Appeal pointless as disputed decision occurred after bid validity period, PPAA rules

Poor compliance levels re-vealed by PPRA’s Annu-al Performance Evalua-tion Report for Financial

Year 2018/19 has prompted the Minister for Finance and Plan-ning, Dr. Philip Mpango, to or-der suspension of procurement offi cers in six procuring entities (PEs) to allow investigation of their culpability, TPJ can report.

Dr. Mpango gave the directive after receiving a briefi ng from PPRA’s Board Chairman, Amb. Matern Lumbanga, to the fact that six procuring entities, name-ly Vocational Education Training Authority (VETA), Agricultural Seeds Agency, the National Insti-tute for Medical Research (NIMR), Kaliua District Council, Nsimbo District Council and Centre for Foreign Relations, had scored per-formance levels of below 60 percent.

The minister also direct-ed heads of those procuring entities ‘to re-evaluate them-selves’ to see if they were still suited for their positions.

“I need more investigation to be conducted for all procuring en-tities with poor compliance level [and] I direct that steps be taken

The Public Procurement Appeals Authority (PPAA) has dismissed the appeal against Tan-

However, the Chairman also told Dr. Mpango that through in-vestigations, PPRA managed to prevent loss of TZS 3.39 bn which would have occurred due to mis-appropriation by unscrupulous bidders and offi cials, a detail which prompted the minister to say with pleasure “You are doing a commendable job and the gov-ernment has noted your support towards government’s efforts.”

Speaking on twelve contracts worth TZS 25.8 bn which were found to have high level of cor-ruption red fl ags, Dr. Mpango di-rected PCCB to take appropriate actions immediately against all the culprits in what he called “this can-cer [which] must be dealt with.”

“Deal with them all, I mean all… don’t leave any stone un-touched,” Dr. Mpango said of the culprits involved in the contracts at the Ministry of Water and Irri-gation, Tanzania Railways Cor-porations (TRC), TBS and Tan-zania Ports Authority (TPA).

According to the Chairman, PPRA conducted value for money audits on 290 procurement con-tracts worth over TZS 8 bn, which comprised of building, roads, bridges and civil works worth over TZS 996 billion; electrical works worth TZS 25.85billion; and over TZS 7 billion worth of railway con-struction works. Others were water supply and irrigation schemes total-ing TZS 60.11 billion; goods worth 124.84 billionn as well as consultan-cy services worth TZS 48.24 billion.

Sheria ya manunuzi ya umma inaruhusu mz-abuni anayehisi kuwa hakutendewa haki

katika mchakato wa zabuni ku-peleka malalamiko yake kwa afi sa masuuli ndani ya kipindi cha siku saba za kazi toka siku alipopata taarifa ya mazingi-ra yaliyozaa malalamiko hayo. Aidha, sheria haimruhusu mz-abuni kupeleka malalamiko iwapo mkataba wa zabuni husi-ka utakuwa umekwishasainiwa.

Sheria hii pia imempa afi -sa masuuli muda usiozidi siku saba kushughulikia malalamiko na kuyatolea uamuzi, na iwa-po atashindwa kufanya hivyo au kama uamuzi aliotoa hau-tamridhisha mlalamikaji, basi mlalamikaji atakata rufaa PPAA ndani ya siku saba toka alipo-pokea uamuzi wa afi sa masuuli.

Kwa upande mwingine, iwa-po mkataba utakuwa umekwisha-sainiwa, mlalamikaji anatakiwa kupeleka malalamiko yake moja kwa moja PPAA. Aidha, kati-ka hali hiyo, sheria imeielekeza PPAA kuitaka taasisi inayolala-mikiwa kuwasilisha taarifa na nyaraka zote zinazohusiana na zabuni husika na ikishazipitia in-aweza kuamua kuyatupilia mba-li malalamiko hayo iwapo itaona

hayana mashiko, au kuyasikiliza na kuyatolea uamuzi kama vile kufuta mchakato wa zabuni husi-ka na hata kuamuru kufanyika kwa mchakato mpya. Sehemu ili-yobaki ya makala hii itabainisha baadhi ya sababu zinazoweza kui-fanya PPAA kufi kia uamuzi huo.

Kanuni za manunuzi ya umma zinaelekeza kufanywa uchambuzi wa zabuni kwa kutumia vigezo vilivyoainishwa kwenye nyaraka ya zabuni peke yake. Hii ni ili ku-toa haki sawa kwa waombaji wote na jambo hili liliwekwa bayana na PPAA katika Kesi ya Rufani ya Zabuni kati ya JKV and Profession-al Associates Services (Mrufani) dhidi ya Halmashauri ya Manispaa ya Morogoro (Mrufaniwa). Katika kesi hii Mrufaniwa alikataa zabuni ya Mrufani kwa kutumia vigezo ambayo havikuwa katika nyaraka za zabuni. Katika uchambuzi wa zabuni hii, ya kumtafuta msimaizi wa miradi ya barabara, zabuni ya mrufani ilikataliwa kwa kigezo cha team leader kuwa na post-graduate degree wakati nyaraka zilitaka digrii ya kwanza. Aidha, kiliwekwa pia kigezo cha mhandi-si wa vifaa kuwa na post grad-uate degree na watumishi wote

katika mradi kuwa watumishi wa kudumu wa kampuni waka-ti hakukuwa na hitaji hilo katika nyaraka ya zabuni. PPAA iliweza kujiridhisha kuwa vigezo vilivyo-tumika vilikuwa vipya na hivyo ilikubaliana na madai ya mrufaa na kuiagiza halmahauri kufanya upya mchakato wa zabuni hiyo.

• Kutoa mkataba kwa kampuni isiyokuwa kwenye orodha ya GPSA kwa aji-li ya huduma mtambuka

Sheria imeipa GPSA jukumu la kuandaa mikataba ya ununuzi wa vifaa na huduma mtambuka kwa ajili ya taasisi za umma. Aidha, kwa vile mikataba hii huwa haina bei, taasisi nunuzi huitisha ush-indani mdogo kutoka kwa waz-abuni walio kwenye orodha ya GPSA ili kumpata mwenye bei nafuu. Taasisi zinalazimika kishe-ria kutoa mikataba kwa wazabuni walioko katika orodha ya GPSA. Msimamo huu ulibainishwa pia na PPAA katika kesi ya Rufani ya Zabuni baina ya Pamba Road Service Station (Mrufani) dhidi ya Mwauwasa (Mrufaniwa). Ka-tika kesi hii, Pamba Service Sta-tion haikuridhishwa na kitendo cha Mwauwasa kukusudia kutoa mkataba kwa kampuni ya ORYX ambayo haikuwa katika orodha ya GPSA. The appellant further al-leged unfairness in awarding the tender, stating that they were the lowest evaluated bidder.

For its part, Tanesco argued that the appellant was indeed disqual-ified from the tender process for failure to co-operate with the en-tity after they were informed via their email address – by which the appellant had received the notice of intention to award - that they in-tended to visit the factory on a par-ticular date to negotiate on quality assurance of the meters, delivery assurance, compliance with le-

bilities and refusing to co-operate.According to Tanesco the ap-

pellant refused to reply to the email, to answer phone calls and also that when the entity decided to visit the factory re-gardless, it was denied access.

The entity added that much as the appellant had quoted the lowest price, eligibility for award depended also on having to com-ply with other checks and bal-ances and prayed that the appel-lant should not be reinstated in the tender process as they had blatantly disregarded tender-ing procedure and denied them-selves the chance of negotiation

and evaluation of their premises.In determining the grounds of

the appeal, the Appeals Author-ity reviewed the tender docu-ments and observed that the bid validity period had expired and that there was no evidence that it was extended – a fact which was not disputed by any party.

PPAA also observed that Tanesco had gone ahead and is-sued the notice of intention to award as if the tender was still valid, contrary to the law and concluded that there was no valid tender for consideration.

Consequently, PPAA dis-missed the appeal and ordered each party to bear its costs.

• Ukiukwaji wa taratibu katika uchambuzi wa zabuni

Kanuni zimeweka utarati-bu wa kufuata katika chambuzi wa zabuni, kuanzia uchambuzi wa awali, uchambuzi wa kina na mwisho post qualification. Ukiuk-waji wa kanuni unaweza kusababi-sha zabuni kufutwa kufuatia rufaa. Msimamo huu uliwekwa bayana na PPAA katika kesi ya Rufani ya Zabuni ya M/s Nippon Automo-bile Garage Limited ( Mrufani), dhidi ya Tanzania Standard News-paper Ltd (Mrufaniwa). Katika kesi hii, kampuni ya Nippon Automo-bile, ilikuwa ikilalamika kwam-ba pamoja na kuwa na bei ndogo, haikushinda zabuni. Pamoja na hoja nyingine, rufani ilijikita katika hoja kuwa mshindi wa zabuni hiyo hakushinda kihalali. PPAA iliweza kubaini kuwa kulikuwa na upun-gufu katika maeneo kadhaa, kama vile kiapo cha dhamana cha mshi-di kutokidhi matakwa ya zabuni, taratibu za uchambuzi kutofuatwa kwani uchambuzi wa kina ulirukwa na hivyo postqualification kufany-wa mara tu baada ya uchambuzi wa awali. PPAA iliweza kubaini kuwa mshindi wa zabuni hiyo hakuwa halali kutokana na uchambuzi ku-endeshwa kunyume na taratibu. Aidha, PPAA iliamuru mchakato

wa zabuni hiyo kufanywa upya.• Marekebisho katika nyara-

ka za zabuni kutotolewa kwa wazabuni wote walioshiriki

Nyaraka sanifu za zabuni zin-aelekeza kuwa iwapo kutakuwa na marekebisho (addendum) katika nyaraka za zabuni, basi mareke-bisho hayo yanatakiwa kuwafikia wazabuni wote walioshiriki, vinginevyo itakuwa vigumu kul-inganisha zabuni kwani nyingine zitakuwa zimeandaliwa bila kuz-ingatia marekebisho. PPAA iliweka msimamo huo katika kesi ya Ru-fani ya Zabuni ya Jaffery Industries Saini Ltd (Mrufani) dhidi ya Tanza-nia Institute of Accountancy (TIA (Mrufaniwa). Katika kesi hii, Mr-ufani hakuridhika na kitendo cha TIA kurudia tathmini ya zabuni bila kuzingatia addendum iliyoku-wa imetolewa kwa ajili ya zabuni hiyo. PPAA ilibaini kuwa sababu ya addendum hiyo kutozingati-wa katika tathmini ya pili ilikuwa kwamba haikuwafikia waomba-ji wote walioshiriki. Hata hivyo, PPAA ilieleza zaidi kuwa zabuni ziliandaliwa kwa kutumia specifi-cations mbili tofauti kwani kuliku-wa na wazabuni waliopata adden-dum na kuzizingatia na kulikuwa na wengine ambao hawakuzipata. Mwisho, PPAA iliamuru mchaka-to huo urudiwe kwani ucham-buzi hauwezi kufanyika kwa ku-tumia specification mbili tofauti.

• Kubadilisha au kuondoa ki-gezo cha uchambuzi ili kumpende-lea mzabuni aliyepungukiwa sifa.

Uchambuzi ni lazima ufanyike kwa kuzingatia vigezo vilivyomo katika nyaraka ya zabuni. Sheria

hairuhusu kubadilisha kigezo ili kumpendelea mzabuni ambaye amepungukiwa sifa; mabadiliko yanaweza kufanyika iwapo hayata-muathiri mzabuni mwingine katika zabuni hiyo. PPAA iliweka msima-mo huu katika kesi ya Koates Tan-zania Ltd (Mrufani) dhidi ya Wizara ya Mawasiliano Sayansi na Tekno-lojia (Mrufaniwa). Katika kesi hii, Mrufani alimlalamikia Mrufaniwa kwa kutokumpatia matokeo ya zabuni na kwa kupunguza muda wa uhai wa dhamana ya zabuni.

PPAA iliweka bayana kuwa zabuni ya Mrufani ilitakiwa ku-kataliwa katika hatua ya awali ya uchambuzi kwani dhamana yake haikukidhi muda wa uhai wa zabuni kwa mujibu wa maelekezo katika nyaraka za zabuni.

HitimishoSheria ya manunuzi ya umma in-atoa fursa kwa yeyote anayehisi kwamba hakutendewa haki ka-tika manunuzi kupeleka malala-miko kwa afisa masuuli wa taasisi au na kukata rufaa PPAA ili apa-te haki. PPAA, ambayo kimsingi inaendeshwa kwa mfumo kama wa kimahakama, hupokea rufaa mbalimbali zinazohusu manunuzi ya umma, kuzisikiliza na baadaye kuzitolea uamuzi unaokwenda sambamba na remedies mbalimbali, ikiwa ni pamoja na kufuta mchaka-to wa zabuni na kuagiza mchaka-to wa zabuni kufanywa upya.

Hata hivyo, kufuta mchakato na kuamuru kurudiwa siyo aina pekee ya uamuzi unaoweza ku-tolewa. PPAA inaweza pia kua-muru mlalamikaji kulipwa fidia na hata kubatilisha uamuzi wa taasisi.

Ili mtoa huduma aweze ku-kamilisha usajili wake kwenye mfumo, anatakiwa alipe ada ya usajili ambayo ni Shilingi 30,000/- (Elfu Thelathini) tu kwa mwaka. Jinsi Ya Kulipia Ada ya Usajili Kwa Mwaka1.
