- Meeting Notifications- City Council Appointment Process- Process for Adding Agenda Items

Meeting Minutes

Council Member Elston stated that the minutes do not include adequate discussion or an explanation for why decisions are made and it is important that any consensus of the body be captured. Council Member Elston proposed that the minutes summarize the group’s discussion for each item, outline the main points of view, and capture individual “talking points.”

Council Member Sebesky agreed that a more accurate record of the dialogue and considerations would be helpful when future Councils are making decisions.

Council Member Aveni stated that he is concerned staff will be over-burdened and there will be many disagreements and reiterations of minutes as Council Members try to get their specific point(s) included. It was noted that City Council meetings, and now work sessions, are recorded and the video can be viewed by those interested in the complete conversation.

Vice Mayor Bass stated that more robust minutes, similar to the Planning Commission minutes, would be helpful in the future when decisions are being made and suggested that bullet points be used to highlights key points and comments.

Ms. Madden stated that minutes are the record of action and it can be challenging to determine what comments or thoughts are significant to each member of the City Council and should be included as part of the minutes.

Council Member Lovejoy stated that capturing the video and audio from work sessions will assist in capturing the conversations of Council and noted that the last time members of Council got involved in crafting minutes, it left a bad taste in his mouth. The current form of the minutes was a conscious decision of the Council and with searchable and archived video, there is less need for the written minutes to be expanded.

Council Member Aveni recommended that Council Members make a statement prior to speaking if they want their comments to be noted in the minutes. For example, a Council Member may state, “Let the record reflect that I am not in support of this action.”

Council Member Elston suggested that specific points be summarized, including verbal reports of the Council, agreements on issues made amongst Council, any expected further action, and questions of the Council with corresponding answers and/or responses.

Mr. Pate pointed out that the Planning Commission meets once a month, however, City Council typically meets three times a month and may meet five or six times during the budget season. Additionally, there are ad hoc committees that must be staffed and all documentation must be prepared and maintained.

Council Member Wolfe suggested that staff research transcription service options and report back to the City Council with costs, to include preparation and storage. Council Member Wolfe stated that Planning Commission discussions tend to be very linear with little controversy; conversations of the City Council, however, are often more circular, at best, and can be very charged.

Council Member Lovejoy supported researching the costs associated with using some type of transcription service and stated that whatever model or format is agreed upon, staff should not be asked to interpret the thoughts or ideas of Council Members. If a member would like something specific to appear in the minutes, he or she can make that clear with a statement indicating such.

Council Member Aveni asked for clarification on what the City Council would approve if transcripts are drafted.

Ms. Madden stated that staff would continue to draft action and summary minutes with the transcripts attached, which would then be approved by Council.

Council Member Aveni commented that he has no issue with how minutes are currently prepared, he is not interested in over-burdening staff, but if a member of Council would like a statement or some agreement noted in the minutes, he has no objection to that.

Vice Mayor Bass stated that she would be interested in learning more about the transcription process and suggested it might be useful in a work session setting, but not necessary for City Council’s regular meetings.

Mayor Parrish questioned why the City would consider transcription service when it already has a video recording of the meeting that includes the entire conversation and suggested the spending of tax dollars on this might be wasteful.

Council Member Sebesky stated that she is also interested in exploring options for transcription and noted that those with hearing impairments may find transcriptions and/or closed captioning helpful.

Council Member Elston stated that his request was for reports, questions and answers, key agreements, and follow-up actions to be included in the minutes.

Ms. Madden stated that she will research options for transcription services and report back to City Council at a future meeting.

Meeting Notifications

Council Member Elston requested that a policy be drafted that would require sufficient notice be given and a report for the record be provided if a member or members of City Council meet with citizens and City staff is present to provide information. Council Member Elston mentioned that the Code of Conduct, signed by all members of Council and the Mayor, prohibits the use of public resources, including City staff time, equipment, supplies, or facilities, which are not available to the public in general, for private gain or personal purposes. A recent meeting of citizens and neighbors on Sandy Court with Mayor Parrish, Council Members Aveni and Lovejoy, and Deputy City Manager Bryan Foster, was specifically discussed. Council Member Elston stated that this gathering should have been noticed, particularly because staff was invited.

Council Member Wolfe stated that he understands Council Member Elston’s position on the matter and suggested that an internal policy be developed to alert the full Council if staff will interact with the public and any member of the Council. Council Member Wolfe asked for clarification on whether or not the meeting on Sandy Court would have been classified as a social event.

Mr. Brown stated that the meeting on Sandy Court to discuss the Micron Pond was not a social gathering, but was not technically a meeting of the Council. Mr. Brown stated that the Council discussing two different issues; one is the concept of a “meeting” and the other is the role of staff in formulating a process or policy that is a corollary to the Freedom of Information Act.

Council Member Sebesky stated that the Council previously discussed and agreed that staff would not be invited to attend meetings with citizens unless the meeting was announced. Council Member Sebesky stated that City staff is public resource that should not be used independently and that is why she was upset when she learned of the meeting on Sandy Court.

Mr. Pate stated that City staff has not violated any open meeting laws and is aware of the legal requirements that must be met when calling a meeting. Mr. Pate explained that he became aware of the Sandy Court meeting two days prior and there was no request by any member of Council for staff to attend the meeting. The day before the meeting on Sandy Court, Mr. Pate asked Mr. Foster to attend the meeting and attempt to answer the questions that would be posed by citizens.

Council Member Lovejoy commented that a few months ago, citizens living near the intersection of Grant and Portner Avenue met at City Hall with Mayor Parrish, Vice Mayor Bass, and Mr. Pate to discuss traffic concerns. This particular meeting was not noticed and members of Council and were not aware of the meeting taking place. Council Member Lovejoy stated that this particular meeting was no different than the meeting that occurred on Sandy Court. Council Member Lovejoy stated that he applauds the efforts of Council to meet with citizens and resolve issues and never thought that the meeting was inappropriate or political in nature.

Council Member Elston stated that the issue before the Council is not about scheduling or limiting citizens’ access to Council, but it is about communicating and doing a better job at being transparent.

Mayor Parrish stated that he has no objections to sharing the details of meetings with citizens to the full Council.

Council Member Aveni supported a brief report from Council Members following any meeting they may have with members of the community and commended Council Member Wolfe’s handling of the Sandy Court meeting. Council Member Aveni read the following tenet from the City Council’s Code of Conduct:

5. The professional and personal conduct of the City Council must be above reproach and avoid even the appearance of impropriety. Members shall refrain from abusive conduct, personal charges, or verbal attacks upon the character or motives of other members of the City Council, City staff, or the public.

Council Member Bass read the tenet regarding the confidentiality of Closed Meeting conversations and stated that she is aware that details and discussions from closed meetings have been shared with citizens.

Council Member Wolfe was excused from the meeting at 7:36 p.m.

Council Member Elston stated that what he is suggesting is that any gathering that includes Council Members, staff, and citizens, it be clarified who will attend. Nobody should show up if it is clear that the gathering is not an open meeting. Following such a meeting, a report should be provided to the Council.

Council Member Lovejoy stated that the resolution to this issue could simply be a report back to Council if a meeting with citizens is held but does not believe that the notification process is necessary as it may create complications and limit flexibility.

Mr. Pate reiterated that staff makes every effort to keep all members of Council informed of events and conversations.

City Council Appointment Process

Council Member Elston stated that he would like a formal process for creating committees and suggested that Council Members rotate on and off the various committees and boards. Council Member Elston stated that the Council should have a conversation prior to the Organizational Meeting to discuss who would be most interested and able to serve.

Mr. Brown discussed the current appointment process detailed in the City Code and in the Charter and presented background information on how appointments have traditionally been made.

Council Member Lovejoy stated that he believes the Mayor should continue to make appointments following a conversation with the members of Council, and ultimately approved by the City Council.

Vice Mayor Bass suggested that the position of Vice Mayor be rotated, which removes some of the political maneuvering.

Mr. Brown recommended an ordinance be drafted to amend the Code and establish a process for appointments; staff will prepare and bring back such an ordinance to the City Council for review and eventual consideration.

Process for Adding Agenda Items

Mr. Pate reviewed with the City Council various processes used by other localities for adding items to a City Council agenda. A discussion regarding the difference between action items and discussion items occurred.

The appropriate role of Council Committees in bringing forward items to the full Council was discussed with a note that some discussions do not neatly fit at a committee meeting and it may need to be scheduled for a work session.

Council Member Sebesky commented that it would be helpful for new members of Council to clearly understand the process for bringing forward items to the Council.

City Council directed staff to prepare and bring forward a policy that will establish the process for bringing forward discussion and action items on an agenda.

1.2 Discussion: 2019 Manassas City Council Meeting Calendar

Staff reviewed the 2019 City Council Meeting Calendar and discussed options for the Organizational Meeting and the Spring Town Hall Meeting. City Council requested that staff schedule the Organizational Meeting for Wednesday, January 2 at 5:30 p.m. and the SpringTown Hall Meeting for Monday, March 18 at 7:00 p.m.

A motion was duly made, seconded and CARRIED UNANIMOUSLY to adjourn the meeting.

Mayor Parrish declared the meeting adjourned at 8:58 p.m.

P R O C L A M A T I O N

WHEREAS, the Manassas City/Manassas Park Crime Solvers, Inc. (Crime Solvers), founded in September 1984, is a collaborative effort among local citizens, business partners, law enforcement officials, and the media; and

WHEREAS, Crime Solvers is a non-profit, charitable, Federally tax-exempt, Virginia Corporation that provides anonymous means for citizens to assist law enforcement agencies in solving crimes; and

WHEREAS, Crime Solvers allows tipsters to remain anonymous by providing them with code numbers to identify themselves rather than requiring the use of their names, and encourages citizens to provide tips that could be vital to solving crimes by paying cash rewards up to $1,000.00; and

WHEREAS, Crime Solvers receives no funding from tax dollars and is wholly funded by donations from private citizens, corporations, civic and social groups, and professional associations; and

WHEREAS, Crime Solvers is managed by a dedicated volunteer Board of Directors who give of themselves to raise the funds to pay rewards and operate the program; and

WHEREAS, Crime Solvers provides an anonymous telephone tip line, a social media presence, an Internet web page and two electronic platforms that are available 24 hours a day, seven days a week, 365 days a year to provide information relating to any criminal activity that is investigated by law enforcement; and

WHEREAS, Crime Solvers provides multi-lingual services in order to reach an increasingly diverse population; and

WHEREAS, over the past thirty-one years, thousands of tips have been received since Crime Solvers’ inception, resulting in numerous crimes being solved; a substantial amount of stolen property being recovered; large amounts of illegal drugs being recovered; and thousands of rewards being issued; and

WHEREAS, this exemplary crime-fighting program has had an extremely positive effect in the fight against crime in the Cities of Manassas and Manassas Park.

NOW THEREFORE, I, Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby recognize October as

Crime Solvers Monthin the City of Manassas and urge all citizens to provide information relating to any criminal activity to Crime Solvers through the anonymous telephone tip line or the electronic platform.

P R O C L A M A T I O N

WHEREAS, Veterans Day, formerly known and celebrated as Armistice Day, was first observed on November 11, 1954, when President Dwight D. Eisenhower requested that the day be set aside to “solemnly remember the sacrifices of all those who fought so valiantly on the seas, in the air, and on foreign shores, to preserve our heritage of freedom;” and

WHEREAS, on Veterans Day we come together to pay tribute, not only to the men and women who have so valiantly risked their lives to preserve the liberty of our Nation as members of the Armed Forces, but also to those unsung heroes who have served in the military and continue to serve as our first responders as police, rescue and firefighters and emergency medical technicians; and

WHEREAS, these dedicated heroes continue to risk their own safety to protect us and they are the first and best defense against all emergencies that threaten our communities; and

WHEREAS, on Veterans Day, November 11th, we have an opportunity to not only honor those who have answered the call when asked to protect and defend our Nation and its Allies, but also those unsung brave heroes who continue to answer the call as a first responder after their military career is at an end; and

WHEREAS, on November 3rd the Greater Manassas Veterans Day Parade will be held honoring the American Legion’s 100th Anniversary.

Project Narrative Manassas Regional Airport

1. Construct New Taxiway G and Taxilane Y (Design thru Bidding) This project will consist of the construction of a new Taxiway G and Taxilane Y, both serving the south east corporate pad site and allowing for a circular flow of aircraft traffic on and off of Taxiway B. This project includes new pavement, stormwater management facilities, drainage, signs, edge lights and striping.

Introduction

The City of Manassas Architectural Review Board has established procedures to review and process applications for Certificate of Appropriateness pursuant to Section 130-405 of the Code of Manassas and suggest regulations and boundary lines adjustment of existing and proposed Historic Overlay Districts in accordance with Section 130-402 of the Code of Manassas. This report details the actions reviewed by the Architectural Review Board in FY18 reporting period (July 1, 2017 to June 30, 2018) and outlines some actions to be undertaken in FY19.

Responsibilities

The Architectural Review Board offers advice to property owners and tenants on questions of historical preservation and restoration. The Board shall also cooperate with and enlist assistance from the Virginia Department of Historic Resources and the City Council to promote and preserve the historic structures within the overlay districts. The duties and responsibilities of the Architectural Review Board include:

• Issue or deny Certificate of Appropriateness for construction, reconstruction, substantial exterior alteration, and demolition or relocation within the Historic Overlay District.

• Assist and advise the City Council, the Planning Commission, other City departments and agencies, property owners and individuals in matters involving historic resources.

• Review and propose additional areas or structures to be included in or removed from an HOD or designated as a Historic Landmark.

• From time to time conduct, or cause to be conducted, a survey of historic resources. • Upon request of the City Council, Planning Commission, or interested citizens, conduct

studies deemed necessary to consider additional historic overlay districts, and means of preservation and utilization of historic assets in the City.

• Develop, adopt, and from time to time modify design guidelines for the City’s historic overlay districts, to be considered by the ARB in granting or denying Certificates of Appropriateness.

• Cooperate with, and enlist assistance from, the Virginia Department of Historic Resources, the National Trust for Historic Preservation, and other interested parties, both public and private, in its effort to preserve, restore, and conserve historic sites, landmarks, buildings, and structures within the City.

Activities The Architectural Review Board's focus in FY18 was consistency with its decisions on all applications in accordance with the Historic District Design Guidelines and to preserve and

protect the community’s history and historic structures. During the period of this report, the Board held twelve (12) regular meetings and two (2) worksessions. The case activity is as follows: In total, 35 applications were received in FY18 and 3 applications were carried over from FY17.

• 33 cases came before the Board for action o 12 were approved as submitted o 1 case was partially approved as submitted o 20 were approved with modifications

• 2 cases were withdrawn • 3 cases carried over to FY19

In the 20 cases that were approved with modifications, the Board diligently worked to meet the needs of the applicants under the Historic District Design Guidelines. While the majority of the applications that came before the Board continue to be for signs and minor structure modifications, the Board did review and approve several larger projects, including the proposed conversions of two structures to accommodate future restaurant spaces, the conversion of a historic church/meeting space into offices, and three single family home expansions. As directed by the City Council’s Land Use Committee in FY17, the Board prepared and submitted a report evaluating the creation of an additional historic district at Annaburg Manor (9201 Maple Street). In the report submitted to City Council, the Board recommended the creation of a Historic Overlay District. Finally, City Council may recall the properties located at 9512 and 9514 Liberty Street which was appealed to Council in 2016 after the Board denied a certificate of appropriateness for the demolition of these structures. With the change in ownership of these properties, the Board was able to approve applications for the renovation of these structures, as well as neighboring 9510 Liberty Street, which also came before the Board in FY18.

A Look Ahead In conclusion, the Board extends its appreciation to the Council for its continued support in the preservation of the City’s historic districts and looks forward to a successful year in FY19. The Board remains committed to exercising its jurisdiction on all matters related to application of the guidelines in the Historic District. Through our mutual efforts, a distinctive appearance is sustained in the three historic districts which instills a personal pride within our residents and has a positive impact on tourism and commercial interest.

Board Members Biographies

WILLIAM S. RUSH, CHAIRMAN TERM EXPIRES: JUNE 30, 2018 Mr. Rush was first appointed to the ARB in 2002. He was Vice-Chairman and later Chairman before his wife was assigned out of the Country. Upon their return, he again volunteered for and was appointed to the ARB in July 2014. He has resided in the City of Manassas since 2005 and has worked in the City since 1985. As a licensed architect, Mr. Rush was Vice-President of the design department for Gregory Construction Company for more than twenty years. He now has a private practice working primarily with automobile dealerships in this area. Mr. Rush and his wife are active in the Bull Run Unitarian Universalist Church in Historic Manassas. JAN ALTEN, Vice-Chair TERM EXPIRES: JUNE 30, 2021 Mrs. Alten was appointed to the ARB as an alternate member in February 2016 and was appointed as a regular member in early 2017. She has been a resident of the City of Manassas since June 1977. She has long been involved with the City as a volunteer in several organizations and on City citizen committees looking for ways to improve the quality of life in Manassas. In 2015, Mrs. Alten retired and closed her successful business, The Opera House Gourmet, located in Historic Manassas. She served as judge for the Virginia Governor’s Cup Wine Awards and the Eastern Seaboard Wine Competition for several years. The Opera House Gourmet won state-wide recognition twice when it was chosen as Virginia Wine Retailer of the Year. Mrs. Alten is currently on the Board of Directors at the Center for the Arts at the Candy Factory, The Manassas Ballet Theatre, and is a member of Manassas Historic Landmarks Preservation and the Old Town Business Association. In retirement, Mrs. Alten is a certified yoga teacher and a volunteer usher and supporter of the Hylton Performing Arts Center. DEBBIE HAIGHT, VICE-CHAIR TERM EXPIRES: JUNE 30, 2018 Ms. Haight was first appointed to the ARB in 2012 as an alternate member and was appointed as a regular member in 2015. She has been a resident of Manassas for over 50 years. She is married with two children and five grandchildren. She is Executive Director and CEO of Historic Manassas, Inc. and has been in this position since 2009. Ms. Haight is also a board member and department treasurer for the Occoquan-Woodbridge-Lorton Volunteer Fire Department.

NANCY HERSCH INGRAM TERM EXPIRES: JUNE 30, 2021 Mrs. Ingram was first appointed to the ARB upon its formation in 1987 and initially served until 1991, during which time she served as Vice-Chairman. She was reappointed to the ARB in 2004 and has served as a member continuously since then. During her initial tenure, she participated in the preparation of the Manassas Historic District Handbook, published in 1990, which formalized

guidelines for the rehabilitation of structures and the design of new construction in Manassas historic districts. A Master’s Degree in Fine Arts from American University, Washington D.C., informs her lifelong interest in architecture. She has directed the restoration of numerous historic properties in Virginia and elsewhere in the United States and consulted on major historic estates in the U.S. and Europe. In Manassas, her historic C.E. Nash House (1905) was the first structure in the City to be restored in accordance with the Secretary of the Interior’s Standards for the Treatment of Historic Properties. The property was saved from demolition and restored in 1982, prior to the establishment of the ARB. With a lifelong commitment to the City, preserving its unique and historic sense of place remains a primary and ongoing interest of Ms. Hersch Ingram. FATIMA PEREIRA-SHEPHERD TERM EXPIRES: JUNE 30, 2018 Mrs. Pereira-Shepherd was appointed to the ARB in 2009. She has been a resident of Manassas for over 39 years and has served in many volunteer positions throughout the community. She has been a licensed Realtor® in Virginia since 2004 and received her broker’s license in 2010. She started her career with a competing local brokerage before joining Long & Foster in May 2011. At Long & Foster, Ms. Pereira-Shepherd excelled not only in real estate sales; she earned the position of sales manager at the company’s Manassas office in August 2012. She then was given the additional responsibility of sales manager at Long & Foster’s Gainesville office in June 2014. She was named as the managing broker of the Annandale office in March 2015. Ms. Pereira-Shepherd is a member of the Realtors® Association of Prince William (PWAR) and has served on its Board of Directors since 2011. She currently holds the position of vice president for the PWAR board, and she belongs to several of the association’s committees. She has also held several leadership positions on the local and state level of the Women’s Council of Realtors from 2010 to 2013. Ms. Pereira-Shepherd currently serves on several committees with the Virginia Association of Realtors and other charity organizations, and she was selected into the 2015 Virginia Leadership Academy. MYRA BUCHANAN BRENT TERM EXPIRES: JUNE 30, 2021 Mrs. Myra B. Brent was appointed to the ARB in 2017 as an alternate member. She was born and raised in the City of Manassas and has resided in the City for fifty-two years. Mrs. Brent has served in many public service positions including: Chief Election Official, City of Manassas, and Prince William County; Board of Directors/Lay Member, Blue Cross and Blue Shield of Virginia; Board Member/First Vice Chair, American Red Cross Prince William County Chapter; Board of Directors, Jubilee Association of Maryland Inc.; Board of Directors/Historian, Hammond Institute of Music and Fine Arts; and Board of Directors, Hammond Scholarship Foundation. She worked for IBM for 25 years as a Personnel Administrator, Employee Relations Advisor, Manager of Employee Data and Records, and HR Advisor, retiring in 1993. She worked for American Express as an Assistant to the Director of Field Service Operations and as a Field Office Administrator from 1993 to 1996.

She worked at Lockheed Martin as a Staff Administrator retiring in 2002, and worked for NeighborCare

Long Term Care Pharmacy until March 2005. Mrs. Brent is a Jennie Dean High School graduate and

attended Franklin School of Science and Arts, Philadelphia, Pa., and Sherwood Institute, where

she studied Medical Terminology and Physiology. She is a licensed Pharmacy Technician and a

Certified Pharmacy Technician (CPhT). Mrs. Brent is retired, and she and her husband, Robert,

have enjoyed fifty-two years together and have two children.

Introduction

The Code of Virginia § 15.2-2308(c) and Section 130-525 of the City of Manassas Code of Ordinances requires that the Board of Zoning Appeals submit an annual report of their actions. In accordance with these requirements, the following report has been prepared for your benefit.

Authority

The Board of Zoning Appeals of the City of Manassas is a quasi-judicial body established and mandated by Title 15.2 of the Code of Virginia. The Board Members are appointed by the Chief Judge of the 31st Judicial Circuit Court upon recommendation of City Council and serve a five-year term at the pleasure of the Court.

Mission

The Board of Zoning Appeals is charged with a specific limited mission as defined under § 15.2-2308 of the Code of Virginia. The Board may hear and decide appeals from any order, requirement, decision, or determination made by an administrative officer in the administration or enforcement of those items covered under the City of Manassas Zoning Ordinance.

In addition to this review authority, the Board may grant certain variances from requirements of the City of Manassas Zoning Ordinance, provided strict application of the zoning ordinance would unreasonably restrict the utilization of the property or that the granting of the variance would alleviate a hardship, as narrowly defined under § 15.2-2309 of the Code of Virginia.

The Board endeavors to discharge all matters before it in a manner consistent with this mission and authority.

Activities

In the period of this report (July 1, 2017 to June 30, 2018), two cases came before the BZA (See BZA Case Report). The BZA heard two cases. The Board reversed the denial of a zoning modification and approved a maximum driveway width of 30-feet wide for a new home at 9038 Sudley Road and approved a variance for new front steps as part of the rehabilitation of the home at 9514 Liberty Street.

Coordination and Staff Support

There continues to be outstanding cooperation among the Board Members and the Zoning Administrator. Cooperation of this nature results in timely exchange of necessary information and well-prepared and well-executed staff reports, memoranda, and orders. The Board is appreciative of the Clerk to the BZA and expressly wants to commend her for her thorough and well-prepared minutes and service to the Board.

Member Profiles

ROBERT W. SCHILPP, CHAIRMAN TERM EXPIRES: APRIL 22, 2019

Mr. Schilpp has been a resident of Manassas for over 30 years and has served his community as a member of the Bethel Lutheran Church Council and as president of the congregation; as a long-time youth soccer coach; and as a member of several Manassas City School committees. Mr. Schilpp, who also serves on the Planning Commission, has been a member of the Board of Zoning Appeals since 2003 and has chaired the board for the past nine years. He retired from the Department of Defense following 34 years of service, and worked as a Defense contractor for a number of years before becoming an adjunct professor of history at Northern Virginia Community College. He holds a bachelor’s degree in history from Susquehanna University and a master’s degree in history from George Mason University. He completed the Virginia Certified Boards of Zoning Appeals Program in the fall of 2002.

JAMES T. NEJFELT, VICE-CHAIRMAN TERM EXPIRES: APRIL 4, 2023

Mr. Nejfelt was first appointed to the BZA in 2005 as an alternate member and became a full member later that year. He has resided in the City of Manassas since 1983 in the Point of Woods neighborhood, and is active in his church. Mr. Nejfelt formerly practiced law and now owns Acreage Title. His legal background and business experience gives him a familiarity with land use issues. He completed the Virginia Certified Board of Zoning Appeals program in 2007.

ROBERT L. FOX, SECRETARY TERM EXPIRES: APRIL 25, 2021

Mr. Fox was first appointed to the BZA in 2008 as an alternate member and was appointed to regular membership in 2011. He has resided in the City for over 20 years in the Wellington neighborhood. He works for the U.S. Army Corps of Engineers on military construction projects. Mr. Fox is a registered Professional Civil Engineer and a certified Project Management Professional. His background and experience in land development design/construction projects give him a strong working knowledge of land use and community issues. He completed the Virginia Certified Boards of Zoning Appeals Program in 2014.

JAMES J. FLETCHER TERM EXPIRES: MAY 15, 2019

Dr. Fletcher was first appointed to the BZA in 2011 as an alternate member. In March 2014, Dr. Fletcher was appointed to fill the regular membership position. He has resided in the City since 1974 in the Point of Woods neighborhood, and served the City as an election official. He is Professor Emeritus of Philosophy at George Mason University, where he was also Associate Provost and Dean for Undergraduate Studies. Dr. Fletcher sits on the Institutional Review Board for a biotechnology company and has served as a member of data and safety monitoring boards for the National Institutes of Health.

JOHN SCANCELLA TERM EXPIRES: MAY 19, 2022

Mr. Scancella was appointed to the BZA in 2017 as an alternate member. He moved to Manassas in 2015 and is presently employed with the DMD in Alexandria. He has also worked at the Library of Congress as an Information Technology Specialist and at Boeing as a Programmer. In 2010, Mr. Scancella received his bachelor’s degree from Franciscan University of Steubenville with a major in Computer Science and a minor in Mathematics. He loves spending time with his wife and two sons. His hobbies are blacksmithing, woodworking and cooking Italian food.

MICHAEL GRIFFIN TERM EXPIRES: OCTOBER 23, 2022

Mr. Griffin was appointed to the BZA in 2017 as an alternate member. He has been a resident of Manassas for 65 years. He graduated from Osbourn High School in 1971. He retired from Prince William Hospital in 2013 after 40 years of dedicated service. He loves sports and has coached various youth and adult teams. He is a member of Mount Olive Baptist Church in Centerville, Virginia. Mr. Griffin is married to Linda who works for Manassas City Public Schools. He enjoys spending time with his wife, their children and grandchildren. After five years of relaxing and enjoying retirement, he is now employed part-time at Walmart.

Introduction

The City of Manassas Planning Commission fulfills the appointed duty of advising the City Council on new development, land use, zoning issues, Capital Improvement Program (CIP) recommendations, and planning issues in the City. This report details the land use actions reviewed by the Planning Commission in FY18 reporting period (July 1, 2017 to June 30, 2018) and outlines actions identified for FY19.

Responsibilities

The Planning Commission serves in an important advisory capacity to the City Council as required by Sec. 15.2-2210 of the Code of Virginia. The Planning Commission exists “to promote the orderly development of such political subdivision and its environs.” The duties and responsibilities of the Commission as set forth in the State Code include:

• Making recommendations and an annual report concerning the operation of the Commission and status of planning within the City.

• Preparing, publishing, and distributing reports, ordinances, and other material relating to its activities.

• Preparing a Comprehensive Plan for the physical development of the territory within its jurisdiction.

• Reviewing and approving new public facilities. • Reviewing and making recommendations on Special Use Permit and Rezoning applications.

Activities

The Planning Commission met eight (8) times to act on land use cases, including special use permits and rezoning requests. The Planning Commission acted on nine (9) special use permit cases recommending approval for:

• A columbarium in conjunction with an existing funeral home. • A modification to support the construction of the final two phases of a natural gas fueling

station. • A small-cell telecommunications antenna on a replacement parking lot light pole. • A place of assembly for a fraternity organization (Kena Shriners). • A place of assembly for an indoor play gym located in a shopping center. • A home business to allow customer pickup of firearms. • A hazardous material storage yard for the distribution and bulk storage of propane as a part of a

propane and ice distribution operation. • A child care center. • A limited medical care facility for diagnostic or outpatient care, or for the performance of

surgical or other medical procedures.

Comprehensive Plan Annual Implementation Report

The Planning Commission is charged with preparation of the City’s Comprehensive Plan and monitors the progress of implementation of the Plan’s recommendations. The Planning Commission and the Department of Community Development supported several significant projects recommended in the Plan and began preparations for the 2018 Comprehensive Plan Update:

• Completed a public facility consistency review of a new site for Fire and Rescue Station 21 on Dumfries Road.

• Completed the Downtown South Housing Study for neighborhoods located south of Prince William Street along Grant Avenue, Wellington Road, and Fairview Avenue. The study identified neighborhood conditions and tools for conservation, rehabilitation, and redevelopment.

• Supported redevelopment goals of Sector Plans by adopting streetscape standards for Mathis Avenue, developing a concept plan for a roundabout at Centreville Road and Sudley Road as recommended by the Mathis sector plan, and finalizing a streetscape design plan for Grant Avenue.

• Completed preliminary public engagement to inform the priorities and direction for the 2018 Comprehensive Plan update. The outreach effort, Community Conversations Phase 1, is summarized at www.manassascity.org/conversations.

• Began the official public engagement process for the 2018 Comprehensive Plan update by hosting the Comprehensive Plan Kickoff & Community Conversation on Land Use on June 19, 2018. Community Conversations Phase II continued into FY19.

A Look Ahead

The Planning Commission’s FY19 work plan will focus on updating the City’s Comprehensive Plan. The official public engagement process, Community Conversations Phase II, will consist of a series of topic-specific meetings hosted by City Boards, Commissions, and Committees. In addition, staff will be available to meet with HOAs and the general public at various pop-up events throughout the City. A

public engagement website, www.letstalkmanassas.org, is available for those who cannot attend a meeting in person. A summary of the update process and upcoming meetings is available at www.manassascity.org/planmanassas As part of the Comprehensive Plan update, the City also initiated a Transportation Master Plan and Comprehensive Housing Study. These efforts will provide valuable background information and include recommended goals for the Planning Commission to consider as it updates the Comprehensive Plan.

Commissioner Biographies

HARRY J. CLARK

Mr. Clark has been a resident of Manassas for over 27 years. During that time, he has been active in promoting and supporting recreation and sports in Manassas. He graduated from Georgetown University in 1972 with a degree in Economics and entered active duty in the Army, retiring in 1994. He has been active with the Stonewall Park Summer Recreational Swim Team, holding a position on the Board for the past 16 years. Mr. Clark is also an active supporter of the Osbourn High School Swim Team. He served as a member and Chairman of the Manassas City Recreation and Parks Committee before being appointed to the Planning Commission and currently serves as a member of the Freedom Aquatic and Fitness Center Advisory Board. The Manassas City Council appointed Mr. Clark to serve on the Manassas Regional Airport Commission. He holds a Master of Science Degrees in Business Administration from Boston University and Information Systems from Strayer University. Mr. Clark is a graduate of the Virginia Certified Planning Commissioner’s Program.

Mr. Harrison and his family have been residents of Manassas since 2002. In addition to the Planning Commission, he served as Chair of the Manassas Electoral Board from 2014 until May 2017, and was a member of the Board, which oversees elections in Manassas, for six years. He also volunteers as a CCD teacher for All Saints Church. Professionally, Mr. Harrison is the Director of Government Relations for the IEEE, the world's largest technical professional society and leading technology standards association. He holds a Bachelors Degree in Political Science from Allegheny College, a Masters in Public Policy from the University of Maryland and is a Certified Association Executive through the ASAE. Mr. Harrison is a certified Virginia Planning Commissioner.

KEN JOHNSON

Mr. Johnson and his family have lived in Manassas for over 37 years. He has served the community in a variety of ways--as a scout leader, soccer coach, president of the Osbourn High School 2B Band Boosters Club, member and Chair of the City's Recreation and Parks Committee, and as Vice Chairman of the Manassas Traffic Safety Commission. He also served on the Citizen’s Advisory Committee for the Downtown Sector Plan, led the Bike Trail Committee, and is Chairman of the Zoning Ordinance Review Committee. Mr. Johnson retired from the Federal government after 32 years of service and is now a contractor consultant. He holds Masters Degrees in Economics and Information Resource Management and is a graduate of the Virginia Certified Planning Commissioner's Program.

ROBERT SCHILPP

Mr. Schilpp has been a resident of Manassas for over 32 years. He has served in a variety of capacities during that time, including as a member of the Bethel Lutheran Church Council for 14 years, and president of the congregation for six of those years; coaching youth soccer for 20 years; and participating on several Manassas City School committees. In addition to the Planning Commission, Mr. Schilpp has been a member of the Board of Zoning Appeals since 2003 and has chaired the board for the past ten years. He retired from the Department of Defense in 2002, following 34 years of service, and then worked as a defense contractor for a number of years before becoming an adjunct professor of history at Northern Virginia Community College. He graduated from Susquehanna University in Pennsylvania with a degree in history in 1968, and received a Masters Degree, also in history, from George Mason University in 1997. Mr. Schilpp is a certified Virginia Planning Commissioner.

BILL THOMPSON

Mr. Thompson has been a resident of Manassas for over 25 years. During that time, he has been an advocate for strong citizen input on development issues affecting the quality of life in Manassas neighborhoods. He graduated from Western Kentucky University with a degree in Mass Communications and served as a rotary wing aviator in the Army, National Guard and Reserves for 20 years. Mr. Thompson retired from his positions as Senior Director of Business Operations for the National Education Association in Washington D.C., Director of NEA Properties, Inc. and Trustee of the Indiana Education Association in 2015. During his working career, Mr. Thompson managed the construction and operations of buildings that won awards from the Building Owners and Managers Association (BOMA) for design and achieved Leadership in Energy and Environmental Design (LEED) Gold Certification for energy efficient maintenance and operations. Mr. Thompson is a graduate of the Virginia Certified Planning Commissioner’s Program.

ELAINE TRAUTWEIN

Ms. Trautwein has lived in Manassas for over 22 years. She established her own law practice shortly after moving to the City with her two children. She has been active in her community and profession and has previously served as a director of the Prince William County Bar Association. Ms. Trautwein is certified by the Virginia Supreme Court as a guardian ad litem for children and has represented their best interests before local courts for many years. Prior to her appointment to the Planning Commission, she was involved as a citizen participant in the preparation of the Manassas Next 2032 Comprehensive Plan. She holds a Bachelor’s Degree in Urban Affairs from Virginia Tech and graduated with honors from George Washington University Law School. Ms. Trautwein is a certified Virginia Planning Commissioner.

RE: SUP #2018-2010: Dean Drive Telecommunication Tower

On October 15, 2018, the Manassas City Council held a public hearing for SUP #2018-2010, Dean Drive Telecommunication Tower. During that meeting, Council members requested additional information regarding revenue generation and lighting requirements for the proposed structure. The following information is provided in response to these questions.

Revenue Generation

The proposed telecommunication tower at Dean Drive is subject to the Telecommunications Marketing Master Agreement between the City of Manassas and Milestone Communications. Under this agreement, rent and fees associated with each site are as follows:

A one-time site fee of $25,000 and collocation fees of $5,000 for each additional carrier. Estimated annual rental revenue of $12,000 per year. Each additional carrier that

collocates on the tower (maximum of 5) will generate additional rental revenue for the City.

Lighting Requirements

At the proposed height of 140 feet, the Dean Drive telecommunication tower exceeds Federal Aviation Administration (FAA) airspace obstruction standards by 30 feet. In a letter dated June 12, 2018, the FAA stated “if the structure were reduced in height so as not to exceed 110 feet above ground level (369 feet above mean sea level), it would not create a substantial adverse effect and a favorable determination could subsequently be issued.”

While reducing the height may eliminate the need for mitigation such as lighting, the lower height would not meet the carrier’s coverage objectives and fill existing coverage gaps in the surrounding business/residential communities. As noted in the staff report, the City has received multiple requests for improved cellular service in this part of the City, including from the Wellington neighborhood area.

WHEREAS, Milestone Communications has applied for a special use permit, pursuant to §130-241 of the Manassas City Zoning Ordinance to permit a 140-foottelecommunications structure at the Manassas Water Tank facility at 9723 Dean Drive; and

WHEREAS, the Community Development staff has reviewed the application and RECOMMENDS APPROVAL subject to specific conditions; and

WHEREAS, the City of Manassas Planning Commission held a public hearing on September 5, 2018, after full compliance with all state code public hearing notice and posting requirements and RECOMMENDS APPROVAL subject to specific conditions; and

WHEREAS, the Manassas City Council held a public hearing on October 15, 2018, after full compliance with all state code public hearing notice and posting requirements; and

WHEREAS, among the purposes of zoning called out in Chapter 15.2-2283 of the Code of Virginia is “to facilitate the creation of convenient, attractive, and harmonious community”; and

WHEREAS, among the matters to be considered in drawing and applying zoning ordinances and districts called out in Chapter 15.2-2284 of the Code of Virginia is “the suitability of property for various uses”; and

WHEREAS, the City Council upon careful consideration finds that approval of SUP #2018-2010 is justified by public necessity and convenience and general welfare, and is consistent with reasonable zoning practices, and that the cumulative effect of the activity proposed will not be detrimental to the character and development of the adjacent land, and is in reasonable harmony with the City’s land use plan and policies; and

WHEREAS, the City Council finds that a comprehensive list of conditions and safeguards can eliminate or mitigate the negative impacts of the proposed height modification sufficiently to justify approval.

NOW, THEREFORE, BE IT RESOLVED that the Manassas City Council does hereby APPROVE SUP #2018-2010 in regular session this 22nd Day of October 2018, subject to the conditions listed on the attached pages.

In addition to compliance with all applicable zoning, subdivision, and Design & Construction Standards Manual (DCSM) requirements, the development and use of the designated property shall be subject to the following conditions:

1. This special use permit is for a Telecommunication Tower.

2. The site, subject to final engineering, shall be developed and operated in substantial conformance with the Generalized Development Plan (the “GDP”) entitled “City of Manassas Water Tank 9723 Dean Drive Manassas, VA 20110”sheets Z-1, Z-2, and Z-3, prepared by Entrex Communication Services, Inc. and dated August 2, 2018.

3. The design of the tower, subject to minor modifications for final engineering, shall be in substantial conformance to the elevation on GDP sheet Z-4 entitled “Monopole Elevation”, by Entrex Communication Services, Inc. and dated August 2, 2018.

4. The height of the telecommunication tower, including antennas and lightning protection, shall not exceed 140 feet.

5. No wall signage or freestanding signage shall be permitted on any structure, including the tower, equipment shelters, or fencing.

6. The marking/lighting of the tower shall be in accordance with the requirements of the Federal Aviation Administration (FAA) determination dated August 17, 2018.

7. Prior to building permit approval, applicant shall provide a letter from a qualified engineer certifying that the monopole design is such that, should it fail, it will collapse in certain direction to eliminate any risk of striking either the water tank or other structures.

8. Approval of this SUP shall not preclude the City of Manassas from making site modifications or improvements to the subject property, including but not limited to, the construction of an elevated water tank(s) regardless of potential impact to the proposed telecommunications tower or interference with the telecommunications signals.

1. This special use permit is for a public utility, telecommunication tower.

2. Special Use Permit #2019-01 shall replace and supersede Special Use Permit #2015-02.

3. The site, subject to final engineering, shall be developed and operated in substantial conformance with the Generalized Development Plan (the “GDP”) entitled “Site Plan” and “Enlarged Site Plan and Details”, sheets Z-1 and Z-2, prepared by Entrex Communication Services, Inc. and dated November 11, 2014 as modified for tower height by the GDP entitled “Site Plan” and “Compound Plan”, sheets Z-1 and Z-2, prepared by NB+C Engineering Services, LLC and dated September 14, 2018.

4. The height of the telecommunication tower shall not exceed 125 feet.

5. The design of the tower, subject to minor modifications for final engineering, shall be a monopine, tree pole design in substantial conformance to the elevation on sheet Z-3 entitled “Elevation”, by NB+C Engineering Services, LLC and dated September 14, 2018.

6. Landscaping shall be in substantial conformance with the GDP. All new trees shall be a minimum of 4.5-inch caliper at the time of planting.

7. No wall signage or freestanding signage shall be permitted on any structure, including the tower, equipment shelters, or fencing.

8. The applicant’s site plan shall include a security plan for the site approved by the Police Department. The plan shall include measures to enhance surveillance of the site, such as motion activated security lighting within the compound. All items on the approved security plan shall be installed or implemented prior to the issuance of the certificate of use/occupancy permit.

9. A copy of the conditions for this special use permit shall be included with any lease agreements and with any permit application submitted to the City of Manassas.

10. The use of this property shall be in compliance with all federal, state, and local ordinances.

Virginia law requires the advertisement and acceptance of bids because the term of the franchise exceeds 5 years (it is for 40 years). A public hearing on the granting of the franchise is also required by law.

Columbia Gas of Virginia, Inc. is installing a new 12-inch gas transmission main in the City in order to increase its capacity to serve gas customers in Manassas and neighboring areas. There are two proposed new easements –one across the property on Dumfries Road that is the site of new Fire Station 521, and one across property at the end of Central Park Drive that is the site of the City’s temporary holding pond that serves Micron Inc. There is also the relocation of an existing gas line and easement across the front corner of the Fire Station 521 property that is required in order to construct the new facility. By granting these new easements at no cost to Columbia Gas, the City will avoid the cost of relocating the existing gas line as Columbia will relocate the line at their expense.

AN ORDINANCE GRANTING PERMANENT NATURAL GAS PIPELINE EASEMENTS TO COLUMBIA GAS OF VIRGINIA, INC. ON CITY PROPERTY

LOCATED AT 10224, 10228 and 10316 DUMFRIES ROAD AND AT 10310 CENTRAL PARK DRIVE / 9911 GODWIN DRIVE

WHEREAS, Columbia Gas of Virginia, Inc. (“Columbia”) has requested a 50’ wide natural gas pipeline easement across City-owned property identified as 10224, 10228 and 10316 Dumfries Road; and,

WHEREAS, Columbia has also requested a 20’ wide natural gas pipeline easement and a 50’ by 50’ exclusive easement on City-owned property identified as 10310 Central Park Drive and 9991 Godwin Drive; and,

WHEREAS, these easements will allow Columbia to replace aging and undersized pipes and infrastructure, so that it can continue to safely deliver reliable natural gas service to its customers; and,

WHEREAS, the above-referenced property on Dumfries Road is the site where the City will construct and operate a new City of Manassas Fire Station; and,

WHEREAS, the construction of the Dumfries Road Fire Station will require Columbia to relocate an existing gas pipeline that crosses the property; and,

WHEREAS, Columbia has expressed a willingness to relocate the existing natural gas pipeline at no cost to the City, provided that the City grant the easements requested by Columbia at no cost to Columbia; and,

WHEREAS, pursuant to Virginia Code §15.2-1800 an advertised public hearing on the granting of the requested easements to Columbia was held before the Manassas City Council on Monday, October 22, 2018 to provide the public with an opportunity to comment on the granting of the requested easements; and,

WHEREAS, the granting of the easements as described herein and as recommended by City staff appears to be in the best interests of the City of Manassas.

NOW, THEREFORE, BE IT ORDAINED by the Council for the City of Manassas, Virginia, that the natural gas pipeline easements as requested by Columbia Gas of Virginia, Inc., and as are necessary to relocate existing infrastructure to facilitate the construction of the Dumfries Road Fire Station, all as shown in the approximate locations on the attached plats, are hereby approved. The City Manager is authorized to execute the Deeds of Easement on behalf of the City, in form approved by the City Attorney.
