THE APPLICATION HAS BEEN PROVISIONALLY REFUSED AS FOLLOWS: The assigned examining attorney has reviewed the referenced application and has determined thefollowing: No Conflicting Marks Found The examining attorney has searched the Office records and has found no similar registered or pendingmark that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02. The applicant, however, must respond to the following requirement. Entity and Citizenship Required The application does not contain the applicant’s entity type or citizenship. Therefore, the applicant mustspecify its entity type and citizenship. For example, an applicant can apply as an individual, a partnership,a corporation or a joint venture. 37 C.F.R. §2.32(a)(3); TMEP §§802.03 et seq. If the applicant is anindividual, then the applicant must indicate his or her national citizenship for the record. 37 C.F.R.§2.32(a)(3)(i). If the applicant is a corporation or association, then the applicant must set forth the U.S.state or country (for foreign applicants only) under whose laws the applicant is organized. 37 C.F.R.§2.32(a)(3)(ii). If the applicant is a partnership or joint venture, then the applicant must list the names andthe national citizenship or the U.S. state or country (for foreign applicants only) of organization orincorporation of all the general partners or joint venturers, as well as specify the state or country underwhose laws the partnership or joint venture is organized. 37 C.F.R. §§2.32(a)(3)(ii) and (iii). Domestic Representative The applicant may designate a domestic representative upon whom notices or process may be served. Trademark Act Section 1(e), 15 U.S.C. §1051(e); 37 C.F.R. §2.24; TMEP §§604, 811 and 1013. If theapplicant does not designate a domestic representative, notices or process in proceedings affecting themark may be served on the Director of the United States Patent and Trademark Office. Correspondence via Facsimile To ensure the Office receives a timely response from the applicant, the applicant may wish to send theresponse via facsimile (fax) directly to Law Office 115. Because equipment used by the Office cannot print adocument larger than 8½ inches by 11 inches, correspondence should not be transmitted on larger sizedpaper. When correspondence is filed by facsimile transmission, it is recommended that the sending facsimilemachine generate a report confirming transmission for each transmission session. This report should beretained by the applicant, along with the original correspondence, as evidence of content and date oftransmission.
