1 MEETING OF THE HOUSE

The House met at 10.00 am according to adjournment. The President took the Chair and read the prayers.

2 100TH ANNIVERSARY KANGAROO MARCH RE-ENACTMENT (Formal Business)

Mr Amato moved, according to notice:

1. That this House notes that:

(a) on 1 December 1915, eight months after the Gallipoli landing, 5,000 people watched 88 men aged from 16 to 60 years commence a 36 day march from Wagga Wagga to Campbelltown,

(b) this march, which is known as the Kangaroo March, was a recruitment drive to sign up volunteers who would become part of the ANZAC legend,

(c) the recruitment drive successfully recruited 222 brave new volunteers to serve during the First World War, and

(d) this year being the 100th anniversary of the march, a re-enactment following in the footsteps of the original 88 Kangaroo marchers will begin in Wagga Wagga on 5 September 2015 before arriving on 10 October 2015 in Campbelltown, a distance of 520 kilometres.

2. That this House acknowledges:

(a) the great achievement and dedication of the original 88 Kangaroo Marchers, including the 222 brave volunteers who were recruited to serve our country, and

(b) the historical significance of the re-enactment and the contribution of the organisers and participants of the event.

3 NSW PARLIAMENTARY LIBRARY 175TH ANNIVERSARY (Formal Business)

Mrs Maclaren-Jones moved, according to notice:

1. That this House acknowledges that this year, the NSW Parliamentary Library celebrates its 175th anniversary.

2. That this House notes that:

(a) the NSW Parliamentary Library supports the work of the Parliament and assists Members of Parliament, their staff, and the staff of the Parliament, and

(b) the NSW Parliamentary Library provides research papers, online and print resources, media monitoring and other essential services that enable the parliament to function more smoothly and effectively.

3. That this House thanks the staff of the NSW Parliamentary Library for their commitment to good and thorough research, and their invaluable assistance to members of Parliament, their staff and the staff of the Parliament.

4 HIA-CSR HUNTER HOUSING AWARDS (Formal Business)

Mr MacDonald moved, according to notice:

1. That this House notes that:

(a) on Saturday 24 October 2015, the Housing Industry Association held its HIA-CSR Hunter Housing Awards at the Wests Leagues Club, Newcastle,

(b) the annual Awards showcase the best housing workmanship in the Hunter, and recognise excellence in housing construction and design,

(c) Lindsay Frew Constructions won HIA-CSR Hunter Home of the Year, as well as Custom Built Home of the Year,

(d) McDonald Jones Homes took out Display Home of the Year, while Central Coast Luxury Homes was awarded Apartment of the Year,

(e) winners will progress to the HIA-CSR Australian Housing Awards, to be held in May 2016 on Hamilton Island, Queensland, and

(f) Mr Scot MacDonald MLC was pleased to represent the Government at the event.

2. That this House:

(a) congratulates all nominees and winners of the 2015 HIA-CSR Hunter Housing Awards,

(b) wishes all winners the best of luck at the Australian Housing Awards in 2016, and

(c) thanks Mr Craig Jennion and the staff of the Housing Industry Association for their initiative in organising such an excellent event.

5 TAFE NSW GILI AWARDS (Formal Business)

Mr MacDonald moved, according to notice:

1. That this House notes that:

(a) on 22 October 2015, the TAFE NSW Gili Awards were held at TAFE NSW Sydney Institute’s Ultimo College,

(b) the Gili Awards celebrate the academic excellence and achievement of Aboriginal students, as well as the contributions of TAFE NSW staff, institutes and programs to Aboriginal communities through vocational education and training,

(c) Hunter TAFE students recorded strong results at the awards:(i) Paige Hall took out an achievement award while Allan Carnley won Apprentice of

the Year, (ii) Kara Walker was awarded trainee of the year, and

(d) Mr Scot MacDonald MLC represented the Minister for Regional Development, Minister for Skills and Minister for Small Business, the Honourable John Barilaro MP at the awards, and presented the Aboriginal Staff and non-Aboriginal Staff Awards.

2. That this House congratulate all nominees and winners of the 2015 TAFE NSW Gili Awards.

6 SYDNEY FISH MARKET (Formal Business)

Mr Franklin moved, according to notice: That this House:

(a) notes that the Sydney Fish Market has been operating continuously for 70 years, having been established in 1945,

(b) notes that the Sydney Fish Market is the third largest fish market in the world,

(c) recognises the vital role the Sydney Fish Market plays in bringing regional seafood produce to an enormous number of consumers every day,

(d) congratulates Mr Bryan Skepper, the General Manager of the Sydney Fish Market and all of the staff on successfully operating the facility with such professionalism and efficiency, and

(e) wishes the Sydney Fish Market well for the next 70 years.

7 STATE EMERGENCY SERVICES HUNTER AWARDS CEREMONY (Formal Business)

Mr MacDonald moved, according to notice:

1. That this House notes that:

(a) on 17 October 2015, the New South Wales State Emergency Service (SES) Hunter Region awards ceremony was held at Kurri Kurri,

(b) the Hunter Region SES consists of 15 SES units which respond to Storm and Flood operations across nine local government areas, as well as providing support to other Emergency Services,

(c) the awards presentation was to 70 Hunter Region members with National Medals and Clasps, Long Service Medals and Certificates in recognition of their service to the SES,

(d) Mr Scot MacDonald MLC represented the Minister for Corrections, Minister for Emergency Services and Minister for Veterans Affairs at the ceremony,

(e) Mr Clayton Barr MP, Member for Cessnock also attended the ceremony,

(f) at the ceremony, Mr MacDonald presented the Hunter Region SES with a Certificate of Appreciation for their response to April’s storm and flood emergency on behalf of the Premier, the Honourable Mike Baird MP and the Honourable David Elliott MP, Minister for Corrections, Minister for Emergency Services and Minister for Veterans Affairs, and

(g) it is fitting that this certificate was presented to the Hunter Region SES, following the exceptional work the SES undertook in the biggest operation in the organisation’s history, during April’s storm and flood emergency.

2. That this House congratulates all award recipients from the Hunter Region SES and thanks them for their service to the community.

8 GRANDMOTHERS AGAINST REMOVALS (Formal Business)

Mr Shoebridge moved, according to notice:

1. That this House notes that:

(a) on 9 November 2015 the Honourable Brad Hazzard MP, Minister for Family and Community Services, launched the ‘Guiding Principles for strengthening the participation of local Aboriginal communities in child protection in decision making’ at the Tamworth “Youthie” in West Tamworth,

(b) in attendance at the launch were Gomileroi elders that included representation from Grandmothers Against Removals as well as the Northern Region Aboriginal Alliance, the Aboriginal Child, Family and Community Care State Secretariat, the NSW Ombudsman’s Office, the Member for Tamworth Mr Kevin Anderson, Greens MP Mr David Shoebridge, Secretary for Family and Community Services Michael Coutts-Trotter and many more members of the local Aboriginal community,

(c) Grandmothers Against Removals was established in January 2014 to ‘highlight the process of removal used by the New South Wales Department of Children’s Services’,

(d) the Guidelines note that “NSW children from Aboriginal communities are being removed from their families at an unprecedented rate with more than 6,000 children, representing about one in 10 Aboriginal children, in out-of-home care in NSW.”, and

(e) the Guidelines are a positive pro-active response to this issue which offer a community based way forward for Aboriginal communities across the state together with Family and Community Services.

2. That this House commends:

(a) Grandmothers Against Removals for their tireless and courageous work advocating for better support for Aboriginal families and a reduction in the number of Aboriginal children forcibly removed from their immediate and extended families, and

(b) the Minister for Family and Community Services, Department of Family and Community Services and the Office of the NSW Ombudsman for their work with Grandmothers Against Removals in developing the set of guiding principles to ensure Aboriginal communities are an essential part of child protection decision making.

9 COMPASS HOUSING (Formal Business)

Mr MacDonald moved, according to notice:

1. That this House notes that:

(a) on 6 November 2015, Compass Housing’s gala lunch celebrating 30 years of continuous operation was held at Newcastle City Hall,

(b) Compass Housing began as the Newmacq Community Housing Company in 1985, managing 92 tenancies in Newcastle and Lake Macquarie,

(c) today, Compass Housing is the largest regionally based provider of community housing in New South Wales, managing more than 4300 tenancies,

(d) a book recording the history of Compass Housing was launched at the event by the Chairman Mr Paul Johnson, and

(e) Mr Scot MacDonald MLC represented Minister for Family and Community Services, the Honourable Brad Hazzard MP at the event, and Mr Tim Crakanthorp MP also attended the function.

2. That this House congratulates Chairman Mr Paul Johnson, Managing Director Mr Joe Townsend and all staff of Compass Housing on attaining this milestone of 30 years of continuous operation, and thanks them for their contribution to our community.

10 SOUTH COAST WARATAHS RECRUITMENT MARCH 100TH ANNIVERSARY (Formal Business)

Mrs Maclaren-Jones moved, according to notice:

1. That this House acknowledges that December 2015 will mark the 100th anniversary of the South Coast Waratahs Recruiting March, a military recruitment march through the south coast of New South Wales.

2. That this House notes that:

(a) the South Coast Waratahs recruitment march began in Nowra in 1915, and passed through Bomaderry, Meroo, Berry, Gerringong, Kiama, Jamberoo, Albion Park, Dapto, Unanderra, Port Kembla, Wollongong, Balgownie, Corrimal, Woonona, Bulli, Thirroul, Coledale, Scarborough, Stanwell Park, Helensburgh, Heathcote, Sutherland, Hurstville, Kogarah and Rockdale before ending in The Domain in Sydney,

(b) the Waratahs also included men from Jervis Bay and Kangaroo Valley, which were not on the march’s route,

(c) the Waratahs entered camp at Liverpool on 17 December 1915,

(d) most Waratahs left Australia between March and June 1916 as reinforcements to the 1st Battalion and fought at Pozieres, and

(e) one side of the Waratahs recruiting flag is displayed in the Australian War Memorial, and the other side is framed and displayed in the Nowra RSL Clubrooms.

3. That this House notes that the New South Wales South Coast community will commemorate the South Coast Waratahs with a Waratah Battalion Reunion from 27 November to 30 November 2015, with a number of community activities and events, including:

(a) the Book Launch of the Centenary edition of ‘March of the Waratahs’ at Shoalhaven Ex-Servicemen’s Club,

(b) a gathering for descendants and families of the South Coast Waratahs at Nowra Showground, and

(c) a re-enactment march from Nowra Showground over the Shoalhaven River Bridge, to Bomaderry memorial.

4. That this House congratulates the South Coast community on its commitment to preserving and promoting the ANZAC legacy, educating younger generations on and engaging them in our nation’s unique and important history, and honouring and commemorating Australia’s ANZACs.

11 LIVERPOOL PLAINS YOUTH (Formal Business)

Mr Buckingham moved, according to notice:

1. That this House notes that:

(a) the Premier, the Honourable Mike Baird MP, will be visiting Tamworth on 20 November 2015,

(b) the Liverpool Plains Youth are a group of young people from the Liverpool Plains region who are committed to showcasing, celebrating and protecting the Liverpool Plains region for the future, and

(c) the Liverpool Plains Youth have written to the Premier requesting that he meet with them when he visits Tamworth so that they can discuss the impacts that the Shenhua Watermark and BHP Caroona coal mines will have on the future of the Liverpool Plains if they are built.

2. That this House calls on the Premier to meet with the Liverpool Plains Youth and listen to their concerns.

12 PASSING OF JOHN DAVIS AND CAROLYN AND RICHARD GREEN (Formal Business)

Mr Buckingham moved, according to notice:

1. That this House notes:

(a) the tragic passing of John Davis and Carolyn and Richard Green in a helicopter accident on Saturday 7 November 2015,

(b) that John Davis was a talented film maker, educator, environmental activist, Greens candidate, chemical engineer and television producer, as well as a loving husband, father and grandfather,

(c) that John Davis worked tirelessly to educate the community about the need for urgent action on climate change and his passion was to protect the climate, the land and water for its beauty and intrinsic value and for future generations,

(d) that Richard Green trained as a physicist and became a renowned landscape photographer, who used a helicopter to explore many of the beautiful, amazing and remote environs of this continent and capture them for the enjoyment and wonderment of others,

(e) that Carolyn Green was a creative and talented graphic artist, author and was a licenced helicopter pilot,

(f) that the Greens published a book of landscape photography entitled ‘Remote and Wild: Seeking the Unknown Australia’,

(g) that John Davis and Carolyn and Richard Green tragically died on their journey back from the Harvest Festival at Breeza on the Liverpool Plains where they supported local farmers in opposing new coal mines, and

(h) that Richard and Carolyn were helping their friend John to film a documentary aimed at exposing the environmental damage wrought by coal mines.

2. That this House recognizes that:

(a) these three people loved and valued the natural world and were committed, creative, generous, passionate and active in striving to protect it, and

(b) their loss will be felt by the environment movement and community across the country and that they will be deeply missed.

3. That this House expresses its condolences to the family and friends of both John Davis and Carolyn and Richard Green.

13 PASSING OF JOHN GEORGE KAYE (Formal Business)

Dr Kaye moved, according to notice:

1. That this House notes with sadness the passing of Denman resident, Greens candidate in the 2015 state election, and dedicated community activist John Kaye.

2. That this House notes that:

(a) John George Kaye was a long-time resident of Denman in the Upper Hunter where he and his wife Kathleen raised three children,

(b) John’s rich and varied working life ranged from being a high school mathematics and computing teacher to running his own business growing wine grapes and training farmers in farm chemical management,

(c) in the last years of his life, despite the mounting toll that leukaemia took on his health, John turned his increasing concern for the impact that coal mining was inflicting on the region he loved into leadership in the campaign to protect the Upper Hunter from the fossil fuel industry, and

(d) John was a passionate advocate for his community and its environment, a great friend and colleague to all who worked with him and a beacon of dedication and good humour.

3. That this House expresses its condolences to his wife Kathleen, their children and all those whose lives this wonderful man touched.

(b) notes that the NSW Youth Frontiers mentoring program targeting years 8 and 9 students for leadership and civic engagement is of great benefit to the community,

(c) commends students on their various projects working in areas like community harmony, youth mental health, environment and conservation, and sporting engagement in the Tweed and Ballina areas,

(d) congratulates Letisha Stirling, Katie Polglaze, Jarra Faunce, Vaughan Lynch, Byron Johnson, Jasmine Hidden, Andrea Shelbach, Jasmine Shelbach, Alice Lampett, Alysha De Lyon, Aditi Walker, Lachlan Butter, Millly Beaver, Tallen Halliday-Baker, Christiana Schweitzer, Liam Thoroughgood, Chahrizma Macdonald-Cass and Ebony Roberts on graduating from the Tweed Youth Frontiers program,

(e) congratulates Brooke Jager, Tim Byles, Eli Salt, Miriam Hopton, Amanda Monti, Justin Smith, Dylan Watson, Bonnie Lang, Rhianna Henry, Shania Hicks, Asher Mosolino, Jason Marchant, Abbey Graham and Samantha Russel on graduating from the Ballina Youth Frontiers program, and

(f) congratulates the 1,200 young people around New South Wales who participate in the program each year.

Insert after section 14:

14A Proceedings for offences commenced by officers of ICAC or PIC

(1) An officer of ICAC does not have the power to commence proceedings for an offence unless the Director of Public Prosecutions has advised the Independent Commission Against Corruption in writing that the proceedings may be commenced by an officer of ICAC.

(2) For that purpose, the Director of Public Prosecutions may liaise with the Independent Commission Against Corruption, but is to act independently in deciding to advise that proceedings for the offence may be commenced.

(3) The Commissioner, an Assistant Commissioner and an officer of the Police Integrity Commission do not have the power to commence proceedings for an offence.

(4) In this section:officer of ICAC means a person acting in the capacity of the Commissioner, an Assistant Commissioner or officer of the Independent Commission Against Corruption.

The Deputy President (Mr Green) reported the following message from the Legislative Assembly:

The Legislative Assembly has this day agreed to the amendments made by the Legislative Council in the Bill with the long title “An Act to constitute and confer functions on the Greater Sydney Commission and to provide for the constitution of planning panels for the Greater Sydney Region; to amend the Environmental Planning and Assessment Act 1979 to make provision in relation to strategic planning; and for other purposes”.
