WHEREAS, the County’s vacation policy states, “Any vacation days accumulated in excess of 264
hours will be forfeited unless approved by the employee’s department head and the
Director of Human Resources”; and
WHEREAS, the Treasurer and the Director of Human Resources approved the accrual of vacation
hours in excess of the 264 hours for the Chief Deputy Treasurer in December 2013 and
extending into the 2014 year; and
WHEREAS, the excess of hours earned was the result of projects and work load which prevented the
use of vacation time; and
WHEREAS, the Chief Deputy Treasurer plans to retire effective June 30, 2014; and as of that date,
will have earned 128.89 hours in excess of the allowed hours.
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby
authorizes a one-time, non-precedent setting payment of unused vacation hours resulting
from retirement to include those hours earned in excess of the allowed hours.

Re: Resolution Authorizing Vacation Time Payoff To Include
Hours Earned In Excess of Allowed Hours
In December of 2013, I realized the Chief Deputy Treasurer had exceeded the allowed hours of unused vacation time under the county’s vacation policy, and as a result was actually losing hard earned vacation time. The same policy allows for exception to the rule with authorization from the Department Head and Director of Human Resources. The authorization as allowed was granted based upon the many tasks/projects preventing the use of vacation time.
With the announcement and planning for the Chief Deputy Treasurer’s June 30th retirement came the discovery that while the authorization to earn and use the additional hours was granted, there was nothing that allowed the inclusion of the unused excess hours in the vacation payoff that results from retirement.
I am asking for a one time authorization to include the unused hours in the payoff of vacation time. As of June 30, 2014, the Chief Deputy Treasurer will have earned 128.89 hours in excess of the allowed hours.
Taking into account the 33 years of dedicated service and over 1300 hours of unpaid overtime within the last 6 months alone, (as a salaried employee), I believe the value received from the Chief Deputy Treasurer far exceeds the dollars associated with 128.89 hours of pay. For this reason, I ask for your support of the attached resolution.

WHEREAS, Resolutions Nos. 2009-07-217, 2010-06-189, and 2012-01-019 established and amended the Vacancy Review policy to address filling position vacancies during the current hiring freeze and to ensure departments identify the need for the position before the position is approved for filling by the Board of Commissioners; and
WHEREAS, the policy currently requires general fund departments to seek approval through the Vacancy Review process to fill most vacant positions; and
WHEREAS, in some cases that means Department Heads and Elected Officials must make multiple requests to fill vacant positions within the same budget year to fulfill staffing needs; and
WHEREAS, the Strategic Planning - Competitive Compensation Committee has reviewed the Vacancy Review policy and recommends the Board Sub-Committees have final approval to fill vacant, budgeted positions and recommends shortening the Request for Exception to the Hiring Freeze form be shortened; and
WHEREAS, requests for new positions must continue to go through the full approval process through the Board of Commissioners and departments must fill out the budget form for new positions; and
WHEREAS, the Personnel Sub-Committee and Finance Committee has reviewed this matter and have recommended the revision of the Vacancy Review policy.
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners
hereby approves the revisions to the attached Vacancy Review policy and Request

A. POLICY
1. PURPOSE: Livingston County instituted a number of cost reduction measures in light of the financial forecasts indicating the County would be unable to sustain current levels of services within available resources. One of those measures is a hiring freeze. The objective of the hiring freeze for general fund departments and departments that receive a significant subsidy from the general fund is to contribute to the reduction of the budget deficit and to begin to make long-term structural changes and improved efficiencies in Livingston County’s work force.
2. POLICY STATEMENT: The Board of Commissioners instituted a hiring freeze on July 7, 2008, which resolved:
No position in a General Fund department which becomes vacant shall be replaced. In departments not funded by the General Fund, vacancies shall be posted internally with employees in General Fund departments given first consideration. The Board encourages the sharing of responsibilities within or between Departments. In addition supervisory positions may be filledinternally as long as a vacancy ultimately falls off the payroll. The Board of Commissioners also endorses consolidation of County offices in order to reduce operating expenses.
In addition, on December 1, 2008 the Board reaffirmed their position on the hiring freeze by resolving:
Any services funded by State/Federal grants which costs exceed grant funding and which services are not basic to the health, safety, and welfare of the residents of Livingston County and/or which are provided by others; shall be discontinued and the grant funding declined.
The approved Authorization and Funded Employee List contained in the annual budget (as amended by authorization of the Board of Commissioners) shall limit the number of employees who are authorized to be employed and no funds are appropriated for any position or employees not on the approved Authorization and Funded Employee List.
All vacancies that occur during this hiring freeze are hereby declared to be a position reduction on the Authorized and Funded Employee List for each such vacated position and funding shall be removed from the Courts, Elected Officials and Department Head budgets. Said vacated position shall not be filled, except by specific Board authorization.
If the Board of Commissioners authorizes a vacant position to be filled, then all Judges, County Elected Officials and County Department Heads will hold that position vacancy that occurs during the 2009 fiscal year for the appropriate duration of time to properly compensate for vacation and/orsick payoffs to insure personnel expenditures don’t exceed the 2009 authorized budget provided that the judges and elected officials can still perform their mandated functions at a serviceable level.

However, there may be a few instances in which the best interests of Livingston County are served by allowing a hire to take place. The attached Vacancy Review Guidelines explain the objective, criteria and procedures for granting exceptions to the hiring freeze.
Vacancy requests will be approved only when it is clear to the applicable Sub-Committee of the Board of Commissioners that:
The work is essential to Livingston County;
The Elected Official/Department Head has examined current work and staffing to identify and then implement changes that improve service, reduce costs and reduce the number of staff required to get the department’s work done;
Alternatives to getting the work done have been seriously explored including redesigning work, reassigning current staff, using additional technology or rethinking how work is performed, streamlining and any other staff-suggested means;
Lower priority work has been eliminated, deferred, or handled some other way. In other words, with approval, can some of the department’s current duties be discontinued?;
There is no reasonable alternative to hiring.
Where there is no reasonable alternative to hiring, it is expected that another position will be surrendered. Step placement at hiring should be scrutinized to minimize overall personnel costs. Avoid incurring any costs that are not necessary. All County expenditures – not just personnel costs need to be examined to reduce costs to the greatest extent possible.
3. APPLICABILITY: Applies to all budgeted full-time and part-time positions that become vacant during the period of time that the hiring freeze is in effect. New positions must go through the applicable subcommittee with final approval vested in the Board of Commissioners. The hiring freeze applies to positions in a general fund department and to departments that receive a significant, greater than 50%, general fund subsidy. Every position will be reviewed on an individual basis.
The following are the exceptions whereby a department head may fill a vacancy without first obtaining the approval of the Board of Commissioners:
Where the Board of Commissioners has previously approved the filling of a vacancy of the same job classification and hours within the same budget year and that position is again vacated
Departments are permitted to temporarily increase staffing levels due to increased workload, vacancies created by terminations or employee leaves of absence if sufficient funding is available within that department’s budget. No approval is required to return the incumbent employee to the original position. If funding is not available within a department’s budget sufficient to cover the expense of a temporary position, the department must receive approval from the Board of Commissioners through the vacancy review procedure prior to filling a temporary vacancy.
The hiring freeze will be in effect until further notice, and will not be lifted without an affirmative action taken by the Board of Commissioners.

A. POLICY
1. PURPOSE: Livingston County instituted a number of cost reduction measures in light of the financial forecasts indicating the County would be unable to sustain current levels of services within available resources. One of those measures is a hiring freeze. The objective of the hiring freeze for general fund departments and departments that receive a significant subsidy from the general fund is to contribute to the reduction of the budget deficit and to begin to make long-term structural changes and improved efficiencies
� � � � � � � � � � � � � � � � � � � � �force.
2. POLICY STATEMENT: The Board of Commissioners instituted a hiring freeze on July 7,
2008, which resolved:
· No position in a General Fund department which becomes vacant shall be replaced. In departments not funded by the General Fund, vacancies shall be posted internally with employees in General Fund departments given first consideration. The Board encourages the sharing of responsibilities within or between Departments. In addition supervisory positions may be filled internally as long as a vacancy ultimately falls off the payroll. The Board of Commissioners also endorses consolidation of County offices in order to reduce operating expenses.
In addition, on December 1, 2008 the Board reaffirmed their position on the hiring freeze by resolving:
· Any services funded by State/Federal grants which costs exceed grant funding and which services are not basic to the health, safety, and welfare of the residents of Livingston County and/or which are provided by others; shall be discontinued and the grant funding declined.
· The approved Authorization and Funded Employee List contained in the annual budget (as amended by authorization of the Board of Commissioners) shall limit the number of employees who are authorized to be employed and no funds are appropriated for any position or employees not on the approved Authorization and Funded Employee List.
· All vacancies that occur during this hiring freeze are hereby declared to be a position reduction on the Authorized and Funded Employee List for each such vacated position and funding shall be removed from the Courts, Elected Officials and Department Head budgets. Said vacated position shall not be filled, except by specific Board authorization.
· If the Board of Commissioners authorizes a vacant position to be filled, then all Judges, County Elected Officials and County Department Heads will hold that position vacancy that occurs during the 2009 fiscal year for the appropriate duration of time to properly compensate for vacation and/or � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � � ! �
2009 authorized budget provided that the judges and elected officials can still perform their mandated functions at a serviceable level.

However, there may be a few instances in which the best interests of Livingston County are served by allowing a hire to take place. The attached Vacancy Review Guidelines explain the objective, criteria and procedures for granting exceptions to the hiring freeze.
Vacancy requests will be approved only when it is clear to the applicable Sub-Committee of the Board of Commissioners that:
· The work is essential to Livingston County;
· The Elected Official/Department Head has examined current work and staffing to identify and then implement changes that improve service, reduce costs and reduce the number of staff required to " � � � ! � � � � � � � # � � � � $ � � � � � � � %
· Alternatives to getting the work done have been seriously explored including redesigning work, reassigning current staff, using additional technology or rethinking how work is performed, streamlining and any other staff-suggested means;
· Lower priority work has been eliminated, deferred, or handled some other way. In other words, with � � � � � & � � ' � � � � � # � � � � ! � � � � � � � # � � � � � � � � � � � � � � � � � ( � � � � � � � � � � � � � ) %
· There is no reasonable alternative to hiring.
Where there is no reasonable alternative to hiring, it is expected that another position will be surrendered. Step placement at hiring should be scrutinized to minimize overall personnel costs. Avoid incurring any costs that are not necessary. All County expenditures * not just personnel costs need to be examined to reduce costs to the greatest extent possible.
3. APPLICABILITY: Applies to all budgeted full-time and part-time positions that become vacant
during the period of time that the hiring freeze is in effect. New positions must go through the applicable subcommittee with final approval vested in the Board of Commissioners. The hiring freeze applies to positions in a general fund department and to departments that receive a significant, greater than 50%, general fund subsidy. Every position will be reviewed on an individual basis.
The following are the exceptions whereby a department head may fill a vacancy without first obtaining the approval of the Board of Commissioners:
· Where the Board of Commissioners has previously approved the filling of a vacancy of the same job classification and hours within the same budget year and that position is again vacated

RESOLUTION AUTHORIZING A CONTRACT WITH MUNICIPAL CONSULTING SERVICES, LLC FOR A CLASSIFICATION AND COMPENSATION STUDY – Human Resources
WHEREAS, the County has a need for a classification and compensation study for non-union employees as the last study was implemented in 2004; and
WHEREAS, a request for proposals (RFP) was published on the Michigan Inter-governmental Trade Network site with over 223 companies receiving notice of the bid. The RFP was also advertised in the local newspaper; and
WHEREAS, the County received two (2) responsive bids and after a successful interview, the bid review committee of the Strategic Planning - Competitive Compensation Committee recommends contracting with Municipal Consulting Services, LLC to perform the classification and compensation study.
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners
hereby authorizes a contract with Municipal Consulting Services, LLC of Ann Arbor, Michigan
to perform the non-union classification and compensation study for a cost not to exceed $95,000.
BE IT FURTHER RESOLVED that the Livingston County Board of Commissioners hereby
authorizes any budget amendments necessary to effectuate this contract.
BE IT FINALLY RESOLVED that the Chair of the Livingston County Board of
Commissioners be authorized to sign any agreements, renewals, or documents as needed for this
project upon review of Civil Counsel.

WHEREAS, Livingston County has a need for Trauma Treatment Services; and
WHEREAS, the current contracts will expire on September 30, 2014; and,
WHEREAS, in accordance with the County’s Purchasing Policy, a formal quoting process was performed and the submitted quotes were evaluated; and
WHEREAS, Mary Hayek and Catholic Charities and Karen Bergbower & Associates, PC submitted a quote that will provide Trauma Treatment Services at the flat rate not to exceed $225.00 per intake/assessment; hourly rate for group meetings not to exceed $240.00; and hourly rate for individual treatment not to exceed $75.00; for the period of May 1, 2014 through September 30, 2014, with an option for a 2 year renewal; and
WHEREAS, funding for same is available through the BJA/SAMHSA Drug Court Enhancement grant; and
WHEREAS, this Resolution has been recommended for approval by the Finance Committee.
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby authorizes
entering into agreements with Mary Hayek, Catholic Charities, and Karen Bergbower &
Associates, PC for Trauma Treatment Services at the flat rate not to exceed $225.00 per
intake/assessment; hourly rate for group meetings not to exceed $240.00; and hourly rate for

CONTRACTS
The Circuit Court continues to find Trauma Treatment to be an effective tool for working with at-risk participants to prevent the need for more intensive counseling services or out-of-home placements and
to provide the participants with life skills, alternative conflict resolution methods and intensive trauma
counseling.
The per-hour counseling rate not to exceed $225.00 per intake/assessment; hourly rate for group
meetings not to exceed $240.00; and hourly rate for individual treatment not to exceed $75.00. There will
be no additional mileage reimbursement. Based on a competitive bidding process, a decision has been
made to award Trauma counseling contracts to Mary Hayek, Catholic Charities, and Karen Bergbower
and Associates. The proposed resolution will approve contracts with each of these providers for Trauma
Treatment services. Each provider has been notified that a masters’ level, licensed provider will be
required to provide the services. Total payments are included in the BJA/SAMHSA Drug Court
Enhancement grant budget, and will not exceed $ $15,000.00 per year.

RESOLUTION TO APPROVE THE FILLING OF THE PRE-TRIAL SERVICE SPECIALIST POSITION IN COMMUNITY CORRECTIONS, AND THE SUBSEQUENT FILLING OF THE ADMINISTRATIVE SPECIALIST POSITION FOR SWIFT AND SURE SANCTIONS (POSITION # 168-00103).
WHEREAS, Community Corrections had an opportunity to review staffing and programming within the department due to the vacancy of two part time positions; and
WHEREAS, Creation of this new position has eliminated those vacant two part time positions within Community Corrections by reorganizing and combining duties of the Community Corrections Manager and Pre-trial investigator; and
WHEREAS, Creation of this new position has been evaluated by Rahmberg Stover and Associates who have graded the position as a Grade J; and
WHEREAS, The Personnel committee approved the creation of this position on May 21, 2014; and
WHEREAS, These personnel changes have been reviewed and approved by both the Michigan Department of Corrections, who awards the grant, and the Community Corrections Advisory Board; and
WHEREAS, funding for this position is provided for in the current grant budget; and
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby
approves the filling of the Pre-Trial Service Specialist position in Community
Corrections and subsequent filling of the Administrative Specialist position for the Swift
and Sure Sanctions program. If funding for this position through the grant is eliminated,
this position will also be eliminated.

Re: Resolution to fill the newly created position of Pre-trial Services
Specialist
The Community Corrections Department had two vacancies – the Pre-Trial Investigator position and the Community Corrections Manager position. These vacancies provided an opportunity for management and the Community Corrections Advisory Board to review some of the areas of concern within the department, which included staffing and programming. In conjunction with the Michigan Department of Corrections, we worked on restructuring the department to provide more investment and continuity in the Community Corrections program, resulting in this new full time position. The creation of this new full time position will result in the elimination of the two currently vacant positions within the department.
This position will be responsible for many of the duties of the previous Pre-trial Investigator position, in addition to new responsibilities of improving mental health assessment opportunities for incarcerated individuals, as well as closely monitoring and assessing incarcerated individuals who are unable to post bond.
We are excited about the improvements to Community Corrections, and have worked closely with the Community Corrections Advisory Board and the Michigan Department of Corrections in building a new direction for the department. We feel strongly that this new full time position will provide the department with additional investment from the staff, as well as provide continuity in the programs.

WHEREAS, this recommendation supports the Board of Commissioners’ strategic planning and succession planning efforts for Livingston County as we look to create long-term visions for our departments; and
WHEREAS, this reorganization was communicated to the 911 Administrative Oversight Board and they supported this recommendation at their May 7th Meeting.
WHEREAS, it is the goal that, upon the retirement of Jeff Boyd:
o The 911 / EMS Director / AME position will be eliminated;
o The 911 - Central Dispatch Deputy Director will be moved to the 911- Central Dispatch Director position; creating a vacant Deputy Director position; and,
o The EMS Deputy Director will be moved to the EMS Director / AME position; creating a vacant Deputy Director position
This will require separate action by the Board of Commissioners.
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners
hereby authorizes the creation of a Department Director position responsible for
both 911 - Central Dispatch and EMS and the appointment of Jeff Boyd, current
EMS Director / Assistant Medical Examiner (AME), to said position;

This recommendation is a bit unique because it spans the authority of both major subcommittees: Infrastructure & Development / Public Safety (911 - Central Dispatch) and General Government / Health & Human Services (EMS). The recommendation is a reorganization of both 911 - Central Dispatch and EMS. This will be accomplished by:
Creating an intermediate term Department Director position responsible for both 911 – Central Dispatch & EMS.
o Appointing Jeff Boyd as Director.
Creating two Deputy Director positions: one (1) each for 911 – Central Dispatch & EMS.
o This will result in decoupling the Assistant Director/Emergency Program Manager position (this position is current held by Mike Kinaschuk) into two (2) positions.
It is the goal that both of these departments will maintain their respective and separate identities.
There are many advantages to this recommendation:
Consistent with Board of Commissioners long-term strategic planning vision to create a succession plan for our aging workforce (similar to the smooth transition of Ted Westmeier’s departure from the Health Department);
Provides for a seasoned/extremely successful Department Director (Jeff Boyd) to mentor the deputy directors, build relationships between deputy directors and
public safety community leaders. As you know, Jeff already has established relationships at the local & state levels; and with professional organizations.
Provides flexibility for 911 – Central Dispatch & EMS, regarding current legislation; more specifically, Next Gen 911 and the impact of healthcare reform on EMS charges-for-service.
Allows the Emergency Program Manager position to focus efforts on emergency management programs. By way of example, rewriting the required mitigation plan; and set-up / practice events for the EOC (Emergency Operations Center).
The final phase of the recommendation is, upon the retirement of Jeff Boyd, the 911 - Central Dispatch & EMS Director position will be eliminated. The 911 -Central Dispatch Deputy Director will be move to the 911- Central Dispatch Director position; creating a vacant Deputy Director position. The EMS Deputy Director will be move to the EMS Director position; creating a vacant Deputy Director position.
I attended the 911 Administrative Oversight Board (AOB) meeting on Wednesday, May 07, 2014 and outlined the above 911- Central Dispatch & EMS reorganization. They support the recommendation.
The goal is a long-term vision for succession planning, smooth transition for operations and delivery of effective/efficient services to the Livingston County constituents. RESOLUTION AUTHORIZING AN AGREEMENT WITH FITCH AND ASSOCIATES TO PROVIDE 911 CONSULTING SERVICES - 911 / Public Safety Committee / Finance Committee
WHEREAS, Livingston County 911 Center has determined a need to complete a strategic plan
outlining the, effectiveness, and efficiency study of the county 911 System and providing
a road map to the future; and
WHEREAS, Livingston County 911 has determined that the results of this study will assist in the 911
5 year strategic plan; and
WHEREAS, the study will also assist 911 in future staffing needs, response time efficiency and
comprehensive overview of the organizations performance practices; and
WHEREAS, in accordance with the County’s Purchasing Policy, a competitive bid process was
performed and the submitted bids were evaluated; and
WHEREAS, Fitch and Associates of Platt City, Missouri, submitted a proposal that will provide the
consulting services at the fixed rate not to exceed $73,950.00; and
WHEREAS, funding is available through the 911 Budget in the operating line item; and
WHEREAS, those funds will be transferred to the contract services line item; and
WHEREAS, this Resolution has been recommended for approval by the Public Safety Committee; and
THEREFORE BE IT RESOLVED that the Livingston County Board of Commissioners hereby
authorizes entering into an agreement with Fitch and Associates for 911 Consulting
Services at the rate fixed of $73,950.00 further be it resolve the Board authorizes a
transfer of $73,950.00 from the operating services line item to the contract services line
item; and
BE IT FURTHER RESOLVED that the Chairman of the Board of Commissioners be authorized to sign
the above-referenced agreement if required upon review and preparation by Civil
Counsel.

Re: 911 Strategic Plan Services with Fitch & Associates
In 1998 the Livingston County 911/Central Dispatch and Emergency Management departmentwas created to provide consolidated dispatching services for police, fire and EMS within the county. Since that inception date, the center has operated under its original structure and plan. The original staffing model from 1998, the facility and the internal equipment are reaching the end of their life cycle.
In addition, the roles and responsibilities of the disciplines served by 911 are rapidly changing. Each discipline is facing new challenges and 911 is the first point of contact for those disciplines that serve the residents of Livingston County. 911 is changing from a reactionary style of managing calls to a proactive response and it’s time for the center to develop a plan of action. Fitch and Associates will provide a thorough review of the Center’s operation and organizational structure including staffing levels; call processing, best practice standards for Police, Fire and EMS; facility design and layout; hiring and training review for best practices and improvements; and assessment of job satisfaction for existing internal employees and external customers.
911 issued a Request for Proposal (RFP) to obtain bids for this service in which 11 proposals were received. Staff from County Administration, Purchasing and 911 reviewed the bids and recommend award to Fitch and Associates.
Therefore, we are requesting that the attached resolution be approved authorizing a contract with Fitch and Associates for 911 Strategic Plan services at a cost not to exceed $75,000.
