CONVENTION ON THE PREVENTION AND PUNISHMENT OF THE CRIME OF GENOCIDE

THE CONTRACTING PARTIES,

HAVING CONSIDERED the declaration made bythe General Assembly of the United Nations inits resolution 96 (I) dated 11 December 1946that genocide is a crime under international law,contrary to the spirit and aims of the UnitedNations and condemned by the civilized world;

RECOGNIZING that at all periods of historygenocide has inflicted great losses on humanity;and

BEING CONVINCED that, in order to liberatemankind from such an odious scourge, inter-national co-operation is required,

HEREBY AGREE AS HEREINAFTER PROVIDED:

ARTICLE I

The Contracting Parties confirm that genocide,whether committed in time of peace or in time ofwar, is a crime under international law whichthey undertake to prevent and to punish.

ARTICLE II

ID the present Convention, genocide meansany of the following acts committed with intentto destroy, in whole or in part, a national, ethni-cal, racial or religious group, as such:

(a) Killing members of the group;(6) Causing serious bodily or mental harm

to members of the group;(c) Deliberately inflicting on the group con-

ditions of life calculated to bring aboutits physical destruction in whole or inpart;

(d) Imposing measures intended to preventbirths within the group;

(e) Forcibly transferring children of thegroup to another group.

ARTICLE III

The following acts shall be punishable:(a) Genocide;(6) Conspiracy to commit genocide;

(c) Direct and public incitement to commitgenocide;

(<f) Attempt to commit genocide;(e) Complicity in genocide.

ARTICLE IV

Persons committing genocide or any of theother acts enumerated in article III shall be pun-ished, whether they are constitutionally respon-sible rulen, public officials or private individuals.

ARTICLE V

The Contracting Parties undertake to enact, inaccordance with their respective Constitutions,the necessary legislation to give effect to the pro-visions of the present Convention and, in particu-lar, to provide effective penalties for personsguilty of genocide or of any of the other actsenumerated in article III.

ARTICLE VI

Persons charged with genocide or any of theother acts enumerated in article III shall be triedby a competent tribunal of the State in the terri-tory of which the act was committed, or by suchinternational penal tribunal as may have juris-diction with respect to those Contracting Partieswhich shall have accepted its jurisdiction.

ARTICLE VII

Genocide and the other acts enumerated inarticle III shall not be considered as politicalcrimes for the purpose of extradition.

The Contracting Parties pledge themselves insuch cases to grant extradition in accordancewith their laws and treaties in force.

ARTICLE VIII

Any Contracting Party may call upon thecompetent organs of the United Nations to takesuch action under the Charter of the UnitedNations as they consider appropriate for the pre-

vention anil suppression of acts of genocide orany of the other acts enumerated in article III.

Disputes between the Contracting Parties re-lating to the interpretation, application or fulfil-ment of the present Convention, including thoserelating to the responsibility of a State for geno-cide or for any of the other acts enumerated inarticle III, shall be submitted to the InternationalCourt of Justice at the request of any of theparties to the dispute.

ARTICLE X

The present Convention, of which the Chinese,English, French, Russian and Spanish texts areequally authentic, shall hear the date of 9 De-cember 1948.

ARTICLE XI

The present Convention shall be open until31 December 1949 for signature on behalf ofany Member of the United Nations and of anynon-member State to which an invitation to signhas been addressed by the General Assembly.

The present Convention shall be ratified, andthe instruments of ratification shall be depositedwith the Secretary-General of the United Nations.

After 1 January 1950 the present Conventionmay be acceded to on behalf of any Member ofthe United Nations and of any non-member Statewhich has received an invitation as aforesaid.

Instruments of accession shall be depositedwith the Secretary-General of the United Nations.

ARTICLE XII

Any Contracting Party may at any time, bynotification addressed to the Secretary-Generalof the United Nations, extend the application ofthe present Convention to all or any of the ter-ritories for the conduct of whose foreign relationsthat Contracting Party is responsible.

ARTICLE XIU

On the day when the first twenty instrumentsof ratification or accession have been deposited,the Secretary-General shall draw up a proces-verbal and transmit a copy thereof to each Mem-ber of the United Nations and to each of thenon-member States contemplated in article XI.

The present Convention shall come into forceon the ninetieth day following the date of depositof the twentieth instrument of ratification oraccession.

Any ratification or accession effected subse-quent to the latter date shall become effective onthe ninetieth day following the deposit of theinstrument of ratification or accession.

ABTICLE XIV

The present Convention shall remain in effectfor a period of ten years as from the date of itscoming into force.

It shall thereafter remain in force for succes-sive periods of five years for such ContractingParties as have not denounced it at least sixmonths before the expiration of the currentperiod.

Denunciation shall he effected by a writtennotification addressed to the Secretary-Generalof the United Nations.

ABTICLE XV

If, as a result of denunciations, the number ofParties to the present Convention should becomeless than sixteen, the Convention shall cease tobe in force as from the date on which the last ofthese denunciations shall become effective.

ARTICLE XVI

A request for the revision of the present Con-vention may be made at any time by any Con-tracting Party by means of a notification inwriting addressed to the Secretary-General.

The General Assembly shall decide upon thesteps, if any, to be taken in respect of suchrequest.

ARTICLE XVII

Trie Secretary-General of the United Nationsshall notify all Members of the United Nationsand the non-member States contemplated in arti-cle XI of the following:

(a) Signatures, ratifications and accessionsreceived in accordance with article XI;

(6) Notifications received in accordance witharticle XII;

(c) The date upon which the present Con-vention comes into force in accordancewith article XIII;

(d) Denunciations received in accordancewith article XTV;

(e) The abrogation of the Convention in ac-cordance with article XV;

(/) Notifications received in accordance witharticle XVI.

ARTICLE XVIII

The original of the present Convention shallbe deposited in the archives of the UnitedNations.

A certified copy of the Convention shall betransmitted to each Member of the United Nationsand to each of the non-member States contem-plated in article XL

ARTICLE XIX

The present Convention shall be registeredby the Secretary-General of the United Nationson the date of its coming into force.

CONVENTION POUR LA PREVENTION ET LA REPRESSION DU CRIME DE GENOCIDE

LES PARTIES CONTBACTANTES,

CONSIDERANT que l'Asscmblee generale de1'Organisation des Nations Unies, par sa resolu-tion 96 (I) en date du 11 dewmbre 1946, adeclare que le genocide ett tin crime du droit desgens, en contradiction avec I'esprit et les fins desNations Unies et que le monde civilise condamne;

RECONNAISSAHT qu'a toutes les periodes del'histoire le genocide a inflige de grandes pertesa l'humanite;

CONVAIHCUES que, pour liberer l'humanited'un fleau aussi odieux, la cooperation Interna-tionale est necessaire;

COHVIENNENT DE CE QUI SUIT:

ARTICLE PREMIER

Les Parties contractantes confirment que legenocide, qu'il soit commis en temps de paix ouen temps de guerre, est un crime du droit desgens, qu'elles s'engagent a prevenir et a punir.

ARTICLE II

Dans la presente Convention, le genocides'entend de l'un quelconque des actes ci-apres,commis dans 1'intention de detruire, en tout ouen partie, un groupe national, ethnique, racialou religieux, comme tel:

a) Meurtre de membres du groupe;6) Atteinte grave a Fintegrite physique ou

men tale de membres du groupe;c) Soumission intentionnelle du groupe a des

conditions d'existence devant entrainer sadestruction physique totale ou partielle;

d) Mesures visant a entraver les naissanceaausein du groupe;

e) Transfer! force d'enfanta du groupe a unautre groupe.

ARTICLE III

Seront punis les actes suivants:a) Le genocide;b) L'entente en vue de commettre le geno-

dde;

c) L'incitation direcle et publique a com-mettre le genocide;

<f) La tentative de genocide;e) La complicite dans le genocide.

ARTICLE IV

Les personnes ayant commis le genocide oul'un quelconque des autres actes enumeres al'article III seront punies, qu'elles soient desgouvernants, des fonctionnaires ou des particu-lien.

ARTICLE V

Les Parties contractantes s'engagent a pren-dre, ctmf ormemen t a leurs constitutions respec-tives, les mesures legislatives necessaires pourassurer l'application des dispositions de la pre-sente Convention, et notamment a prevoir dessanctions penales efficaces frappant les person-nes coupables de genocide ou de Tun quelconquedes autres actes enumeres a l'article III.

ARTICLE V!

Les personnes accusees de genocide ou de Tunquelconque des autres actes enumeres a l'articleIII seront traduites devant les tribunaux compe-tents de l'Etat sur le territoire duquel 1'acte a etecommis, ou devant la Cour criminelle intema-tionale qui sera competente a l'egard de cellesdes Parties contractantes qui en auront reconnuU juridiction.

ARTICLE VII

Le genocide et les autres actes enumeres aParticle III ne seront pas considered comme descrimes politiques pour ce qui est de 1'extradition.

Les Parties contractantes s'engagent en pareilcas a accorder 1'extradition conformement a leurlegislation et aux traites en vigueur.

ARTICLE VIII

Touie Partie contractante peut saisir les or-ganes competents des Nations Unies afin que

ceux-ci prcnnent, conformement a la Charte desNations Unies, les mesures qu'ils jugent appro-prices pour la prevention et la repression desactes de genocide ou d* Tun qoelconque des au-ties actes enumeres a l'article III.

ARTICLE IX

Les differends entre les Parties conlractantesrelatifs a interpretation, l'application ou 1'exe-cution de la presente Convention, y compris ceuxrelatifs a la responsabilite d'un Eiat en matierede genocide ou de Tun quelconque des autresactes enumeres a ]'article III, seront soumis a laCour Internationale, de Justice, a la requete d'unePartie au differend.

ARTICLE X

La presente Convention dont les textes anglais,cbinois, espagnol, francos et russe feront egale-ment foi, portera la date du 9 decembre 1948.

ARTICLE XI

La presente Convention sera ouverte jusqu'au31 decembre 1949 a la signature au nom de toutMembre des Nations Unies et de tout Etat nonmembre a qui TAssemblee generate aura adresseone invitation a cet effet.

La presente Convention sera ratifiee et les ins-truments de ratification seront deposes aupresdu Secretaire general des Nations Unies.

A partir du ler Janvier 1950, il pourra etreadhere a la presente Convention au nom de toutMembre des Nations Unies et de tout Etat nonmembre qui aura regu l'invitation susmentionnee.

Les instruments d'adhesion seront deposes au-pres du Secretaire general des Nations Unies.

ARTICLE XII

Toute Partie contractanta pourra, a tout mo-ment, par notification adressee au Secretairegeneral des Nations Unies, etendre 1'applicationde la presente Convention a tout les territoires

ou a l'un quelconque des territoires dont elledirige les relations exterieures.

ARTICLE XIII

Des le jour ou lea vingt premiers instrumentsde ratification ou d'adbesion anront etc deposes,le Secretaire general en dressera proces-verbal.II transmettra copie de ce proces-verbal a tous lesEtats Membres lies Nations Unies et aux non-membres vises par l'article XI.

La presente Convention entrera en vigueur lequatre-vingt-dixieme jour qui suivra la date dudepot du vingtieme instrument de ratification oud'adhesion.

Toute ratification ou adhesion effectuee ulte-rieurement a la derniere date prendra effet lequatre-vingt-dixiome jour qui suivra le depot del'mstrument de ratification ou d'adbesion.

AHTICLEXTV

La presente Convention aura tine duree de dixans a partir de la date de son entree en vigueur.

Elle restera par la suite en vigueur pour uneperiods de cinq ana et ainsi de suite, vis-a-vis desParties contractantes qui ne l'au tunt pas denonceesix mois au moins avant Inspiration du terme.

La denonuiation se fera par notification ecriteadressee au Secretaire general des Nations Unies.

ARTICLE XV

Si, par suite de denonciations, le nombre desParties a la presente Convention se trouve ra-raene a moins de seize, la Convention cesserad'etre en vigueur a partir de la date a laquelle laderniere de ces denonciations prendra effet.

ARTICLE XVI

Une demande de revision de la presente Con-vention pourra etre formulee en tout temps partoute Partie contractante, par voie de notifica-tion ecrite adressee au Secretaire general.

L'Assembler generate statuera sur les mesuresa prendre, s'il y a lieu, au sujet de cette demande.

ARTICLE XVII

Le Secretaire general des Nations Unies noti-fiera a tous los Etats Membres des Nations Unieset aux Etats non membrea vises par l'article XI:

a) Les signatures, ratifications et adhesionsrecues en application de l'article XI;

6) Les notifications recues en application del'article XII;

c) La date a laquelle la pr&ente Conventionentrera en vigueur, en application de l'ar-ticle XIII;

if) Let denunciations recues en application del'article XIV.

e) L'abrogation de la Convention, en appli-cation de l'article XV,

/) Les notifications recues en application derarticle XVI.

ARTICLE XVIII

L*original de la presente Convention sera de-pose aux archives de reorganisation des NationsUnto.

Une copie certifiee conforme sera adressee atous les Euts Membres des Nations Unies et auxEuts non membrea vises par Particle XI.

ARTICLE XIX

La presente Convention sera enregistree parle Secretaire general des Nations Unies a la datede son entree en vigueur.

CONVENCION PARA LA PREVENCION Y LA SANCION DEL DEL1TO DE GENOCIDIO

LAS PARTES CONTRATAHTES,

CONSIDERANDO que la Asamblea General deUs Naciones Unidas, por su Resolution 96 (I)del 11 de diciembre de 1946, ha declarado queel genocidio es un delito de derecho intemaeio-nal contrario al espiritu y a loa fines de las Na-ciones Unidas y que el mundo civilizado eondena;

RECONOCIENDO que en todos los perfodos dela historia el genocidio ha infligido grandes per-didas a la humanidad;

CONVENCIDAS de que para Bberar a la huma-nidad de un flagelo tan odioso se necesita lacooperacion international;

OONVIENEN EN LO SICUIENTE:

ARTICULO I

Las Partes contratantes eonfimian que el ge-nocidio, ya sea cometido en tiempo de paz o entiempo de guerra, es un delito de derecho inter-national que ellas se coinprometeu a prevenir ya sancionar.

AsricuLO II

En la presente Convention, se entiende porgenocidio cualquiera de los actos mencionadosa continuation, perpetrados con la intention dedettruir, total o parcialmente, a un grupo nacio-nal, etnico, racial, o religioso, conio tal:

a) Matanza de miembios del grupo;b) Lesion grave a la intcgridad fisica o men-

tal de los miembros del grupo;c) Somelimientointencional del grupo acon-

diciones de existeneia que liayan de aca-rrear su destruction fisica, total o parcial;

d) Medidas destinadas a iinpedir los naci-mientoa en el seno del grupo;

e) Traslado por fuerza de nifios del grupo aotro grupo.

ARTICULO III

Seran castigados los actos siguientes:a) El genocidio;b) La asociacion para cometer genocidio;c) La instigation directs y publics a cometer

genocidio;d") La tentativa de genocidio;

e) La complicidad en el genocidio.

ARTICULO IV

Las personas que liayan cometido genocidioo cualquiera de los otros actos enumerados en elarticulo III, seran casligadas, ya se irate de go-bemantes, funcionarios o particulares.

ARTICULO V

Las Partes contratantes se comprometen aadoptar, con arreglo a sus Constituciones respec-tivas, las medidas legislativas necesarias paraasegurar la aplicacion de las disposiciones de lapresente Convention, y esjiecialmente a estable-cer sanciones penales eftcaces para castigar a laspersonas culpables de genocidio o de cualquierolro de los actos enumerados en el articulo III.

AltTICULO VI

Las personas acusadas de genocidio o de unocualquiera de los actos enumerados en el articuloHI, seran juzgadas por un tribunal competent*del Estado en cuyo territorio el ucio fue cometi-do. o ante la corte pennl internacionnl que seacompetente respecto a aquellas de las Partes con-tratuntes que liayan reconocido su jurisdiction.

ARTICULO VII

A los efectos de extradicion, el genocidio y losotros actos enumerados en el articulo III no se-ran considerados como delitos poli'ticos.

Las Partes coctratantes se comprometen, enta! caso, a conceder la extradition conforme a sulegislation y a loa tratados vigentes.

ABTICDLO VIII

Toda Parte contratante puede recurrir a losorganos competentes de las Naciones Unidas afin de que estos tomen, conforme a la Carta delas Naciones Unidas, las medidas que juzguenapropiadas para la prevention y la represion deados de genocidio o de cualquiera de los otrosados enumerados en el articulo HI.

ARTICULO DC

Las controversias entre las Partes contratan-tes, relativas a la interpretation, aplicacion oejecucidn de la presents Convention, incluso lasrelativas a la responsabilidad de un Estado enmateria de genocidio o en materia de cualquierade los otros ados enumerados en el articulo III,serin sometidas a la Corte Internacional de Jus-tick a petition do una de las Partes en la con-troversia.

ARTICULO X

La presente Convention, cuyos textos ingles,chino, espanol, frances y ruso seran igualmenteautenticos, llevara fa fecfaa de 9 de diciembredel948.

AitTfcuLoXI

La presente Convencion ettara abierta hastael 31 de diciembre de 1949 a la finna de todoslos Miembroa de las Naciones Unidas y de todosloa Estados no miembros a quienes la Asam-blea General haya dirigido una invitacidn a esteefecto.

La presente Convencion sera ratificada y loainstrumentos de ratification seran depositadosen la Secretaria General de las Naciones Unidas.

A partir del 1" de enero de 1950, sera posibleadherir a la presente Convencion en nombre detodo Miembro de las Nacionea Unidas y de todo

Estado no miembro que haya recibido la invita-tion arriba mencionada.

Los instrumentos de adhesion serin deposita-dos en la Secretaria General de las NacionesUnidas.

AKTI'CULO XII

Toda Parte contratante podra, en todo mo-memo, por notification dirigida al SeeretarioGeneral de las Naciones Unidas, extender laaplicacion de la presente Convencion a todos losterritories o a uno cualquiera (If IDS territoriesde cuyas relaciones exteriores sea responsable.

AKTICULO XIII

En la fecba en que hayan sido depositadoe losveinte primeros instrumentos de ratification o deadhesion, el Seeretario General levantara un actay transmitira copia de dicha acta a todos los Es-tados Miembros de las Naciones Unidas y a losEstados no miembros a que se hace referenciaen el articulo XI.

La presente Convention enlrara en vigor elnonagesimo dfa despues de la fecfaa en que sehaga el deposito del vigesimo instrumento deratification o de adhesion.

Toda ratification o adhesion efectuada poste-rionnente a la ultima fecha tendra efecto el nona-gesimo dia despues de la fecha en que se hagael deposito del instrumento de ratification o deadhesion.

ARTICULO XIV

La presente Convention tendra una durationde diez anos a partir de su entrada en vigor.

Permanecera despues en vigor por un perfodo ,de cinco anos; y asi sucesivamente, respecto delas Partes contra tantes que no la hayan denun-tiado por lo menos seis meses antes de la expi-ration del plazo.

La denuncia se hard por notification escritadirigida al Seeretario General de las NacionesUnidts.

AKTI'CULO XV

Si, como resnltado de denontias, el numerode las Partes en la presents Convention M redu-ce a menos de dieciseis, la Convencion cesara deestar en vigor a partir de la fecha en que la nlti-ma de was denuncias tenga efecto.

ARTICULOXVI

Una demanda de revision de la presente Con-vencion podra ser fonnulada en cualquier tiempopor cualquiera de las Partes contratantes, pormedio de notification escrita dirigida al Secre-tario General.

La Asamblea General decidira respecto a lasntedidas que deban tomarse, si hubiere lugar,respecto a tal demanda.

ARTICULO XVII

El Secretario General de las Naciones Unidasnotificari a todos los Estados Miembros de lasNaciones Unidas y a los Estados no miembros aque se hace referenda en el artfculo XI:

a) Las firmas, ratificaciones y adhesiones re-cibidos en aplicacion de] articulo XI;

6) Las notificaciones redbidas en aplicaciondel articulo XII;

c) La fecha en que la presente Convencidnentrara en vigor en aplicacion del articuloXIII;

d) Las denuncias retibidas en aplicacion delartfculo XIV;

«) La abrogation de la Convention, en apli-cacion del articulo XV;

/) Las notificaciones retibidas en aplicaciondel articulo XVI.

ARTICULO XVIII

El original de la presente Convencion sera de-positado en los archivos de las Naciones Unidas.

Una copia certificada sera dirigida a todos losEstados Miembros de las Naciones Unidas y alos Estados no miembros a que se hace referendaen el artfculo XI.

ARTICULO XDt

La presente Convencion sera registrada por elSecretario General de las Naciones Unidas en lafecha de su entrada en vigor.
