Ever wonder what is the number onedispute in almost any construction liti-gation or arbitration? That would be ourfriend the change order. Or, as onejudge stated, construction is nothingmore than “organized chaos“ and “anal-ogous to ever changing commands onthe battlefield.” Fact is, when you arefacing a judge there is hardly any con-struction dispute that does not includewithin its nasty ambit that loved ordreaded concept of an extra. And guesswhat the number one defense to payingis? Claiming the change order was notin writing, even if you were directed todo the work! So let us get our armsaround how to make sure you are paidsuch extras.

Example: Frank is a general contrac-tor who has a contract with a veterinar-ian to construct a new vet clinic andboarding facility. The property has aback section reserved for a parkingwith a steep slope up from the pave-ment toward the back of the lot. Thebase contract and specs layout a 4-footX 80-foot redwood retaining wall withdrainage through an outlet directlyonto the parking lot surface, where itwill drain downhill into the street. Butin laying the foundation, it was deter-mined there is constant moisture froman underground spring, making the

soil unstable. After talking to a soil en-gineer, the vet owner acknowledges it isan extra in the presence of two witness-es, clearly directing Frank to constructa 4-foot X 80-foot CMU retaining wallwith underground drainage exitingthrough a curb at street level. It is fur-ther agreed to be done on a T and M ba-sis based on the same hourly rate asunder the base contract.

You can guess what happened next.Frank went back to his office and pre-pared a written change order, faxing itto the owner. They had a number ofconversations later, but it was neversigned. The owner never told him tostop or not do the work. Relying on theowner’s good faith, Frank diligently hadhis crew do the necessary work. Theyeven worked overtime so as not to un-necessarily extend the completion date.But after submitting a number of in-voices, he continued to get the“runaround” and was never paid.

At trial, it was uncontested Frank didthe work and it was an extra, but it isclaimed no payment is due because thechange order was not reduced to writ-ing. The owner offered to the judge’s acopy of the contract which stated: “Con-tractor shall make no changes in thework required to be performed underthis contract, nor perform any extra

work without the prior written consentof the owner or representative, as seenby an executed written change ordersigned before the extra work com-mences which describes the work, theadditional compensation, and the ex-tended time, if any.”

Now some good news. You will behappy to know that since the mid-20thcentury, most (but not all) states do notrequire a signed change order as longas: 1. there is clear evidence the ownerverbally authorized and directed thework, 2. the work actually is an extra,

and 3. the contractor relied upon thatdirection and actually did the work. Andbetter yet, if you send the owner achange order and it is never signed, inmost cases you will have an even betterchance of prevailing as long as it is de-livered prior to starting the work.

So what do you do if your changeorder is not signed? Most courts frownon abandoning the project at thatpoint and look much more favorably ifyou complete the project and make

your claim later. At that point they re-ward you under the doctrine of waiv-er, estoppel and unjust enrichment. Itis a legal theory that if you are told todo something and rely to your detri-ment, the party benefiting from yourservices waives the right to requirethe technicality of a signed change or-der because it was a condition solelywithin their control.

Steps to take to protect your rights:

• Pre-Construction job meetings.Make it clear your goal is to completethe base contract as quickly as possiblewithout the delays of change orders. Letthe owner know change orders willmake the project more expensive. Nowis the time to do any revisions to thecontract if they want otherwise. Make itlook like you are doing them a favor toadvise on such financial matters — sothey can stay within budget.

• “Let’s have a little talk,” when youare confronted with the first change or-der. Remind the owner of your initialconversation where you said the projectwill be more expensive and take longerif there are changes. Let them know youare willing to continue with the basecontract, but if they want change or-ders, it will costs more.

• Memo of Meeting. Write a “short andsweet” Memo confirming any conversa-tion you have about a change order ande-mail or fax it to the owner or represen-tative within 24 hours. It will confirmthat the additional work will is an extraand was directed by the owner. If termshave been agreed upon, including priceand time extension, confirm that as well.

Example: “Hi Joe. This will confirmthe verbal direction received at the sitethis morning to perform work which wasagreed to be an extra: (describe the

work). We estimate the time for comple-tion will be extended for two days. We arewilling to do this on a T and M basis atthe contract rate of $65 per hour. Workwill start Wednesday. Let me know if thisdoes not accurately reflect our conversa-tion. Thanks for your cooperation.”

• Send a written change order. Af-

ter the memo, send off a formal writ-ten change order also by fax or e-mail attachment.

• If no signature, send a work underprotest memo. If no signature is forth-coming, you get confusing signals, or if

they change their mindand want the work donewithout extra compensa-tion, send the following:

Example: “Dear Joe.This will again confirmwe have been directed byyou on June 25, 2011 ata job site meeting to per-form work outside thecontract/specs without

additional compensationconsisting of (describethe work). This work willbe performed underprotest. We reserve ourright to claim charges forextras as additional com-pensation. Time for com-pletion will be extendedtwo days. We also reservethe right to claim com-pensation for impact ex-

penses (examples delay,extended overhead, su-pervision, over time, ac-celeration, unproductivedowntime, reschedulingand interference with jobcoordination). A require-ment of a signed changeorder is therefore waivedfor failure to sign the pre-viously submitted writtenchange order.”

In the case above,Frank sent the initialmemo followed by a writ-ten change order which

was never signed. Guesswhat? He won. After trial,he told his attorney thatthe total time to prepare

these two documents was30 minutes. Now that’s acheap insurance policy.

FLANDERS, NJ —Imagine being cut offfrom the town you havelived in for 27 yearswhen suddenly, accessto your community wassevered by HurricaneIrene. The otherwise gen-tle river near your housebecame a flash flood,washing away the onlybridge between yourcommunity and the out-side world. This is whatthe Costello’s and the Ul-brich’s of Mill Road inMt. Olive Township, NJfaced on Sept. 28, 2011.In only two hours, thewater had completelyovertaken the road anddestroyed the old wood-en bridge that connectedMill Road to Mt. Olive.

In the aftermath of thisnatural disaster, the com-munity began the processof trying to rebuild theirlives. Beyond the obviouslogistical problems of nolonger having a bridgeinto town, one of the fam-ilies on Mill Road hadspecial needs child thatrequired regular medicalcare. To this family, thelack of a bridge repre-sented much more thaninconvenience. To further

complicate matters, thecommunity bridge androad are not owned bythe township, so the com-munity residents bear theresponsibility of replacingthe bridge.

David Scapicchio, themayor of Mt. Olive Town-ship, was struggling withthe resident’s problemwhen he received a callfrom Mabey Bridge &Shore’s Product Special-ist, Jim Porreca. Porrecahad heard about Mt.Olive’s situation andwanted to let the mayorknow that his companywas ready to help. MayorScapicchio explainedthat the Mill Road com-munity did not have theresources to replace thebridge and asked if therewas anything we coulddo to help.

Porreca wasted no timeworking out a plan to getthe citizens reconnectedwith their community,families and emergencyessentials. When Mabeysaw the need for the resi-dents and realized that fi-nancing was not going tobe available, the companydid not hesitate to providea bridge under a program

that required no capitaloutlay by the community.Bob Aylward, CEO ofMabey Bridge & Shore,felt that the companyneeded to step up in a sig-nificant way to help theresidents of Mill Road.

Mr. Aylward said,“Mabey has built a suc-

cessful operation in thestate of New Jersey. Wesee New Jersey as a veryimportant region as ourcompany expands. WhenHurricane Irene hit, wesaw an opportunity forMabey to give somethingback to a region that hasbeen very good to us. You

don’t have to go halfwayaround the world to helppeople in need. Ourneighbors in Mt. Olivehad a problem that weknew how to solve. I amproud to lead a companylike Mabey that caresabout our customers, ouremployees and the com-

munities in which we re-side. My hope is that thebridge we provided willserve as a daily reminderto the community thatthere are companies andpeople who care and whoare willing to help.”

New model meets Tier 4 interimemissions requirements

RACINE, WI — Case ConstructionEquipment today launched its CX470Cfull sized excavator. The machine is the

newest in the Case C Series excavatorline that features increased fuel efficien-cy, productivity and improved servicea-bility and operator comfort, whileachieving Tier 4 Interim certification.

The new Case CX470C excavator re-places the company’s CX470B model. Itfeatures Tier 4 Interim certified cooledexhaust gas recirculation (CEGR) tech-nology that burns cleaner while deliver-ing superior horsepower.

The CX470C, rated at 362 net hp, isavailable in Long Undercarriage (LC), Re-tractable Undercarriage (RTC) and MassExcavator (MEX) models, with operatingweights ranging from 105,300 to108,600-pounds. The CX470C models

Many a watchful eye is focused upon the Slate HillConstructors, Inc. crew working on the redecking androad repair project currently under way on State FairBoulevard near the New York State Fairgroundscomplex in Syracuse. As spring weather allowed anearly start to this year’s work schedule, ProjectSuperintendant, Dale Carlson said that the work isapproximately 40 percent complete as they head intothe first week in May. More importantly, for thosewho use State Fair Boulevard as a daily commuterroute, and for those who are planning to attend theNew York State Fair in August, Carlson said thatweather permitting; the work will be completed ontime.

“We were hoping to pour concrete this week (weekof April 23), but because of the rainy weather, it lookslike we will have to wait until next week to do that,”he said during a recent interview with Hard HatNews. “This project is about a half mile from thefairgrounds and it is an important access road intothe facility. We will be replacing the bridge decking,bearings and pavement on either end of the 100-footby 75-foot bridge. Our targeted completion date isAugust 4 and we should be completed by then.”

Carlson explained that Slate Hill Constructors,Inc., owned by Jeff Hanlon of Warner, NY, has been inbusiness since 1985, and specializes in road andbridge construction, site prep work and other munic-

ipality related work that requires a company thatknows the needs of the communities that they serve.“We do work in New York State from Buffalo toAlbany,” he said. “At our peak, we will have seven oreight crews out on jobs, with a total workforce ofabout 60 people. This year, because of the niceweather, we got an early start, especially on thisproject. We were out here the first week in March.That usually isn’t the case in the Syracuse area forthis time of year.”

Worker’s personal needsCarlson said that whenever possible, Slate Hill

“We have three route driversthat maintain the customers’units, some of whom have theirrestrooms serviced once per weekwhile others are serviced moreoften,” he said. “We have fourpumper trucks and two flatbedsthat we use to pickup, deliver andservice the units. As part of ourgood stewardship of the environ-ment, we take the waste materialthat we collect, to waste treatmentplants that are in some of thecounties that we serve.”

Wilkinson said that Sabre notonly serves contractors like SlateHill Constructors, who are doingreplacement work on a bridgenear the State Fair Grounds, butthey also supply units for otherlarger events other than construc-tion jobs,” he said. “One eventthat we serviced last year wastraining exercises at Fort Drummilitary base. We serviced over200 portable restrooms daily forone month for over 7,000 troopsthat where training for deploy-ment overseas. This job reinforcedour thinking that we can take onany event no matter what size. Italso gave us a great feeling ofbeing involved and doing a smallbut thankful part for our

military.”Other large events that Sabre

will be serving in the coming yearinclude Taste of Syracuse and TheSyracuse Corporate ChallengeRace. Outdoor concerts such asKROCK at the NYS Fairgroundsand road and cycling races are onthe agenda as well. “As summerevents and construction projectsbecome more numerous, we getbusier,” he said.

“Routinely, we offer same dayservice when someone calls toarrange for a unit to be deliveredto their site,” said Wilkinson. “If acustomer calls in the morning, wewill do everything we can to haveit there that day. Our rental ratesare extremely reasonable.”

Wilkinson said that they haveplans to broaden their coveragearea in the future, with newlocations in Watertown, NY andBinghamton planned. “We wouldlike to make this happen withinthe next two years,” he said. “Thepast six years have offered a lot ofchallenges when it comes to thegrowth of our business, butoverall, we have been able toexpand even while the economyand more specifically theconstruction industry, has hadsome temporary setbacks.”

“The CX470C joins aproduct line from Casethat sets new standardsin fuel economy, produc-tivity and operator envi-ronment,” O’Brien said.

Like other excavators inthe Case C Series, thenew CX470C featuresCase Intelligent Hy-draulic System technolo-gy that reduces total fuelconsumption and im-proves performance.

Boom Economy Control(BEC) automatically re-duces engine RPMs andhydraulic power to theboom when speed andpower is not a priority,such as when swingingback to the hole. SwingRelief Control (SWC)technology manages thehydraulic power allottedat the start of the swingoperation, and SpoolStroke Control (SSC) cre-ates an automatic pres-sure adjustment to meetdemand during diggingoperations, but withoutbuilding unnecessarypressure. Then, the fea-ture of Auto EconomyControl (AEC) lowersRPMs when the joysticksare inactive.

Also boosting fueleconomy and perform-ance are engine improve-ments such as comput-er-controlled fuel deliv-ery and variable geome-try turbocharging, aswell as automatic match-ing of engine perform-ance and RPMs to powerdemands and hydraulicsystem requirements.

“Typical CEGR sys-tems lose fuel efficiency,but with the Case Intelli-gent Hydraulic Systemtechnology and engineimprovements, we’ve ac-tually increased fuel effi-ciency on the CaseCX470C excavator by fivepercent over our previousB Series model,” O’Brienexplained. “And all of ourCase C Series excavatormodels continue to be inthe top of their class forproductivity.”

Increased productivity

With up to five percent

faster cycle times thanthe previous model, thenew Case CX470C exca-vator can move more ma-terial and load moretrucks per hour.

Along with faster cycletimes, the new Case exca-vator offers operatorssmoother and easier con-trol and maneuverability.

The CX470C excavatorprovides six percent morelift capacity than the previ-ous B Series model. Withits standard arm length of11-foot 1-inch, the CaseCX470C excavator has amaximum dig radius of39-feet 4-inches, a maxi-mum dig depth of 25-feet4-inches and a dumpheight of 25-feet 5-inches.

The boom and arms,as well as the mainframeand undercarriagestructure, have been re-designed for this addi-tional capacity, deliver-

ing improved, worldclass durability.

Its standard arm dig-ging force is 42,490-pound-foot and standardbucket digging force is55,530-pound-foot. Avail-able Power Boost technol-ogy increases both ofthese values by approxi-mately 10 percent.

The CX470C featuresa 172 gallon fuel tankand a 122 gallon hy-draulic system.

Improved operatorenvironment

“The Case CX470C ex-cavator provides a high-ly functional and com-fortable environment forthe operator, an impor-tant consideration inachieving maximummachine productivity,”O’Brien said.

bration refinement on thecab’s reinforced tubularstructures, create an ex-tra quiet cab environ-ment, with automotivelike noise levels as low as

The LED screen also pres-ents to key operating data, including anew function which provides fuel con-sumption per hour. “Operators can usethis information to refine fuel efficiencyfor their particular operation,” he said.

The machine’s low profile design alsoenhances visibility from the cab, effi-ciently accommodating Tier 4 emissionsystem components without compro-mising the operator’s view of the jobsite.

The CX470C excavator also includes astandard air suspension seat and an in-cab auxiliary hydraulic setting systemwith a new option for 10 memory recall,attachment flow settings to make tool

changes quick and easy for operators.

These improvements in operator com-fort features are complemented by theadded safety of a full ROPS structurearound the cab.

Ease of maintenance

“Extended service intervals for theCase C Series excavators help reduceoperating costs,” O’Brien said. They aredesigned with 500 hour engine oilchange intervals, 5,000 hour hydraulicoil change intervals and 1,000 hourgreasing intervals with Easy Mainte-nance System bushings.

The cab includes new access points toeasily reach the air filter and fuse box.

“The design of the CX470C excavatorefficiently accommodates the redesignedengine, cooling and exhaust systemswhile offering excellent serviceability

and operator visibility,” O’Brien said.

The machines feature wide-open pan-els for easy access to service points andground level access to grouped lubrica-tion points.

SEATTLE, WA — Mud-slinging isn’t the type ofactivity that normallywins accolades, butMichael Diponio hasnothing but praise for theway his SENNEBOGEN870 M material handlerhas been heaving themuck around at his cur-rent jobsite for SoundTransit in Seattle.

Sound Transit is extend-

ing the U-Link subwayfrom its LRT station atPine Street to a new stationplanned at Capitol Hill.Diponio, the vice presidentof Michigan based Jay DeeContractors, is projectmanager for the JayDee/Coluccio/Michelsjoint venture which willmine the two tunnels, each21-feet in diameter and3,800-feet long.

Tunneling like this isJay Dee’s stock in tradeand the family-ownedbusiness has been doingit for more than 45years. With the U-Linkproject, however,Diponio faced uniquechallenges posed by theenvironmental standardsof Washington State andthe city of Seattle.

The problem, in a word,

is muck. Conveyors fromthe project’s two tunnelboring machines delivertheir tailings in the formof a heavy slurry to theopen cut for the futuresubway station. The slur-ry arrives about 80-footbelow grade and Diponiohas to move the wet muckup to road level and haulit out to his fill site with-out compromising thecity’s strict standards for

protecting its water tableand roadways.

Cleanup can be costly

“We’re working in a veryurban area here, and ourhaul route travels directlythrough a residentialarea,” Diponio explains.“The track out is severelylimited, and using thou-sands of gallons of washwater every day is count-er productive.” The con-tract includes significantcash incentives for com-plying with these require-ments, and a local envi-ronmental technician isstationed on the site tomonitor the operation.Officials for the city andconsultants conduct awalking tour of the proj-ect every week.

The simplest approachto moving the muck waswith stacking conveyorstransferring it up to amuck bin or to waitingdump trucks. However,the conveyor process re-sulted in the mucksplashing too much forcrews to clean up. “Thedrop from the end of theconveyor into the dumpwas about 6 or 7-feet.The muck was splatteringeverywhere, 30 or 40-feet.It was going right up oursound wall! We had a‘splooge patrol’ of fiveguys with loaders going

full time to clean up.”

The muck wouldn’tsplatter so much if it wasdrier, of course, but itthen becomes too stickyto offload easily from thebuckets and dumps.Foaming agents are actu-ally added by the TunnelBoring Machine to condi-tion the muck so that itflows freely from the ex-cavation chamber.

Precise handling isthe solution

“What we needed was amethod to place, notdrop, the material pre-cisely into the dumptrucks. We looked at someother machines, but weneeded more horsepowerand more mass to get thestability for a precisetransfer. We went with theSENNEBOGEN 870 M onthe recommendation ofModern Machinery. Butreally, we had no idea if itwas going to work.”

The SENNEBOGEN870 M is a purpose builtmaterial handler weigh-ing 165,000-pounds andpowered by a 426 hp en-gine. The wheeled unit ismounted on a speciallyreinforced platform rais-ing it 30-feet above thefloor of the excavationwhere the muck flows in.

Modern Machinery fitted the machinewith a SENNEBOGEN extra long boomto make the 63-foot reach up to thewaiting trucks. Its 2.5-yard clamshellbucket was also custom built with tightbucket closing tolerances to preventleakage and spilling as the clamshellbucket swings over the truck bed.

The SENNEBOGEN is positioneddown in the hole, 40-feet beneath theground surface. Once the bucket israised above the surface and the ma-chine swings over the edge of the shaft,the machine operator loses sight of thebucket. Jay Dee’s operators scoop upthe muck and guide it up to the roadlevel using two cameras to find theirway. One camera is mounted at theboom knuckle and another is positionedroadside by the trucks’ station. With atotal boom length of 63-feet, they havejust 3-inches of clearance to reach theirtargets, the dump bodies and pup trail-ers. The bucket is carefully lowered di-rectly into the bed, with only inches ofclearance on either side of the bucket,before the bucket is opened to let themuck flow out.

The fleet of dump trains grew as oper-ators became increasingly proficientwith the 870 M and the drivers wereable to navigate into the exact positionwith the help of markings painted onthe pavement.

Picking up the pace

Loading each truck requires fourpasses to fill the front unit and five to

fill the trailer. The system was able toget the job done but the question onDiponio’s mind was, how much timewould it take? “This method has per-formed well beyond our expectations,”he’s pleased to say. “We now haveeleven trucks moving through the cycleand the SENNEBOGEN more thankeeps up with them.”

Diponio reports that the initial load-ing times exceeded his target, but theoperators advanced up the learning

Governor Andrew M. Cuomo an-nounced a $29.7 million investment forNY Works projects to upgrade and re-pair six parks in Western New York.

New York Works is designed to rein-vent state economic development withinnovative new strategy that will putNew Yorkers back to work rebuildingthe state’s infrastructure. The TaskForce will help create tens of thousandsof jobs by coordinating comprehensivecapital plans, overseeing investment ininfrastructure projects, and accelerat-ing hundreds of critical projects across

the state.

“New York State has passed, for thesecond year in a row, a transformativeand balanced budget that holds theline on spending, while focusing on jobcreation and government efficiency,”Governor Cuomo said. “The center-piece of this budget is the New YorkWorks program, a new strategy forleveraging capital to put New Yorkersback to work and rebuilding our aginginfrastructure including the state parksystem that is used by so many peopleacross the state.”

Senator George D. Maziarz said,“There has been a great need to devoteresources to help rehabilitate parks inmy district for a number of years. Thisbeing the largest investment of capitaldollars in New York State Parks in his-tory, I commend Governor Cuomo andthe Legislature for making this a part ofthis year’s budget. This investment inour area’s future will go a long way toenhance the beauty and visiting experi-ence of these assets to our community.”

Senator Patrick M. Gallivan said,“New York State has long been knownfor its beautiful landscape and storiedhistory. The New York Works Fund’s in-

curve very quickly. “Be-fore we started, we spenta day or so with the op-erators, going over thedrawings to make sureeveryone understood theconcept. The first testscame in at 20 minutesfor a full load, and wewere looking for 12 min-utes,” he recalls. “Theaverage now is under 10minutes, which meanswe can now meet ourproduction projections!”The best loading timeachieved by any operatorso far is just six minutes.

The contractors arelooking forward to earn-ing their bonus for envi-ronmental compliance,too. Even at its fastestloading times, the 870 Mis moving with precision,enough that the worksitestays meticulously clean.“The inspectors can tourthe site in their streetshoes without a prob-lem,” claims Diponio. JayDee’s “splooge patrol” hasbeen replaced by a crewof two who police the siteonce a day with a wheel-barrow. A wheel washersystem and street sweep-er take care of anyspillage coming from thetrucks’ tailgates.

The Budget continuesthe Governor’s commit-ment to fiscal responsibil-ity while creating jobs andstrengthening communi-ties across the state. Itcloses a multi-billion dol-lar deficit with no newtaxes, fees or gimmicks,limits spending growth totwo percent or below forthe second year in a row,and launches the NewYork Works Task Force toinvest billions of dollars torebuild the state’s roads,bridges, parks and otherinfrastructure and createtens of thousands of jobs.

The Budget includeskey economic develop-ment and transportationinitiatives, important re-

forms to improve govern-ment efficiency and meas-ures to strengthen com-munities across the state.

New York Worksestablishes the New

York Works Task ForceThe New York Works

Task Force will coordi-nate capital plans across45 agencies and authori-ties, oversee investmentin projects and access tofunding, and facilitate thecreation of tens of thou-sands of jobs.

Prior to the New YorkWorks initiative, therewas no comprehensivestate plan for the $16 bil-lion in annual capital ex-penditures by 45 stateagencies and authorities.In some cases, includingwith respect to projectsby the Port Authority, theMTA and the Dept. ofTransportation, billionsof dollars of taxpayer orcommuter funds are be-ing used to fund trans-portation plans in thesame region with no coor-dination between theagencies. For the firsttime, the New York WorksTask Force will develop acoordinated capital infra-structure plan amongagencies and authorities.The Task Force, made upof leaders in finance, la-bor, planning and trans-portation will also recom-mend financing optionsfor projects and methodsto accelerate constructionof critical infrastructure.

The New York WorksTask Force will consist offifteen members. Nine ofthe members will be ap-pointed by the Governorand six by the Legisla-ture. All major state agen-cies and authorities willparticipate in an imple-mentation council to co-ordinate capital planning.

All New York Worksprojects will be posted onthe web with real time up-dates so that New Yorkerscan track the progress ofprojects in their commu-nity. The full list will beposted online over thenext several days.

Rebuilding NewYork’s State ParksThe New York Works

Fund will provide $89million, leveraging $143million in total funding,to rehabilitate stateparks, representing thesingle largest infusion inhistory of capital dollarsfor New York’s parks.Currently, 83 percent ofstate parks are deterio-rating. Projects will befunded in every region ofthe state and will en-

hance the visitor experi-ence and enable our stateparks to reemerge afteryears of decline.

The New York WorksProjects in Western NewYork are as follows:

• Allegany State Park:Upgrade the electricalsystems in the Red Houseand Cain Hollow camp-grounds, which are cur-rently outdated and pres-ent health and safetyconcerns. In addition,they cannot accommo-date modern camping ve-

hicles - Cost: $2,400,000.

• Allegany State Park:Reconstruct the CainHollow and Camp 5 rest-room and shower build-ings. Located in theQuaker camping area,these two deteriorated fa-cilities are visible signs ofdisinvestment in thispark. Cost: $950,000.

• Midway State Park:Construct a new buildingaround the park’s historiccarousel to replacing theexisting failing structure.Cost: $150,000.

• Niagara Falls StatePark: Restore popularviewing areas and trails,rehabilitate Cave of theWinds area, design re-placement AmericanFalls Bridge and rehabili-tate the park’s roadwaysand infrastructure. Thisproject will use accelerat-ed NYPA Niagara. Green-way funding to supportthe improvements at thisflagship park. Cost:$25,000,000.

• Evangola State Park:Reconstruct a comfort

station in Evangola StatePark. Cost: $500,000.

• Golden Hill State Park:Reconstruct a comfort sta-tion in Golden Hill StatePark. Cost: $550,000.

• Long Point State Park:Install a new fueling sys-tem at the marina at LongPoint State Park. Cost:$150,000

Total: $29,700,000

OKLAHOMA CITY — The new Terex®CR652RX remix anti-segregation systemmainline paver features the largest rub-ber drive tire in the industry to enhancetractive effort, allowing for paving widthsreaching 30-feet. Many of the same ex-clusive features pioneered by the rubbertrack Terex CR662RM RoadMixpaver/MTV are now found on the new

10-foot CR652RX rubber tire paver.With outboard drive spreading augersand a new generation remix anti-segre-gation system, the CR652RX enhancespaving quality and efficiency by prevent-ing material and thermal segregation.

The new spreading auger design usestwo outboard drive motors mounted to

the tractor’s rear bulkhead. Two, 5-footlong spread auger sections efficiently de-liver material to the left and right handsections of the screed. Each screw augerfeatures its own speed control, allowingoperators to independently adjust mate-rial flow to either side of the screed. Theauger sections back up to each other,leaving no separation in the center. Thisnew drive and screw auger arrangementreduces centerline segregation and elim-inates the need for reversing augers andthe center gearbox drive found on com-petitive mainline pavers.

The CR652RX rubber tire paver in-cludes the new generation remix anti-segregation system design, which virtu-ally eliminates material and thermalsegregation at the last stage of thepaving process. Two sets of two counterrotating augers with interleafing flightsuniformly draw down material from allareas of the hopper and aggressively re-blend the asphalt to produce a more ho-mogeneous mix. The entire length of theauger shafts is lined to reduce wear.

Positioned at or below hopper winglevel, the augers feature a constant12-inch diameter, so material ispulled from directly above the fulllength of the shafts. A new, largervariable pitch design — 10-inches atthe front of the hopper to 12-inchesjust before the feed tunnel — quicklychannels material from the hopper tothe spreading augers, increasingtruck exchange efficiency. The augers’sloped design results in a larger open-ing at the end of the feed tunnel, elim-inating material buildup.

Upon exiting the hopper, asphalt en-ters the feed tunnel’s approximately 8-foot long mixing zone under the enginecompartment. Here, 100 percent of theuniformly drawn down material ismixed in a figure eight pattern by thepugmill style mixers as it is channeledto the spreading augers. TheCR652RX’s Remix System featuresmore than a 900-TPH capacity.

The new Terex CR652RX remix anti-segregation system paver boasts the

same system features of previous de-signs that have made these machinesthe pavers of choice for mainline paving.The exclusive three point suspensionsystem essentially “floats” the paverover pre-existing irregularities, main-taining a consistent feed height at thescreed for a smoother mat. Raising andlowering of the paver’s rear frame by thepatented frame raise system assists intruck loading and unloading and allowsoperators to fine-tune the head of mate-rial at the spreading augers, reducingsome forms of segregation.

Standard receiving hopper capacity ofthe CR652RX paver is 16.7 tons. Whenequipped with the available hopper in-sert that channels asphalt directly intothe hopper’s reblending augers, hoppercapacity increases to 27 tons. Unlikeother insert designs, Terex hopper in-serts are shaped so there are no “deadspots” where asphalt can gather andcool to create thermal segregation.

The new CR652RX remix anti-segre-gation system paver is powered by a260 hp Cummins QSB6.7 diesel engine.Contractors can choose from three dif-ferent screed models — the electric ordiesel Fastach® 10, electric Ver-saScreed and the electric or dieselStretch 20®. — overhead allocation iscomplicated, and the realanswer to your questionis way beyond the scopeof this column. For amore detailed explana-tion, I recommend work-ing with your CPA to findthe most appropriatemethod of overhead allo-

cation for your company.Companies can use manydifferent methods to allo-cate overhead. For exam-ple, you can allocate us-ing job revenue, laborhours or costs, materialcosts, subcontract costs,

equipment costs, or acombination thereof.

Let’s use an over sim-plified example. Assumethat you’re a labor inten-sive contractor and you’reworking on three jobs onwhich you’ve spent$80,000 in indirect ex-penses that you want toallocate as overhead toyour jobs. The success ofyour jobs depends onhow productive yourworkers are, so it makessense to use labor in de-termining a formula forallocating overhead.

In this case, it doesn’tmatter how big the jobswere — but it does matterhow productive they werebecause your company

depends on efficient laborto make a profit. Over-head exists to supportyour workers on the jobsand the more labor youuse, the more overhead isabsorbed. This methodgives you a more realisticview of your profitability.

As I said, working withyour CPA to determinethe best method for yourbusiness is best.Whichever method youchoose, there are manyconstruction specific ac-counting systems canhelp contractors to trackoverhead costs, calculatea ratio against actual ex-penses and report this ina way that’s understand-able and accurate. Run-

ning these reports regu-larly will give contractorsa more accurate under-standing of all costs andgive a clearer picture ofthe bottom line.

LAS VEGAS — Case ConstructionEquipment today launched its CX210Cfull sized excavator at the World of Con-crete 2012 show. The most recent additionto the company’s C Series product line, theCX210C model features increased fuel ef-ficiency, productivity and improved serv-iceability and operator comfort.

The new Case CX210C excavatorachieves 160 net hp using Tier 4 Inter-im certified cooled exhaust gas recircu-lation (CEGR) technology that burnscleaner while delivering superior horse-power. A new narrow undercarriage ver-sion, measuring 8-foot 6-inches wide, isavailable for easier transport.

“The new Case CX210C excavatordelivers both the lower operating costsand higher productivity that contrac-tors expect,” said Tim O’Brien, brandmarketing manager, Case Construc-tion Equipment. He cited 10 percentfuel economy gains, three percent cycletime reductions and seven percent liftcapacity increases among crucial prod-uct improvements.

“An advanced version of the Case In-telligent Hydraulic System technologyreduces total fuel consumption and im-proves performance,” O’Brien said.Boom Economy Control lowers engineRPMs during the boom down and swingoperation, while the Auto EconomyControl lowers RPMs when the joysticksare inactive. Swing Relief Control tech-nology manages the hydraulic power al-lotted at the start of the swing opera-tion, and Spool Stroke Control createsan automatic pressure adjustment dur-

ing digging operations.

“These fuel efficiency gains are espe-cially significant,” O’Brien explained.“While typical CEGR systems lose fuelefficiency, we’ve actually increased fuelefficiency on our Case CX210C excava-tor by 10 percent over the previous BSeries model. While delivering excep-tional fuel efficiency, the Case C Seriesmodels continue to be in the top of theirclass for productivity.”

He continued, “Because excavatorsrun with little change to engine speed,CEGR technology was the best choicefor efficiency and convenience.”

Increased productivity

With three percent faster cycle timesthan previous models, the new CaseCX210C excavator can load moretrucks or trench further during everywork shift. Along with faster cycletimes, the new Case excavators offer op-erators smoother and easier control andmaneuverability.

The CX210C provides seven percentmore lift capacity and boasts a 440-pound increase in operating weight totackle bigger jobs. The excavator has anoperating weight of 47,800-pounds, abucket digging force 34,171-pounds,arm digging force of 24,729-pounds anda maximum dig depth of 21-foot 10-inches. Standard bucket sizes rangefrom .65 to 1.53-cubic-yards.

The new excavator offers three powermodes — SP (speed priority), H (heavyduty) and A (automatic) — to allow op-erators to choose the best mix of powerand fuel efficiency. The throttle settings

also adjust the hydraulic settings forfurther tailoring to specific tasks.

Improved operator comfort, visibility

The Case CX210C excavator gives op-erators a more spacious, comfortableand quiet cab, with 19 percent bettervisibility from the operator’s seat (in-cluding a new roof skylight) comparedto previous models. Noise reduction im-provements, including vibration refine-ment on the cab’s reinforced tubularstructures, create an extra quiet cab en-vironment, with automotive like noise

levels as low as 69.9 dBa.

The cab on the new Case excavatorprovides seven percent more overallspace and 25 percent more airflow. Airconditioning performance also has in-creased by eight percent.

data, including a newfunction which providesfuel consumption per

hour. Operators can usethis information to refinefuel efficiency for theirparticular operation.

Case engineers de-signed the CX210C, likeother C Series excava-tors, with a very low pro-file that enhances visi-bility from the cab whileefficiently accommodat-ing Tier 4 emission sys-tem components.

The CX210C excavatoralso includes a standardair suspension seat andan in-cab auxiliary hy-draulic setting systemwith a new option for 10memory recall settings tomake tool changes quickand easy for operators. ALevel 1 ROPS/FOPS(rollover/falling objectprotection systems) cabstructure provides helpsenhance operator safety.

Ease of maintenance

Extended service inter-vals for the Case C Seriesexcavators help reduceoperating costs, O’Briensaid. They are designedwith 500 hour engine oilchange intervals, 5,000hour hydraulic oil changeintervals and 1,000 hour

greasing intervals withEasy Maintenance Sys-tem bushings. The cab in-cludes new access pointsto easily reach the air fil-ter and fuse box. TheCase CX210C excavatorscored a two percent im-provement over previousmodels on the SAE main-tainability index.

“The new Case C Seriesexcavators efficientlypackage the redesignedengine, cooling and ex-haust systems whilemaintaining excellentserviceability and opera-tor visibility,” O’Briensaid. “The machines fea-ture wide open panels foreasy access to servicepoints and ground levelaccess to grouped lubri-cation points.”
