Resubmitted Agenda CAC Item No.01 HOD Remarks Name of the Industry : M/s. Chandrapur Ferro Alloy Plant, Survey No.498/2, 499 & 500 & 503/2, Mul Road, Chandrapur. HOD Remarks: 1) Applied for consent to establish for expansion project by installing one submerged

Electric Arc Furnace of capacity of 45 MWA for production of high carbon ferro-manganese, silico-mangnese and electricity plant of capacity of 4.0 MW based on co-gas generated from manufacturing process.

2) Existing unit consent for manufacturing of Ferro Manganese Plant, Sinter Plant and Power Plant was valid up to 31.12.2011 and Capital Investment of existing unit is Rs.86.70 Crores. Applied for renewal of consent for existing unit. Show cause notice issued to the existing unit vide letter dated 23.04.2012 due to non-compliance of consent conditions and interim directions issued by the Board and due to discharge of substandard into river Zarpat.

3) Capital Investment of the expansion project is Rs. 221.42 Crores. Industry has paid Consent fee of Rs.4,42,480/-, as per new GR

5) Domestic Effluent is 24 CMD. and Industrial Effluent is 500 CMD, Septic Tank and Soak pit provided.

6) This office has issued interim directions vide letter dated 19/12/2011 to carry out Environmental Works in time bound manner.

The case was discussed in CAC meeting held on 3.7.2012 and it was decided to issue show cause notice for refusal of consent as the existing unit has not complied with the consent conditions. Accordingly the show cause notice was issued to the industry on 12.7.2012. R.O. Chandrapur vide letter dated 17.7.2012 submitted the reply of SCN. The unit is not complying with the time period issued by the Board for completion of pollution control system and industry requested for extension of time period. The B.G. of the existing unit of Rs.12/- Lakhs is forfeited by the Board as per the decision taken in the Consent Committee. The case was discussed in CAC meeting held on 24.09.2012 and it was decided to keep the case in abeyance till the completion of pollution control system for existing unit. RO Chandrapur vide letter dated 14.12.2012 has submitted the compliance report and seen that unit has mostly complied with the directions but unit has not yet submitted the Bank Guarantee of Rs.24 Lakhs for existing unit as per the decision taken in CC. In view of above, we may grant consent to establish for expansion only after submission of B.G. of Rs.24/- Lakhs.

1. Applied on 03.04.2012 for grant of renewal of consent to operate for RMC plant. 2. Application for grant of renewal of consent to operate received to HQ on

28.09.2012. 3. SRO-Mahad has reported in his processing report that industry has not

provided adequate air pollution control system. 4. Regional officer –Raigad has recommended case for grant of renewal of

consent to operate under orange category up to 31.03.2014. 5. As per CPCB’s direction dated 04.06.2012 regarding classification of the

industry, RMC plant falls under Green category [Green industries list- sr.no.72]. 6. Industry has paid consent fees Rs.15,000/-as per revised G.R.25.08.2011. 7. This RMC unit is located inside the premises of Dighi port and said activity is

carried out for development of Dighi port. The total capital investment of the port is Rs. 1,053/- Crores.

8. This case was discussed in the CAC meeting held on 26.11.2012 and it was decided to issue SCN for non provision of APCS.SCN was issued to industry on 04.12.2012.

9. Industry has submitted their reply on 06.12.2012 stating that, they have provided roads within premises are regularly cleaning and wetting ground within premises, planted trees at the site and frequently sprinkling water all around the site and area.

10. Field Officer -Mahad has visited site on 10.12.2012 reported that industry has not provided adequate air pollution control system and not in operation since June-2012.

11. Industry has not provided adequate air pollution control system Hence Refuse grant of renewal of consent to operate.

• Applied for renewal of consent • Application received at SRO- Pune on dtd 02/05/2012 and at HQ on 21/06/2012 • Previous consent was valid up to 30/06/2012 • Industrial Effluent Generation is 1008 CMD. The trade effluent is being treated in

ETP of M/s. Bilt Graphics Paper Products Ltd. (sister concern unit Bhigwan) which is adjacent to this unit.

• Treated effluent is utilized for plantation in factory premises. Remaining effluent is discharged into Bori Nalla

• Total area covered under plantation 6.9 hectors • Domestic effluent is 62 CMD. Its mixed in trade effluent & treated in ETP • Industry has provided electrostatic preceptors followed by common stack of 120 mtr

height to the CFBC boiler 1 and 2 also provided bag filters followed bu common stack of 75 mtr height to the Oil boiler and FBC boiler.

• Coal handling section the concreting/pitched road is not provided. Water sprinkling arrangement needs improvement.

• As per previous consent condition industry not installed Continuous monitoring facility for stack emission analysis and 3 CAAQMS and micrometeorological station for So2, Nox and PM.

• RO Pune has recommended the case for grant of renewal of consent • The case has been discussed in the Consent Appraisal Committee meeting held on

24/09/2012 and the Consent Appraisal Committee has decided to issue SCN for refusal of consent for discharging effluent in to Nalla, CAAQMS not installed and inadequate land for disposal of effluent.

• We may grant renewal of consent for one year period with condition that 1 industry shall stop discharge effluent from power plant into Bori Nall within 3 month with BG of 5/- Lakhs 2. To install opacity & CAAQMS before June 2013 with BG of 5/- Lakhs 3. To provide adequate land to disposal of effluent within next 6 month with Bg 5/- Lakhs 4. For operation & pollution control system as continuous basis BG of Rs. 5/- Lakhs • We may place the consent application before CAC for further consideration.

Application received at SRO Tarapur on 12/11/2010 and at HQ 13/12/2010. 3. Textile processing industry. 4. Consent toEstablish was granted by Board vide dtd B-85, 30/08/2010 upto

commissioning of Unit. 5. The condition of 100% recycle/reuse of treated effluent in the plant & to achieve Zero

discharge, was prescribed to industry. SRO Tarapur vide letter dtd 03/11/2011 reported that, A) Industry has provided 3 MLD effluent treatment plant comprising of Bar screen, Oil

& grease trap, Reaction tank, equalization tank, Aeration tank, Secondary Clarifier, Decanter.

B) The erection of 1 MLD capacity RO plant has been completed comprises of Pre treatment plant (Silica removal, tertiary reactivator clarification, chlorination,& multimedia filtration, ultra filtration & reverse osmosis Plant (Single stage 70% recovery), Chlorine treatment for RO reject.

C) The culture development (MLSS) in aeration tank is under progress.

6. Industry vide letter dtd 03/11/2011 requested for amendment in consent to Establish i.e permission of discharge of RO reject 30% i.e @400 CMD to out let of CETP instead of zero discharge .

7. Application was discussed in CAC 22.11.2011 and it was decided to issue SCN to industry.

8. SCN was issued & case was re discussed in CAC dtd 31.1.2012 & refused the consent. 9. Ind requested for withdrawl of refusal and Application was discussed in CAC meeting

dtd 24.09.12, It was decided to seek clarification from MIDC regarding the capacity of effluent carrying pipeline from CETP to final disposal point.

10. Letter was sent to MIDC on 30.10.2012 by Legal department.

11. MIDC vide letter dtd 10.12.2012 communicated that

A)The existing disposal line upto navapur creek is 1000mm dia psc which can safely carry effluent of 75 MLD.

B)Tarapur CETP can accommodate 400CMD treated effluernt received from M/s Mandhana Industries Ltd at CETO out Let as per TEPS letter dtd 20.08.2012.

c)The commection point for treated effluent of said industry after CETP out l;et will have to be finalized by MIDC & MPCB so as to monitor their treated effluent.

3. The total CI after clubbing two applications is Rs 433.01 crores i.e. Rs.292.71 crores existing and Rs.140.3 crores expansion. The CI shown by industry during C to E was Rs. 231.65 crores. Industry vide their letter dated 27/11/2012, reported that the proposed project was for Audi Q-7 & Q-3 car assembling, but now only project of Audi Q-7 is approved and accordingly capital investment was approved by industry Board and submitted the CA certificate of CI as Rs. 140.33 crores.

4. The existing ETP & STP will be used by industry for treatment of indl. & domestic effluent generated. The capacity of ETP is 25 CMD and total effluent generated is 24 CMD from existing & expansion. The capacity of STP is 50 CMD and total effluent generated is 45 CMD from existing & expansion.

5. JVS results are within limit. 6. Submitted the Environment statement for the year of 2011-2012. Cess returns are

filed upto October- 2012 and have not received the assessment order. 7. RO & SRO have recommended the grant of consent Renewal & 1st operate. 8. The fees paid for renewal are Rs 1756287/- for three years period, this is considering

CI as Rs.292.71 crores and paid fees for 1st operate are Rs.280674/- for one year considering CI as Rs.140.3 crores. If we grant consent for three years considering CI as Rs.433.01 crores the fees will be Rs.2598600/-. So the difference fees of Rs. 561639/- is to be recovered from industry.

9. We may consider grant of consent renewal and 1st operate for period of three years after receipt of additional fees.

limits.

• Though the proponent had carried out remediation work , which has been verified by the RO, Thane by collecting and analyzing ground water and soil samples , being pesticide mfg. industry, this needs to certify by the reputed third party viz. IIT, NEERI, UDCT etc.

• We may consider the request of the industry about cancellation of consent by imposing following conditions.

The project proponent is responsible for carrying out any remedial measures, if required in future at their own cost. the consent fees paid up to 31.12.2014 shall not be refunded. The proponent shall settle any dues viz. cess payment, JVS analysis charges, if any. The project proponent shall submit a copy of report of third party about safe closer of the site to the Board and responsible for implementations of suggestions, if any there of. • This is separate orange category unit, not connected with sugar factory.

• By mistake processed in CAC Confirmed with SRO

• Authority is MS

• Recommended for withdrawing from CAC

• Industry has applied for Environmental Clearance for expansion of Sugar and Co-

generation unit.

• JVS are exceeding prescribed consented standard. 

• SRO, Solapur and RO, Pune has recommended Consent to Establish (Expansion)

• We may grant C to E as existing unit is complying to directions.

• We may grant C to E as per consistence approach.

• BG of Rs. 5 Lakhs towards compliance and provision of pollution control devices.

• Recommend to grant C to E.

(Co-generation Unit), Malinagar, Tal – Malshiras, Dist – Solapur

HOD Remarks :

• Industry has applied for Establish of 14.80 MW co-generation plant.

• Total C.I. 177.26 Cr. in which Co-generation C.I. is 93 Cr.

• JVS are exceeding existing unit. But JVS are of last season.

• Board has granted consent on 31.10.2012. with B.G of Rs. 5 + 2 and 2 lakh for wet

scrubber.

• Industry has not submitted B.G. In process of submission.

• JVS results dt. 26/4/2012,10/05/2012, 30/10/2012 are exceeding

• As per Consistence approach, BG submitted by industry for for existing unit hence

we may treat this as compliance.

• BG of Rs. 5 Lakhs shall be obtained in C to E for provision of pollution control

devices

• We may grant Consent to Establish.
