    3.1 The principles and scope of the policy

    Lincolnshirepartnersarecommittedtoprovidingeverymemberofthecommunitywiththehighestpossiblestandardofserviceirrespectiveofage,gender,race,sexualorientation,disability,religionandbelief.Ourequalityanddiversityaimsarecentraltohowwedealwithanti-socialbehaviour(ASB).

    ThepurposeofthispolicytoprovideaframeworktoallowLincolnshirepartnerstoworkcollaborativelytomanageandresolvereportsofASBeffectivelyandensureclearlinesofresponsibilityandcommunicationacrossLincolnshiresstrategicandthirdsectorpartnerorganisation.

    TacklingASBisakeypriorityforallpartners.WecollectivelyunderstandtheimpactASBhasoncommunitycohesionandcrime,andarecommittedtoinvestingresourcestodevelopprocedurestodealwithiteffectively.

    Ourfocusisonthevictimthroughprotection,preventionandsupport.Weintendtofocusmoreonthevictimsperspective,tobetterassesstheharmandriskscausedandencouragethoseexperiencingASBtocomeforward.

    AsapartnershipwerecognisethecomplexityofASBandthechallengingnatureofsomevictims,offendersandlocations.ThispolicypromotesandsupportsaProblemSolvingmethodology,developinganapproachthatseekstotacklethecauseratherthanattending

    4 Introduction/Legal Basis

    tothesymptomstimeaftertime.

    Inadditionitisintendedtoprovideaframeworktoallstaffacrossthepartnership,customersandotherstakeholdersonwhatactionwewilltakewhenacomplaintofASBismade.AsapartnershipwerecognisethateveryASBcaseisuniqueandwehavewrittenthispolicywithaviewtoprovidingstaffwithabestpracticeapproachtomanagingreportsofASB.

    3.2 The aim of the policy

    AimsToensurethecommunitiesofLincolnshirereceivethebest,consistentserviceandsupportfromallpartnersinrespectofpreventing,reducingandmanagingASB,irrespectiveoflocationorserviceprovider.

    4.1 The origins/background information

    ThisdocumentshouldberegardedasanumbrellapolicydocumentintendedtocoveralltypesofASBincludinghatecrime.

    In2012theLincolnshirePolicealonereceivedinexcessof26,000callstoservice.InthefirstfullyearofoperatingtheSentinelcasemanagementmodeltheASBPartnershiphaveidentifiedandmanagedintheregionof3,000repeatandvulnerablevictims.

    In2012theCountyCommunitySafetyBoard(CCSB),nownamedLincolnshireCommunitySafetyPartnership(LCSP)wasrestructuredwithaviewtoimprovingtheconnectionbetweenthemselvesandlocalCommunitySafetyPartnerships(CSPs),aligningstrategicobjectivesthroughtacticalandoperationalactivitymanagedbybothStrategicManagementBoards(SMBs)andCSPs.TheLCSPhasagreedfivestrategicprioritiesfortheperiod2013/14, DrugsHarm AlcoholHarm, Anti-SocialBehaviour DomesticAbuse RoadSafety.TheseprioritieshavebeenratifiedandalsoadoptedbysomelocalCommunitySafetyPartnershipstatutorypartners.

    TheLincolnshireASBPartnershipisleadstrategicallybytheASBSMB,whichisanswerabletotheLCSP;andmanagedatatacticallevelbytheASBDeliveryGroup.TheDeliveryGroupconsistsofbothmangersandoperationalstaffresponsiblefordeliveringtheoutcomessetwithinadeliveryplanformulatedandagreedbytheASBSMBtodevelopastrongpartnershipapproachtotacklingASBinLincolnshire.

    In2012AlanHardwick,thefirstPoliceandCrimeCommissioner(PCC)for

    Lincolnshirewaselected.ThePCChasmadereducingASBoneofhisprioritieswithinthePoliceandCrimePlan2013-2017andencouragestheuseofworkinginpartnershipinbothpreventingandrespondingtoASB.Objectivesinclude,supportingearlyengagementinitiativessuchasthe

    FamiliesWorkingTogetherandeducationalprogrammessuchasItsthatEasy;andcollaboratingwithpartnerstobetterco-ordinatetheresponseagainstASBthoughspecialistofficerstoidentifytroublespotsandrespondquicklytopreventrepatition.

    ThisPolicyunderpinsLincolnshiresmulti-agencyapproachtotackleASB.ItmarksstepstoimproveworkbetweenorganisationsandcommunitiesacrossLincolnshireworkingtogethertochallengeASB.

    Anti-Social Behaviour

    Thetermanti-socialbehaviourwasformalisedinthelate1990stodescribeawiderangeofnuisance,disorderandcrimethataffectpeoplesdailylives.Including:

    Noisenuisance Intimidationandthreateningbehaviour Rubbishorlitterlyingaround Vandalism,graffitiandotherdeliberate

    damagetopropertyorvehicles Peopleusingordealingdrugs Peoplebeingdrunkorrowdyinpublicplaces Abandonedorburntoutcars Neighbourdisputes

    ASBthereforeincludesmanydifferenttypesofbehaviour.Suchactsaresometimesdismissedastrivial,howeverASBcanhaveahugeimpactonthequalityoflifeofaparticularindividual,grouporcommunityanditisthepublicsnumberoneconcernwhenitcomestolocalcrimeissues.

    FollowingaperiodofconsultationwiththecommunityandallpartneragenciesinLincolnshirethethreedefinitionswereidentified;

    TheCrimeandDisorderAct1998definesASBas:

    Actinginamannerthathascaused,orislikelytocauseharassment,alarmordistresstooneormorepersonsnotofthesamehouseholdas(thedefendant).

    Alternatively,theHousingAct(1996)statesASBis:

    Engaginginorthreateningtoengageinconductcausingorlikelytocauseanuisanceorannoyancetopersonsengagedinlawfulactivities.

    Furthermore,TheCharteredInstituteofHousing(1995)describesitas:

    Behaviourthatunreasonablyinterfereswithotherpeoplesrightstotheuseandenjoymentoftheirhomeandcommunity

    Onthe16thNovember2010,givingdueconsiderationtothe3utiliseddefinitions,theASBSMBagreedthattheoverarchingdefinitionforASBis:Behaviourbyanindividualorgroupthat

    resultsin: Anotherpartyfeelingpersonallythreatened Createsapublicnuisance,or Hasadetrimentalimpactuponthe

    environmentandtherebyhasadetrimentaleffectuponthequalityoflifeofanindividualorthecommunityasawhole

    ThePartnershipacknowledgethatsuchbehaviourdoesnotexcludecriminaloffences,andrecognisethatifASBescalatestocrimeitwillcontinuetobedealtwithasASB,incorporatingrequiredcriminalsanctionsintotheinterventionprocess.

    4.2 Motivators/Driving Forces

    Itistheoneissuethatsurveyaftersurvey,bothlocalandnational,identifiesthatourcommunitiesconsiderASBtobethekeyissueforPoliceandPartnerstotackle.ItisrecognisedthatourcommunitiesdonotdifferentiatebetweencrimeandASB,nordotheycarewhotacklestheproblemsolongassomeonedoessomething.

    ThisisclearlyhighlightedinthecaseofFionaPilkingtonwhokilledherselfandherdaughter,FrancescaHardwick,aftersufferingyearsofASBandhatecrime.Fionamadenumerousreportstovariousagenciesaskingforhelp,tonoavail.The2011EqualityandHumanRightsCommission(EHRC)inquirytitledHiddeninPlainSight,publishedfollowingthistragiccasefoundthattherewere

    ...systemicfailingsbypublicauthoritiesto;

    recognisetheextentandimpactofharassmentandabuseofdisabledpeople,takeactiontopreventithappeninginthefirstplaceandinterveneeffectivelywhenitdoes

    Notonlydoesthisemphasisestheimportanceofworkinginpartnership,butalsohighlightshowthosemembersofthecommunitywhoareleastabletoprotectthemselvescanbetargeted.Inrecognitionthatthosemostvulnerableinoursociety,orthosefromdiversebackgroundsareproportionallymorelikelytobecomevictimsofASB,thispolicyhasbeenintegratedwiththeLincolnshireHateCrimeStrategyandtheprioritiessetwithinit.ThispolicyalsoincorporatesthefindingsoftheBradleyReport(2009)whichfoundanoverwhelmingneedforpartneragenciestoidentifyandsupportvictims,oroffenderswithmentalhealthproblemsorlearningdisabilities;andalsorecognisetheirvulnerability.ASBPartnershipistheidealforumforliaisonbetweenstatutoryandvoluntarysectoragenciestoraiseawarenessanddevelopearlyinterventioninitiativesandreferralpathways.

    ThepublicationofHerMajesty'sInspectorateofConstabulary(HMIC)reporttitledStoptheRotin2010andProfessorInnessinquiryin2013titledRethinkingthepolicingofanti-socialbehaviourhavealsoprovidedadrivingforceforchangeinthewayLincolnshirePolicebesttackleASB.LincolnshirePolicesperformancewasratedbytheHMICasinlinewiththenationalaverageandlowerlevelsofASBperheadofpopulation.However,theydididentifykeyareasofdevelopmentinorderfortheforce

    toprovidevictimsofASBwithagoodservice,resultinginLincolnshirePoliceexploringhowtheycanmakeimprovementsandalsopromotepartnershipworking.

    PartnersinLincolnshirerecognisetheneedtotackleASBanditsperceptionwithinourcommunities.Asaresult,wehavedevelopedamulti-agencyASBPolicy,whichreflectstherecommendationsoutlinedinthesereports.

    4.3 General Principles of the Policy Statement of Purpose

    Thispolicyoutlinesaframeworkofactivityaimedatdevelopinggreaterpublicconfidenceinlocalpolicingandpartners,recognisingthatthiscannotbeachievedwithoutthesupportandcommitmentofourstaff,officersandpartnersacrossthecounty.

    WedonotunderestimatetheimpactASBcanhaveonpeopleslivesorignorethefactitisoneofthecommunitiestopconcernswhenitcomestolocalcrimeanddisorder.InordertoaddressthenegativeimpactASBhasinourcommunitieswehavedevelopedamulti-agencyapproachtoeffectivelyandconsistentlytackleASBinLincolnshire.

    WearenotonlycommittedtoreducingASBbutalsotoprovidingahighqualityservicewhichmeetstheneedsofindividualsandcommunitiesandprovidesaservicethatpeoplevalue.

    ThepolicychallengesthewaypartnersrespondtoreportsofASBandrecognisestheneedforaconsistentapproachinthecasemanagementofvulnerableandrepeatvictims,andareahotspotsofASBacrossthecounty.AllpartnershavenowpurchasedawebbasedI.TsystemnamedSentineltocarryoutthisfunction(somepartnershavealsoadoptedthesystemastheirincidentloggingdatabaseforallreportsofASB).AnInformationSharingAgreementhasbeensignedbyallpartnerstoallowauthorisedpersonstobeabletoviewthecollectiveinformationthathasbeeninputbythedifferentsourcesandforittobe progressedappropriately.

    AllSentinelusersareallocatedusergroupsandassignedprivilegesaccordingtotheirrole.Therearegeographicsecuritymeasuresforviewingcasesbutatleastonepersonfromeachpartnerwillhaveglobalaccesstosee allcases. 9

    Thissystemnotonlyallowsustodeliverauniformedcasemanagementprocessacrosspartnersbutbythenatureofthesharedtechnologyenforcesmanagedandriskassessedinformationsharing.

    Taking a Partnership Approach

    WetakeallreportedcasesofASBseriously,recording,investigatingandkeepingvictimsinformedofactionsinconjunctionwithotherkeyagencies.NooneagencyisresponsibleforASBandbyworkingatalllevelswewill

    Shareappropriatedatausingjointtaskingandco-ordinationarrangementswithpartners,inordertoproactivelyidentifyandreduceASB.

    Improveco-ordinationacrossthecountyandacrosspartnerstointerveneandprotectthepublicandLincolnshirecommunities,particularlythemostvulnerable.

    HaveanInformationSharingAgreementinplace,workingwithincurrentlegislationondatasharing.

    Undertakeeffectivemulti-agencycasemanagement,linkingincidentsandvictimswhereappropriate

    PromoteaproblemsolvingapproachtoreducingASB.

    TrainstafffromallpartnerstoeffectivelydealwithreportsofASBeffectivelyusingalltoolsavailabletothem.

    Understanding the Needs of Our Communities

    Wearecommittedtoprovidingserviceswhicharevisible,accessibleandresponsiveandparticularlyaimtoassistthosewhoareatincreasedriskorarevulnerablenomatterofage,gender,race,sexualorientation,disability,religionandbelief.Theintroductionofagreeddefinitions,procedureandcasemanagementwillensurepartnersacrossthecountyhaveanimprovedandrealunderstandingofASB.Thiswillbefurthersupportedbyanalyticalevidence,throughmonthlyanalysisandgeneratingreportstoallowpartnerstoconsistentlyassessandmaintainperformancelevels.

    Theimportanceofcommunityinvolvementisstressedingovernmentpolicyandhasbeenwidelyadvocatedwithregardtocrimepreventioninitiatives,anissueraisedinDecember2012byPCC.

    Firstly,thereisthedesirabilityofresidentstoparticipateindecisions,whichaffecttheirlives(Crawford1998,Fitzpatricketal2000).Secondly,thereisanassumptionthatlocalresidents,beingclosertoexperiencesofcrimeinthearea,havethebestunderstandingofwhattheirneedsareandhowthoseneedsmightbemet(Cairns1996,McArthuretal1996,Crawford1998).Certainly,publicconsultationcangeneratedatatofillgapsininformation

    concerninglocalcrimeproblems,forexamplebyprovidingdataonvictimisationtosupplementrecordedcrimefiguresandonperceptionsofcrime.Publicconsultationcanalsohelptogenerateownershipofcrimepreventionworkandthusenhancepublicparticipation,encourageresidentstotakeresponsibilityfortheirownproblemsandimprovetheircapacityforself-help.Thisresultsinmakingschemesmoreselfsustaininganddurable(Liddle&Gelsthorpe1994;Thomas1999).Localpeopleneedtofeelthattheyarestakeholdersinthecrimepreventionprocessandthattheyhavesomethingtocontributeaswellasreceive.

    Vulnerable and Repeat Victims

    WewilltakeavictimledapproachbyaddressingtheneedsofvictimsandassesstheirneedsthroughapartnershipapprovedRiskAssessment.

    Thedefinitionofavulnerablevictimforthecountyasagreedbyallpartnersis:

    Avulnerablepersonisonewhoseexperienceand/oreffectofharmasaresultoftheincidentislikelytobemoresignificantbecauseoftheirindividualpersonalcircumstances.Who is vulnerable to ASB?

    AvictimofASBisvulnerable:

    Iftheconductinquestioncausesanadverseimpactontheirqualityoflife;ortheybelievetheyarevulnerable;ortheyhavesufferedASBorsomethingsimilarbefore.

    What does adverse impact include?

    Riskofharm, Deteriorationoftheirhealth,mentaland/or

    emotionalwellbeing,oran Inabilitytocarryoutnormaldaytoday

    routinethroughfearandintimidation

    Thisdefinitionofvulnerableputsemphasisonhowthecomplainantfeelsabouttheproblemandhowtheyperceivethelevelofintimidation.Everyvictimsopinionisimportantwhenthepartnersaredeterminingtherisktothem.Thispolicyrecognisesthatweneedtoconsidervulnerabilityinrespectofage,gender,race,sexualorientation,disability,religionorbelief,however,itistheimpactASBhasontheindividualorcommunitythatisimperativewhenidentifyingvulnerablevictimsofASB,takingintoaccountpersonal/socialisolation,location,repeatvictimisationandthetypeofASB beingreported.

    Allcallstoservicewillberiskedassessed,enablingpartnerstoestablishtheneedsofthevictimandinformtheappropriateresponse.

    Repeat Victimisation

    RepeatvictimisationoccurswhenthesamepersonoraddressissubjectedtoathirdincidentofASBwithinarolling12monthperiod.

    ItiswidelyrecognisedthatvictimsrarelyreporttheirfirstexperiencesofASB,oftenwaitinguntilsuchbehaviourbeginstoimpactupontheirlife.ThereforethisdefinitionincludesbothreportedandunreportedincidentsofASBwithinthe 12monthtimeframe.

    Agrowingbodyofevidenceshowsthatcertainpeopleandplacessufferrepeatedincidents ofcrime.

    AnalysesoftheBritishCrimeSurvey2000,forexample,haveestimatedthat4%ofvictimsaccountforbetween38%and44% ofallcrimereportedtothesurvey.

    Theevidenceisthathighcrimeareashavesuchhighcrimelevels,notbecausetheyhavemorevictimsbutbecausetheyhavemoreheavilyvictimisedvictims.

    Pastvictimisationisoftenapredictoroffuturevictimisationandis,therefore,preventable;

    Throughtheuseofimprovedskillsandknowledgeforthepotentialvictims,empoweringchildrenandyoungpeople toprotectthemselves.

    Improvedawarenessamongprofessionalsandservicesofchildrenandyoungpeoplesvulnerabilityandpreviousexperiences.

    Thetargetingofresourcestohelpreducerisksandincreasesafetymoreeffectively.

    Tackling Repeat Victimisation has a number of benefits

    Ithelpsprotectthosewhoarevulnerable andsafeguardthemfromcrimeorabuse.

    Ithelpstoreducecrimeanddisorder. Itmakesbetteruseoflimitedresources

    bytargetingthemwheretheycanbe mosteffective.

    Itcanhelpthepolicetotargetprolificoffenders.

    Byreflectingthetruenatureofvictimisation,itaddressespeoplesfearofcrimeandcanstimulateimprovementsinthequalityofservicestovictims.

    Repeat and hot spot locations

    ThispolicyalsoacknowledgestheneedtoidentifyASBrepeatlocationsorhot-spots, andrespondaccordingly.

    Repeatlocationsorhotspotstendtobethoseareasmostaccessibletothepublic,forexampleashoppingprecinct,childrensplaypark,orpubliccarpark,andcanevenexpandtocoverentirehousingestates.Theyofteninvolvemultipleoffendersandmorethanonecomplainant,resultinginawiderimpactonthecommunity.

    TakingthisintoconsiderationthePartnershipdefinesarepeatlocationasanareawhere:

    3ormoreincidentsofASBhaveoccurredinthesamelocationwithinaonemonthperiod,reportedbymorethanoneperson.

  • Byclearlydefiningsuchhotspotareaspartnerscanimplementamulti-agencyresponsetailoredtotheneedsofaspecificlocation,consideringbothshortandlongtermmeasuresofintervention.

    TheASBPartnershipwillidentifysuchareasbyreviewinganalyticalproductsandsharinginformation.Amulti-agencyproblemsolvingapproachwillbeappliedandcasemanaged on Sentinel.

    Recognising Needs of the Offender

    ThispolicystressesaVictimbasedapproachtotacklingASB.However,itisimperativethatthepolicyalsorecognisestheneedsofoffendersandadoptsthepositiveprinciplesofRestorativeJustice(RJ),CommunityJusticePanelsandFamiliesWorkingTogetherandconsiderstheirsuccessinrespectofreducingre-offendingusingoptionsnotroutedwithintheCriminalJusticeSystem.

    Itisrecognisedthatmanyoffendershavecomplexneedsandarefromtroubledfamilies.Toensurethatthepartnershipareabletodeliverlongtermsustainablesolutions,thatwillimpactonbothASBandvolumecrime,theASBPartnershipwillworkhandinhandwiththeCountyFamiliesWorkingTogetherproject;amulti-agencyapproachtoaddressingfamilyproblems,whichmaybetherootcauseofoffendingbehaviour.Theschemeoffersincentivestorewardpositivebehaviouraswellassanctionstodiscouragedeviation.ThiswillextendacrossallpartnershipproductsandincludedevelopingareaswithinRestorativeJusticeandCommunityJusticePanels.

    Restorative Solutions and Community Justice Panels

    The2012Anti-SocialBehaviourDraftBillcapturesthepositivebenefitsofRestorativeJusticeandCommunityJusticePanelsbyproposingthatallpolicingareaswilldeliverastructuredapproachthatallowsthecommunitytoconsiderthedisposalofASBandsomecrimeoutsideoftheCriminalJusticeSystem.

    RestorativeJusticeisaprocessthatbringsthoseharmedbycrimeorconflict,andthoseresponsiblefortheharm,intocommunication,enablingeveryoneaffectedbyaparticularincidenttoplayapartinrepairingtheharmandfindingapositivewayforward.ThismethodhasalsobeingincorporatedintoCommunityJusticePanels,whichprovideastructuredprocessofinterventiontohelpvictimsandoffenderstounderstandeachother,findresolutiontoconflictandrepairtheharmdone. Integrated Offender Management

    InsomeseriouscasesLincolnshirepartnersmaygostraighttoenforcementactionwhilstinotherlessseriouscasesalowerlevelwarningactionmaysuffice.Whereverpossiblewewillaimtoresolveanyproblemsamicablythroughthepromotionofpositivecommunication,suchasmediationand/orconsideralternativemeansofinterventionfromotheragenciesandutiliseMultiAgencyMeetings.

    Thisisinitialcontactwiththeperpetratortoinformthemoftheaffectandconsequencesoftheirbehaviour.ItisoftenusedasanimmediateresponsetoanincidentofASBwhentheperpetratorisfoundtohavenopreviousinvolvementinASB.

    Thisfacetofacecontactwiththeperpetratoralsoprovidestheopportunityforthepartnertoidentifyanycontributingfactors,suchasmentalhealthorlearningdisability,andprovideearlyinterventionbymeansofareferraltotherequiredagencytoprovidesupportandpreventfurtherinvolvementinASB.

    Stage Two: Advice letters

    ThesecanbesentbythePoliceorLocalAuthority/RegisteredSocialLandlords,inmostcasestheLocalAuthorityhastakentheleadtoensureaconsistentapproach.

    Itisanexerciseusedtoeducateandraiseawarenesstoparents/guardiansbyinformingthemthattheirchildhasbeenidentifiedasbeinginvolvedinASBanddetailsthecircumstancessurroundingtheincident.

    Itmakesarequestforparents/guardiantodiscusstheissuesbeingraisedwiththeirchild. 19

    Stage Three: Unacceptable Behaviour Warning

    TheLocalAuthority,RegisteredSocialLandlordsorPolicecanissuethiswarning.

    Anunacceptablebehaviourwarningoutlinesthecomplaintreceivedaboutapersonsanti-socialbehaviourandrequeststhatitstops.Italsostressestheseriousnessofthematteranddetailswhatfurtheractionwillbetakenshouldthepersoncontinuetobehaveinthismanner.BestpracticehasfoundthatwhenawarningisissuedinpersonbyeitheraLocalAuthorityASBOfficerorPoliceOfficer,theimpactontheoffenderismoresignificant,thanaletterviathepost.Furthermore,itallowsfordiscussionwiththeoffendersparent/guardian,whenapplicable.However,duetoresourcesandtimeconstraintsthisisnotalwayspossible.Thereforepartnerswillbeabletousetheirowndiscretionwhenissuingsuchwarnings.

    Stage Four: Acceptable Behaviour Contracts (ABC)

    Thisavoluntarycontractbetweentheadultoryoungperson,theirparentsifapplicableandtheLocalAuthority/RegisteredSocialLandlordsand/orthePolice.

    ALocalAuthorityorRegisteredSocialLandlord(oftenincompanywithalocalPoliceOfficerorPCSO)willvisitthesubjectinpersontonegotiateandagreethecontentofthecontract.Itwillcontainalistofanti-socialactsthattheywillagreenottocontinuetodo.

    ThecontractmayalsocontainoffersofsupporttoaddressanyunderlyingcausesoftheASB.

    Allcontractscanbereviewedandalteredat thediscretionandagreementofallthe agenciesinvolved.

    Criminal Anti Social Behaviour Order (CRASBO)

    ThepowerstoimposeASBO'swerestrengthenedandextendedbythePoliceReformAct2002,whichintroducedordersmadeonconvictionincriminalproceedings,recognisingthelinksbetweencrimeandASB.

    ACRASBOisappliedforbythePolicethroughtheCrownProsecutionService,inconjunctionwithevidencefromLocalAuthorities/RegisteredSociallandlords,asanothermeansofenforcementto;preventASB,protectthepublicandencouragelocalcommunitiestobecomeactivelyinvolvedinreportingcrimeandASB.LikeanASBOtheindividualsubjectoftheCRASBOwillhaveasetofprohibitionsuniquetothecaseandanybreachisacriminaloffence.
