Dear Mr. Gaita:
As you know, we have provided you with the records which you requested under FOIA.
We have also examined all available files regarding the Student Activity Fund (SAF) and
the Class of 92. Our analysis of this information reveals that the Class of 1992 accounthad a balance of $9,741.68 as of June 30, 1998, and a balance of $0 as of July 31,1999.
It is our position that the Class of 92 account was closed at some point between June
30, 1999 and July 31, 1999, and that the remaining balance was transferred to the SAFgeneral account at Henry Abbott. It is also our position that this practice is permissiblein light of the procedures outlined below:
July 29, 1986 ProceduresThe procedures from this period of time state that If any account remains inactive for a
period of one year after the purposes for which the account were set up have beensatisfied, the account will be closed and the balance transferred to the Miscellaneous
Account. Inactive accounts will be reviewed periodically and appropriate action taken.
This includes class account balances.
Under the fund raising section, the procedures state Commencing with the class of
1989, classes may raise funds only for graduation expenses, yearbook, and class trip.Balances in class accounts remaining after all class activities have been paid will revert
to the Student Government miscellaneous account.
December 6, 1990 ProceduresAs cited in the Office of Internal Audits report dated April 4, 2012 regarding the Henry
Abbott Student Trustee Account, the revised procedures state Commencing with theclass of 1989, balances in class accounts remaining after all class activities have beenpaid may revert back to the Student Council account. Funds which are in class accounts
may not be transferred to the custody of class officers. The school Director mustmaintain custodial obligation over these funds. If there are no specific instructions leftin the class minutes regarding use of the funds and a class account has had no activity
for a year and it is certain that all encumbrances have been paid, then the funds willrevert back to the student activity associations general fund and the account is closed.

To date, you have not produced class of 92 minutes that provide specific instructionsregarding use of the funds. Therefore, in light of the above procedures,we are notpermitted to issue any further disbursements to the Class of 92.
We also recognize that you do not accept our position. The Connecticut Technical High
school System (CTHSS) is operated by the Connecticut State Board of Education and is
an administrative unit within the State of Connecticut. If you wish to pursue a claimagainst the CTHSS, the claim must be made to the Office of the Claim Commissioner.To file a claim, directions and necessary forms may be obtained directly from the Office.
The claimant may call 860-566-2024, or go to the website
www.occ.ct.gov/director.aspx. In order to prevail with the Claim Commissioner theinjured party generally must establish that the claim has merit.
