Milestone in property

W hen I collected the keysfor the holiday shack inNorfolk from Katy last

week, she mentioned that therewas an elderly couple residingin the chalet next door whowere not getting on well withthe storage heating and wantedto move into Katy’s (which hasa proper boiler) as soon as I’dleft. Katy, who no longer letsout her holiday home to thegreat unwashed – mainlybecause she hates almosteveryone – was loathe to letthe couple move in, but hadagreed to do so because theletting agent was one of thefew people on her ChristmasCard list and she wanted tohelp her out. The followingparagraph is an excerpt fromthe email Katy sent to theletting agent. I am the ‘friend’,by the way;

“So, they’re saying that theydon’t like the chalet being socold, but they think the heatersare too hot? Sounds like they’llnever be happy. My friend’sleaving Monday, unless she gets snowed-in, in which case they can’t move in.If we let them in, my friend can show them how to work the boiler before sheleaves. There is a new mattress on the double bed. Can you please point thisout and tell them that any damage (coffee stains etc!) will have to be paid for.Please let them know that I do not like letting this chalet out and am doing itas a favour, so if they don’t like it, they can get lost! Also, please tell themthere is no washing machine, dishwasher, oven or curtains. Oh yes, andsmoking and pets are definitely not allowed!”

Can you feel the love?Since I’ve been here at the chalet, I hadn’t heard a peep from the elderly

couple, until this morning when an old man appeared on my doorstep ataround 8am. I’d just got up, which meant that I was wearing all my clothes,due to the sub-zero temperatures, so I must have looked like an overweightvagrant. The wind was so ferocious that the poor man was hanging onto thedoor post for dear life, so I invited him in. He seemed to be very confusedwhen I told him that I wasn’t leaving until the following day and said thatthey’d already packed their stuff ready to move in now. At least that’s what Ithink he said – he was in possession of a Brummie accent so strong that hemight as well have been speaking Gaelic. Within the space of a few moments,I was conversant with all his ailments, knew that he was 81 years old and hadonce fallen off a 270 foot chimney in Selly Oak, yet only suffered shock andminor burns from the lime pit that he landed in. I knew how many bullets histhree brothers took during World War II (and their locations) and how manybones he’d broken when a barn roof collapsed on him in 1979. I’m locking thedoor tonight. Pity there’s no curtains...

Two quite different tripsthis week. One to theNatural History Museum,

and one to Milton Keynes. Onewith kids and one without. Soit’s the ideal time for compareand contrast, more about thejourneys than the destinations.

Let’s start with the NationalGallery by train. It’s me, The Boyand Youngest™; I know in advancethat it’s ambitious, but I steel myselfknowing the end result will beworth it, and head off. It’s thepushchair that causes themain problems, not thechildren. To start with, on abusy train, the pushchair isan advantage. Youngest™gets his own seat. Later,the pushchair works less in ourfavour. It’s all about the search forslopes, the enemies that areescalators and the love of lifts,meaning that it’s not so much A toB, as A to C because you’ve gotblocked off, trying E, someone elsesuggests F, then you eventuallyget to D which takes you – finally, unexpectedly – to B.

There is a clue in the word ‘Underground’ that indicates we might haveproblems. The place name is simply stating its alternative height! It does exactlywhat it says on the tin! Luckily, we only have to go two stops plus we aregenuinely blessed with the kindness of strangers, who play a kind of tag-helping.

The Natural History Museum is great, of course. The highlight, as always,was the blue whale – “and white, and grey” as Youngest™ points out (he’skeen on details) – but there were also the fantastic exhibits in the centralhall, the dinosaurs, the dolphins you can swivel (long story) and a newsection called ’Treasures’.

My other journey was Milton Keynes in a car. For reasons too lengthy toexplain, I needed to make a delivery which meant a 6 hour round trip, withoutkids. Not the most glamorous day, but it felt like a kind of luxury. I’d get tolisten to my own music without a chorus (no pun intended) of disapproval fromthe back. I wouldn’t have to ‘sell’ where we were going every few minutes, andthere would be no need to make up car games: “Who can spot an animal?”There aren’t that many animals on the M1 – or in Milton Keynes for that matter.

I could also swear, which I was certainly tempted to do when faced withMilton Keynes’ so-called ‘centre.’ Despite the travelling being a little easier, I’d take Natural History Museum every day. Even when you are forced tomake a divert (because of the pushchair) you get to travel past a wholedifferent species. When I got diverted (because of M1 roadworks) on myMilton Keynes trip, all I saw was Hemel Hempstead.

I ’ve applied for mydaughter's school placefor a primary school. I've

had to consider where Iwould like my child to growup from age 7-11. This kindof mum responsibility forcesme to consider all the fears Ihave about my child growingup and consider what I wantfor her future. The pressurefeels horribly god-like. I feellike I’m making decisionsthat will affect her whole life. These early institutions affect us forever.

I remember having some issues in my 20s and a friend suggestinghypnotherapy would help. Whilst in a subconscious state the hypnotherapistasked me when I had felt this vulnerability before, and I recalled anexperience from primary school that I had totally forgotten about. How Icould have forgotten that the WHOLEschool had stopped talking to me formonths? 200 kids sent me to Coventry.The reason? Had I told someone SantaClaus didn’t exist? Had I eaten anotherkid’s Mojo? (The penny sweets, notAustin Power’s groovy essence)...Had Iput a friend’s Cabbage Patch doll under abus? No, I had stood up for my friendwho was being bullied.

Her friend Eva had stopped talking to her and then incited everyone toignore Geraldine. But I didn’t, I stood by her. What happened next was thatpeople started talking to Geraldine again and sent me to Coventry instead! Notliterally, that would have been quite nice for the 9-year-old me, I could havevisited my grandad. No, similar to disobedient monks sent to Coventrycathedral to reform in a vow of silence, I was ignored.

Being ostracised by a whole school at 9 years old for being a loyal friendwas something that apparently my brain didn’t want to remember, I buried itfor years. At least ostracised biblical figures usually die quickly after, orbecome king or summat. I had to carry on going to primary school. After talkswith teachers and parents, everything was sorted. Well apart from a fewthreatening phone calls from evil Eva telling me if she saw me in the streetshe was going to smash my face in. Secondary school was worse for bullyingso perhaps I just forgot about this minor incidence until my brain was able tocope with it. So choosing a primary school might seem a simple decision formost people; “can one park outside?” But going through my head was: howlikely is this school capable of permanently damaging my child’spersonality? Is anyone called Eva there? Are there any islands I can bring upmy daughter away from humans? Combine that with wanting her to have anincredibly good education so she can afford hypnotherapy when she’s older,making a school decision has been fraught.

I’ve had to organise psychometric testing for 200 families in Hove, ensureno children are called Eva at her new school and get a bloody grip!

T he heavy bite of the recessionhas resulted in cutbacks to theLegal Aid budget, limiting

availability and placing constraintson individuals’ incomes, whichmeans they are often not able toafford the use of solicitors. A greaternumber of people are having to ‘go italone’ when dealing with the falloutfollowing a marriage or relationshipbreakdown. We have noticed anincrease in the number of peoplestruggling to complete Courtapplications and having to attendCourt unrepresented. The breakdownof a relationship is a distressing timeand having to cope and deal with theformalities of Court only adds to thepressure and can further damagealready fraught relationships.

The Law Commission areconsidering whether they shouldmake changes, to make it easier forcouples, by providing more certainty

and clarity, particularly in respect offinancial matters. The advantage of this would be that applications tothe Court would be much more likelyto settle, as everyone would knowwhere they stand. The disadvantageof certainty and clarity is “a broadbrush, one suits all approach”,rather like the stance adopted by the CSA. This approach can beterribly unfair, as it does not takeinto account the circumstances ofan individual’s case but this is theprice that would have to be paid ifsuch reforms are to be made.

People looking for law firms whostill carry out Legal Aid work areoften unable to find a firm with thecapacity to take on their case. Evenif they are successful in finding afirm, they will often have their case

In both cases the employeessuggested that their employer couldallocate same-sex couples to theircolleagues. Their employersdisagreed, took disciplinary actionand dismissed them.

The ECHR did not interfere with theJudgments of the UK Courts, whichhad said that both employees hadbeen dismissed not because of theirreligious beliefs but because theiractions were contrary to theemployer’s fundamental aim ofpromoting equal opportunities to all.

Q.Can you update me as to therecent cases where employers havehad to balance employees’ religiousrights against the rights of gay menand women not to be discriminatedagainst on the grounds of theirsexual orientation?A.The European Court of HumanRights (ECHR) handed down theirJudgment in two such cases recently,along with their decision in the caseinvolving the British Airwaysemployee who was told to remove the crucifix that she wore on hernecklace. Whilst the British Airwaysworker won her case, two otherindividuals who had also applied tothe ECHR after they’d been dismissed,were not successful.

One case involved a ChristianRegistrar who refused to carry out Civil Partnerships on the basisthat same sex relationships werecontrary her religious belief. Her
