The Public Procurement Appeals Authority (PPAA) has upheld an appeal against Tanzania

Airports Authority (TAA) with regards to tender for supply of airport crash/rescue fi re tenders for regional airports, after the bidder it disqualifi ed successful-ly challenged the entity’s deci-sion not to offer him the contract.

According to the ruling, Marcé Fire Fighting Technol-ogy, who was the appellant, challenged the validity of the grounds TAA cited to reach the

Apparently, the dispute orig-inated in the understanding or otherwise about the essence of minimum specifi cations, that is, whether a bidder could in fact be deemed to have met spec-ifi cations if they offered spec-ifi cations that were superior.

According to the ruling, the specifi ed inter axle clearance was given as “a break over ramp an-gle of 30o-28o “ while the appellant quoted “116o. minimum inter axle clearance” and claimed that his quotation was in fact 32 degrees

Noting that many projects which were audited by the Public Procurement Regulatory Author-ity (PPRA) were identifi ed with poor performance and high cor-ruption likelihood faced investi-gations as well as possible legal consequences, Dr. Mpango said it should be clear to everybody that the government would never tolerate loss of taxpayers’ money.

‘’In the case of Tanzania, public procurement accounts for over 70 percent of recurrent expenditure and 100 percent of development expenditure. This sheer size of pub-lic procurement in the fi scal space, justifi es close attention’’ he said.

Dr. Mpango called for close monitoring of public procurement especially in developing coun-tries where, he said, the profes-sion was prone to both petty and grand corruption. ‘’It is estimat-ed that 90 percent of corruption in developing countries has to do with public procurement,” he said.

Mahitaji ya Serikali yakielekez-wa kwenye bidhaa za ndani kwa kiwango maalum kisheria kwa kutumia Sheria ya Ununuzi am-bayo ndiyo mwongozo wa ma-tumizi yote kwenye upande wa manunuzi, watu wengi wataingia kwenye uzalishaji kwa kuwa ku-takuwa na uhakika wa soko na ubunifu utaongezeka. Matumizi ya bidhaa za ndani yana matokeo chanya moja kwa moja kwa Serika-li yenyewe kwa kutengeneza ajira, kuongeza mapato, kukuza viwan-da vya ndani, kuongeza mauzo nje na maendeleo ya vizazi vijavyo.

Ununuzi wa umma un-aweza kutia hamasa katika ubunifu wa kuzalisha bidhaa na huduma kwa njia tatu.

Moja; Taasisi za umma kununua bidhaa ambazo ziko sokoni tayari kama mfumo wa

kawaida ulivyo na kutokuwa na kipengele cha utafi ti na maende-leo lakini kukiweka kipengele cha ubunifu katika vitabu vya zabuni vinavyotumika na watoa hudu-ma kuomba kufanya kazi na ta-asisi za umma. Msingi mkubwa hapa ni ubunifu ambapo kamati ya uthamini ya zabuni (S.40 ya sheria ya Ununuzi wa Umma ina-paswa kuzingatia sana wakati wa kuchambua zabuni yenye sifa sta-hiki. Kwa mfano taasisi za umma zinaweza kuweka kipengele cha kila meza ya ofi si kuwa na nembo ya ngao ya taifa kama sifa kub-wa ya kushindana na atakae buni vizuri ndio anapata mkataba wa kufanya biashara na taasisi husika.

TAARIFA KWA UMMA the minimum specifications pro-vided for in the tender document.

On offering an engine capacity that differed with specification, the appellant argued that TAA had clarified by saying that for 4x4 vehicles the capacity should not exceed 300hp and for 6x6 ve-hicles it not exceed 420hp. This being so, they offered to supply vehicles of 6x6 with 420hp and 4x4 vehicles with 326hp – mean-ing all vehicles and their horse power rating were all within the range specified and that there-fore TAA should not have dis-qualified him on that ground.

The gist of the appellant’s ar-guments was that as TAA pro-vided only minimum specifica-tions, the fact that his quotation superseded them could not have led to disqualification, as they

complied with the requirements.For his part, TAA replied that

the appellant’s tender was disqual-ified for failure to comply with the technical specifications and argued that while indeed it had specified minimum specifications, howev-er, that did not allow him to sub-mit specifications beyond those provided in the tender document.

The entity was adamant that the appellant ought to have strictly adhered to specifica-tions as per the tender docu-ment and prayed for dismissal of the appeal for lack of merits.

In determining the grounds of the appeal, the Appeals Authori-ty observed with regards to min-imum inter axle clearance that the appellant offered 116o ramp angle or 32o break over ramp an-gle which is higher than the one specified in the tender document. It also observed that the entity’s expert failed to counter the ap-

pellant’s argument and also that he insisted that the appellant did not comply without any techni-cal input to support that stand.

Furthermore, PPAA observed that as TAA had allowed the sub-mission of higher specifications, the basis for evaluation could not be fixed at minimum specifi-cations and went on to disagree with TAA that the appellant did not qualify because of sub-mitting superior specifications.

Regarding height, PPAA ob-served that it was not stated in the tender document that the vehicles

wanted should fit TAA’s parking spaces, or even providing mea-surements for their parking spaces and also observed that TAA was adamant without citing the tender document, later on admitting that the standard height for the fire sta-tion door is not less than 4.0m. In that regard, the Appeals Author-ity ruled that the appellant had complied with this criterion and that therefore their disqualification on this ground was not justified.

PPAA concurred with the expert that the monitor system of 6000L/min which was offered by the ap-pellant instead of 4500L/min speci-fied, was more advantageous to the procuring entity since the vehicle was capable of discharging water

more forcefully compared to what TAA had specified. In that regard and taking cognizance of the entity’s own desire to be supplied with su-perior vehicles, PPAA ruled that the appellant’s disqualification based on this criterion was not justified.

On engine capacity, PPAA not-ed TAA’s admission during the hearing that due to the issued clar-ification, the bidders were at liber-ty to quote either 6V or 8V engine provided that for the former the horse power should be not less than 420 - which the appellant com-plied with. The Also on this mat-ter, the Appeals Authority ruled that the disqualification of the appellant’s bid was not justified.

PPAA formed the view that

TAA misconceived the public pro-curement law for disqualifying the appellant, since the entity’s own tender document allowed flexibil-ity on specifications and conclud-ed that the appellant’s disqual-ification was not justified at all.

Consequently, PPAA upheld the appeal, nullified the proposed award and ordered reinstatement of the appellant in the tender pro-cess. In addition, the Appeals Au-thority ordered TAA to re-evaluate all tenders including the appellant’s tender, from the detailed evalu-ation stage, specifically on price comparison, and then to conclude the tendering process accordingly.
