T hose first minutes on returning from a day at workhave to be amongst the most precious of times.Not because anything important happens, simply

because it is the moment in which you can wind downand relax. But of late that has not been so easy.

Since moving to the beautiful SussexSquare, those precious moments have beenpunctuated by unsolicited calls. Many of them appearto be international which immediately makes me thinkcall centre, some are definitely from the UK, and a largepercentage when the phone is answered simply go dead. It’sannoying to say the least when all you want to do is kick offyour shoes and pit your wits against the Eggheads.

I experienced this once before when I lived in sexySaltdean (it was sexy despite me and not because of me, Ihasten to add). Back then I made a few enquiries andeventually discovered I could request to be put on aregister of people who did not wish to receivecold calls from people selling services I hadnot requested.

It worked too, not completely but I didsee a marked reduction in the number ofcalls. So now I have to do the same again,find out who to call and request that I gooff the radar of firms who want to sell merandom services that I have nointerest in.

That will be my task for theweekend, to rid my early evening ofrude intruders of the telephonic kind.

Annoyingly though, they now seemto have my mobile number and I amgetting a stupid number of calls fromcompanies who want to sell meinvestments in the fine wines ofBordeaux. Now, do I look like the kindof man who has spare cash lashingabout to invest in weighty reds? No, I do not. I like a nice bottle of red and Ican be tempted to pay over the odds for a bottle of my favourite wines, a StEstephe perhaps or even a bottle of Chateau Musar from the Lebanon. Butnot a case of something for £1,000 with the promise that even if it does notgo up in price I can still drink the stuff, and owing to a tax loophole it is notdue death duty on my demise. Well, it’s not that cheery a thought, is it?

I like the phone, at home and about town, but I see it as an aid to my workand a means of staying in touch with family and friends – and anyone elsewho happens upon my numbers will receive the short sharp “no thank you”that I reserve for the unsolicited.

I was amazed on returning from Portugal to find the kitchen in a similarstate to how it would have been had I been there cleaning and scrubbing allweek. The filth usually in situ when I return from a holiday was nowhere to

be seen and I was initially so bewildered that I thought my children andlodgers might have been admitted to hospital, kidnapped, or gone on holidayin my absence. I fondly stroked the brand new, sleek black dishwasher, whichis more of a Porsche Turbo than a dishwasher, and silently thanked it forarriving the very day before I went away.

Mind you, reality lurked inside the dishwasher when I opened the door andit was obvious from the appalling stacking that my children had very muchbeen present in my absence. My children tend to only load the front half ofthe dishwasher, as anything which requires pulling out a drawer in order tostack it properly also requires an amount of effort that neither of thempossesses. Still, the kitchen was tidy, so I didn’t really care if they’d had thehalf-empty dishwasher on four times a day while I was away.

With domestic matters in order, I had to address the ongoing issue – for thepast six years in fact – of the purchase of the Freehold of the properties I ownin Hastings. I had beenreceiving various emailson the topic throughoutmy holiday. There areeight flats in thebuilding, of which I owna half-share of two. Ofthe other six lessees,three are perfectly sane,reasonable people andthe other three are – asfar as I’m concerned –obstreperous idiots.

Five years ago, I wentto great efforts in orderto get the valuation ofthe Freehold done,organise solicitors,form a limitedcompany and generallyrun around like a headless–and for the most part unpaid –chicken for six months.As we were just a dayaway from exchange,one of the obstreperouslessees said he wasn’tprepared to go ahead atthe agreed price, as hethought it was tooexpensive. Of course, said lessee did nothing to suggest how we could getthe price down or offer his ‘expert’ advice during the lengthy negotiationprocess. His lack of participation made the other five participating lesseesdecide not to go ahead. Instead, we went for the Right To Manage, whichhas done nothing more than act as an ineffectual sticking plaster. Now,with leases running under 70 years, the lessees are murmuring once moreabout the possible Freehold purchase. The Landlady & the suspiciously clean house...

Overcrowding, smallpox, cows, ‘unusually offensive’manure, drunken fights and

funfairs defined the neighbourhoodto the south-west of Hove Stationduring Victorian times.

Although bus-related activitieshave taken place in the area sincethose days, it was the opening ofthe enlarged and remodelled busdepot on the north of the site in1940 that saw the operationconsolidated. 1965 was the yearthat demolition of the five-acre plotbelow the bus depot commenced,between Sackville Road, EthelStreet, Conway Street andClarendon Road. Terraced housing,workshops and garage werereplaced with four large residentialblocks and several industrial units.

A proposal to demolish the bus depot and the industrial units to construct a nine-screen cinema, a climbing wall, asupermarket (Waitrose, I hope), offices,housing and a number of other bits andpieces is now in the process of beingunveiled to and discussed with members ofthe public. It specifically involves theentirety of the four blocks which surroundthe Fonthill Road/Conway Street junction.

Andrew Lambor of local firm MatsimProperties is the man with the plans, and NickLomax and his team at Brighton-based LCEArchitects have drawn them up. It is currentlyat the concept stage which means that now is really the time for neighboursand policy-makers to have their say. The planning stage is too late.

Seven years ago, when the country was spending more money than it had,there were major projects popping up in front of us left, right and centre. Ideasfor the King Alfred, Black Rock, the Brighton Centre and the Marina came tonothing. Plans for inappropriate towers on the King Alfred seafront site gavemajor projects, especially those which involved tall buildings, a bad name.

This industrial location is quite different to the King Alfred in that these is noparticular conservation angle nor are there buildings to the north. Any shadowsthat might be cast affect only a wide railway line. If the architecture is of a highquality, and it is accepted that more homes are needed, I can see little reason tonot welcome this exciting proposal with open arms.

The King Alfred project was monikered the “tin-can towers’ but this schemehas not got a nickname yet, or even a name for that matter. Perhaps readerscan help. I will publish any sensible, or amusing, suggestions that I receive in acolumn [email protected]

Distracted Dad Mama MaloneRichard Hearn’s holiday on the rocks

T he trick of making a one week summer holiday feel like a two weeksummer holiday is to write a column. That way, you get to lengthen outits description to last two weeks (also known as: this is a barrel that I’m

going to take a fortnight to scrape).So here it is; part one of our week long holiday in Bath. And if I have to

come up with a theme for this week, it’s going to be ‘stones and rocks ofvarious sizes’. The main stone, of course, is the Bath Stone, which gives thecity its distinctive colouring and uniform feel. It reminded me of Edinburghwith a warm filter, and is genuinely beautiful, even in the rain – and rain is somuch a feature of our summer holidays, it reminds me of them.

On the stone theme, there were also ‘Roxy’ and ‘Peblo’, two christenedpieces of gravel from just outsideour holiday home, or“Ordayoam” asYoungest™ called it.Roxy and Peblobecame well-travelled gravel overthe week, going toBristol Zoo andacross the CliftonSuspension Bridge,and have nowrelocated to Hove. ‘Roxyand Peblo’ is also now thetitle of my newly-written children’s book(interested publishers can contact me viaLatest Homes).

The fact that gravel played a key featurein our holiday shouldn’t surprise regularreaders; The Boy has always been great atcreating makeshift toys from the mostmundane items. I just wish they weren’t soloseable, which always causes anguish.

Roxy and Peblo also went to Avebury tosee the stones there (a kind of ‘Meet theAncestors’). Now this is where I divert fromthe present and tell you about my singleprevious trip there. It was 22 years ago, Iwas an art student in London, and oneJanuary weekend a friend wanted to getout of the capital. We took a coach to Salisbury and a local bus to Avebury.We arrived there mid-afternoon with no easy way back and imagined –wrongly – that we’d be able to find some kind of hostel or cheap B&B. Thenext bus was at eight in the morning. Hopelessly unprepared, we ended upsleeping in a bus shelter on what must have been the coldest night of my life.Between some rocks and a hard place. One two-hour period was spent tryingto get warm by walking round and round a puddle that was slowly freezingthroughout the night; it was like a rubbish version of a camp fire. It was thecoldest and most uncomfortable night of my life. And 22 years on, I’m veryglad I did it.

Where was I? Oh, on the way back this time, we also went to Stonehenge.

T he child is mostdefinitely suddenly six.By six I mean older,

confident, and well... a bitcocky. Overnight she hasmorphed into Little MissChatback. Every sentenceseems to start with “NoMummy, it’s...” I am beingcorrected at every turn.After Mummy being a bit‘mumsy’ for years, I amhaving to wake up! I’m beingcorrected about everything;I’m no longer sure if myname is even correct. It isDumbo, right? Whereasbefore a “well, Earth is a planet inspace” would have easily answeredher question, I’m now practicallyhaving to explain dark matter, anti-matter and light years. Give it a fewmonths and I think she will beexplaining it to me. I wish I was ascientist. I don’t mean Brian ‘like you,just a bit more sciency’ Cox, I meanlike proper science. Y’know, in a labwearing a white coat. I wish I could go back to school and swap the art forscience (ignoring the fact that I got an E for biology and As in Art). I wouldlove to spend my days being overly logical and critical and analytic. (I’m stillhopeful there is a job for me that appreciates the skills my boyfriend findsimpossible in me.) When I was a teenager, being creative wasn’t consideredessential for a scientist – now that it is, I could have stared at tubes in labswith my imagination trying out all sorts of combinations.

Thing is... I don’t really get a lot of what they are saying in sciencedocumentaries unless I pause them for a minute and absorb theinformation. My mind is not quick enough to understand huge sciencetheories at speed, it needs to breathe in the theories. It feels a bit the samewith a six-year-old. I can’t keep up; she has accelerated overnight and I havestayed the same. My brain is having to think, not just quickly, but reallycarefully and really deeply about every answer I give her. Because not onlydo I want her to learn the correct answers, but if I get one tiny bit of itwrong, I will pay for it. I will get lost in loops of questioning hell, where I’mbacktracking and scaling walls to get out of questions I can’t answer.Questions like “why doesn’t the moon fall on our heads, Mummy?” A yearago I could have gotten away with “sticky tape”. Or even “because it doesn’t,now go to sleep”. Now I'm having to explain Newton’s theory of gravity,elliptical orbits and the interaction of centrifugal and centripetal forces. I puther to bed and want to put my head in the oven. (Luckily the oven isbroken.) Not only does my child want to know everything, she seems toalready know everything too, and gets really agitated if I correct her onanything. Tell me, is this a phase? I want my five year old back!

but the vast range of colours, textures and highfashion prints and patterns make them perfect forbringing your home into the now. They’re also greatvalue. This week, Latest Interiors has a night – or,rather, an afternoon – on the tiles.

Back to natureOn the one hand, tiles made from natural materialslike stone, slate and travertine are simple andbeautiful, giving classic, understated style to anyspace. Natural tiles have been used in homes andbuildings for centuries. Limestone is a classic finishfor period hallways, and looks great in bathrooms.Travertine has a more variegated appearance, and isalso available in a rage of forms and tones, includingpolished, honed and tumbled. Marble gives a cool,glossy finish. All of these natural materials will lookfabulous on walls or floors.

Made for youCeramic tiles are just as versatile as stone. Theycan also be more affordable, easier to work with,and offer a greater choice of colour and finish.Unlike natural stone, ceramics can offer uniform,clean lines, and are perfect for a contemporarylook. For a more traditional finish, terracotta,encaustic and mosaic tiles are just right for periodhalls, bathrooms and conservatories.

Colour and pattern are still a huge trend, though,and we love quirky folk and botanical motifs to addcharacter to a room. To update wall tiles, retroprints and architectural designs with prints andstyles from the ’40s and ’50s, Victorian botanicalillustrations, Majolica, and metallics (think agedsilver or bronze) are all key style themes. Forsomething simple but striking, choose vibrantcoloured glass tiles and mosaics which give asleek, almost luminescent finish. Paler shades ofblue and aqua glass work very well against wood,steel or granite worktops. Coloured grout can helpto bring out the colour of tiles, or add contrast.

Shape & sizePlaying around with different textures or sizescan make a big difference to a space. Outsized,rectangular tiles and flagstones on walls andfloors are popular, and can help to make smallspaces seem bigger. For small bathrooms, chooselarge, rectangular wall tiles to enhance the senseof space. Mosaics are coming back too – we lovethe glass and metallic mosaics at Fired Earth.Smaller mosaics, in ceramic or glass, can make astunning feature wall. You can also vary tile sizeswithin a space – use smaller square or oblongmosaic tiles to mark the borders of a room, withlarger tiles in the centre, for a very Victorian floor.A single row of small, coloured tiles along the topof splashbacks or worktops can also be a neatway of adding colour to a kitchen.

TEN out of TEN

In the ten years since they launched I have met with Simon Goldin, SimonLemcke and members of their team on many occasions. Not only at theirspacious Church Road offices but also out and about at properties they have

been marketing.It’s not often that an agent will invite a journalist to go along with them to

meet a client and view the property with them so on each occasion I wasfascinated to not only see the property but to meetthe vendors. But on every occasion it soon becameapparent why they wanted me to be there.

The reason was simple: it was only by meeting withtheir vendors that I would see at first hand the uniqueservice that they provide, the immediate bond, thelevel of honesty and the realistic presentation of aproperty’s potential.

On one occasion I met a couple in a fabulouslymodernised Hove Property. They had clearly lavishedtime, money and talent on their home – but theywere ready to move on once again. I say once againbecause the client had chosen Goldin Lemcke onceagain to market their home – and there wasabsolutely no doubt in their minds that they weremaking the very best choice.

It was a slightly strange experience; up until thenI had been shown letters of thanks by agents, but Ihad never seen this level of enthusiasm. Of course Isoon worked out why I had been asked along. Thetwo Simons would never have told me in their ownwords just how enthusiastic these clients were,they are far too modest, in that charming oldschool way, to boast at this level. No, far better totake me to see and hear it first hand.

As a company, Goldin Lemcke has never beenpublicity hungry and that is perhaps because theyhave, for the most part of their first ten years,been far too busy to court that sort of attention.But now, ten years on, they justifiably want tocelebrate that success.

Many firms would do that by waving andshouting about how good they are and there is littledoubt that Goldin Lemcke are good, how else would theyhave come through a double dip recession and still beperforming with such buoyancy? But for the twodirectors this is as much an opportunity to say thankyou, thank you to their clients, thank you to theirbusiness associates but most of all thank you to theirhard working and loyal team.

But there has to be more to that success, surely?Theiranswer is clear and simple: focus! From day one, ten yearsago, they were focused on offering an excellent service inthe field of property sales. It’s a policy that has done themproud, even in the bleakest moments of the financialcrisis. Unlike other companies who diversified into lettings,Goldin Lemcke stood firm with what they knew they didbest. Lettings is, after all, an entirely different business.They stood firm and that stoic approach has paid off.

Equally they have never felt the need to adopt a corporate approach oruse corporate business practices. They have always been and intend toremain fiercely independent, recognising that the people of the city ofBrighton and Hove actually love the proliferation and strength of localindependent businesses.

When I ask many agents what makes them different from the rest they willlist all the extra services that they offer, a string of related deals that can forsome clients be useful, but for many, they have already put in place theirfinances, have a regular law firm with who they like to work and the samewith surveyors.

When I asked the two Simons what marks them out as different from otheragents they smiled and as one replied: “We’re not different from other agents inmany ways, but we like to think we are better.” It’s a frank and simple response,but when coupled with their policy of focus it is one that makes sense. So, are there any other secrets to their succesand longevity? “One thing we have always doneand will always do is be here, present in theoffice. We may be the directors but we firmlybelieve in being here, picking up the phone andanswering the calls. We talk directly with ourclients and make sure they see us as activemembers of the team and not just directors,sitting back and letting our staff do the work.

“We also believe in looking forward andensuring that as a business we have a strongfuture. In estate agency there are inevitablelean times. The banking crisis certainly showedeveryone that. But on a year on year basis thereare seasonal changes in this business, a slowAugust when many people are on vacation andChristmas when few people want to deal withhaving a property on the market and theintrusion of viewings. We have always believedin making provision for those times with a strong

forward business plan that makes that possible. Wecould go out when times are flush and spend all ourprofits in a profligate way, but we have always neededto know that the money is there to see us throughevery circumstance.”

Recently, Goldin Lemcke has joined the NationalHomes Network. There is one estate agent in each UKcity. “We are strongly represented in London with anoffice and internet presence. This is a great opportunityfor us but also for our vendors. We can go to the MarbleArch office to meet potential buyers in person. Rather surprisingly it has recentlybeen decided in the Court of Appealthat a senior employee who is not adirector, depending on the terms ofhis Contract of Employment, doesnot owe such a fiduciary duty to thecompany. In other words he wasunder no fiduciary or contractualduty to tell his employer that he wasmeeting with existing customers ofthe company with a view to doingbusiness with them when he left. Inthat particular case, there was norestrictive covenant preventing theemployee setting up in businessafter he had left.

Q. In those circumstances I assumetherefore that I would not beentitled to dismiss my employee?A. It would be dangerous to do so

Q. I run a small IT company withsome fairly highly paid senioremployees. I suspect that one ofthem is planning to leave and set upin competition with me. Can Idiscipline him including possiblydismissing him, for this conduct?A. If the employee in question is adirector of your company he has afiduciary duty to the companywhich in practice means that thesort of conduct which you suspectwould be in breach of his director’sduties and assuming that you hadsome proof of what you suspect, hecould be dismissed for grossmisconduct and removed as adirector provided proper proceduresare followed.

Q. Are restrictive covenants worth anything?A. The courts have vacillated overthe years but the current trendseems to be to enforce thesecovenants provided they arereasonable in time and geographicalreach and are clearly worded in away that is relevant to theemployers’ business needs.
