GENERAL INSTRUCTIONS….

(1) The tenders are invited from "Bus manufacturers/ Authorized Distributers/ Authorized Dealers on behalf of Manufacturer‖ as per MSRTC Specifications and Pre-qualification Criteria.

(2) The tender shall be submitted through e-procurement portal only.

(3) All Tender details are available at, https://msrtc.maharashtra.etenders.in.

(4) This tender is in Two Bid System Tender viz. TECHNICAL TENDER and COMMERCIAL TENDER.

(5) Quantity:-Quantity of this tender item will be approximately 27 (53 seater-2 & 45 seater-25) Fully Built, Air-conditioned, Integral, Hi-Tech Coaches conforming to Euro III Emission norm and MSRTC Specifications

(6) Tender shall be valid for the period of 12 MONTHS (one year) from the date of Opening of the Tender.

(a) Terms and conditions of the tender are available for free view. (b) The documents which are to be downloaded are available on payment of non refundable

tender form fee Rs 20,000 ( Rupees: TWENTY THOUSAND ONLY) per set including VAT @ 12.50% to be paid by RTGS (on or before last date and time of Online Bid Submission stage) in favour of MSRTC FUND A/C in SBI Account no. 10044570260 IFSC, Code SBIN 0000547, Branch Code 547 , MICR No. 400002009, Branch – Mumbai Central. The UTR no. must be uploaded in Technical Bid. or Any Tenderer who wish to pay tender form fee by Demand Draft then DD in favour of MSRTC FUND ACCOUNT payable at Mumbai be submitted at Accounts Department, MSRTC, Central Office, Mumbai well before expiry of Bid Submission. (11) UPLOADING TENDER:-

I. The tenderer has to read and understand all terms and conditions of the tender.

II. Complete all formalities/documents /Annexures in all respect along with its supporting/requisite evidences as per instructions in the tender document and concern annexure.

III. Upload all required documents in technical tender.

IV. Upload annexure E in commercial tender.

V. Submit technical tender and commercial tender before due date and time.

(12) OPENING OF TENDERS:-

On the date, specified in the tender schedule, following procedure will be adopted for opening of the Tender.

I. Technical tender of each tenderer will be opened online. Pre-qualification criteria is evaluated,

specifications are verified by tender opening authority. If Pre-qualification criteria and specifications are acceptable to the Corporation then only Commercial tender will be opened. If, Pre-qualification criteria or specifications of tenderer do not meet MSRTC requirement, such tenders will not be considered to open its commercial bid. A note will be recorded accordingly by the tender opening authority and the said tenderer's Commercial Tender will not be considered for further action and the same will be recorded. The decision of the tender opening authority in this regard will be final and binding on the tenderers.

II. Commercial tender of tenderer will be opened on satisfaction/acceptability of Technical Tender and verification of specifications only .

(13) Approaching any of the authority / officer of the Corporation, through himself or by his authorized agent/

Liaisioning agent influencing to obtain favorable decision in respect of tender shall be dis-qualification and for this breach Earnest Money Deposit will be forfeited.

STANDERED TERMS AND CONDITIONS:-

A) INTRODUCTION:- A-1. MSRTC – Profile at a glance:-

MSRTC is a leading organization in public transport sector in Maharashtra, having network of 250 depots and 30 divisions. MSRTC is having fleet of about 17000 different types of buses (Ordinary, City, Semi luxury, Air conditioned) which are operated on different routes in Maharashtra and performing 200 crore kms. per year.

A-2. Purpose of tender:-

The tender is being invited for Procurement of 27 no of FULLY BUILT, AIRCONDITIONED, HIGH TECH, INTEGRAL COACHES conforming to Euro III Emission norm and MSRTC Specifications. These buses will be operated throughout Maharashtra and interstate operations.

A-3. Cost of Tender:-

The tenderer shall bear all costs associated with the preparation and submission of its tender, and MSRTC will in no case be responsible or liable for these costs, regardless of the conduct or outcome of the tendering process.

A-4. Quantity:-

This tender is invited to purchase approximately 27 FULLY BUILT, AIRCONDITIONED, HIGH TECH, INTEGRAL COACHES. Out of 27 Buses, 2 Buses will be having seating capacity of 53 seats and 25 Buses will be having seating capacity of 45 seats. However the said quantity may vary/increase/decrease.

A-4. Specifications:-

i. The detailed requirements and specifications of 53 seating capacity and 45 seating capacity coaches are available at Annexure ―B‖ with Specification folder No(BDY-338/1) Month: August 2014 and (BDY-338/2) Month: August 2014 respectively.

ii. Tenderers are requested to confirm the requirement furnishing detailed specifications for each model which they are offering against this tender in the format given at annexure ―B1 and B2‖

iii. The coach offered should be confirm to latest CMVR norms. Type approval certificate for each offered model from the authorized certifying agency to be provided.

iv. All fully built integral coaches supplied under the tender shall be manufactured in the manner set out in the specification or wherever not set out, CMVR/AIS norms are to be considered to the reasonable satisfaction of the General Manager (ME) or the representative.

v. The design shall be developed based on the requirement given in the technical specifications and sound engineering practices.

vi. At any stage of the supply and operation, if any discrepancies arise as to the meaning and import of the specifications for the fully built integral coaches to be supplied under the tender, the same shall be explained by the Engineer, and his explanation shall, subject to the decision of the General Manager (M.E.) in case a reference is made to him, be binding upon the tenderer and the tenderer shall supply the fully built integral coaches and float units according to such explanations and shall also carry out all necessary modifications as implied by the specifications, even though such modifications are not specially shown and described in the said specifications.

vii. The terms and conditions mentioned in tender document regarding specifications will also be the part of the specifications.

viii. The points where the specification is not specified by MSRTC then the brief specification to which the product is manufactured i.e. ISI/BIS/DIN/OE etc. or the details of company's own specifications is to be given when it will be specifically asked.

ix. The fully built integral coaches are expected to be fuel efficient. Therefore, Seating capacity wise minimum Kms per liter of fuel ( KMPL) should be as under:

A-5. Qualification criteria:-

This tender is called from "Bus manufacturers/Authorized Distributers/ Dealers on behalf of Manufacturer as per MSRTC Specifications and Pre-qualification Criteria".

A-6. Validity of Tender:-Tender shall be valid for the period of one year (12 months) from the date of opening of commercial Tender.

B) Tender Conditions:- B-1 General Instructions:-

(i) Tender documents incorporate the General instructions, Standard terms and conditions of contract, specifications, Information’s in Annexures, schedule of rates, contract agreement, performance guarantee, minutes of the Pre Bid meeting, correspondence related to tender etc.

(ii) The tenderers are requested to read all instructions, forms, terms and conditions,

specifications and other information mentioned in the tender documents carefully.

(iii) Failure to furnish all information required or submission of a tender not substantially responsive to the tendering documents in every respect will be at the Tenderer's risk and may result in rejection of tender.

(iv) The language of the tender shall be in English Only.

(v) The fully built integral coaches for which this invitation of tender is issued are required

urgently and Tenderers shall indicate the guaranteed delivery offered by them. B-2 Right for alteration, deletion, rejection, acceptance:-

(i) The General Manager (ME) has every right to reject any or all the tenders so received on the due date without assigning any reason thereof.

(ii) The General Manager (ME) reserves the right to accept or reject any tender and to amend tendering process and / or to reject any or all tenders at any time during process or prior to award of contract without reason thereby incurring any liability to the affected Tenderer or Tenderers and there will be no obligation to inform the affected tenderer or tenderers the reasons for the rejection.

(iii) General Manager (ME) reserves the right to alter the quantities specified in the tender,

contract, purchase order or delivery schedule.

(iv) The General Manager (ME) reserves right to alter / delete specification as he may deem fit due to various reasons such as pollution norm imposed by CMVR, MMVR, M.V.act from time to time during the course of Tender Evaluation or during the course of contract period.

(v) The General Manager (ME) reserves the right to add / modify/ delete any of the terms

and conditions listed in the tender till finalization of tender. (vi) The General Manager (ME) shall be under no obligation to accept the lowest or any other

offer received in response to this tender notice and shall be entitled to reject any or all offers including those received late or incomplete offers without assigning any reasons whatsoever.

(vii) The General Manager (ME) reserves the right to make any changes in the terms and

conditions of purchase order / rate contract applicable to tender. (viii) The General Manager (ME) also reserves the right to accept the whole or any part of

tender or portion of the quantity offered by Tenderer. (ix) The General Manager (ME) reserves the right to waive any infirmity in any tender and to

reject one or all tenders without assigning any reasons for such rejection. (x) The General Manager (ME) has also reserves right to vary the quantities of fully built

integral coaches in the schedule of supply as may be necessary.

B-3) Other Conditions:-

(i) Failure or breach of the clause shall render the tenderer/s liable for black listing them from the business with MSRTC.

(ii) Only those tenderers who accept all the terms and condition mentioned in tender document in full will be considered.

(iii) Tenderer should sign at the end of each page with page no. and upload the same. Tenderer must ensure that the tender document submitted must be accompanied with all relevant/requested documents.

(iv) Every term shall be mentioned in proper detail and shall be no ambiguity in term in the tenderer's response to the tender.

(v) The tender shall be free from strikeouts, over–writing, erasures or other modifications or any clerical, computational or other errors, failing which such tenders shall be liable for rejection. Incomplete or erroneous tenders are liable for rejection.

(vi) Tenders not complying with instructions mentioned in the tender are also liable for rejection.

(vii) Offers received in response to the tender, shall be opened in the presence MSRTC officials on the specified date, time. Commercial tender will be opened in respect of only those tenderers who will successfully meet qualification criteria and specifications of technical tender. The Technical and Commercial tender may or may not be opened on the same day.

(viii) The submission of any tender connected with the "Invitation of Tender and conditions of tender" shall constitute agreement that the tenderer shall have no cause of action or claim against the MSRTC or its officers, employees, successors or assignees for rejection of its tender.

(ix) Modifications of specifications and extension of the closing date of the tender, if required, will be made by an addendum. Copies of each addendum will be sent to the tenderers. These shall be signed and shall form a part of the tender's / tender.

(x) Late tender – Any tenderer submits his tender after the tender submission deadline prescribed by the MSRTC, it will not be accepted in any case.

(xi) Subsequent Offers:-Tenderer is requested to quote their most competitive offer unconditionally while submitting the tender itself. Any subsequent offer received after the closing date of the tender will not be considered.

(xii) As per policy, the tender is processed by General Manager (ME) and PO placed. However, the sell letter be issued in the name of "SECRETARY, MSRTC, C/O Divisional Controller, Pen unit where the fully built integral coaches are to be delivered.

B-4. Clarification:-

(i) Clarification about tender:- In case of any clarifications, tenderers may contact Chief Engineer (OPN) and may notify to MSRTC in writing to General Manager (ME), Mechanical Engineering Department, Dr. Anandrao Nair Marg, Mumbai Central, Mumbai 400 008 within ten days from the date of purchase of tender form.

(ii) PRE BID CONFERENCE:-

A Pre-Bid Conference under the chairman-ship of Vice-Chairman & Managing Director, MSRTC will be held well in advance before the date of tender submission. All intending bidders will be allowed to participate in the conference. The tenderers can freely make queries regarding the tendering process, terms and conditions, if required, which may clear the difficulties and doubts in tendering process. The tenderers are requested to inform their queries in writing well in advance i.e. atleast three days before Pre- Bid Conference. Tentative date and time for Pre Bid Conference is mentioned in tender schedule.

Decisions given by Chairman of Pre Bid Conference on all the decision taken during Pre bid meeting will be the part of tender.

(iii) Clarification of offer:-

To assist in the scrutiny, evaluation and comparison of offers, General Manager (ME) may, at his discretion, ask some or all tenderers for clarification of their offer. The request for such clarifications and the response will necessarily be given in writing.

(iv) If tenderer notice any ambiguity/contradiction/error/mistake in the tender document it should bring to the notice of General Manager(M.E.) well in advance, otherwise in case of any dispute the decision of General Manager (ME) will be binding on the tenderer.

C) Preparation of Tender documents:-

C-1 TECHNICAL TENDER WITH QUALIFICATION CRITERIA-:-

Tenderer should attach all the necessary documents with Technical Tender. Essential documents required with reference to this tender shall be submitted in prescribed format. Tender form duly signed wherever it is required. The required documents are mentioned in Pre-qualification criteria. Enclose all the Annexures duly filled with information as attached with the tender documents, except Annexure E of commercial tender.

If commercial offer or annexure is found with technical tender, the tender will be disqualified.

C-2 COMMERCIAL TENDER -:-

The Tenderer should attach signed Annexure ―E‖ – Rate schedule duly filled in all respect without corrections. Corrections are not allowed. However, any correction OR over writing is required then authorized person should sign the figures and those only will be considered, if approved by Tender Committee. Annexure "E" should be submitted in Commercial bid only.

D) Earnest Money Deposit:-

D-1) Each Tenderer has to deposit a sum of Rs. 5,00,000(Rs. Five Lakhs Only) against

this tender towards Earnest Money Deposit, which shall be paid by Demand Draft of any nationalized bank in Mumbai, in favour of MSRTC FUND ACCOUNT, M.S.R.T. Corporation, Mumbai 400 008. Tender must be accompanied by scan copy of Demand Draft or EMD may be paid by RTGS uploading UTR number in technical tender.

D-2) The Earnest Money deposits of unsuccessful tenderers will be returned after tender is

decided, within sixty (60) days subject to settlement of outstanding dues, if any.

D-3) The Earnest Money Deposit of successful tenderer will be refunded after the receipt of Security Deposit.

D-4) The Earnest Money Deposit may be forfeited:-

a. If the Tenderer withdraws its tender during the period of tender validity specified

by the Tenderer in the Tender Form. b. If Tenderer fails to accept the letter of indent / offer/ purchase order / tender

conditions for Rate Contract within the specified time limit.

D-5) No tender will be accepted unless the Earnest Money Deposit is paid.

D-6) EMD will not become a part of security deposit.

D-7) No interest will be paid on the E.M.D.

D-8) The General Manager (ME) reserves the right to recover the dues payable to Corporation, if any from the E.M.D.

E) PRICES:-

All the following terms and conditions are applicable for commercial offer for purchase of Bus and also for commercial offer for Comprehensive Annual Maintenance Contract wherever applicable. (E-1) The Commercial offer shall be on unconditional fixed basic price exclusive of taxes, govt.

levies etc. The basic price/ rate exclusive of excise duty and taxes should be firm and no upward price rise will be allowed during the contractual period.

(E-2) Prices shall be quoted in the Indian Rupees (INR). The delivery of all buses will be taken at MSRTC , PEN unit in dist. Raigadh (MS). Basic Price must be on FOR DESTINATION basis exclusive of all Central Government Taxes and State Government Taxes and levies Cess etc. The firm will quote the rate FOR destination basis by giving the bifurcation including basic price, excise, other taxes, levies, Sales Tax / VAT etc.

(E-3) Firm will clearly mention the quantum of Excise Duty, Sales Tax, VAT and other Govt. levies applicable.

(E-4) The landed cost for MSRTC shall be quoted clearly and readable.

(E-5) Octroi and registration charges will be borne by MSRTC. Hence Tenderer should quote the rates exclusive of Octroi and registration charges. However, charges for extension of CRTEM, entry tax and transit insurance will be borne by tenderer.

(E-6) If concessional rate in excise duty is applicable, then firm must clearly specify the slabs of Excise Duty and details.

(E-7) Discounts – The rates are to be offered by firm without any discounts. However, as regard the discounts, it is to clarify that all discounts offered during contract will be availed by MSRTC based on the business awarded to the firm without linking it to the condition of no. of orders placed or without the condition of minimum quantity, value of supply at once destination.

(E-8) The increase in excise and taxes and government levy, if any will only be accepted subject to receipt of documentary evidences. This change will be applicable only after issue of separate circular from this office, however the firm will not stop the supplies for the want of amendment from this office to this effect. Any change in CMVR / MMVR regulations in terms of modifications /additions / fitments, the same shall be incorporated in the buses without any additional cost during the contractual period.

(E-9) If there is any downward revision in price due to decrease in the rate of statutory levies, taxes, the same will be applicable to the supplies made to the MSRTC from the date of implementation, as may be specified by the authority for such revision takes place. It will be the responsibility of the tenderer to bring such downward revision to the notice of MSRTC. If over the period, such type of down ward revision noticed by MSRTC, the retrospective recovery with interest will be made by MSRTC.

(E-10) All statutory levies payable on basic price shall be reimbursed (paid) based on submission on actual payment alongwith actual bus body number for supplies made during lead time / scheduled delivery period. However, after the expiry of lead time / scheduled specified the increase in excise duty, statutory levy, any government levy will not be considered at the increased rate.

(E-11) The Corporation shall not be responsible for any omissions or other errors committed by the tenderer in communicating such cost components. Any liability arising out of any duty, charges, taxes, and levy or components thereof not being explicitly stated by the tenderer, shall be totally borne by the Tenderer.

(E-12) The Commercial Tender shall be readable and shall not contain any strike outs, over-writing,

erasures or other modifications and shall be free of any clerical or computational error. (E-13) The tenderer shall examine the conditions of tender, general conditions of the contract and the

specifications of satisfy himself as to all the terms and conditions and circumstances affecting the contract price. He shall quote prices according to his own views on these matters and understand that no additional charges except as otherwise provided therein will be levied. The MSRTC shall not be responsible for any misunderstanding or incorrect information obtained by the contractor other than information given to the contractor by General Manager (ME).

(E-14) Sales Tax:-Sales Tax of any description whatsoever, where leviable and intended to be

claimed from the purchaser, whether as part of the price or may of tax in pursuance of any statutory provision enabling the dealer to collect the Sales Tax leviable on him from the purchaser should be distinctly shown alongwith the prices quoted. Where this is not done all claims for payment of reimbursement of Sales Tax of any description whatsoever whether as part of the price or as a tax shall be deemed to be waived for all occasions and no such claims shall be entertained on any ground whatsoever.

F) Award of Contract Criteria:-

F-1) The tenderer who are meeting qualification criteria prescribed in the tender document and whose technical offers are found to be in accordance with the specifications mentioned in the tender document would be short-listed and only their Commercial Tender would be opened.

(I) MSRTC will award the contract to the successful Tenderer whose tender

has been determined to be substantially responsive and to be the most advantageous beneficial tender from the point of view of MSRTC.

(II) It will be the discretion of MSRTC to decide whether to select one or more sources to fulfill the requirement, subject to the condition that such selected source other than L-1 should agree in writing to match their rates to the rates of L-1.

G) Security Deposit:-

a) Every Tenderer whose tender is accepted either in whole or in part, must deposit by way of

Security Deposit against performance guarantee for the due and proper fulfillment of the supplies, fulfillment of tender terms and conditions, an amount of Rs. 30,00,000(Rupees: Thirty Lakhs only) upto contract price of Rs. 3.00 Crores and thereafter 2% of the balance contract price rounding off to next Rs. 1000.00 maximum upto 1.50 Crores. Estimated value is purely tentative value of purchases, however, General Manager (ME) does not bind himself to make actual purchase equivalent to the estimated value.

b) The contractor guarantees the successful and satisfactory performance of the product supplied

under this contract. The contractor further guarantee the product as presented and specified and guarantees against any and all defects in design and workmanship and shall upon written notice by the MSRTC fully and forthwith remedy, free of cost to the MSRTC, such defects as developed under the normal use of the said bus.

c) The interest free Security Deposit be paid by Demand Draft/ e-Payment in the name of MSRTC

FUND ACCOUNT within 15 working days from the date of offer letter before purchase order / rate contract is issued, failing which MSRTC may cancel the offer. Non submission of Security Deposit, the firm will be black-listed and will not be allowed to participate in MSRTC Tender Enquiry for next three years. EMD will be forfeited.

Security deposit will also be accepted in the form of irrevocable and non revolving performance Bank Guarantee issued by any Nationalized Bank. Bank Guarantee format enclosed at Annexure "G".

The security deposit will be forfeited, if the tenderer fails to supply the buses as per MSRTC specification and as ordered by this office within the date stipulated in the purchase order or commits any breach or breaches of any of the terms and conditions of the contracts.

(d) Any dues to the Corporation on account of recoveries, penalties, etc. including earlier dues, if

any, will be recovered from the Bank Guarantee of successful tenderers, if not settled by the supplier.

(e) The Tenderer has to enter 5 years Comprehensive Annual Maintenance Contract for

maintenance of Buses procured under this tender with MSRTC. Any dues to the Corporation on account of recoveries, penalties etc. under CAMC if any will be recovered from the Bank Guarantee of successful tenderers, if not settled by the contractor. Any dues to the Corporation on account of recoveries, penalties etc. under warranty claim if any will also be recovered from CAMC bill/balance payment, if not settled by the contractor.

(f) The validity of Security Deposit will be for sixty (60) months from the date of acceptance of the

offer or submission of Bank Guarantee whichever is later. (H) Entering into a contract:-

Notification of Award:- Prior to expiry of the validity period of tender, the MSRTC will notify the successful tenderer in writing, that its tender has been accepted and the successful tenderer shall enter into a written contract / legal agreement to abide with terms and conditions of tender with the MSRTC within 15 days (FORMAT FOR CONTRACT AGREEMENT IS ENCLOSED AT ANNEXURE “F”).

MSRTC will request the tenderer to confirm his acceptance in writing. Also Tenderer will be requested to submit Security Deposit.

The cost required to be incurred for such agreement will have to be borne by the successful tenderer. The successful tenderer shall be liable to pay the Stamp Duty as provided under the Bombay Stamp Act 1958. The notification of award will constitute the formation of the contract The contract shall be constructed according to and subject to the Laws of India and jurisdiction of Courts of Mumbai. The successful tenderer shall be required to execute the contract agreement on receipt of intimation to execute the contract, failing which, appropriate penal action will be taken.

(I) General Conditions of contract:-

(I-1) Scope of the contract shall cover supply of fully built integral coaches to the MSRTC at its

destination as specified in accordance with the terms and conditions and specifications laid down in the "Contract Agreement" as defined in clauses herein.

(I-2) In the contract, the following words and expressions shall have the meanings hereby assigned

to them except where in the context otherwise requires.

The contract shall mean the tender and acceptance thereof and the formal agreement, if any, executed between the General Manager (ME), MSRTC and the contractor together with the documents, legal documents referred to therein including their conditions and appendices and any special conditions, the specifications designs, drawings, price schedule, bill of quantities and schedules or rates. All these documents taken together shall be deemed to form one contract and shall be complementary to one another.

The contract conditions shall mean the sub named in the tender subject to additions thereto or deductions there from as may be made under the provisions of the contract.

The specifications shall mean the specifications annexed to of issued with the General Conditions and shall include the schedules, technical data and drawings attached thereto.

(I-3) The contractor shall indemnify MSRTC against all claims, actions, suits, proceedings,

demands, costs charges and expenses arising from or incurred by reason of any infringement or alleged infringement of any patent, design or copyright protected either in the country of origin or in India by the sue of any equipment supplied by the tenderer.

(I-4) In the event of any claim being made or action brought against MSRTC arising out of the

matter referred to in this clause, the contractor shall be promptly notified thereof and may at his own expense conduct all negotiations for the settlement of the same and litigation at that may arise there from. The MSRTC shall not unless and until the contractor shall have failed to take over the conduct of the negotiations of litigation, make any admission, which might be prejudicial thereto. The conduct by the contractor of such negotiations or litigation shall be conditional upon the contractor having first given to the MSRTC such reasonable security as shall from time to time be required by the case may be of any compensation, damages, expenses and cost for which the MSRTC may become liable in respect of such infringement as aforesaid. The MSRTC shall at the request of the contractor afford all available assistance for the purpose of contesting any such claim or action and shall be repaid any expense incurred in so doing.

(I-5) In the event of any additional facility or benefit extended during the contractual period by L-1 fully built integral coaches supplier on contract at no extra cost to MSRTC, the same will be automatically binding on another fully built integral coach manufacturer, if on contract.

(I-6) PERIOD OF CONTRACT:-

a) Period of contract shall be of twelve months (one year) from date of issue to award of

contract.

b) MSRTC will place the purchase order upto the last date of rate contract period contracted for the supplies not later than three months from the last date of contract period.

c) In case MSRTC desires to place purchase order for additional quantity over and above tendered quantity, the contractor may supply required quantity at the same rates. During the delivery of this additional quantity if tender is floated and rates quoted by concerned contractor found to be less and better terms, the same will be applicable for the fully built integral coaches to be supplied from the date of dropping the tender and not for the whole additional quantity. If any rise in the rates is found in new tender, the rates for this additional quantity will remain firm as per the earlier contract at which purchase order is issued.

d) MSRTC can avail this facility for supply of maximum quantity limiting to 10 % within three months after the expiry of the contractual period.

(J) DELIVERY, INSPECTION AND PAYMENT:- (J-1) DELIVERY:-

(i) The contractor shall offer one proto type fully built bus of each type within 45 days from the date of PO issued and approval obtained from MSRTC.

(ii) Bulk supply shall not be accepted unless the proto type fully built bus is approved by the MSRTC after trial.

(iii) First one bus (prototype) will be operated by MSRTC for three months. The contractor will do necessary maintenance for three months. Operating performance, fuel consumption, defect observed will be evaluated by MSRTC. After confirming satisfactory performance of this bus further delivery schedule for supply of remaining buses will be decided.

(iv) If the performance of the proto type bus will not found satisfactory the further extension of trial period or re-allocation of business will be decided. If the performance is not satisfactory proto bus will be returned / transferred to the contractor and the cost of the bus if any, will be recovered from security deposit.

(v) The delivery schedule will be decided by mutual consent. It will be the responsibility of tenderer to supply the vehicles as per delivery schedule agreed mutually.

(vi) All the fully built integral coaches shall be delivered at the destination as specified by the Corporation within the contract period as per delivery schedule given by MSRTC and also as per the amendments issued if any, in the delivery schedule from time to time by MSRTC. However, Maharashtra State Road Transport Corporation reserves the right to make changes in the given delivery schedule, so also reserves the rights to cancel, increase or decrease the quantity / model of fully built integral coaches ordered. Penal charges@18%p.a.would be charged towards delayed delivery and the

same will be recovered from the respective bill/pending bills/security deposit of the successful tenderer.

(vii) At least 15 days pre-intimation of delivery of buses to be given by the successful tenderer.

(viii) The successful tenderer shall supply all necessary documents which are mandatory as per CMVR/Government rules and notification along with each bus.

(ix) The firm shall transfer and handover the fully built integral coaches to the authorized representative of MSRTC, after carrying out PDI at their end. Every fully built bus shall have at least 100 liter fuel in tank when it arrives at our destination.

(x) Upon receipt of the buses, at designated destination and after joint inspection with the contractor's representative, the concerned unit head will issue an Acceptance Certificate in which he shall certify the date on which the fully built integral coaches have been received and so accepted. Taking over of fully built integral coaches found defective due to faulty design or workmanship or damaged due to defective packing or otherwise not in conformity with the requirements of the contract shall be with-held until such time the defects have been corrected. The necessary penalty will be levied on the delay.

(xi) The issuance of the Acceptance Certificate shall in no way relieve the tenderer of his responsibility for the satisfactory operation of the buses, in terms of the specifications.

(J-2) INSPECTION:-

(i) Prototype bus of each type should get inspected from any Government approved agency preferably ARAI or CIRT in confirmation with the type approval, AIS 052 requirement and MSRTC specifications. The expenses for this third party inspection will be borne by the successful tenderer. The successful tenderer will send the inspection report of the above agency to General Manager (M.E.). On receipt of inspection report, MSRTC team will also inspect the prototype bus before delivery.

(ii) On the receipt of fully built integral coaches at place of delivery, those shall be jointly inspected by the representative of the tenderer and the representative of MSRTC for completeness and satisfactory conditions of all equipments, components. Damages defects and deficiencies if any, shall be noted and tenderer shall initiate immediate action for making good the same under advice to the MSRTC. Any delay in testing and commissioning of these buses due to this will be on the contractor's account and will be dealt with as per the condition of the contract and necessary penalty will impose. Although the fully built integral coaches are charged Ex. Works / RSO, the fully built integral coaches shall be attended for PDI and brought to the specified destination from Ex. Works / RSO, as per given schedule at the destination. The fully built integral coaches indicated in the invoice but not accepted during the inspection, should be deleted from the invoice. A fresh invoice should be submitted for payment as and when said fully built bus is inspected and accepted.

iii) REPLACEMENT OF REJECTED BUSES:-

(a) If any fully built integral coaches is rejected by the consignee due to its not conforming to the prescribed specifications for any other valid reason, the firm will be informed accordingly in writing and the firm will immediately on the receipt of communications to replace the rejected buses. If the fully built integral coaches are not replaced within this time, MSRT Corporation will return the fully built integral coaches without any further intimation without paying transportation charges, MSRT Corporation shall be free to purchase the fully built integral coaches from elsewhere unless already purchased under clause the terms of risk purchase contained in clause

shall apply to all such purchases. If the firm fails to lift the rejected fully built integral coaches within 45 days of the intimation of its rejection, MSRT Corporation shall have the rights to sale the rejected bus by public auction with notice thereof given to the firm and sale proceeds after adjusting all dues, expenses and costs involved in the auction shall be credited to the supplier and adjusted against advance, if any.

(b) If the consignee unit observed that the fully built integral coaches supplied are not

conforming to the prescribed specification or approved samples for proto type or for any other valid reasons and in case consignee units at their own and without having any rights of the supplier decided to accept such consignment, the consignee units may accept the same with levying penalty as may deem fit. However, such fully built integral coaches will not be taken on charge unless and until the supplier accept in writing the penalty decided by the consignee unit is acceptable to them. In case supplier do not agree with the penalty decided to be levied by the consignee, then the supplier will be bound to replace the fully built integral coaches and consignee units / MSRT Corporation will have full rights to take all other actions as narrated in the above para of this clause.

(c) In the event of the buses supplied by the tenderer are found defective in design, material or workmanship or otherwise not in conformity, with the requirements of the contractual specification, the General Manager (ME) shall either reject the fully built integral coaches or request the contractor in writing to rectify the same. The tenderer on receipt of such notification shall either rectify or replace the defective fully built integral coaches without cost to the MSRTC. If the tenderer fails to do so, the General Manager (ME) may…

At his opinion replace or rectify such defective fully built integral coaches and recover the extra cost so involved from the tenderer plus fifteen percent to cover overhead or terminate the contract for default as per tender condition.

Acquire the defective fully built integral coaches at a reduced price considered equitable under the circumstances. The provisions of this article shall not prejudice the MSRTC rights under clause given above.

(J-3) Payment:-

(i) Corporation will make the payment by RTGS/NEFT.

(ii) The successful tenderer will have to complete the required formalities as indicated in the tender document such as contract agreement, bank guarantee towards Security Deposit, etc. unless which payment will not be effected for the first lot of buses .

(iii) Payment Term:- The payment term applicable for the contract shall be 100% payment

on 30th day on receipt and acceptance of bus against the invoice / challan at respective destination or receipt of the delivery challan or receipt of invoice / bills whichever is later. The invoices of buses shall be submitted to this office directly immediately after the acceptance of buses at the respective destination specified. If the bus/buses indicated in the invoice is / are not acceptable during inspection and returned back for rectification the same should be deleted from the invoice / challan. If the same bus / buses is/are to be supplied after rectification it should be supplied under fresh invoice and challan for inspection.

(iv) The above payment term will not applicable for prototype Bus. 100% Payment of

prototype bus will be made on 100th day after satisfactory trial report, (This report must be satisfactory) from the operating unit.

(v) If the trial of the prototype bus is not found satisfactory, MSRTC will not make any payment. In this case tenderer has to take this bus back by doing necessary transferring formalities on his own cost.

(K) Maintenance Of Buses-

For the maintenance of the buses proposed to procure under this tender the following conditions are mandatory for the tenderer.

(K-1) Training- The contractor shall impart training to the MSRTC's staff i.e. drivers / mechanics at

depot / divisional level for the correct maintenance practices, overhaul of aggregates for smooth operation of the buses.

(K-2) Tenderer should also give training to the drivers to drive the vehicle smoothly and efficiently. (K-3) Special Machineries and Tools required – Tenderer should give list and specification of special

tools and machineries required for maintenance of buses. (K-4) Specification of aggregates- Tenderer should give specifications of

aggregates/Lubricants/Greases etc. required for maintenance of these buses. (K-5) The successful tenderer shall furnish the operators hand book, seating layout and other

drawings maintenance details, operation manuals, maintenance schedule for preventive maintenance of the coach, technical data book, coloured wall charts of the major units showing assembly details of engine, gear box, clutch and lubrication system and brake system, coloured wall charts showing assembly details of fully built integral coaches, maintenance instructions together with the detailed drawing of spares and units and other sketches of bodies, seat lay out etc. with sufficient details to enable the MSRTC staff to operate the buses in a smooth and trouble free manner and to maintain, dismantle, reassemble and adjust all the parts or units.

All the above document to be send to the concerned operating unit and one copy to M.E. Department, MSRTC C.O. Mumbai on FOC basis well in advance..

(K-6) Comprehensive Annual Maintenance Contract-

MSRTC will enter into the comprehensive maintenance contract with Tenderer. The tenderer has to submit Annexure "Z" in technical tender. The tenderer is requested to quote his best offer for comprehensive Annual Maintenance Contract for the coaches proposed to purchase under this tender. The tentative terms and condition for ―Comprehensive Annual Maintenance Contract for the Air-conditioned integral coaches proposed to purchase under this tender‖ are given below for guidelines only.

a) Duration of Comprehensive Annual Maintenance Contract will be 60 months from the

date of commissioning of bus in MSRTC or as per the requirement of MSRTC.

b) Base for CAMC charges calculation is ''Rupees per Kilometers run by Bus".

c) Location where maintenance / repair activity will be carried out by CAMC contractor /provider is at MSRTC depots from where these coaches are operated , probable locations are Mumbai, Pune, Aurangabad, Nashik, Kolhapur.

d) Minimum Annual (assured) Kms for CAMC 2,10,000

e) Driver - Trained/Approved by Vehicle Manufacturer/tenderer.

f) MSRTC will provide diesel.

g) Permissible Off Road days for repair activity- First year 10 and thereafter every year 5 more off road days will be permissible.

h) After 3 years of operation CAMC provider should carry out External and Internal painting.

i) Excluded Services—Supply of fuel, Accessories like speakers, VCD/CD Players etc., Roof lining, blind screen, mud flaps (Seats except upholstery but seats adjustment mechanism) repair cost of all sorts of paint damages not limited to fading, peeling, chipping, corrosion, erosion, rusting etc., Replacement of Tyres, tubes, flaps, Tools supplied with the vehicles Glasses, Battery, Chrome parts, Door trims, floor mats. All vehicle delivery to/collection from the service locations, The cost of repairs resulting from all causes beyond the control of CAMC provider such as collision, damages, traffic accidents and other force major conditions.

j) MSRTC will provide necessary place in depot premises to the tenderer for Storage.

k) The unserviceable spare parts/assemblies which come under CAMC and MSRTC has not paid any charges for the same is the property of CAMC contractor /provider.

l) MSRTC Depots are equipped with various tools /machineries including washing, welding, greasing facilities. This facilities can be used by CAMC provider for repairs of buses. However, Special Tools required for maintenance/repairs of buses if required should be provided by the tenderer.

m) Tenderer is requested to offer CAMC Charges considering Warrantee period of buses.

(L) Warranty:-

(i) The ready built buses and related body / chassis components / spares shall be designed to give minimum life of as well as covered under unconditional warranty of three years or three lakh kms. from the date of registration whichever is later. Any premature failure of aggregate of bus bodies within the warranty period shall be attended free of cost. Wherever defects are considered as type defects i.e. those applicable to all units supplied irrespective of whether defects have manifested in all the units, the contractor shall carry out the rectification / replacement in all the units.

(ii) The supplier should give the guarantee for supply and availability of required spares for repairs

for next 8 years from the date of purchase and according to this adequate stock of spare parts to promptly meet all requirements is to be kept by tenderer. MSRTC will have full liberty to procure the spare parts and consumable required for maintenance and repairs of any brand from any vendors available in the market.

(iii) The contractor shall give warranty that, the fully built integral coaches supplied under this

contract is new, unused of the most recent or current models and they incorporate all recent amendments in CMVR/ MMVR/AIS.

(iv) No claim for interest will be entertained by the General Manager (ME) in respect of any moneys' or balance, which may be in this hands owing to any dispute or difference or misunderstanding between the General Manager (ME) on the one hand and the contractor on the other.

(M) Service facilities shall inter-alia ensure the following:-

a. Default liability:- The General Manager (ME) may upon 30 days written notice of default to the tenderer terminate the contract in circumstance detailed here under..

If in the judgment of the General Manager (ME), the contractor fails to make delivery of buses within the time specified in the contract agreement or within the period for which extension has been granted by the General Manager (ME) to the contractor, OR

If in the judgment of the General Manager (ME), the tenderer fails to comply with any of the other provisions of this contract.

b. If the tenderer shall become bankrupt or have a receiving order made against him or compound

with his creditors or being a Corporation commenced to be would up not being a voluntary winding up for the purpose only of amalgamation or reconstruction or carry on its business under a receive for the benefit of its creditors or any of them, the General Manager (ME) shall be at liberty..

To terminate the contract forthwith by notice in writing to the contractor or to the liquidator or receiver or to any person in whom the contract may become vested and to act in the manner provided in defaulter liability as though the last mentioned notice has been the notice referred in such article and the bus body have been taken out of the contractor's hand OR

To give such liquidator, receiver or other person the option of carrying out the contract subject to his providing a guarantee for the due and faithful performance of the contract upto an amount to be determined by General Manager (ME)

c. The tenderer warrants that he has not employed any person to solicit or secure the contract upon

any agreement for a commission, percentage, brokerage or contingent free, Breach of this warranty, shall give MSRTC the right to cancel the contract or to take any other measure as to the MSRTC may deem fit. The warranty does not apply to commission payable by the contractor to establish commercial or selling agent for the purpose of securing business.

d. Whenever any claim for the payment of a sum to or the recovery of an advance by the MSRTC

arises out of or under this contract against the contract, the same may be deducted by the MSRTC from any sum then due or which at any time thereafter may become due to the contractor under this contract and failing that any contract with the MSRTC or from any other sum due to the contractor from the MSRTC.

(N) Falls Clause:-

If tenderer or any of their dealers in India extends benefit to any ST Undertakings in the form of lower price or credit facilities in kind for similar / same / equal fully built integral coaches with same specifications and term and conditions to be supplied either, Ex. Works or Ex. RSO, the same will automatically be applicable in respect of fully built integral coaches supplies made to the Corporation and that both tenderer / dealer will be jointly and severally liable to compensate the MSRTC in cash to the extent of value of such benefits from the date of offering such concessions to any ST Undertakings. If any benefits in terms of payment or other facilities offered to any other STUs, then it will be your responsibility to inform this office as per falls clause. If it is informed late, necessary interest and penalty will be charged as deemed fit. This clause will be applicable only to the offers to any other STUs after the opening of this tender.

(O) Force Majeure Clause:-

If the supplies to MSRTC are subject to FORCE MAJEURE condition then, the only clause acceptable to the Corporation will be as below and no variation there from shall be made in any case. While every efforts will be made to carry out the obligation of the contract, the contract shall not be liable for non performance either in whole or in part of any contract offer any delay in performance thereof in consequence of an Act of GOD, War, Strike, Lock out non availability of imported raw material or any other cause beyond control of the contractor / tenderer.

(P) Risk Purchases:-

On entering into Rate Contract or after placement of order, tenderer fail to supply in accordance with the terms and conditions of the contract or fail to replace buses rejected by General Manager (ME) or units on his behalf with such time as may be stipulated, the General Manager (ME) shall be entitled to purchase such buses from any other sources at your risk and cost and at the price as the General Manager (ME) shall be in his sole discretion think fit and if such price shall exceed the rate set out in the schedule, you shall be responsible to pay the difference between the price and at which such fully built integral coaches have been purchased by the General Manager (ME) at the price calculated at the rate set out in the schedule.

(Q) Shortfall Clause:-

If lower rates and / or better terms than those agreed with MSRT Corporation are offered by the firm to other STUs/ purchaser during the currency of the contract for the offered model with similar specifications, terms and conditions, such lower rates and / or better terms and conditions shall become Ipso-facto applicable to all the contracts with the M.S.R.T.Corporation and the price and terms and conditions of the supply shall automatically change with effect from the date of offer of lower rates and better terms by the supplier.

(R) Income Tax Certificate:-

Even though, as per notification no. 2 of 2004 dt. 10.2.2004 under CBTD Circular from Govt. of India, it is not necessary to provide IT Certificate, the tender has to mention PAN No. and also attached the Xerox copy of the PAN No. and also copy of last year's Income Tax return.

(S) Banker:- The tenderer shall furnish the name of his banker for a reference. (T) Jurisdiction:-

Any dispute regarding security deposit, payment and or any litigation arising out of or in connection with the terms of this contract and or supply or supplies made there under, including any suit to enforce the right or either party under / or in respect of this contract, shall be instituted and exclusively tribal by the Courts of Competent Authority Jurisdiction within Greater Mumbai. Not withstanding that part of the clause of action may have arisen outside jurisdiction of such courts and the suppliers expressly agree to the jurisdiction of such courts.

(U) Decision of disputes:-

In the event of any disputes arising under this contract shall be referred to Vice Chairman & Managing Director, MSRT Corporation, Mumbai whose decisions shall be final and binding on both the parties.

(V) Dues to the Corporation:-

The General Manager (ME), MSRTC reserves the right to himself to recover the amounts, if any, due to the MSRTC against the earlier and against the contract that may be entered into against the tender form any amount that may be due from the MSRTC.

(W) REDUCED RATES OFFERED IN THE TENDER BY EXISTING CONTRACT HOLDER:-

If the firm on present contract offers reduced rates, better terms and conditions in this tender compared with the contracted rate, terms and condition, then the same will be made applicable for the existing contract from the date of submission of offer without your consent.

(X) Condition of Tender:-

(i) Approaching any of the authority of the Corporation, through himself OR by his authorized agent to influence to obtain favourable decision in respect of tender shall be disqualification and for this breach EMD will be forfeited.

(ii) The tenderer shall not appoint Liaisioning agent in respect of tenderer. Only the authorized

responsible alongwith the authority letter with Identity Card shall participate in the tender process and for breach of this condition Earnest Money shall be forfeited and the firm shall be black-listed.

(iii) During the contractual period if it is found any Liasioning agent or mediator intervening in the

operation of contract or indulge in any unauthorized act, the Security Deposit will also be liable for forfeiture.

(iv) CORRUPT OR FRAUDULENT PRACTICES:- The tenderer and their respective officers, employees, agents and advisers shall observe the

selected standard of ethics during the tender process and subsequent to the issue of the tender and during the subsistence of the agreement. Not-with-standing anything to the contrary contained herein, or in the tender authority may reject a bid, withdraw the tender terminate agreement as the case may be without being liable in any manner whatsoever to the tenderer or contractor as the case may be, if it determines that the tenderer or contractor as the case may be has directly or indirectly or through an agent engaged in corrupt practice, fraudulent practice coercive practice, undesirable practice or restrictive practice in the tender process. In such an event, the authority shall be entitled to forfeit and appropriate the EMD or bid security as the case may be as damages without prejudice to any other right for remedy that may be available to the authority under this tender document and / or the agreement or otherwise.

Without prejudice to the rights of the authority under clause hereinabove and the rights and

remedies which the authority may have under the tender or the agreement or otherwise if a tenderer or contractor or as the case may be is found by the authority to have directly or indirectly or through and agent engaged indulged in any corrupt practice, fraudulent practice coercive practice undesirable practice or restrictive practice during the tender process or after the issue of the tender or the execution of the agreement such tenderer or contractor shall not be eligible to participate in any tender during a period of 2 (two) years from the date such tender or contractor as the case may be, is found by the authority to have directly or indirectly or through an agent, engaged or indulged in any corrupt practice, fraudulent practice coercive practice undesirable practice or restrictive practice as the case may be.

For the purpose of this clause the following terms shall have the meaning hereinafter

respectively assigned to them.

(i) Corrupt practice means (a) the offering, giving, receiving or soliciting directly or indirectly, of anything of value to influence the actions of any person connected with the tender process (for avoidance of doubt, offering of employment to or employing or engaging in any manner whatsoever directly or indirectly, any official of the authority who is or has been associated in any manner, directly or indirectly with the tender process or has dealt with matters concerning the agreement or arising there from, before or after the execution thereof, at any time prior to the expiry of one year from the date such official resigns or retires from or otherwise ceases to be in the service of the authority, shall be deemed to constitute influencing the actions of a person connected with the tender process) or

(ii) Engaging in any manner whatsoever, whether during the tender process after the

execution of the agreement, as the case may be, any person in respect of any matter relating to the project or the tender of agreement, who at any time has been or to the legal, financial or technical adviser of the authority in relation to any matter concerning the project.

(iii) Fraudulent practice means a mis-representation for omission of facts or suppression of

fact or disclosure of incomplete facts, in order to influence the tender process.

(iv) Coercive practice means impairing or harming or threatening to impair or harm, directly or indirectly, any person or properly to influence any persons participation or action in the tender process.

(v) Undesirable practice means (1) establishing contracts with any person connected with

for employed or engaged by the authority with the objective of canvassing, lobbing or in any manner influencing or attempting to influence the tender process, or (2) having a conflict of interest, and

(vi) Restrictive practice means forming a cartel or arriving at any understanding or

arrangement among tenderers with the objective of restricting or manipulating full and fair competition in the tender process.

(Y) The tender shall submit an affidavit as per Annexure – H :-

(a) Convicted of cognizable offence by any court of law with imprisonment for a term exceeding one

year, or (b) Imposed a penalty of Rs. One Crore or more for violation of the provision of the Foreign

Exchange Regulation Act 1973. (46 of 1973) (since repealed) for Foreign Exchange Regulation Act 1999. (42 of 1999) or

(c) Detained under the National Security Act, 1980 (65 of 1980) or the Narcotics Drugs and

Psychropic Substance Act, 1985 (61 of 1985), or

(d) Adjudged guilty by the Stock Exchange Board of India or any other such Financial Regulatory Boards or Tribunals or Agencies or

(e) Found to be associated in any manner with an organized crime syndicate or its associate or with

any Association declared unlawful under the Unlawful Activities (prevention) Act, 1967 (37 of 1967) or any other law for the time being in force or

(f) Found to be connected with activities prejudicial to the National Security is not considered for

selection as vendor for supply of new tyre sets. Failure or breach of the clause shall render the tenderer/s liable for black listing them from the business

with MSRTC.

DRAFT AGREEMENT ON STAMP PAPER AS PER GOVERNMENT RULES AND REGULATIONS AT THE TIME OF AGREEMENT

PROCUREMENT OF "AIRCONDITIONED HIGH-TECH ,INTEGRAL COACHES"

This agreement is entered into between MSRTC having its office at Maharashtra Vahatuk Bhavan, Dr. Anandrao Nair Marg, Mumbai 400 008 hereafter called the Corporation and M/s. ________________________________ having its address at _____________________________________________________________ hereafter called as vehicle manufacturer on this dated ____________ whereas the Corporation had floated open tender for procurement of Air-conditioned, Hi-Tech, integral Coaches. Whereas it was informed in the said tender that tender whereas supplier M/s. ____________________, whose tender is accepted by the Corporation and as per the tender document, it is agreed between parties that in additional to the PO, the contractor will enter into an agreement with MSRTC. In compliance of the same, it is agreed by and between both the parties as under:- (i) The Tenderer hereby agrees to abide by all the terms and conditions of PO placed for the supply of Air-

conditioned luxury buses. (ii) It is agreed by and between the party in addition to the terms and conditions mentioned in the PO are

binding on the both the parties. (iii) The tenderer hereby agrees to do comprehensive Annual Maintenance Contract for the buses supplied

under this contract as per the terms and condition of the tender and offer given by the tenderer. (iv) It is agreed that by any dispute or litigation arising out of or in connection with the terms of this contract and

/ or supply or supplies made there under, including any suit to enforce the rights of either party under or in respect of this contract shall be instituted and exclusively triable by the Courts of Competent ordinary jurisdiction within Greater Mumbai. Notwithstanding that part of the cause of action may have arisen outside the jurisdiction of such courts and the supplier express agrees to submit to the jurisdiction of such courts.

General Manager (ME) Maharashtra State Road Transport Corporation Mumbai Central , Mumbai 400 008 Bank Guarantee No. Dear Sir, Whereas the General Manager (ME), Maharashtra State Road Transport Corporation (herein after called "MSRTC") has recently placed Letter of indent / purchase order no. ST/ME/VEH/_______________________ dated__________ with M/s. ________________ (herein after called "The Contractor") inhabitants carrying on business at ___________________________________________________________ for supply of fully built Air conditioned Hi-Tech Integral for the period stated therein and whereas it is one of the condition of the contractor that the contractor should furnish a Security Deposit to the General Manager (ME), MSRTC. Notwithstanding anything contained herein:- a. Our liability under this Bank Guarantee shall not exceed (Rs. ____________) (Rupees:___________________________________).

b. The Bank Guarantee shall be valid upto __________ and the same may be further extended if so requested by applicant / contractor.

Acceptance for Comprehensive annual maintenance Contract

It is compulsory for the firm who want to participate in MSRTC tender enquiry, to accept to enter in Comprehensive annual maintenance contract with MSRTC for five years .

"This is to certify that, I/we agree to enter in Comprehensive annual maintenance contract with

MSRTC for the coaches offered in tender for period of five years." Accordingly CAMC rates per KM are offered in commercial tender.
