HOD Remarks:

1. Applied for renewal of consent for the production of Recrystallised Hexamine, Acids, Single base

Propellant , Ballistite Propellant, Nitrocellulose, RDX & RDX Compounds, Double Base Rocket

Propellants – Quantity as per production target decided Ministry of Defence.

2. Earlier consent for the manufacturing of Hexamine-60 MT/M, Ether-20 MT/M, Weak Nitric Acid-

200 MT/M, Sulphuric Acid (Conc.94-96%) -200 MT/M, Nitric Acid (Conc. 99%)-500 MT/M &

Nitrocellulose-120 MT/M was valid up to 31.07.2012.

3. Capital investment of the industry is Rs.115.21 Crores. Consent Fee 6,91,260/- paid for the

period up to 31.7.2015.

4. DE-3200 CMD. Sewage Treatment plant provided. Disposal on land in the premises. I.E.-5200

CMD. Primary, Secondary and Tertiary Treatment provided. Treated effluent disposed into nalla

outside the premises.

5. R.O. Nagpur vide letter dated 2.11.2010 has issued the directions U/s. 33A of Water (P & CP)

Act, 1974 and U/s.31A of the Air (P & CP) Act, 1981, the copy of directions is enclosed herewith.

6. SRO, Bhandara reported that industry has not complied with the following directions.

i) Treated effluent is not recycled/re-used and it discharge into local nalla outside factory

premises.

ii) Industry submitted proposal for laying of treated effluent distribution pipeline network for

disposal of treated effluent on land in the premises which had to be start in June 2012

and will be completed by June, 2014. However, the work is not yet started.

iii) Treated effluent collections sump of adequate capacity not constructed.

7. SRO further reported that

i) Huge quantum of chemical sludge is found dumped near .S.D.B.

ii) Storage facility for dried chemical sludge is not adequate.

iii) One of the wall of SDB was found broken and hazardous waste found spilled out of this

unit.

iv) Industry has installed new RDX plant and have added RDX product in this application but

investment is not mentioned. Also additional fees not paid and from when they have

commissioned this plant is not disclosed.

v) There is increase in the Industrial effluent by 1200 M3/day but details of capacity of

existing ETP is not mentioned.

vi) SRO Office has issued a letter dated 22.6.2012 to the industry & reply is awaited.

The case was discussed in C.A.C. Meeting held on 25.07.2012 and it was decided to issue SCN for refusal of consent for non-compliance of consent conditions, directions issued by the Board and

installed new RDX plant without prior permission of the Board. Accordingly Board has issued SCN vide letter dated 31.7.2012. Industry has submitted the reply of SCN vide letter dated 13.08.2012. In view of above we may grant consent with additional products such as RDX with the following conditions. 1) Reuse the treated effluent and execute the scheme before December, 2013 with Bank Guarantee

of Rs.5/- Lakhs. 2) For storage of sludge in scientific manner the adequate arrangement shall be carried out before

March, 2013 with B.G. of Rs.2/- Lakhs. 3) Operational Bank Guarantee of Rs.2/- Lakhs. 4) To obtain the Membership of Hazardous Waste within next 2 months with B.G. of Rs.1/- Lakh. 5) All the remaining hazardous which is lying shall be disposed to CHWTSDF within next 45 days

with operational B.G. of Rs.2/- Lakhs. 6) For carrying out any expansion in future Consent to Establish shall be taken.

Name of the Industry: M/s. Wardha Power Company Ltd (Phase-I), Plot No.B-2, Warora Growth Center, Warora MIDC, Dist: Chandrapur. H.O.D. Remarks:

1. Applied for renewal of consent to operate for one year with no change in consented electricity generation i.e 2 x 135 MW.

2. Earlier consent was valid up to 31.05.2012. 3. Earlier estimated gross capital investment was Rs 1581.12 Crores whereas industry has now shown

Gross capital investment as Rs 1478.38 Crores. The industry has submitted this is actual investment including infrastructure development, clean technology, pollution control systems, and better production management. Consent fees of Rs.29,56,760/- paid for the period up to 31..05.2013.

4. Industrial Effluent – 5358 CMD. ETP provided. Domestic Effluent- 384 CMD, STP provided. Treated effluent recycled to maximum extent and remaining disposed on land for gardening.

5. ESP followed by Bag house provided to boiler. Bag house provided to coal crusher and transfer point. 6. Analysis results of ambient air quality monitoring carried out between 22.10.2011 to

08.02.2012 shows the parameter RSPM are exceeding the standards. 7. Stack monitoring results are exceeding the standards most of the times. 8. Cess payment made up to 31/08/2011 & Environmental statement was submitted. 9. As per earlier consent directions industry has deposited bank Guarantee of Rs 5.0 Lacs which is valid

up to 13 March 2013. Discussed in CAC held on 3.7.2012 & it was decided to issue show cause notice for refusal of consent for non-compliance of consent condition. Show cause notice was issued on 13.7.2012 and industry submitted the reply of show cause notice on dated 16.7.2012. Necessary pollution control system is provided by the unit. Already Bank Guarantee of Rs.20/- Lakh is available against Phase –II renewal. We may grant renewal of consent for phase-I Unit up to 31.5.2013.

2) Existing unit consent for manufacturing of Ferro Manganese Plant, Sinter Plant and Power Plant was valid up to 31.12.2011 and Capital Investment of existing unit is Rs.86.70 Crores. Applied for renewal of consent for existing unit. Show cause notice issued to the existing unit vide letter dated 23.04.2012 due to non-compliance of consent conditions and interim directions issued by the Board and due to discharge of substandard into river Zarpat.

3) Capital Investment of the expansion project is Rs. 221.42 Crores. Industry has paid Consent fee of Rs.4,42,480/-, as per new GR

6) This office has issued interim directions vide letter dated 19/12/2011 to carry out Environmental Works in time bound manner.

The case was discussed in CAC meeting held on 3.7.2012 and it was decided to issue show cause notice for refusal of consent as the existing unit has not complied with the consent conditions. Accordingly the show cause notice was issued to the industry on 12.7.2012. R.O. Chandrapur vide letter dated 17.7.2012 submitted the reply of SCN. The unit is not complying to the time period issued by the Board for completion of pollution control system and industry requested for extension of time period. The B.G. of the existing unit of Rs.12/- Lakhs is forfeited by the Board as per the decision taken in the Consent Committee. In view of above, we may grant consent to establish for expansion only after the completion of pollution control works of the existing unit.

CAC Item No.04

Name of the Industry: M/s. ISMT Ltd, Plot No. C-1, MIDC Ahmednagar, Dist: Ahmednagar. HOD Remarks:

1. Industry has applied for expansion in the production of Seamless Tubes of different

diameters – 2000 MT/Month. 2. Capital Investment of the proposed expansion is Rs.17.4 Crores. Capital Investment of

existing unit is Rs.94.90 Crores. Total Capital Investment of the industry is Rs.112.3 Crores, hence in the purview of CAC. Consent to Establish fee of Rs.50,000/- is paid by the industry.

3. Existing unit consent for manufacturing of Seamless Metal Tubes of different diameters – 4000 MT/Month is valid up to 31.03.2014.

4. Proposed expansion is in existing unit which is located in MIDC Ahmednagar & about 2.8 km from Sina river, A-II Class.

5. Domestic Effluent-43 CMD, Septic Tank and Soak pit provided. Treated effluent is disposed on land for gardening. Industrial Effleunt-24.0 CMD, Primary treatment provided. Treated effluent disposed on land for gardening.

6. SRO Ahmednagar reported that; i) Industry already completed work of expansion unit last year without obtaining

consent from the Board.

ii) ETP Sludge found lying on the ground. iii) Industry has not provided fume extraction system facility & adequate air pollution control

equipment to pickling, phosphating Section and Surface treatment plant as per the previous consent granted by the Board.

iv) Industry has not provided sampling facility to furnace chimney. v) Industry is disposing treated effluent on the back side of the ETP towards MIDC

road. vi) Industry has dumped ETP sludge on open land near sludge filter press. vii) Hazardous waste storage was not as per Hazardous Waste Rule. viii) Adequate height of chimney was not provided to fired tagging section.

7. Environment Statement for the period 2010-2011 submitted. 8. Latest analysis result of treated effluent, ambient air quality monitoring & stack monitoring

are not furnished. 9. Cess payment details are not furnished. Discussed in CAC dated 3.7.2012 and it was decided to issue Show cause notice for refusal of consent for not obtaining necessary permission from the Board before starting the expansion activity and existing unit is not complying with the consent conditions. Accordingly SCN was issued on 12.7.2012. Industry replied the to the show cause notice on 26.7.2012 stating that they have already done expansion and production trial is already taken. We may grant consent Establish (Expansion) with condition that industry should submit Company Board Resolution as the unit has taken production without consent.

CAC Item No.05 Name of the Industry: M/s Hindalco Industries Limited, (Expansion Project), Sr. No. 95/1, 95/2, Village Daheli, Tq. Mouda, Dist. Nagpur

HOD Remarks:

1. Existing RED/LSI unit of manufacturing of Aluminium strips & sheets – 3250 MT/Month having valid consent for the period up to 31.12.2012.

2. Now applied consent to establish for expansion for manufacturing of additional products of Aluminium Strips, Sheets, Foils and Aluminium Laminated and Printed Products -2250 Mt/month.

3. Capital investment of the proposed expansion is Rs.197.34 crore. Capital Investment of the existing unit is Rs.198.8/-crore. ( Total C.I. is Rs. 396.14/-crore)

4. Industry has paid consent to Establish fee of Rs. 3,94,780/- as per New Consent Feee GR dated 25.8.2011.

5. Industry does not satisfy RRZ policy as Kanhan River is about 350 meter from plant, hence industry required to submit the pollution load certificate for existing and expansion activity.

The case was discussed in CAC meeting held on 16.04.2012 & it was decided to issue SCN for refusal of consent for not complying with RRZ policy, 2009. Accordingly, SCN dated 24.04.2012 was issued to the industry. Industry vide e-mail dated 25.05.2012 submitted the reply to the SCN.

In view of non-compliance of R.R.Z. Policy we may refuse the application of the industry for expansion project. Discussed in CAC Meeting held on 3.7.2012 and it was decided that SLO shall review the industry reply dated 25.5.2012 regarding coverage of Kanhan river policy 2009 and resubmit the case in next CAC. SLO recommended that the file may be referred to RRZ policy Committee for review and opinion. The industry vide letter dated 14.09.2012 has submitted the revised proposal for the expansion project for further consideration. Industry stated that there will not be any increase in production level. Only they are proposed to add some machineries like rolling mill/separator/roll grinder/annealing furnace etc. so that from the same machine micro level alluminium sheets can be made keeping the same production level and there will be reduction in water quality to 60 me3/day and no increase in effluent quantity discharge. The additional machine cost 197.34 Crores to install the same. The unit has given original and modified proposal. In view of above, we may put up the modified proposal before CAC for further consideration on the ground that there will not be any change in production quantity as per earlier granted one and decrease in water consumption.

HOD Remarks :

Case was disused in CAC meeting held on 31.01.2012 and was decided to refuse the consent as the industry had not completed commissioning of RO Plant & ETP plant system to chive zero discharge.

Consent was refused on 06.02.2012.

Industry submitted vide letter dated 23.08.2012 requesting withdraw of the refusal and also requested to allow them to discharge 30% (400 CMD) to MIDC drainage network which further leads to CETP.

The TEPS CETP, Tarapurhas issued NOC dt. 20.08.2012 for discharging treated effluent to outlet of CETP at point suggested by MIDC /MPCB.

Hon’ble high court, Mumbai in PIL filed by Nicholas Almedia V/s State of Maharashtra & Ors to oversee the compliance of the CETP’s in state of Maharashtra.

Sub-Regional Officer, Tarapur has reported that CETP has already receiving 25 MLD effluent and no further effluent could be accommodated in CETP, Tarapur.

Sr. Law Officer has stated that decision may be taken on basis of the order passed by Hon’ble High Court, Mumbai

The order includes monitoring the performance of non-compiling CETP, particularly highly polluting category which includes Tarapur.

We may grant permission to industry for disposal of 30% @ 400 CMD to outlet of CETP. The separate pipeline up to outlet of CETP shall be lay down by industry with prior permission from MIDC including confirmation of joining point to outlet pipeline of CETP.

Treated effluent is disposed by spring on coal and ash handling section and own land for Gardening and Plantation.

Industry generates domestic 2.5 m3/day effluent which is treated in septic tank

8. SRO, Nagpur-II has also verified the fact and certified that the work of Rolling Mill No.1 and Laminator is completed.

Board has granted Consent to Operate for Rolling Mill No.1 and Laminator for the period up to 28.02.2013 as per the decision taken in CAC meeting held on 02.03.2012. Industry vide letter dated 14.09.2012 has submitted that they have completed all the installation of the machine and are ready for operation.

We may grant consent to operate amalgamating of existing consent for rolling mill no.2, twin chamber remelt furnace, roll grander and aluminium furnace.

5. JVS analysis results of effluent are within limit. 6. ESP provided to unit no.2 & 3. 7. Stack monitoring results are exceeding the standards limit. 8. Fly ash is disposed to cement manufacturers. Earlier the case was discussed in CAC dated 29.05.2012 and it was decided to issue Show Cause Notice for refusal of consent for non-compliance of consent conditions. Accordingly, Board has issued SCN vide letter dated 20.6.2012. Industry has submitted their reply vide letter dated 30.6.2012. Action plan submitted by Power Station as per joint action plan meeting. The power station authorities has given the programme for retrofication / revamping / pollution control system upgradation as per joint action plan. The recommendation of MPCB along with time period are shown in separate chart which is attached herewith.

In view of above we may grant renewal up to 31.12.2012 with total B.G. of Rs.79/- lakhs as per the programme / recommendation of MPCB against each compliance shown in column no.’N’.

provided. 6. Coal consumption is 13151 MT/day. 7. ESP provided with design of SPM standard of 50 mg/Nm3. 8. Dry ash silo provided. 9. Regional Officer, Nashik vide letter dated 2.5.2012 received on 10.05.2012 reported the

non-compliance of MAHAGENCO Power plant related to Unit No.5 and also mentioned that MAHAGENCO authority has not taken any effective steps regarding disposal of ash slurry effluent. Regional Officer, Nashik recommended refusal of consent to operate of Unit No.5 of 500 MW.

The case was discussed in CAC meeting held on 29.05.2012. It was decided to revert back to CAC after receipt of completion report from R.O. regarding the pollution control system. R.O. Nashik vide letter dated 10.8.2012 received on 21.08.2012, has submitted the compliance report of M/s. Bhusawal TPS Unit-5. Industry has submitted joint action plan for unit no.4 & 5. We may grant 1st Consent to Operate for Unit No.5 for one year period subject to following conditions. i) To achieve the consent standards regularly for which operational B.G. of Rs.10 Lakhs

shall be obtained. ii) To provide STP within one year period for which operational B.G. of Rs.5 Lakhs shall be

taken. iii) To provide ash water recycling arrangement within one year period for which B.G. of

Rs.5 Lakhs shall be obtained.

4. The Board vide letter no.MPC/CRO/137/352/2011 dated 18/02/2011, had issued interim directions to said mine. As per directions, mine authority has completed following works. a)Concrete pavement to 100 meter at weigh bridge. b) Sprinkler arrangement near Weigh Bridge.

5. Mine authority has taken following measures to control pollution i) Water sprinklers at CHP area, with side cladding to conveyor belts. ii) Tarring of coal transportation roads. iii) Sprinklers along haul road. iv) Mobile water tankers for water spraying. v) Sprinklers at weigh bridge. vi) Rain gun at Coal stock yard no V vii) Road cleaning & booming.

6. Water Pollution i) Work shop ETP. ii) Sedimentation Tanks for mine water treatment. iii) DETP for treatment of colony sewage.

7. Analysis results of ambient air quality monitoring shows the RSPM level are exceeding the standards.

Discussed in CAC held on 3.7.2012 and it was decided to keep the case in abeyance till the completion of installation of Pollution control system as per Environment Clearance/Consent condition for existing and proposed unit. Report from SRO Chandrapur received on 14.09.2012. all the pollution related works are now completed as per SRO report. Except work of A.P.C. at C.H.P. and roads. Regular complaints from nearby residents. In view of above, we may grant consent for 3.0 million ton per annum capacity with condition that mine shall complete remaining works within 2 months with a Bank Guarantee of Rs.10/- Lakhs.

Earlier C to E was granted for mfg of Liquid CO2, weak & Concentrated Nitric Acid on 29.4.2008.

Industry has obtained C to O for all the products except conc. Nitric Acid.

Now applied for 1st consent to operate for mfg of Concentrate Nitric Acid CNA III- 3850 MT/M.

Existing full fledged common two ETPs provided. The total I.E. –3878.28 CMD and D.E. 577 CMD. Proposed IE & DE – NIL

Industry location 50 mtrs from Kasardi river. Attracts RRZ policy 2009 but C to E already granted in 2008, prior to RRZ policy 2009.

Proposed direction was issued on 7/12/11 due to ammonia gas leak incidence on 1.12.2011 & fish kill incidence in Kasardi river on 03.12.2011. industry submitted the reply at RO NM.

RO Navi Mumbai has recommended for grant of consent to 1st operate with BG condition for checking P.D. compliance or to ensure no such incidence takes place in future.

Earlier case was discussed in CAC meeting held on 25/7/2012 and it was decided to refer the case to RRZ Committee and revert back to CAC. Accordingly letter sent to RRZ committee on 28/8/2012. mean time industry has made representation to Hon’ble Chairman of the Board stating that, they are obtained C to E on 29/4/2008, prior to RRZ notification 2009 and there is no increase in pollution load in earlier combined consent granted by Board and requested for grant of consent to operate and not to refer the case to RRZ Committee as the plant is already erected and commissioned. As Kasardi river was not notified before 2009.

In this regard CAC may take suitable decision about industry request. If the industry request is consider then, We may consider case for 1st C to O for Concentrated Nitric Acid with amalgamation by imposing following conditions-.

1. Provision of emergency waste storage tank of sufficient capacity in case of any accidental discharge / contaminated storm water.

2. Proponent shall submit the adequacy report about APC of concentrated Nitric Acid plant

Industry has submitted “No increase in pollution load certificate” from IIT Bombay. Industry has proposal of installing RO plant of 24.0 CMD capacity and achieving no additional discharge to CETP.

The proponent has planned to recover the CO2 gas which is going to atmosphere, there by reducing GHG emissions.

Considering IIT Bombay report we may grant consent to establish with no increase in pollution load.

5. Now applied only for Sponge Iron production. Cost of Sponge Iron unit shown as Rs 39.7 Crores and deposited consent fee of Rs 75,000/- for one year.

6. Total capital investment of the industry (Power Plant 30 MW, Sponge Iron Unit 180 TPD, Billet Plant 525 TPD & Re-rolling Mill 500 TPD) is Rs.157.75 Crores.

7. SRO Chandrapur reported that; a) Industry has erected only one sponge iron kiln having capacity of 100

TPD and ready for operation. b) Electrostatic Precipitator having three fields is provided with stack having

height of 60 meters. c) Bag Filters are provided at cooler discharge, Product house & raw

material section & separation building. d) Conveyor Belts with side claddings are provided. e) Bag filters are provided at coal crusher with chimney of height 30 meter. f) Electric connection of all the de dusting is expected to complete within

seven days. The Unit has not yet completed the necessary pollution control system and consent to operate for phase-I may be given only after compliance of Consent to Establish and Environment Clearance conditions

But Industry requested not to reduce the consented effluent quantity.

7. Nearest mine lease boundary of Pimpari is about 225 meters from the notified River Penganga & thus not satisfying RRZ policy.

8. Regional Office vide letter dated 22/11/2011 has issued interim directions to the existing unit with directions to provide fixed water sprinklers along mine haul roads. The unit has not yet complied to the interim directions issued by R.O. Chandrapur. Consent to operate is required for 0.6 Million Ton/Annum for lime Stone Mining for which consent to establish is already obtained. Air Pollution control system needs to be strengthened. 5) For air pollution control, mine authority has deployed mobile water tankers, fixed water sprinklers along light weight movement road, but existing facility is totally inadequate to control, air pollution.

6) AAQM results are mostly exceeding to the consented standards.

7) R.O. Chandrapur reported that, this mine is complaint & LAQ oriented and thus observing non-compliance of consent conditions & directions issued by the Board. As per Board’s directions Existing BG of Rs 10.0 Lacs for Railway siding & Rs 2.0 lacs for mine has been forfeited and new BG of same amount has been obtained which are valid up to 10th April 2013. Condition of internal road needs improvement.

8) R.O. Chandrapur recommended renewal of consent with following directions with time bound program.

I. To provide high efficiency air pollution control system based on latest available technology. II. To provide at least three Continuous Ambient Air Quality Monitoring Stations.

III. To maintain coal transportation road along with automatic dust collection & road wetting machine.

IV. Tarring of internal road shall be carried out. V. Mine authority shall undertake water harvesting program in mine area, railway siding & in the

vicinity villages. The unit is still not yet complied. R.O. Chandrapur has submitted the report which is not complied. Complaint from local MLA regarding discharge of effluent into nalla. The industry has started trail run of the weaving machinery since December 2011 for training of workers.

As per C to E granted by board, total consented effluent were 166 CMD (Industrial -106 CMD + Domestic 60 CMD), however now industry has curtailed generation of total effluent to (Industrial 22 CMD + 42 CMD = 64 CMD)

Industry will be generating of 42 CMD domestic effluent at full capacity utilization which will be treated by CSTP provided by M/s. IITP which will comprise units as Equalization tank, pH Correction tank, Bar Screen, O & G Trap, Flocculation, Settling Clarifier, UASB Reactor.

Presently IITP has provided 20 CMD packaged STP and further full-fledged CSTP of 370 CMD capacity will be provided which is under construction and will be completed by 30.09.2012

Industry is generating 22 CMD Industrial Effluent from sizing, Boiler Blow Down and Humidification Activity which will be treated by CETP provided by M/s. IITP. This CETP comprising the unit as Equalization tank, Bar screen, O&G Trap, pH Correction tank, Ozone contact tank, Flocculation, Settling Clarifier, however upgradation of CETP is under process and will be completed by 30.09.2012

M/s. Islampur Integrated Textile Park will be recycled & reused treated effluent for development of green belt & horticulture in over area of 60,000 m2 which will be completed by 30.09.2012.

Industry has provided mechanical type Dust Collector to Boiler having stalk height of 30
