The Consent Appraisal Committee meeting of the Board was held on 09.02.2018. Following members of the Consent Appraisal Committee were

Committee noted that PP has applied for proposed logistic

STP based on MBBR Technology is proposed for the
treatment of sewage including OWC for wet garbage.
In view of above, it was decided to grant consent to
establish for proposed logistic park on Total Plot Area
1,44,065.50 sq. mtrs and Construction BUA 1,05,000 sq.
Mtrs. by imposing following conditions:
1. PP shall not take any effective steps without obtaining
prior Environmental Clearance and submit BG of Rs 10
lakh towards compliance of the same.

assembling etc. Individual industry in the logistic park
will be responsible for obtaining their Consent to
Establish and Operate separately from MPCB.
4. Applicant shall provide and operate common pollution
control infrastructure facility such as STP, Bio-gas
plant/OWC and ensure that the individual
industries/units shall enter into MOU with Industrial
park to ensure operation and maintenance of the
common facility and other assets.
5. PP shall not allot the plot to the trade effluent
generating industry.
6. PP shall achieve the treated domestic effluent standard
for the parameter BOD- 10 mg/lit.
7. The treated domestic effluent shall be 60% recycled for
secondary purposes such as toilet flushing, air
conditioning, cooling tower make up, firefighting etc.
and remaining shall be used on own land for gardening/
irrigation purpose within premises. In no case, effluent
shall find its way to any water body directly/indirectly
at any time. The firm shall affix the separate meter for
ensurance of 60% recycling of treated sewage and keep
the records of the same.
8. PP shall install online monitoring system for BOD, TSS
and flow at the outlet of STP.
9. PP shall submit BG of Rs. 25 Lakhs towards
compliance of Consent to Establish condition.
Consent shall be granted after receipt of map showing
proposed pollution control system i.e. ETP, STP, MSW
disposal arrangements etc.

Committee noted that Show Cause Notice for refusal of
Consent was issued on 03.01.2018 and also noted the
reply submitted by PP on 05.01.2018 wherein, PP has

Considering the reply of the PP, it was decided to grant
Consent to Establish for Expansion for Hotel activity for
total plot area- 13,24,930 Sq. mtrs. and Construction BUA
(Expansion) of 7076.21 sq. mtrs out of 35,821.11 Sq. Mtrs
as per EC dated 09.12.2016 by imposing following
conditions;-
1. PP shall submit an affidavit in prescribed format
regarding compliance of conditions of EC and
Consent to Establish condition.
2. PP shall submit an affidavit regarding the area for
which expansion of C to E application is made is
included in Environment Clearance.
3. PP shall achieve the treated domestic effluent standard
for the parameter BOD- 10 mg/lit.
4. The treated effluent shall be 60% recycled for
secondary purposes such as toilet flushing, air
conditioning, cooling tower make up, firefighting etc.
and remaining shall be utilized on land for gardening.
5. PP shall install online monitoring system for BOD,
TSS and flow at the outlet of STP.
6. PP shall submit BG of Rs. 25 Lakhs towards
compliance of EC and Consent to Establish condition.
7. PP shall re-validate the EC if project is not completed
before the expiry of the same.
8. 1st consent to operate for expansion will be considered
only after submission of NOC from CGWB/Irrigation
department for consumption of ground water/Surface
water.
Consent shall be issued after receipt of additional fees, if
required.

5. PP shall submit Board Resolution from company
Board, towards starting of construction work without
obtaining valid consent to establish from the MPC
Board thus violated the provisions of Environmental
Laws and in future, they will not do such violations
and BG of Rs. 2 lakh towards submission of Board
resolution within one month of issue of consent.
6. PP shall amend the EC dated 16.03.2015 for name
change from M/s. Sunnyvista Realtors Pvt. Ltd to M/s.
Persipina Developers Pvt. Ltd
7. 1st consent to operate for expansion will be considered
only after submission of NOC from CGWB/Irrigation
department for consumption of ground water/Surface

1 Policy Guideline for Use of Pet Coke as a
fuel in Cement Kiln
It was decided to use Pet Coke as a substitute fuel in integrated cement
plants subject to the terms and conditions notified in the MoEF notification
dated 10.05.2016 & 23.11.2016.
1. They should abide by the conditions mentioned in proceeding in Writ
petition 13029/1985 in Hon’ble Supreme Court in the matter of Mr. M.
C. Mehta Vs Union of India.
2. The height of stack shall be as per the standard formula of stack height
calculation. They shall install all requisite pollution control measures as
per guidelines.
3. All the cement plants shall conduct ambient air quality monitoring on
regular interval of 15 days.
4. For pet coke storage where grinding and storage of pet coke carried out,
a barrier walls of adequate height along the periphery of premises shall
be provided.
5. Pet coke using cement industries shall submit detail of analysis of pet
coke before its use.
6. Pet coke shall be transported by providing scientific cover so as to
control fugitive emissions.
7. They shall comply with the Hazardous Waste (M & TM) 2016.
8. To comply the order issued by Hon’ble N.G.T. in the matter of

2 Policy Guidelines for utilization of
Pond/Bottom Ash generating from
Thermal Power Plants for backfiling in
Abandoned mines/Stone quarry
It was decided to approve only bottom ash generating from Coal based
Thermal Power Plants for backfilling in abandoned mine / stone quarries
subject to land approval from district authorities.
On the basis of compliance of fly ash notification issued by MoEFCC, GoI
we may grant NOC for utilization bottom ash for landfill to reclaim low
lying areas including back filling in abandoned mines/ stone quarry, with
following BG Regime.
Bank Guarantee Regime for utilization of Bottom ash generated form
Thermal Power Plant for back filling in abandoned mines/stone quarry.
1. Dispose available bottom ash at designated sites (earth quarry) and soil
borrow area shall be filled up with proper compaction and reclamation
and shall ensure that such reclamation and compaction to be done in
accordance with the specifications and guidelines laid down by
authorities & fly ash notifications.
2. The compaction shall be done on a scientific way so as to give strength of
natural soil strata
3. The boundary of the reclaimed site shall have fencing and entire
reclaimed site shall be bordered by scientific garland drain so as to
prevent the runoff before commencement of activity.
4. Tree plantation shall be done on the reclaimed land @ 2500 plants /
hectare and shall be maintained. The proposed program and its
implementation schedule shall be submitted within one month of
commencement of the work.
5. Declare bottom ash generation details on monthly basis prior to its
disposal. A separate register about disposal of bottom ash shall be
maintained where officials shall make entry of utilization of bottom ash
regularly and industry shall regularly submit manifests of bottom ash

6. There shall not be any fugitive emissions, leakage/ spillage during
transportation [Loading /Unloading] and Bottom ash transportation trucks

case it shall not be transported through the village.
3 Policy decision in respect of grant of
consent to Establish Expansion of
Industrial Units in the area of non-
performing CETPs
The committee noted that scheme of zero liquid discharge. Industries had
filed Writ Petitions before Hon’ble High Court Mumbai to consider their
application along with ZLD plan in a time bound manner and to grant
requisite permission.
The Hon’ble High Court Mumbai in one of the Write Petition vide order
dated 11.04.2017 directed to MPCB to process the application of the
petitioner and it is come to the conclusion that the petitioner satisfies
requirements and guideline of CPCB, then NOC may be granted to the
Petitioner.
Considering the NGT and High Court orders in the matter of non-complying
CETP’s, the issue was discussed at length and decided to consider to grant
consent to establish / expansion of industrial units with effluent treatment
plant in non-performing CETP areas, where in industry shall achieve the
zero liquid discharge (ZLD) and no pollution potential, subject to
compliance of the following directions dated 31.03.2016 issued by CPCB.
1. Not resulting in increase in pollution load such as industries generating
Nil industrial effluent, 100% industrial effluent recycling, industries
