The provisions of this by-law apply to any campground constructed or established after the adoption of this by-law and to any additional construction on an existing campground and to any a1 teration to the layout of an existing campground. 2. Where the construction or layout of an existing campground does not conform to the provisions of this by-law no person may carry out additional construction or make an alteration to the layout of the campground if the effect of such construction or alteration i s likely to aggravate the non- conformity. 3. This by-law does not apply to campgrounds licensed under the Community Care F a c i l i t y Act. C. DEFINITIONS In this by-1 aw, unless the context otherwise requires, "approval" means approval i n writing; "buffer area" means the buffer area described in Part IV Section B; "~ampground'~ means an area o f land that has been designed and intended for the temporary placement of recreational vehicles and/or tents to accommodate the travelling public; "camping space" means an area i n a campground used f o r one trailer or tent; "dependent trailer" means a trailer other than an independent trail er;

PART I - INTERPRETATION AND APPLICATION

A. TITLE

B. APPLICATION

1. 3. This by-law does n o t apply t o campgrounds l i censed under the Community Care F a c i l i t y Act.

C. DEFINITIONS

I n t h i s by-1 aw, unless the con tex t o therwise requ i res ,

"approval" means approval i n w r i t i n g ;

" b u f f e r area" means t h e b u f f e r area descr ibed i n P a r t I V Sect ion B;

"~ampground'~ means an area o f l and t h a t has been designed and in tended f o r the temporary placement o f r e c r e a t i o n a l veh ic les and/or t e n t s t o accommodate the t r a v e l l i n g p u b l i c ;

"camping space" means an area i n a campground used f o r one t r a i l e r o r t e n t ;

"dependent t r a i l e r " means a t r a i l e r o t h e r than an independent t r a i l er;

"independent t r a i l e r n means a t r a i l e r equipped w i t h a water c l o s e t and a p lace f o r washing; wastes from bo th o f which may be disposed o f d i r e c t l y i n t o a sewage d isposal system through a d r a i n connect ion;

"Medical Heal th O f f i c e r " means the Medical Heal th O f f i c e r appointed under t h e Hea l th Ac t f o r the t e r r i t o r i a l j u r i s d i c t i o n of t h e area i n which a campground i s located;

"owner1' means an owner, agent, l essor , o r manager o f , o r any person who operates a campground;

"sa fe water" means water which i s approved f o r d r i n k i n g purposes by the Medical Heal th O f f i c e r ;

" p r i v y " means an approved b u i l d i n g over an approved s a n i t a r y e a r t h p i t f o r the r e c e i v i n g and d isposal by decomposition o f human excrement, and inc ludes a l a t r i n e ;

"roadway" means road w i t h i n a campground p a r t o r a l l o f which i s made s u i t a b l e f o r normal v e h i c u l a r use f o r access t o a b u t t i n g camping spaces and o ther f a c i l i t i e s ;

" s e r v i c e b u i l d i n g " means a b u i l d i n g , o ther than a p r i v y , housing t o i l e t o r ba th ing f a c i l i t i e s o r such o ther s a n i t a t i o n f a c i l i t i e s as a re requ i red by t h i s by-law;

"sewage d isposal s t a t i o n " means a p lace where t r a i l e r sewage- s torage tanks may be emptied and f lushed;

" t r a i l e r " means any veh ic le , coach, house-car, o r conveyance, designed t o t r a v e l on the highways, cons t ruc ted o r equipped t o be used as temporary l i v i n g o r s leep ing quar te rs by t r a v e l l e r s .

D. PROHIBITIONS

1. No person may c o n s t r u c t o r l a y o u t a campground o r any p a r t o f a campground w i t h o u t be ing i n possession o f a v a l i d and s u b s i s t i n g permi t f o r t h a t purpose issued pursuant t o t h e p r o v i s i o n s o f t h i s by-law.

2. No person may c o n s t r u c t o r l a y o u t a campground o r p a r t o f a campground i n a manner n o t au thor i zed o r i n a manner p r o h i b i t e d by the p r o v i s i o n s o f t h i s by-law.

E. SEVERABILITY

I f any sect ion, subsect ion, sentence, clause, o r phrase o f t h i s by-law i s f o r any reason h e l d t o be i n v a l i d by t h e dec is ion o f any c o u r t o f competent j u r i s d i c t i o n , such dec is ion s h a l l n o t a f f e c t the v a l i d i t y o f t h e remaining p o r t i o n s o f t h i s by-law.

PART I 1 - ADMINISTRATION, APPROVAL AND PERMIT

A. ADMINISTRATION

1. An o f f i c e r appointed by the Board o f D i r e c t o r s o f the Dewdney-Alouette Regional D i s t r i c t s h a l l admin is ter the p r o v i s i o n s o f t h i s by-law.

2. The o f f i ce r appointed under subsection 1 may enter any campground a t a l l reasonable times fo r the purpose of administering or enforcing the provisions of t h i s by-law.

B . PERMIT REQUIRED

1. No person shall construct , a1 t e r , extend or expand a campground until written approval i s received and permit i s issued by the o f f i ce r appointed under Part 11, Section A, subsection 1.

2. Written approval and permit under subsection 1 shall not be given until a sewage disposal permit has been issued and the water supply system and garbage disposal method has been approved under a1 1 re1 evant 1 egi s l at ion which m a y include: the Health Act; Waste Management Act; and Water Act.

C . APPLICATION, APPROVAL AND PERMIT

1. All applications for campground approval and permit shall be made in writing t o the off icer appointed under Par t 11, Section A, subsection 1 and shall contain:

( a ) the name and address of the applicant;

( b ) a general description of the location of the land and a fu l l legal description of the land on which the proposed campground i s t o be established, constructed, a l tered or extended; and

( c ) two ful l s e t s of working drawings to sca le showing:

( i ) the area, dimensions and legal description of the parcel ( s l of 1 and;

( i i the dimensions and location of the buffer area required under Part IVY Section B;

( i i i ) the number, location, dimensions, and designa- t ion of a l l camping spaces; and location and dimensions of a l l roadways, the owner's residential plot ( i f any), common recreation areas and storage area ( i f any);

( i v ) the location of service buildings, any sewage disposal s ta t ion , or any other proposed structures;

( v ) the internal layouts of a l l service anci l lary buildings and other s t ructures , apart from the owner's residence;

( v i l the location and de ta i l s of the source of water, treatment plants, water d is t r ibut ion 1 ines and out1 e t s ;

( v i i ) the location and d e t a i l s of a l l connections to the sewer, sewer l ines , sept ic tank(s.1 and sub- surface disposal f i e l d , or other private sewage treatment plants and disposal methods;

( v i i i the location of storm drains and catch basins;

( i x ) the location and de ta i l s of a l l on-site garbage and refuse disposal areas;

( x ) a north arrow and notation of the scales used;

( x i ) a genera1 landscaping plan fo r the s i t e ;

I x i i ) a l l water courses or water frontage within or adjacent to the proposed campground;

( x i i i ) a l l steep banks or slopes within or adjacent to the land concerned; and

(x iv) the relat ionship of the proposed campground t o adjacent roadslhighways.

2. The off icer appointed under Part 11, Section A, subsection 1 may require the appl icant to provide additional re1 evant information, including but not limited to topographic and soil condition data.

D. FEES

Each application for a campground permit submitted shall be accompanied by an application fee of two hundred dollars for the f i r s t f i f t y camping spaces and four dollars fo r each additional camping space shown in the campground plan.

E . APPROVAL AND PERMIT

1. The off icer appointed under Part 11, Section A, subsection 1 shall examine each application fo r a campground permit and shall notify the applicant i n writing within s ix ty calendar days e i the r tha t the permit i s issued or tha t i t i s refused.

2. I f a campground permit i s refused, the o f f i ce r appointed under Part 11, Section A, subsection 1 shall notify the applicant i n writing of the reasons fo r refusal .

3 . A campground permit shall permit the establishment of a campground, on the land concerned, but only i n compliance with the approved campground plan and the conditions of the permit.

4. I f the holder of the permit does not commence the construction permitted by the permit within one year of the date of the permit issued, the permit lapses.

PART 111 - GENERAL PROVISIONS

A . OTHER REGULATIONS

1. Every campground shall comply with:

( a ) the plumbing, e lec t r ica l and building by-1 aws and regulations i n force;

( b ) a l l regulations made pursuant to the Fire Services Act; and

( c ) a l l regulations made pursuant t o the Forest Act re la t ing to f i r e protection and other matters.

2. Nothing i n t h i s by-law shall rel ieve the owners of a campground from the responsibil i ty t o seek out and comply w i t h enactments applicable.

B . BUILDING PERMIT

No person shall commence or continue any work re la ted to building in a campground, unless he has a valid and subsist ing permit from the Building Inspector, pursuant to the Dewdney-Alouette Regional Di s t r i c t Building By-law No. 149-1978 and amendments thereto.

C . DRAINAGE

No person shall locate or extend a campground except on a s i t e tha t i s well drained and is a t a l l times f ree of stagnant pools.

PART IV - FACILITIES AND LAYOUT

A. CAMPING SPACES

Each camping space w i t h i n a campground shal l :

( a ) have a m i n i m u m area of 84 m2 and be c lear ly ident i f ied by a number or similar designation;

( b ) accommodate only one t r a i l e r or t en t ;

( c ) be no closer than 3 m to a roadway; and

( d l have one conveniently located parking space adjacent t o the roadway, a l l or part of which may be within the setback required under clause ( c ) .

B. BUFFER AREA

1. A campground shall have immediately w i t h i n i t s boundaries a buffer area of 7.6 m w i t h i n which no parking, garbage disposal areas, pr iv ies or recreati onal areas, except fo r waterfront recreation, shall be permitted.

2. The only roadways permitted i n the buffer area except fo r exist ing roadways are those which cross i t as close to r igh t angles as practicable and connect d i rec t ly w i t h the roadway system contained within the remainder of the campground.

C . RECREATION AREA

1. A campground shall have open space fo r playground, park, sports , games and similar recreational areas to serve the campground in the amount of not l e s s than 5 per cent of the area of the campground.

2. The recreation areas shall not include buffer areas, parking areas, ancil lary buildings, camping spaces, driveways and storage areas.

0. SIGNS

Subject to the Motor Vehicle Act and Highway Act, an ident i f ica- t ion sign to a maximum height of 2 m above ground and to a maximum area of 3 m2 may be located a t the principal entrance to the campground.

E . OWNER'S RESIDENCE AND OFFICE SPACE

Within a campground a dwelling unit including o f f i ce space may be provided for the accommodation of the owner or operator of the campground. The minimum s i t e area fo r such f a c i l i t y shall be 1 670 m2.

F. RETAIL FACILITIES

A r e t a i l f a c i l i t y for the purpose of se l l ing groceries, camping supplies and souvenirs i s permitted to serve the campground provided the maximum f loor area does not exceed the provisions prescribed below.

( a ) The maximum r e t a i l f loor area ~ e r m i t t e d within a . . camp round with 50 or l e s s camping spaces shall be 2 25 m .

(b) The maximum r e t a i l f loor area permitted within a camp round with 51 or more camping spaces shall be ! 25 m plus 0.3 m2 for each camping space i n excess of 50 up to a maximum f loor area of 50 m2.

G. ACCESS

1. A t l e a s t one highway access shall be provided to a campground containing eighty or l e s s camping spaces.

2, A second access from a public highway, separated by a t l e a s t 50 m from the f i r s t access, shall be provided to each campground containing 81 or more camping spaces, except where an exist ing campground i s located a t the end of a pub1 i c highway and the associated l o t has l e s s than 50 m of highway frontage.

Within 50 m of the campground entrance or off ice there shall be provided customer's parking/holding area in an amount of 18 m* for each 10 camping spaces up to a maximum of 140 m2.

I . ROADWAYS

1. Access to and from a campground shall have a m i n i m u m roadway width of 13 m and a minimum hard surfaced or gravelled width of 6.7 m. No parking shall be allowed on the access roadway.

2. All camping spaces, owner's or operator 's residence, service buildings as well as other f a c i l i t i e s where access i s required shall have access by an internal roadway system.

3. Roadways giving access to and from camping spaces shall have a minimum roadway width of 6.7 m and a m i n i m u m hard surfaced or gravel led width of 4 .3 m.

4 . Roadways i n a campground shall be well drained, and maintained in such a manner as to render them free from dust a t a l l times.

5. Dead end roadways and cul-de-sacs shall have a turning c i r c l e a t the end with a radius of a t l e a s t 12 m.

PART V - SERVICE FACILITIES AND BUILDINGS

A. WATER SUPPLY

The owner of a campground shall provide a water supply system to furnish a constant supply of safe water i n compliance with the Health Act.

B. SEWAGE DISPOSAL

1. The owner of a campground shall provide fo r a disposal of a l l waste water and of a l l human excretion generated w i t h i n the campground by causing a l l sewage and waste water to be discharged into a public sewer or into a private sewage disposal system in compliance w i t h the Health Act or Waste Management Act.

2 . The owner shall obtain the appropriate sewage disposal permits i n accordance w i t h the Health Act and/or Waste Management Act.

3. I f there i s not su f f i c i en t supply of water to operate flush t o i l e t s , privies and/or a1 ternative methods of 1 iquid waste disposal may be permitted in accordance w i t h the Sewage Disposal Regulations, under the Health Act.

4. Where water and sewer systems are available, each camping space intended fo r use by an independent t r a i l e r shall be provided w i th a t l e a s t a 76.2 mm sewer connection. The sewer conection shall be provided w i t h a su i table f i t t i n g so t h a t a water t i g h t connection can be made between the t r a i l e r drain and the sewer connection. The connection shall be so constructed tha t i t can be closed when not linked to a t r a i l e r , t o prevent the escape of odours.

C. FACILITIES AND SERVICES

1. Where sewer and water systems are ins ta l led , the campground shall be provided w i t h a t l e a s t one service building equipped w i t h flush type f ix tures and other sanitary f a c i l i t i e s as prescribed below and as applied to camping spaces fo r t en t s and dependent t r a i l e r s only.

For each campground having more than 100 t e n t and dependent t r a i l e r camping spaces, the re s h a l l be prov ided i n a d d i t i o n t o the number o f f l u s h type f i x t u r e s and o ther s a n i t a r y f a c i l i t i e s p resc r ibed i n subsect ion 1 above, one t o i l e t and washbasin, f o r each sex, f o r each a d d i t i o n a l 30 t e n t and dependent t r a i l e r camping spaces; one shower, f o r each sex, f o r each a d d i t i o n a l 40 t e n t and dependent t r a i l e r camping spaces; and one u r i n a l f o r men f o r each a d d i t i o n a l 100 t e n t and dependent t r a i l e r camping spaces.

3. Serv ice b u i l d i n g s s h a l l :

( a ) be loca ted a t l e a s t 4.5 m and n o t more than 150 m from any camping space; t h e 150 m d is tance s h a l l n o t apply t o an independent t r a i l e r camping space;

( b ) be o f permanent c o n s t r u c t i o n and be i l l u m i n a t e d by t h e f o l l o w i n g minimum 1 i g h t i n t e n s i t i e s :

( i ) i n t e r i o r passageways: 5 f o o t candles (54.18 1x1;

( i i 1 enclosed areas f o r p u b l i c use: 30 f o o t candles (322.6 1x1; and

( i i i ) outdoor areas exposed t o the n i g h t sky and l o c a t e d w i t h i n 5 m o f t h e se rv ice b u i l d i n g e x t e r i o r w a l l s : 2 f o o t candles (21.5 1x1;

(c) have wal ls , f l o o r s and p a r t i t i o n s t h a t can be e a s i l y cleaned and w i l l n o t be damaged by f requen t hosing, w e t t i n g o r d i s i n f e c t i n g ;

( d l have a l l rooms we l l v e n t i l a t e d , w i t h a l l openings e f f e c t i v e l y screened; and

( e l p rov ide separate compartments f o r each bathtub o r shower and t o i l e t and a t i g h t p a r t i t i o n t o separate those f a c i l i t i e s designated f o r males and females.

4. Laundry f a c i l i t i e s may be prov ided and s h a l l be i n a separate room o f a se rv ice b u i l d i n g o r i n a separate b u i l d i n g .

D. SEWAGE DISPOSAL STATION

1. Where a campground con ta ins camping spaces f o r use by t r a i l e r s , t h e owner s h a l l , except where p r i v i e s are p e r m i t t e d o r s u f f i c i e n t sewer connect ions a re a v a i l a b l e i n accordance w i t h P a r t V, Sect ion B, subsect ion 4, p r o v i d e a t r a i l e r sewage d isposal s t a t i o n f o r the purpose o f r e c e i v i n g the contents o f t r a i l e r sewage storage tank.

2 . T r a i l e r sewage d isposal s t a t i o n s s h a l l be l o c a t e d i n an area a p a r t from any roadway and ou t o f which a t r a i l e r may be e a s i l y and conven ien t l y moved.

3. T r a i l e r sewage d isposal s t a t i o n s s h a l l be cons t ruc ted i n accordance w i t h t h e design shown i n Schedule "A" t o t h i s by-law.

E. PRIVIES

Where p r i v i e s are permi t ted, a1 1 p r i v y b u i l d i n g s s h a l l be s u b j e c t t o t h e requirements o f t h e Sewage Disposal Regulat ions under the Heal th A c t and s h a l l be so const ructed and mainta ined so t h a t :

( a ) f l i e s , insects , r a t s , o r small domestic animals do n o t have access t o the waste mate r ia l s ;

( b ) the sur face o r ground water cannot e n t e r the p i t o r v a u l t ; and

( c ) i t i s no c l o s e r t o any camping space o r b u i l d i n g than 15 m.

F. GARBAGE DISPOSAL

1. The owner o f a campground s h a l l dispose o r arrange f o r d isposal o f garbage o r refuse.

2. The owner o f a campground s h a l l :

( a ) p rov ide one con ta iner f o r each f i v e campsites; l o c a t e each con ta iner a maximum d is tance o f 30 m from each campsite; and ensure t h a t each c o n t a i n e r i s durable, f l y t i g h t , water t i g h t and rodent p roo f f o r t h e d isposal o f a l l garbage;

( b ) ma in ta in the con ta iners so t h a t they s h a l l n o t become f o u l smell ing, uns igh t l y , o r a breeding p lace f o r f l i e s ; and

( c ) be responsib le f o r ensur ing t h a t no person s h a l l dispose o f garbage, waste, o r re fuse except i n accordance w i t h t h e arrangements made f o r the campground.
